Abstract

The detention of children facing in the Law is an important issue in the Juvenile Criminal Justice System because it concerns restrictions on the freedom of subjects who are obliged to receive special protection. Even though the Law regarding the Juvenile Criminal Justice System states that children should only be detained as a last option and must be held in a Temporary Child Placement Institution or a Social Welfare Implementation Institution, the actual practice does not always follow these rules. The issue at hand is how to detain minors who are in legal trouble according to the guidelines set forth in Law Number 11 of 2012 about the Juvenile Criminal Justice System. The method of investigation adopted is a normative legal approach employing deductive reasoning. The findings from the discussion and conclusions indicate that the placement of minors in the State Detention House in this instance does not align with the standards for child detention, as it contradicts the principle of prioritizing the best interests of the child and the requirement to separate them from adult detainees. Thus, the practice exhibits procedural and substantial breaches that call for enhancements in its execution

Abstract

Child Adoption is a legal act intended to ensure the best interests of the child. In practice, adoptions carried out without compliance with applicable legal procedures are still found. The legal problem issue examined in this research concerns the implications of regulations governing adoption conducted without fulfilling legal procedures. This study employs normative legal research using a statutory approach, emphasizing principles of family law, particularly in the field of adoption. It is descriptive and analytical, utilizing secondary data analyzed qualitatively and through deductive reasoning. The findings result and conclusion show that adoption conducted without the prescribed legal procedures, particularly in the absence of a court determination, constitutes an unlawful act. Consequently, the legal status of the adopted child is not recognized, and no civil legal relationship arises between the adopted child and the adoptive parents. This condition results in the non-fulfillment of the child’s rights, including legal protection, certainty of identity, and welfare guarantees. Therefore, adoption must be carried out in accordance with applicable legal provisions to ensure legal certainty and protection for the child

Abstract

One of the requirements for marriage in Indonesia, based on Article 7 paragraph (1) of Law No.1/1974 in conjunction with Law No.16/2019, stipulates a minimum age limit of 19 years for men and women. If this requirement is not met, the state provides the opportunity to apply for a marriage dispensation to the court on urgent reasons. The problem in this study whether premarital pregnancy can be used as an urgent reasons in applying for a marriage dispensation according to Law No.16/2019 jo. PERMA No.5/2019. This research is a descriptive normative legal study using secondary data analyzed qualitatively and drawing conclusions deductively. The result and conclusion, based on the analysis on Judicial Number 42/Pdt.P/2021/PA.Tas, the judge rejected the request for dispensation due to incomplete administrative requirements without considering the pregnancy condition in depth. In fact, premarital pregnancy should be considered an urgent reason in accordance with Article 53 of the KHI regarding premarital pregnancy and the principle of child welfare as regulated in Law No.4/1979.

Abstract

Constitutional Court Decision No. 128/PUU-XXIII/2025 reinforces the prohibition on dual positions for Deputy Ministers as a measure to safeguard integrity, prevent conflicts of interest, and ensure that their performance remains focused on core ministerial duties. This paper examines the Court’s legal reasoning and the effectiveness of the decision’s implementation within the Merah Putih Cabinet. The findings show that although the ruling provides clear normative boundaries, its implementation has not been fully effective. Several Deputy Ministers continue to hold concurrent positions as commissioners or officials in state-funded institutions, creating accountability issues and reflecting the strong influence of political accommodation in public office appointments. It is concluded that while the decision plays a significant role in structuring the position of Deputy Ministers. The legal issue addressed in this study is How does the implementation of Constitutional Court Decision Number 128/PUU-XXIII/2025 affect the practice of holding concurrent positions by Vice Ministers within the structure of the Merah Putih Cabinet for the 2024-2029 period

Abstract

The synchronization between Article 31 of Police Regulation Number 4 of 2020 on Community-Based Security and Article 151A of Law Number 6 of 2023 on Job Creation is important to ensure legal certainty for security guards as strategic security personnel. Differences in regulatory scope often lead to irregularities in guidance, assignment, and employment relations. This study formulates the problem of how the alignment of these two provisions operates in normative implementation and in the practice of security guard employment relations. The research aims to analyze the coherence of the two regulations using a normative juridical approach by examining applicable laws and regulations. The results indicate the existence of implementation inconsistencies, particularly concerning retirement age limits, training standards, and the absence of integration of Police Regulation provisions into employment contracts, company regulations, or collective labor agreements. These obstacles are further exacerbated by weak inter-agency coordination and limited normative understanding at the operational level. The study recommends harmonizing employment-related legal documents, strengthening supervision and guidance by the Police and labor authorities, and enhancing the professionalism of security guards.

Abstract

Dumping practices in international trade have the potential to cause unfair competition and harm domestic industries, thus requiring effective regulatory and law enforcement mechanisms. This study aims to analyze the similarities and differences in the regulation of anti-dumping mechanisms between Indonesia and China as fellow members of the World Trade Organization (WTO). The research question raised is what are the similarities and differences in the regulation of anti-dumping mechanisms between Indonesia and China. The research method used is normative legal research with a comparative law approach, which is descriptive and analytical in nature, using secondary data in the form of legislation and scientific literature. The results show that Indonesia and China both refer to the WTO Anti-Dumping Agreement, but differ in their domestic implementation. Indonesia implements a more legalistic, transparent, and proportional mechanism through the separation of institutional functions and the application of the lesser duty rule principle. In contrast, China uses a centralized system with broad authority vested in a single institution and tends to be protectionist. In conclusion, the differences in these mechanisms reflect the character of each country's legal system and national economic policy orientation, even though they are within the same international legal framework

Abstract

As the Provincial capital, Bengkulu city possesses significant tourism potential across natural, cultural and historical sectors. This strategic asset, if managed effectively, could drive economic growth and serve as primary source of local genuine revenue (PAD). Despite iconic landmarks such as “pantai panjang” and “fort Marlborough”, the tourism sector’s contribution to Bengkulu city’s PAD remains disproportionately low relative to its potential. Financial data for 2024 shows PAD realization at only IDR 184.17 billion, falling significantly short of the IDR 320 billion target set in the regional budget (APBD). Consequently, regional financial management in the tourism sector must prioritize the principles of legality, effectiveness, efficiency and compliance with prevailing regulations. This research addresses the legal issue of local government efforts to increase PAD through strategic tourism areas in Bengkulu city. This research using a normative juridical method, this descriptive study utilizes secondary data supported by primary data, analyzed qualitatively through deductive reasoning. The research concludes that the government’s financial management remains suboptimal in achieving the predetermined targets estabilished in the Bengkulu city APBD

Abstract

The Indonesian criminal justice system aims to ensure justice and protection for convicts, one of which is through the legal remedy of Judicial Review (PK) as stipulated in the Criminal Procedure Code (KUHAP). The Criminal Procedure Code limits the grounds for Judicial Review to 3 (three) categories: the existence of new circumstances (novum), conflicting decisions, and judicial error/manifest error. However, it turns out that there is one Supreme Court Decision Number 270 PK/Pid.Sus/2020 based on the reason of disparity. The question is whether the legal difference in Supreme Court Decision Number 270 PK/Pid.Sus/2020 constitutes a judicial error/manifest error according to Article 263 of the Criminal Code. The researcher integrated normative legal research with qualitative descriptive analysis. The discussion and findings indicate that differences in sentencing are not grounds for Judicial Review, but can be a judicial error/manifest error if there is a legal error in the evaluation. This analysis concludes that inequity in sentencing can be used for Judicial Review if it causes manifest injustice.

Abstract

Marriage in Bugis-Makassar customary society is understood not only as a religious bond but also as a social event embedded with customary values, particularly concerning mahar (sompa) and uang panaik (doi panaik). Mahar is a mandatory requirement in Islamic marriage and normatively becomes the absolute right of the wife from the moment the marriage contract is concluded, while uang panaik serves as a symbol of customary respect toward the bride’s family. The different legal positions and functions of these two concepts often lead to disputes in cases of divorce, especially regarding claims for the return of mahar. This study examines the perspective of the Compilation of Islamic Law on the protection of women’s rights in Decision Number 63/Pdt.G/2021/PA.Mks. This research is a descriptive normative legal study using secondary data analyzed qualitatively, with conclusions drawn through deductive reasoning. The results show that Article 32 of the KHI affirms mahar as the absolute right of the wife; however, in Decision Number 63/Pdt.G/2021/PA.Mks., the judges still accommodated customary values by granting the partial return of mahar. Therefore, it can be concluded that the protection of women’s rights has not been fully consistent with the provisions of the KHI.

Abstract

The increase in deportation cases indicates weak data integration, procedural differences, and limitations in the protection mechanisms for Indonesian citizens (WNI), which have resulted in delays in the repatriation and handling of deported WNI. Therefore, coordination between representatives of the Republic of Indonesia and the Directorate General of Immigration is needed in handling WNI who are deported from abroad. The research question in this study is: how is the coordination between representatives of the Republic of Indonesia and the Directorate General of Immigration coordinate in handling WNI who are deported from abroad? This study employs a normative legal method, is descriptive in nature, utilizes secondary data obtained through literature studies, analyzes the data qualitatively, and draws conclusions deductively. The results of the research and conclusions show that effective coordination requires data integration, clear communication channels, and standardised procedures, from notification to repatriation. Harmonisation of institutional roles is also important to ensure that the handling of deported Indonesian citizens can be carried out quickly, accurately, and in accordance with the principles of state protection.
