Abstract

Narcotics abuse is a complex legal problem because on the one hand it is seen as a criminal act, but on the other hand, narcotics can also be used for medical recovery purposes as regulated in Law Number 35 of 2009 concerning Narcotics. The difference between the use of narcotics in the context of medical recovery and the illegal abuse of narcotics often does not receive adequate attention in judicial practice, especially in the evidentiary mechanism in trial. The formulation of the problem raised in this study is "What is the strength of the evidence of expert testimony in the Denpasar District Court Decision Number 1050/Pid.Sus/2022/PN Dps?" This study uses a normative legal research type with a descriptive nature. Data analysis was conducted qualitatively with deductive conclusions drawn. The results of the discussion and conclusions indicate that expert testimony in this case has valid, formal evidentiary power. The use of drugs included in certain categories should be accompanied by a letter or official document proving that the person concerned has permission to use the drugs. The absence of this document demonstrates the importance of expert testimony in providing evidentiary power, particularly in assessing whether the act constitutes drug abuse

Abstract

Ports are a strategic sector in supporting trade and the country's economy, but in practice, they are prone to unhealthy business rivalry, such as price-fixing agreements. The problem formulation examined is how the competition authorities in Indonesia and Malaysia prove alleged violations of price-fixing agreements in the port services sector. The research method used is normative legal research with a comparative law approach, using secondary data from primary legal sources such as laws and related legal literature. The results of the discussion and conclusions of this article show that Indonesia and Malaysia recognize the Per se Illegal and Rule of Reason legal approaches, as well as the use of direct or indirect evidence. However, there are significant differences in the consistency of the application of the legal approach by the Business Competition Supervisory Commission (KPPU) in Indonesia

Abstract

Indonesia, as a state governed by the rule of law, places the principle of legality as a fundamental basis for all governmental actions, including those undertaken at the regional level. Every policy issued by a regional head must have a clear legal basis and comply with the prevailing laws and regulations. In 2025, the Governor of West Java adopted a policy involving school children in a military barracks program as an effort to foster discipline and character development. The research problem addressed in this study is whether the authority to involve school children in a military barracks program is in accordance with the scope of regional governmental authority granted by law. This research employs a normative legal research method, using statutory and conceptual approaches. The findings indicate that the Governor’s authority in the field of education is limited to administrative management and the supervision of secondary education and does not extend to the implementation of militaristic disciplinary programs. Furthermore, the military barracks policy potentially conflicts with the principles of child protection and the best interests of the child. Therefore, from a legal perspective, the policy raises issues concerning its validity and requires reconsideration to ensure conformity with the principle of legality and the protection of children’s rights.

Abstract

Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA Law) emphasizes that the Special Children’s Development Institution (Lembaga Pembinaan Khusus Anak/LPKA) is the designated place for implementing criminal punishment for children in conflict with the law. This provision aims to guarantee the protection of children’s rights, ensure separation from adult offenders, and support guidance and rehabilitation. The problem is, in judicial practice shows that some court decisions do not explicitly include LPKA in the verdict, although it is mentioned in the legal considerations, as reflected in the Batam District Court Decision Number 67/Pid.Sus-Anak/2021/PN.Btm. This study aims to analyze the conformity between the normative provisions of the SPPA Law and their application in the decision. The research employs a normative juridical method with a descriptive approach through document studies of statutory regulations, court decisions, and relevant legal literature. The analysis is conducted qualitatively using deductive reasoning. The findings indicate that the omission of LPKA in the verdict creates legal uncertainty and may undermine the principles of child protection and the objectives of the Juvenile Criminal Justice System, which emphasize rehabilitation and the best interests of the child.

Abstract

Praktik penjualan rumah melalui Perjanjian Pengikatan Jual Beli (PPJB) kerap menimbulkan persoalan perlindungan konsumen ketika pengembang melakukan wanprestasi, khususnya dalam bentuk keterlambatan pembangunan dan serah terima unit rumah, seperti yang terjadi pada proyek perumahan YVE Habitat Limo, Dimana konsumen yang telah memenuhi kewajiban pembayaran tidak memperoleh rumah sesuai perjanjian serta menghadapi kesulitan dalam memperoleh pengembalian dana. Pencantuman klausula refund conditional dalam PPJB yang mensyaratkan pelepasan hak gugat dan menggantungkan pengembalian dana pada kondisi tertentu menghambat pemulihan hak konsumen. Tulisan ini menggambarkan bentuk perlindungan hukum bagi konsumen terhadap wanprestasi pengembang dalam PPJB YVE Habitat Limo serta kesesuaian klausula pengembalian dana bersyarat dengan ketentuan peraturan perundang-undangan yang berlaku. Hasil dari penelitian menunjukkan bahwa wanprestasi pengembang menimbulkan kewajiban hukum untuk memenuhi hak konsumen sebagai bentuk perlindungan konsumen yang diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan Peraturan Pemerintah Nomor 12 Tahun 2021, selain itu, klausula pengembalian dana bersyarat dalam PPJB YVE Habitat Limo merupakan klausula baku yang bersifat eksoneratif, sehingga bertentangan dengan Pasal 18 UUPK dan harus dinyatakan batal demi hukum.

Abstract

The development of artificial intelligence technology has given rise to new forms of digital-based sexual crimes, such as deepfake pornography, which threaten women’s right to privacy and dignity. This phenomenon legal problem issues concerning the effectiveness of legal protection for women as victims. This study examines legal protection for women victims of deepfake pornography in Indonesia based on the Law on Information and Electronic Transactions, Law Number 44 of 2008 on Pornography, and the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW). The result and conclusion research employs a descriptive-analytical normative legal research method, supported by library research. The findings indicate that legal protection remains suboptimal due to fragmented regulations, challenges in digital evidence, and limited legal responses to technological developments, thereby necessitating the strengthening of regulations and victim-centered law enforcement

Abstract

Land has a strategic role in life, so it becomes an important aspect in ensuring certainty and legal protection for the community. Indonesia and Germany both regulate land trading as a form of transfer of land rights, but differences in the legal system influence the legal mechanisms, procedures, and powers of the process. Indonesia developed a national land law based on customary law with bright and cash characters, and implemented a land registration system that is a negative publication with a positive trend. In contrast, Germany adopted a system of strong codification of civil law through the Bürgerliches Gesetzbuch, which required notarial deeds and registration in Grundbuch as a constitutional requirement for birth and transfer of property rights to the land. The legal problems studied in this paper are found in the differences in the position and power of land registration law and its implications for legal certainty for rights holders. This study used a normative juridical method with a comparative approach to law through a library study of related laws, doctrines, and legal literature. The results and conclusion of the discussion show that land registration in Indonesia serves as a strong evidence but is not final, while in Germany land registration is a binding determinant of ownership and provides maximum legal protection. These differences directly affect the level of legal certainty in land buying and selling practices in both countries

Abstract

he monitoring and data collection of foreign nationals in Tangerang City is carried out by the Foreigners Monitoring Team (TIMPORA) as an inter-agency coordination forum. The high level of industrial and service activity in Tangerang City has led to increased mobility of foreign nationals, requiring effective and integrated monitoring. The research question is: What are the obstacles and challenges faced by TIMPORA in supervising and collecting data on foreign nationals in Tangerang City? This research uses a qualitative, descriptive method, using secondary data, which is analysed qualitatively, and conclusions are drawn deductively. The results of the discussion and conclusions show that TIMPORA has a strategic position in the regional immigration monitoring system, but its implementation has not been optimal due to weak inter-agency coordination, limited resources, and the lack of integration of the foreign national data collection system. In addition, the high mobility of foreign nationals and low community participation also pose challenges to supervision. Therefore, strengthening the role of TIMPORA requires increased institutional synergy, integration of cross-sector data collection systems, increased capacity of officials, and active involvement of local government and the community to realise effective and accountable supervision of foreign nationals in Tangerang City.

Abstract

The circulation of expired infant formula products constitutes a serious issue that may endanger the health of infants as a highly vulnerable group of consumers. Therefore, the state has a responsibility to provide adequate legal protection for consumers against unsafe food products. The problem formulation of this study examines how the legal framework governing consumer protection with regard to expired infant formula products is regulated in Indonesia, as well as how consumer legal protection concerning expired infant formula products is regulated in a comparative perspective between Indonesia and Canada. This research employs a normative legal research method using a statutory approach and a comparative law approach. The discussion and conclusions indicate that both Indonesia and Canada have legal regulations that prohibit the distribution of expired infant formula products and require business actors to ensure product safety. However, Indonesia tends to apply consumer protection through law enforcement after violations have occurred, whereas Canada places greater emphasis on a preventive approach

Abstract

Perkembangan digitalisasi sektor perbankan mendorong penggunaan Sistem Layanan Informasi Keuangan sebagai instrumen pengelolaan dan pertukaran data debitur yang memiliki implikasi hukum terhadap hak nasabah. Data nasabah yang tercatat dalam Sistem Layanan Informasi Keuangan digunakan sebagai dasar penilaian kelayakan kredit sehingga berpengaruh langsung terhadap akses pembiayaan dan posisi hukum nasabah dalam sistem perbankan. Permasalahan hukum dalam penelitian ini berfokus pada bentuk perlindungan hukum bagi nasabah perbankan terhadap data yang dikelola dalam Sistem Layanan Informasi Keuangan serta tanggung jawab hukum bank atas ketidakakuratan data tersebut. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan doktrin hukum yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa data nasabah dalam Sistem Layanan Informasi Keuangan merupakan objek perlindungan hukum yang pengelolaannya wajib tunduk pada prinsip kehati-hatian, asas perlindungan konsumen, dan tata kelola bank yang baik. Kelalaian bank dalam pencatatan atau pelaporan data dapat dikualifikasikan sebagai perbuatan melawan hukum yang menimbulkan tanggung jawab keperdataan. Kesimpulan penelitian menegaskan perlunya penguatan tanggung jawab bank dan optimalisasi mekanisme pemulihan hak nasabah guna menjamin kepastian hukum dan perlindungan konsumen jasa keuangan.
