Abstract

Globalization and advances in information technology have increased the mobility of foreign nationals (FNs) to Indonesia, while simultaneously facilitating online prostitution practices involving the misuse of residence permits. The research problem in this study is how the authority of the West Jakarta Immigration Office is implemented in handling foreign nationals involved in online prostitution. The research employs a normative legal method with statutory and conceptual approaches and adopts a descriptive-analytical design, combining literature studies of primary, secondary, and tertiary legal materials with empirical data derived from official reports and media coverage of relevant cases. The findings reveal that the West Jakarta Immigration Office predominantly applies administrative immigration measures, such as deportation and entry bans, rather than criminal sanctions. Although this approach is considered efficient in enforcing immigration law, it faces limitations in anticipating offenders’ evolving modus operandi that exploit digital platforms. The effectiveness of enforcement is strongly influenced by inter-agency coordination, the capacity to identify foreign nationals, and adherence to human rights principles. In conclusion, the exercise of immigration authority in West Jakarta emphasizes preventive and administrative measures but requires strengthened oversight mechanisms, cross-agency integration, and enhanced utilization of technology to more effectively curb online prostitution practices.

Abstract

The United States' withdrawal from the 2015 Paris Agreement, under Donald Trump's administration, for the second time has caused uncertainty for global climate governance, particularly in relation to funding for the Least Developed Countries (LDCs). The research questions are: what factors caused the United States to withdraw from the 2015 Paris Agreement, and what impact did the United States' withdrawal from the 2015 Paris Agreement have on the climate funding scheme for LDCs? The research method employed is a normative juridical and descriptive analytical approach, utilizing secondary data, and the data are analyzed qualitatively. The results of the discussion and conclusions show that the United States is one of the largest contributors to the Green Climate Fund (GCF) and a key actor in climate finance negotiations, having a strategic process for the sustainability of mitigation and adaptation projects in LDCs. The uncertainty of the United States' commitment, both due to its withdrawal from this agreement and the lack of an explicit statement regarding its contribution within the framework of the New Collective Quantified Goal on climate finance (NCQG), will have implications for increased funding risks and hamper energy transition efforts and the strengthening of climate adaptation capacity in LDCs.

Abstract

Perceraian menimbulkan berbagai akibat hukum yang harus diselesaikan, salah satu yang penting adalah terkait harta bersama karena sering kali menimbulkan sengketa berkepanjangan antara para pihak, diantaranya pembagian yang tidak merata terhadap harta bersama. Hal tersebut juga terlihat pada Putusan nomor 969/Pdt.G/2024/PA.Cbn, sehingga permasalahan terhadap kondisi ini apakah putusan Pengadilan Agama Cibinong Nomor 969/Pdt.G/2024/PA.Cbn mengenai pembagian harta bersama sudah sesuai dengan hukum keluarga Indonesia. Penelitian ini merupakan penelitian normatif yang berfokus pada asas-asas di bidang hukum perkawinan kemudian dianalisis secara kualitatif. Penelitian ini bertujuan menggambarkan kesesuaian putusan dengan peraturan yang ada. Analisis terhadap pembagian harta bersama pasca perceraian dilakukan dengan cara menelaah bahan data sekunder. Dalam putusan tersebut, hakim melakukan pembagian tidak rata terhadap harta bersama, yaitu 25% untuk Penggugat (istri) dan 75% untuk Tergugat (suami) karena mempertimbangkan kontribusi dan peran para pihak selama perkawinan, sehingga dapat disimpulkan amar putusan tersebut belum sesuai dengan Pasal 37 UUP jo. 97 KHI yang menetapkan bahwa setelah perceraian harta dibagi dua antara suami istri.

Abstract

The Most-Favoured-Nation and tariff binding principles state that when a WTO (World Trade Organization) member country implements a policy to reduce tariffs for its trading partners, it must extend the same treatment to all other trading partners. This requirement holds as long as the reduced tariffs do not exceed the negotiated tariff concessions. The United States imposed a 19% reciprocal tariff on all Indonesian commodities, both those covered and those not covered by the tariff concessions. The research question is whether the imposition of a 19% reciprocal tariff by the United States violates the Most-Favoured-Nation principle and tariff binding. The study approach used is normative legal research grounded in legal principles, using secondary data. The results of this study indicate that the United States has violated the Most-Favored-Nation and tariff binding principles by imposing a 19% reciprocal tariff on Indonesian commodities. This action creates unfavorable market access for Indonesian products in the United States compared to similar products from other WTO member countries. This conclusion that the United States’ actions could close market access for Indonesian commodities exported to the United States.

Abstract

The principle of popular sovereignty is the normative basis for the implementation of constitutional review of laws in Indonesia. In this regard, the Constitutional Court (MK) has a strategic role in ensuring that every piece of legislation is in line with the will of the people as mandated by the 1945 Constitution. The research question is: how does the MK position the principle of popular sovereignty as a basis for legal considerations in MK Decision Number 176/PUU-XXII/2024 and what are the implications for the practice of constitutional review? This research uses a normative legal research method, is descriptive in nature, uses secondary data obtained through literature studies, analyses data qualitatively, and draws conclusions deductively. The results of the study and conclusions show that the Constitutional Court not only conducts textual testing of norms against the 1945 Constitution, but also prioritises interpretations based on substantive democratic values, particularly in the protection of political rights and people's representation. This approach strengthens the function of judicial review as an instrument for safeguarding people's sovereignty, but at the same time raises debates about the limits of the judicial role and legislative authority.

Abstract

Indonesian Islamic inheritance law normatively regulates the distribution of inheritance between sons and daughters at a ratio of 2:1, as stipulated in Surah An-Nisa verse 11 and Article 176 of the Compilation of Islamic Law. However, in practice, several religious court decisions in Indonesia have found equal distribution of inheritance. The research question is whether the equal distribution of inheritance between sons and daughters is permissible under Islamic inheritance law. The type of research used is normative, focusing on the principles of Islamic inheritance law. It is descriptive in nature, using secondary data that includes primary and secondary legal materials, which are then processed qualitatively with deductive conclusions. The results and conclusion of the discussion show that the development of Indonesian Islamic inheritance law is reflected in the practice of equal inheritance distribution, which is realized with several legal considerations without necessarily disregarding the applicable faraidh provisions. Equal inheritance distribution can be carried out with the agreement and deliberation of each heir, resulting in peace.

Abstract

This study examines the role of the Governor of the Special Capital Region of Jakarta in determining the Provincial Minimum Wage (UMP) based on the Ministry of Manpower Regulation No. 16 of 2024. The background of this research is the wage policy dynamics in Jakarta, which often generate controversy, particularly the 2022 UMP determination by Governor Anies Baswedan, which caused tensions among the regional government, employers, and workers. The research problems focus on the UMP determination process by the governor and the governor’s role during the leadership periods of Joko Widodo, Basuki Tjahaja Purnama, and Anies Baswedan. The research method used is normative juridical, with a literature study approach on legislation and official documents, supported by interviews. The results show that the governor has a strategic authority in setting the UMP, integrating tripartite aspirations with local economic and social conditions. This process requires a balance between workers’ and employers’ interests, transparency, and compliance with national regulations. The study emphasizes the governor’s role as an accountable and fair decision-maker in setting the minimum wage and draws lessons from the 2022 case to strengthen governance mechanisms and UMP determination procedures in the future.

Abstract

The application of the duty of care principle constitutes a primary obligation of directors in carrying out corporate management functions, particularly in the management of debt repayment obligations to creditors. In Indonesian bankruptcy law practice, corporate bankruptcy is not always caused by a condition of inability to pay (insolvency), but may occur as a result of directors’ negligence in exercising the principle of prudence, even though the company factually still possesses adequate financial capacity and sufficient assets. The legal issue examined in this study concerns the legal aspects of directors’ neglect of debt repayment that results in corporate bankruptcy. This research employs a normative legal research method using a statutory approach. The Decision of the Commercial Court at the Semarang District Court Number 2/Pdt.Sus-Pailit/2024/PN Niaga Smg is used as a factual reference to illustrate the phenomenon of corporate bankruptcy involving a relatively small amount of debt compared to the assets owned by the company. The findings and conclusion indicate that directors’ negligence in managing debt repayment obligations may be classified as a violation of the duty of care principle, which opens the possibility of corporate bankruptcy, regardless of the company’s financial condition that remains substantively sound.

Abstract

The development of the digital economy has introduced new challenges in competition law, particularly concerning the abuse of dominant positions by Big Tech companies that control digital markets through data dominance, algorithms, and network effects. The research question in this study concerns the similarities and differences between Indonesian and German regulations on the abuse of dominant positions by Big Tech companies in digital markets. The research method applied is normative legal research with a comparative approach. The findings indicate that Indonesia, through Law No. 5 of 1999, still assesses dominant positions based on conventional market share, whereas Germany, through the Gesetz gegen Wettbewerbsbeschränkungen (GWB), has introduced specific provisions such as Sections 18(3a) and 19a that take into account the characteristics of digital markets, including multi-sided markets, network effects, and data access. In conclusion, Germany’s regulatory framework is more adaptive, comprehensive, and capable of anticipating abuses of dominance by Big Tech companies, while Indonesia still requires regulatory updates to align with the dynamics of the global digital market.

Abstract

Trade secrets constitute assets of significant economic value requiring comprehensive legal protection, particularly within the salon industry where hair dye formulas serve as a primary competitive advantage. The problem regarding the entitlement to ownership of hair dye formula trade secrets within a salon based on Law Number 30 of 2000 concerning Trade Secrets. The research methodology employed is normative legal research, utilizing both a statutory approach and a conceptual approach. Primary legal materials include Law Number 30 of 2000 concerning Trade Secrets, whereas secondary legal materials; treatises pertaining to intellectual property rights. The result of this research indicate that Law Number 30 of 2000 concerning Trade Secrets lacks specific provisions governing the ownership of trade secrets arising from an employment relationship, as otherwise regulated under copyright and patent regimes. However, it can be concluded that in the event a hair dye formula is conceived by a stylist without the utilization of salon facilities, the trade secret shall vest in the stylist. Consequently, the ownership of hair dye formula trade secrets in salons is determined by several legal criteria, inter alia: the creator of  formula, the existence of an employment or licensing agreement, and security measures implemented by proprietor of information
