Abstract

Outsourcing refers to the use of labor services by contracting out or transferring the duties and responsibilities of work or company activities from the original autonomous parent company to another company as a provider of labor services through the form of a cooperation contract. This research aims to determine whether the implementation of wages for outsourced workers at PT Carefastindo has followed the applicable regulations. The method used in this research is an empirical research study that refers to the results of research in the field. The data used in this research are the implementation and regulations related to the applicable work copyright regulations, evaluations, and interviews with workers at PT Carefastindo. The results indicate that in the implementation of wages for outsourced workers at PT Carefastindo Surabaya, East Java, there is still an implementation of wage payments below the City Minimum Wage. The implementation of wage payments for outsourced workers should fulfill the principle of justice, which refers to proportionality, the provision of salaries, and fulfillment by taking into account achievement and seniority. This wage payment refers to the needs of workers and families from an economic perspective, in accordance with the amount of wages received from the same job as others. Several factors occur in the wages of outsourced workers at PT Carefastindo who are paid below the City Minimum Wage, including the existence of a Cooperation Contract or Work Agreement given to the client of PT Carefastindo.

Abstract

The default act leads to the right for the injured party to file a lawsuit against the defaulter to provide compensation in order to ensure that there is no one who is legally prejudiced by the default. Unlawful acts are caused by infringement of obligations that come from a contract between the parties involved, such as the default that occurred between PT Haspra Konsulting and PT Baja Bahagia Sejahtera. Therefore, this research aims to determine the default of the cooperation agreement. The research method used is a normative juridical research method, a type of legal research that examines library materials or secondary data of legal material. Meanwhile, the data collection method used is literature research and law study. The research findings indicated that the default that occurred in the cooperation contract related to Decision No. 523/Pdt.G/2022/PN/JKT. SEL, it was found that the judicial decision consisted of granting the Plaintiff’s claim for some part, stating that the Defendant had committed a default by not complying with its obligations in accordance with Cooperation Contract Number P-008/BBS/HAlSPRA/RHS-WFQ/XI/20 on 16 November 2020, punishing the Defendant to compensate the losses suffered by the Plaintiff with the details of payment for Invoice number 045_IV/22/BBS/RHS/HAlSPRA on 19 April for IDR 122,100,000 (one hundred and twenty-two million one hundred thousand rupiah) and to charge the Defendant to pay compensation of IDR 3,755,000 (three million seven hundred fifty five thousand rupiah).

Abstract

Hydrological analysis is conducted to determine the rainfall discharge that can be accommodated by the river with various specific return periods and hydraulic analysis to examine the water level that impacts the toll bridge that passes through the Sei Batang Serangan river. Therefore, this research was conducted to calculate the design flood discharge for the return period of 2, 5, 10, 25, and 50 years; and the water level elevation of Sei Batang Serangan toll bridge in the Sei Batang Serangan riverside. Based on hydraulic analysis using the HEC-RAS 5.0 program from steady flow data, the maximum water level elevation is at River Sta 5+00 of 10.52 m in a 50-year return period, and the minimum water level elevation is at River Sta 2+00 of 4.45 m in a 2-year return period. Thus, based on the flood water level of 12.691 meters, the Sei Wampu toll bridge area does not have flood inundation because the water level elevation value does not exceed the flood water level value (TMA < MAB). Meanwhile, from the results of the steady flow data analysis, it can be concluded that no flooding occurred at the Sei Batang Serangan toll bridge in the Sei Batang Serangan riverside at a known return period.

Abstract

The United States of America (USA) dominates in almost every aspect globally, including the sport of mixed martial arts (MMA). Most of the MMA sports promotion companies that dominate the global market are from the US. One of the largest and most popular is the UFC. As a global company, UFC is the most dominant MMA sports competition promoter in the world today due to its global economies of scale. Since its inception in the US, the UFC has developed into competitions held in several countries, such as Canada, the UK, Russia, Brazil, Uruguay, the United Arab Emirates, Australia, New Zealand, South Korea, and Singapore. This research aims to find out the UFC’s business strategy as a global company in globalizing its commodities to dominate the mixed martial arts (MMA) sports industry on a global scale. This research uses a descriptive qualitative method accompanied by a 4P Marketing Mix perspective as an analytical tool in examining the strategies implemented by the UFC. This research concludes that the UFC’s global marketing strategy is to implement various marketing elements from upstream to downstream optimally so as to be able to dominate the market share of the global MMA sports industry.

Abstract

Excavators is one of the heavy equipment used to do transport, excavation, loading work that is operated using hydraulic energy. Excavator construction consists of three main parts, which consist of undercarriage, upper structure, and front attachment. During operation, one of the front attachment parts that has the highest performance is the boom cylinder actuator because it carries the entire load of the front attachment activity. The continuous work of the hydraulic boom cylinder will definitely suffer damage that cannot be avoided and can interfere with the performance of the unit. The damage is in the form of external leaks, internal leaks, scratches, and wear. This research aims to identify the types of damage, causal factors, and impacts caused by boom cylinder damage, explain the boom cylinder maintenance system and process, identify bends in the cylinder rod, and provide a reference price for repairing the Hitachi excavator boom cylinder. The methods used in this research are literature study, observation, and interviews. The results indicate that damage can be minimized by performing scheduled maintenance, such as selecting and replacing the right hydraulic oil and grease, cleaning the hydraulic oil cooler every 500 hours, replacing the oil filter every 250 hours according to the maintenance schedule, performing the inspection process during daily checks, operating the unit in the right way, avoiding modifications that can cause overloading, and performing oil analysis every 250 hours to ensure high availability of the unit as planned.

Abstract

There are several things that might become the aftermath of someone’s trauma. It might influence someone’s capability to form any social interaction with other people or even how someone feel about themselves. To cope with their own trauma, one usually does something unconsciously to make them feel better, as a normal effort that might be carried out by someone to protect their selves from being hurt. This is qualitative research where the data are taken from a graphic novel entitled The End of the F***ing World by Charles Forsman. Sigmund Freud’s psychoanalysis will be used as the grand theory to analyse the character’s core issue, especially for the part of psychosexual development and defense mechanism. This research aims to discuss about James, the main character in The End of the F***ing World, who is struggling with his surroundings as the effects of his childhood trauma. This research reveals that James’ core issue is Oedipus complex and unstable sense of self, which is strongly associated with his trauma of witnessing his mother’s suicide. The loss of his mother has also affected James’ personality as well that he got stuck in his phallic stage and became mother-fixated. Since James did not successfully resolve his phallic stage, his tripartite model becomes imbalance. When the id in himself started to become too demanding, James let out his defense mechanism, which are displacement and repression.

Abstract

When a researcher comprehends the research, they can develop research methods because the research needs to adhere to scientific principles. Because of this matter, a methodical scientific approach is required to guarantee that the study can be reaffirmed by other researchers. Moreover, the descriptive qualitative method has become popular due to its less reliance on numerical values or metrics for variable measurement. The aim of this research is to provide a general review of the literature on descriptive qualitative research methods. The researcher can determine that qualitative descriptive research is a descriptively described research method that employs qualitative data based on the findings of the research. Analyzing events, phenomena, or social conditions is a common use for this kind of descriptive qualitative research. Furthermore, qualitative research does not rely on numerical measurements for its research object, nor does it employ statistical methods to test elaborative characteristics. Its application allows for the combination of different data collection techniques, data analysis, instrument creation, and other research stages commonly used in qualitative and descriptive research methodologies.

Abstract

The framework of curriculum implementation had been argued to be complex and vague since it was hard to identify how, what, and where to begin. This paper aims to review the framework of curriculum implementation in the ASEAN context on how the curriculum is formulated, prototyped, and implemented. Employing the integrative review approach of the conventional review paper, 27 articles (22 primary data and 5 secondary data) were collected from Google Scholar to form themes, sub-themes, and codes. The findings indicated that the curriculum is implemented into 5 main circles: (1) the planning and consultation circle is categorized into 5 elements: identifying core values and areas of knowledge, key knowledge and skills for learners, basic and relevant resources, practitioners and relevant stakeholders, and reviewing plan and consultation; (2) designing and development circle is classified into 3 elements: contents, pedagogies, and assessments; (3) the trailing and prototyping circle is covered by 3 elements: contents, syllabuses, and resources; (4) the implementation and communication circle is followed by 3 elements: gathering information, reflection, and possible changes; and (5) post-implementation and evaluation is classified into 4 elements: assessment and feedback, reflection and evaluation, making changes, and post-implementation and updates.

Abstract

Quality assurance has been a regulatory obligation in Cambodian colleges since 2003, yet it remains a relatively new idea. There is no official quality-management structure at the systemic level, and little attention has been devoted to this in the higher education sector. This study seeks to identify the internal quality elements that influence employability and quality improvement in higher education. The study uses a quantitative approach for measurement, with 200 accurate structured questionnaires sent to the public. Inferential statistics were used to do quantitative data analysis. Inferential statistics of data were presented using regression analysis and multiple regressions. This study found that leadership, academic staff, physical facilities, student evaluation, and teamwork all had a favorable impact on quality improvement. Mission approach and curriculum do not appear to have statistically meaningful effects on quality improvement.  Furthermore, the study found a weak positive association between the quality of higher education and employability in higher education. The current study aims to investigate how internal quality improvement influences graduate employability and helps to the growth of private institutions in Phnom Penh, Cambodia.

Abstract

Staphylococcus epidermidis infections of the skin can cause boils, itching and long-lasting sores. Currently, around 75% to 90% of S. epidermidis infection cases are resistant to the antibiotic methicillin. Thus, this becomes a concern in the health sector. This research aims to discover a new method to treat S. epidermidis infection by using lactic acid bacteria as its opponent, so that the use of antibiotics can be reduced. The physical test includes confirmation of Lactic Acid Bacteria (LAB), inhibition test of lab on S. epidermidis, lotion formulation, organoleptic and homogeneity test of lotion, lotion hedonic test, LAB total plate count test in lotion, and data analysis using Microsoft Excel, Statistical Program Service Solution (SPSS), and ANOVA test. Lactic acid bacteria isolates were obtained from previous research stocks and tested for their ability to inhibit S. epidermidis in vitro. These lactic acid bacteria were added to the lotion. The favorability level of consumers to the lotion was also tested. The results indicated that lactic acid bacteria were able to inhibit the growth of S. epidermidis and remained effective until the seventh day. In addition, respondents provided a positive response to the physical quality of the lotion that contained lactic acid bacteria.
