Abstract

Putusan Mahkamah Konstitusi Republik Indonesia (MK RI) No. 42/PUU-XIX/2021 tentang pembatalan ketentuan masa jabatan Kepala Desa telah memicu perdebatan di masyarakat. Penelitian ini bertujuan untuk menganalisis pembatasan masa jabatan Kepala Desa berdasarkan putusan tersebut dalam perspektif Fiqih Siyasah. Dengan menggunakan metode kualitatif dan pendekatan studi pustaka, penelitian ini mengkaji prinsip-prinsip kepemimpinan dalam Islam yang relevan dengan isu tersebut. Hasil penelitian menunjukkan bahwa pembatalan pembatasan masa jabatan Kepala Desa sejalan dengan prinsip-prinsip Fiqih Siyasah, terutama dalam hal musyawarah (syura), keadilan (al-'adalah), dan kemaslahatan umat (maslahah 'ammah). Namun, implementasinya harus mempertimbangkan konteks lokal, potensi tantangan, dan kebutuhan akan regulasi serta pengawasan yang efektif. Penelitian ini menyimpulkan bahwa fleksibilitas dalam masa jabatan Kepala Desa, jika diterapkan dengan tepat, dapat menjadi sarana untuk meningkatkan kualitas kepemimpinan dan kesejahteraan masyarakat desa sesuai dengan tujuan syariat Islam.

Abstract

Penelitian ini bertujuan untuk menganalisis pelanggaran Hak Asasi Manusia (HAM) oleh guru terhadap anak didik dari perspektif Siyasah Dusturiyah, yang merupakan bagian dari hukum Islam yang mengatur tata negara dan pemerintahan. Dalam Islam, perlindungan terhadap hak-hak individu, termasuk anak didik, merupakan kewajiban yang harus dijunjung tinggi. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kualitatif, melalui studi kepustakaan yang melibatkan analisis terhadap peraturan-peraturan hukum, kasus-kasus pelanggaran HAM, dan landasan hukum Islam. Hasil penelitian menunjukkan bahwa meskipun regulasi nasional seperti Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia dan Undang-Undang Nomor 14 Tahun 2005 tentang Guru dan Dosen telah menetapkan kerangka hukum yang jelas, implementasinya masih sering lemah dan tidak konsisten. Pendekatan Siyasah Dusturiyah menawarkan perspektif yang dapat melengkapi hukum positif dalam melindungi hak asasi manusia dalam dunia pendidikan, dengan mengintegrasikan nilai-nilai agama dan moral ke dalam sistem hukum. Penelitian ini merekomendasikan peningkatan upaya penegakan hukum serta pendidikan dan pelatihan bagi guru mengenai etika profesi dan HAM, guna menciptakan lingkungan pendidikan yang lebih aman dan adil.

Abstract

Purpose: This study analyzes the application of the fiqhiyyah rules taghayyur al-fatwā and al-muḥāfaẓah in the context of changing marriage agreement provisions in Indonesia, specifically in the Regulation of the Minister of Religious Affairs Number 19 of 2018 (PMA 19/2018). The taghayyur fatwa rule refers to the flexibility of the fatwas, which can change according to the needs of society. Al-muḥāfaẓah emphasizes the importance of maintaining good old values while adopting new opinions that are more relevant and contextual. These two principles became the primary analytical framework for evaluating the dynamics of changes in marriage agreements in PMA 19/2018. These changes are inseparable from the challenges of the modern era, such as issues of gender equality, the protection of women's rights, and legal certainty in marriage. Methods: The research used a normative juridical method with a legislative approach. Data sources were obtained from libraries through legislation, books, and related articles. Findings- This study shows that the application of the rules of taghayyur fatwa and al-muḥāfaẓah in PMA 19/2018 reflects an effort of ijtihad to balance between maintaining the fundamental values of Islamic law (al-muḥāfaẓah) and accommodating the changes and dynamics of modern society (taghayyur fatwa). This change can be seen in the flexibility of the time needed to make a marriage contract, which could only be done before or during the marriage but can now be done during the marriage. Contribution/Limitations- PMA 19/2018 is a form of legal response to the development of modern society while ensuring that marriage law remains relevant, fair, and follows the principles of justice in Islam. Thus, PMA 19/2018 is proof of the adaptation of Islamic family law to contemporary challenges. The limitations of this study lie in its normative focus, without an empirical field analysis. Originality/Value- This research offers a family law perspective on the dynamics of modern society in dealing with contemporary issues, which can be a reference for academics and legal practitioners.

Abstract

Purpose – This study analyzes the implementation of electronic trial administration in Religious Courts using the responsive law theory approach. It examines its policies from the perspective of siyāsah idāriyyah to assess their alignment with the principles of effective and just judicial governance. Methods – The study employed library research using a descriptive-analytical approach. It focuses on the bureaucracy of Religious Courts in Indonesia, particularly the implementation of electronic courts within the Religious Court System of the Supreme Court of Indonesia. Data were collected through a literature review from primary sources, namely the Supreme Court Regulations (PERMA) No. 1 of 2019 and No. 7 of 2022, and secondary sources, such as books, journals, and related regulations. The analysis used a qualitative descriptive method with an inductive approach to draw conclusions based on the interrelationships among the data. Findings – This study finds that digitalizing religious court administration through e-courts is a strategic step toward building an adaptive and responsive legal system. In addition to improving efficiency, digitalization reflects the principles of responsive law and expands access to justice, especially for underprivileged groups. However, the digital divide and data protection must be addressed. From the perspective of siyāsah idāriyyah, it is essential to maintain the relevance of the judiciary to modern needs, without disregarding Islamic law. With fair policies and proper management, e-courts can strengthen a contemporary, inclusive religious court system that aligns with Islamic and national law. Research contribution/limitations – This research contributes to the study of Islamic law and the judiciary by highlighting the role of e-court digitalization. Theoretically, it expands the understanding of responsive law in the context of siyāsah idāriyyah. These findings can serve as a policy foundation to enhance the inclusivity and effectiveness of e-court in providing access to justice. Originality/value – This research examines the digitalization of religious courts from the perspective of responsive law and siyāsah idāriyyah, which has rarely been the primary focus of previous studies.

Abstract

Purpose - This research examines the dynamics of Islamic legal thought in contemporary Indonesia concerning the cultural wisdom of the archipelago. This research aims to understand how sociopolitical changes, modernization of the Islamic education system, and awareness of local identity affect the acculturation process of Islamic law with local cultural values.Methods - This research uses historical-anthropological and socio-juridical approaches with qualitative methods. Data collection techniques included literature studies, historical document analysis, and in-depth interviews with 15 contemporary Islamic law thinkers in Indonesia.Findings - The results showed that Islamic fiqh in Indonesia underwent a process of adaptation through dialog with the local culture. Concrete examples of this acculturation include (1) inheritance division practices that accommodate customary law, such as the gono-gini system in Javanese society; (2) marriage rituals that combine elements of sharia with local traditions; and (3) the implementation of zakat, which is adjusted to the traditional economic system, including zakat on agricultural products that vary according to regional customs.Contribution/Limitations - Theoretically, this research enriches the study of Islamic law by highlighting the role of 'urf (custom) as a secondary source of law. This research provides input for formulating fatwas and Islamic law legislation responsive to the Indonesian sociocultural context. The limitation of this study lies in the scope of the area, which is still limited to specific case studies.Originality/Value - This research contributes to understanding how Islamic law can be contextualized in a multicultural society. It also opens up space for further exploration of the role of fatwa institutions and legal policies in responding to social dynamics in Indonesia.

Abstract

Purpose - This study aims to analyze the implementation of Supreme Court Circular Letter (SEMA) Number 1 of 2022 in divorce cases at the Yogyakarta Religious Court, especially in case Number 119/Pdt. G/2024/PA.YK using Contemporary Islamic Family Law. This regulation stipulates formal requirements for divorce, including the provision of a minimum of six months of separation from home for couples who apply for divorce on the grounds of continuous disagreement (broken marriage). This study examines the judge's reasoning in granting a divorce, even though these requirements have not been fully met.Method - Normative legal methods are used with a document study approach or literature research. This study focused on the decision of Yogyakarta Religious Court Number 119/Pdt. G/2024/PA.YK. The analysis focuses on court decisions with permanent legal force to understand the application of regulations in judicial practice by analyzing them using maqāṣid al-sharī‘ah theory and Judge Discretion theory.Findings - The results showed that even though the six-month separation requirement had not been met, the panel of judges still granted divorce because the dispute had not subsided (broken marriage), and there was no hope for reconciliation. This indicates flexibility in applying SEMA Number 1 Year 2022 following the actual conditions of the disputing couple.Research contribution/limitations - Theoretically, this study enriches the contemporary Islamic family law literature and provides insights into policies in Religious Courts. This study offers policy recommendations for applying SEMA No. 1 in 2022 to increase legal certainty in divorce cases. However, the limitation of this research is that its scope is limited to one particular case; therefore, further research with a broader scope is needed.Originality/value - The originality of this research lies in the empirical analysis of the implementation of SEMA No. 1 of 2022 in recent divorce cases, which has not been specifically studied. This study contributes to the development of contemporary Islamic legal theory and provides practical solutions for the world of justice and family law policies in Indonesia.

Abstract

Purpose - Contemporary ijtihad methods have emerged in response to the need to update and adapt Sharia law to the times. An adaptive and innovative approach is required to ensure the applied law remains relevant and meets societal needs. This research explores the method of contemporary ijtihad in determining Sharia business law in depth.Method - This research is library research with a descriptive normative approach. The research data were sourced from secondary data with documentation data collection techniques that were collected continuously until it reached saturation. The data analysis is studied through several steps, starting with data reduction and ending with data presentation and conclusion drawing.Findings - The contemporary ijtihad method in determining Sharia business law is essential for addressing Muslims' legal challenges in the modern era. In this context, ijtihad relied on classical traditions and considered social changes, culture, and scientific developments. Various methods, such as tarjihi, insya'i, and integrative ijtihad, have been used to formulate laws that suit the needs of society. These methods allow mujtahids to explore and apply Sharia principles in contemporary business contexts such as e-commerce transactions, insurance, and investment. Thus, contemporary ijtihad plays a crucial role in ensuring that Sharia business law remains relevant, dynamic, and in tune with the people's interests while adhering to the basic principles of Sharia.Research Contributions/Limitations - The research findings are essential to developing flexible and contextual Islamic legal thinking and highlighting Islamic business law issues that have not been explicitly regulated in classical texts to address the dynamic challenges of Islamic business. However, the research study is limited to Muslim-majority countries so that it can be different from countries with a more pluralistic legal system.Originality/Value - This research connects contemporary ijtihad with the practical needs of Sharia business law in the modern world to offer theoretical solutions and real applications that are useful for practitioners and academics and contribute to the application of Sharia business law that is relevant and responsive to changing times.Keywor

Abstract

Purpose: This study aims to analyze the disparity in judicial interpretations and the application of legal progressivism in marriage dispensation decisions at the Muara Bulian Religious Court. This study seeks to explore how judges construct legal reasoning when faced with applications for underage marriage dispensation and whether their decisions reflect consistency or divergence in applying child protection principles. Methods - This study employs a socio-legal approach with qualitative methods. Data were obtained from case decisions, field observations, and interviews with judges at the Muara Bulian Religious Court. The data were analyzed thematically to identify patterns of judicial interpretation and the extent of progressivism in the rulings’ content. Findings - The results reveal a disparity in judges’ interpretations, particularly regarding the use of progressive legal reasoning. Some judges strictly adhere to statutory provisions, while others accommodate sociocultural considerations and parental requests, resulting in inconsistent outcomes. Although progressive legal theory provides opportunities for child protection, in practice, dispensations are often granted, thereby reinforcing early marriage practices instead of preventing them. Contribution/Limitation of Research: This study contributes to the discourse on judicial discretion and progressive legal thought in the context of family law adjudication. However, it is limited to the Muara Bulian Religious Court; thus, its findings cannot be generalized to all religious courts in Indonesia. Originality/Value - This study highlights the tension between statutory child protection norms and judicial discretion in marriage dispensation cases. It offers a critical socio-legal perspective on how progressivism is interpreted and practiced at the local courts.

Abstract

Purpose: This study aimed to analyze the legal considerations and implementation of custody decisions in Case Number 977/Pdt. G/2022/PA.LT at the Lahat Religious Court. Specifically, it seeks to examine the legal basis used by the judge in granting custody to the father and evaluate how the decision has been implemented. Methods - A normative-empirical research method is employed, which combines legal analysis with field research. Data were collected through structured interviews with the parties involved and library research on relevant legal sources. This study adopts a qualitative approach with descriptive analysis to interpret judicial reasoning and assess the ruling’s impact. Findings - The judges prioritized the best interests of the child over Article 105(a) of the Compilation of Islamic Law, which normally grants custody of a non-mumayyiz child to the mother. The decision was based on three key considerations: the child had been continuously cared for by the father since the separation, the child expressed a preference to remain with the father, and the mother admitted infidelity as a factor in the divorce. The ruling has been partially effective: while the child remains in the father’s custody, the mother’s visitation rights have been hindered by parental conflict. Over time, however, the child’s initial reluctance to meet the mother shifted toward more positive interactions. Contribution/Limitation: This study contributes to the discourse on custody disputes by demonstrating how judicial discretion and social dynamics influence the application of family law. A limitation of this research lies in its focus on a single case, which may not fully represent broader judicial trends. Originality/Value - The originality of this study lies in its combination of legal and empirical perspectives, offering insights into how custody rulings are not only legally grounded but also shaped by practical, social, and familial considerations.

Abstract

Purpose - This study examines the legal validity of Indonesian-Taiwanese mixed marriage contracts from an Islamic law perspective, specifically analyzing the impact of linguistic barriers in Ījāb Qabūl on fulfilling the requirements of tarāḍī (consent) and fahm al-'aqd (contract comprehension). This study fills a gap in contemporary Islamic jurisprudence studies regarding the legal implications of language barriers in marriage rituals that potentially affect contract validity. Method - This study employs an empirical juridical method integrated with a socio-legal approach, focusing on KUA Paguyangan, which handles Indonesian-Taiwanese mixed marriage cases with significant linguistic challenges. Primary data were collected through in-depth interviews with KUA officials, field observations of ceremony documentation, and analyses of official marriage records. Findings - This study reveals that cross-cultural Islamic marriages achieve validity through four key elements: linguistic innovation where Taiwanese grooms use native script with Indonesian vocalization (ḥifẓ al-ma'nā ma'a taghyīr al-rasm), legal framework fulfilling comprehension, pronunciation, witness validation, and willingness requirements, institutional adaptation by KUA officials balancing authenticity with accessibility, and theological alignment with Islamic principles of ease (taysīr), concession (rukhṣah), and public interest (maṣlaḥah). Research limitations - The research is limited to one case at KUA Paguyangan; thus, generalization requires caution. However, post-marriage aspects and cultural integration dynamics have not been explored. Originality/value - This research makes an original contribution to the study of Islamic family law in a global context by providing an in-depth analysis of practical solutions to overcome language barriers in religious rituals, which have not received adequate attention in previous academic literature.
