Abstract

Purpose - This study aims to analyze the societal principles of K.H. Hasyim Asy'ari (1871-1947 CE) in his monumental work, Arba'in Hadithan Tata'allaq bi Mabadi Nahdlat al-Ulama. The main focus of this study is how the traditions collected in the book represent social principles and their relevance in contemporary Islamic law and fiqh of the archipelago. The study also explores the tradition of writing forty hadith in Islamic history and the contribution of K.H. Hasyim Asy'ari in enriching the intellectual treasures of Islam in Indonesia. Methods - This research uses the content analysis method with a qualitative approach. The data were analyzed systematically to identify the social principles summarized in the Book of Arba'in Hadithan. This research also pays attention to the historical aspects of hadith codification and the development of Islamic thought in the archipelago. Findings - The study results showed that the tradition of writing forty traditions has been going on since the beginning of the codification of hadith until the time of K.H. Hasyim Asy'ari. The Book of Arba'in Hadithan contains societal principles that emphasize the values of togetherness, justice, and welfare. The hadiths discussed in this book are relevant to contemporary Islamic law and Indonesian fiqh. Contribution/Limitation - This research contributes to understanding the relevance of K.H. Hasyim Asy'ari's thoughts to contemporary Islamic law, especially in Nusantara fiqh. However, this research is still limited to analyzing the Arba'in Hadithan book and has not examined comparisons with other books. Originality/Value - This research enriches the insight into the writing tradition of Nusantara scholars and their contributions to Islamic law. The findings can be a reference for academics and practitioners studying Indonesian fiqh.

Abstract

Purpose - This research analyzes the Nagari system of governance in West Sumatra as an independent customary law system rooted in family and blood relations. In addition, it examines the respect for this system in its day, including by the Dutch colonial government, and its impact on modern regulation. Contemporary Islamic law is also examined in supporting or criticizing this system, particularly concerning justice, deliberation, and leadership. Methods - This research uses a qualitative method with an empirical juridical approach and descriptive analysis. Data were collected through direct observation and recording of social and legal phenomena in Nagari communities. Findings - The results showed that West Sumatra is a village-based customary law society with a unique organizational structure now regulated in Law No. 6 of 2014. The democratic system of the Minangkabau Nagari Community has the disadvantage of being hereditary, which can inhibit more inclusive leadership dynamics. Its political structure tends to be paternalistic, influencing patterns of governance and decision-making. Contribution/Limitation - This research helps to understand the dynamics of the Nagari government system in the context of customary law and the challenges of modernization. In addition, it examines the relevance of this system to contemporary Islamic legal principles, particularly in social justice, leadership transparency, and community participation. However, this research is limited to analysis in West Sumatra and does not include comparisons with other regions. Originality/Value - This research provides insight into the sustainability of the Nagari government system in the face of modern regulations and social dynamics, as well as its relevance in contemporary Islamic law.

Abstract

Purpose - This research aims to analyze the concept of kafa'ah in the Rabithah Alawiyah community in Asahan and to find out the views of the Indonesian Ulema Council (MUI) of Asahan Regency on the marriage of Syarifah with non-Sayyid. In the Rabithah Alawiyah community in Asahan, which still upholds the values of the descendants of the Prophet Muhammad SAW (Ahlul Bait), the concept of kafa'ah is often associated with the prohibition of marriage outside the Sayyid or Syarifa'h community. Methods - This research uses empirical legal methods with a qualitative approach. Data were collected through observation, interviews, and documentation with MUI Asahan Regency, members of the Rabithah Alawiyah community, and individual Syarifahs and Sayyids. Analysis was conducted by exploring legal facts directly to obtain accurate data. Findings - The results showed that in the Rabithah Alawiyah community in Asahan, Syarifah's marriage with non-Sayyids is considered to damage the nasab and not maintain family honor. This is not only because of kafa'ah considerations but also as an effort to preserve the purity of the Prophet's lineage in the contemporary era until the end. Contribution/Limitation of Research - This research provides an understanding of the dynamics of kafa'ah in the Rabithah Alawiyah community and its relevance to contemporary Islamic family law. However, this research is limited to the community in Asahan, so the findings cannot be generalized to other regions. Originality/Value - This research offers a contemporary Islamic Family law perspective on kafa'ah in marriage. The findings can serve as a reference for Islamic law academics and practitioners in understanding the concept of kafa'ah in the modern social context.

Abstract

Bahwa wakaf untuk proyek jalan tol adalah peristiwa yang sudah sering terjadi di Indonesia dan hal tersebut menimbulkan persoalan dalam perspektif Hukum Islam, sehingga artikel ini bertujuan untuk menggali rumusan tentang hukum ruislag tanah wakaf yang berlaku di Indonesia dan pandangan Hukum Islam terhadap tanah wakaf belum bersertifikat yang terdampak proyek pembangunan jalan tol. Penelitian ini dilakukan dengan tujuan untuk mengkaji tentang bagaimana ruislag tanah wakaf menurut hukum yang berlaku di Indonesia dan menjelaskan bagaimana ruislag tanah wakaf belum bersertifikat untuk proyek pembangunan jalan tol dalam perspektif Hukum Islam. Penelitian ini menggunakan penelitian kepustakaan (library research) dengan menggunakan pendekatan yuridis normatif. Teknik pengumpulan data dilakukan dengan cara dokumentasi, kepustakaan dan wawancara. Hasil dari penelitian ini menunjukan bahwa penyebab terjadinya ruislag tanah wakaf di Indonesia disebabkan oleh 2 faktor, yaitu faktor kepentingan pihak tertentu dan faktor kepentingan umum. Ruislag tanah wakaf belum bersertifikat dalam perspektif Hukum Islam tetap sah dengan syarat dan rukun wakaf yang sudah terpenuhi. The endowment of land for toll road projects is a recurring event in Indonesia, and it raises legal issues from an Islamic perspective. Therefore, this article aims to explore the formulation of the law of ruislag tanah wakaf (the transfer of endowment land) in Indonesia and the Islamic perspective on non-certified endowment land affected by toll road construction projects, necessitating the application of ruislag. This research is conducted with the purpose of examining how ruislag tanah wakaf is regulated by the prevailing laws in Indonesia and non-certified endowment land for toll road development projects is viewed from the perspective of Islamic law. This study utilizes library research as a method, employing a normative juridical approach. Data collection techniques include documentation, literature review, and interviews. The findings of this research indicate that the occurrence of ruislag tanah wakaf in Indonesia is caused by two factors: specific interests and public interests. Non-certified ruislag tanah wakaf remains valid from the perspective of Islamic law, provided that the conditions and pillars of the endowment have been fulfilled.

Abstract

Posisi wali dalam sebuah pernikahan merupakan hal yang penting untuk diketahui karena akan memperngaruhi keabsahan pernikahan. Seorang wali yang seharusnya melafadzkan akad dalam pernikahan kerap kali tugas tersebut dilimpahan kepada pihak lain seperti yang dilakukan oleh kebanyakan warga muslim di Kecamatan Purbolingo Kabupaten Lampung Timur, melimpahkan hak walinya kepada petugas KUA (Penghulu) ataupun kiai dan pemuka agama di lingkungan mereka. Mereka tidak terbiasa menikahkan anak perempuannya sendiri. Perilaku demikian itu dianggap sebagai sesuatu yang sah-sah saja atau hal yang biasa terjadi. Bagi mereka hal tersebut tidak dipandang sebagai perbuatan yang menyimpang, namun merupakan solusi atas ketidakmampuan dalam menikahkan anaknya sendiri. Tujuan penelitian ini adalah untuk mengetahui praktik wakalah wali, faktor penyebab wakalah wali, dan untuk menjelaskan perspektifnya dalam sosiologi hukum. Penelitian ini adalah penelitian lapangan (field research) dan bersifat kualitatif.  Pendekatan terpusat pada hal-hal umum yang menjadi dasar munculnya perilaku tertentu dari fenomena yang terjadi dalam masyarakat. Hasil penelitian menemukan bahwa setidaknya ditemukan tiga penyebab mengapa praktik itu terjadi. Pertama, faktor grogi atau khawatir jika sehingga tidak mampu dan merasa tidak pantas untuk menikahkan sendiri anaknya; Kedua, sikap ta’dzim kepada kiai mengingat jasa besar sang kiai kepada keluarga mereka.; Ketiga, disebabkan si wali itu belum pernah menikah atau kalau pun sudah menikah ia belum memiliki cucu, yang menyebabkan si wali tidak sanggup (tidak patut) mewalikan dan menikahkan si pengantin wanita. Dalam perspektif sosiologi hukum, praktik wakalah wali yang biasa dilakukan oleh masyarakat di Kecamatan Purbolinggo nyatanya memiliki nilai maslahat terhadap pelaksanaan hak dan juga kewajiban yang melekat pada diri seorang wali nikah. The position of the guardian in a marriage is important to know because it will affect the validity of the marriage. A guardian who is supposed to recite the marriage contract is often delegated to another party, as is done by most Muslim residents in Purbolingo Subdistrict, East Lampung Regency, delegating their guardianship rights to KUA (Penghulu) officers or kiai and religious leaders in their neighborhood. They are not accustomed to marrying off their own daughters. Such behavior is regarded as something that is valid or common. For them, it is not seen as a deviant act, but a solution to the inability to marry off their own children. The purpose of this study is to find out the practice of wakalah wali, the factors causing wakalah wali, and to explain its perspective in legal sociology. This research is field research and is qualitative in nature.  The approach focuses on the general things that are the basis for the emergence of certain behaviors from phenomena that occur in society.  The research found that there are at least three reasons why this practice occurs. First, the factor of nervousness or worry if so unable and feel inappropriate to marry off their own children; Second, the attitude of ta'dzim to the kiai considering the great service of the kiai to their families; Third, because the guardian has never been married or even if he is married he does not have grandchildren, which causes the guardian to be unable (inappropriate) to marry off the bride. In the perspective of legal sociology, the practice of wakalah wali commonly practiced by the community in Purbolinggo Subdistrict in fact has a maslahat value towards the implementation of the rights and obligations attached to a marriage guardian.

Abstract

Penelitian ini menggali peran ayah dalam pengasuhan anak di konteks pendidikan Islam, dengan fokus pada guru-guru laki-laki di Pondok Pesantren Nurul Arofah Nahdatul Wathan. Seringkali literatur pengasuhan mengabaikan peran ayah, namun studi ini menyoroti pentingnya keterlibatan ayah, baik dalam kehidupan keluarga maupun dalam profesi keguruan. Dengan pendekatan kualitatif dan teknik purposive sampling, penelitian ini mengidentifikasi lima peran ayah: penyedia nafkah, pelindung, pengambil keputusan, pendidik khusus anak, dan pengasuh. Hasil penelitian ini menunjukkan bahwa ayah-guru telah mampu memenuhi peran-peran ini, dengan dua di antaranya mencapai tahap 'keluarga sakinah III' dan dua lainnya mencapai 'keluarga sakinah III plus', sebuah konsep dalam Islam yang merujuk pada keharmonisan keluarga. Temuan ini menegaskan bahwa dalam hukum Islam, pengasuhan anak adalah tanggung jawab bersama antara ayah dan ibu, di mana ayah memiliki peran krusial dalam memastikan pemenuhan kebutuhan dasar, pendidikan, perlindungan, dan pembinaan karakter anak-anak yang selaras dengan nilai-nilai Islam, etika, dan akhlak. Studi ini memberikan wawasan penting tentang dinamika keluarga Muslim dalam konteks pendidikan dan pengasuhan, serta menawarkan perspektif baru tentang keterlibatan ayah dalam membentuk keluarga sakinah. This study delves into the role of fathers in child upbringing within the context of Islamic education, focusing on male teachers at the Nurul Arofah Nahdatul Wathan Islamic Boarding School. Often, parenting literature overlooks the father's role, but this study highlights the importance of paternal involvement, both in family life and in the teaching profession. Employing qualitative methods and purposive sampling techniques, the study identifies five roles of fathers: breadwinner, protector, decision-maker, children's educator, and caregiver. The findings indicate that teacher-fathers have been able to fulfill these roles, with two reaching the stage of 'sakinah family III' and another two achieving 'sakinah family III plus', a concept in Islam that refers to family harmony. These findings assert that in Islamic law, child upbringing is a shared responsibility between father and mother, where the father has a crucial role in ensuring the fulfillment of basic needs, education, protection, and character building of children in alignment with Islamic values, ethics, and morals. This study provides important insights into the dynamics of Muslim families in the context of education and upbringing and offers a new perspective on the father's involvement in forming a harmonious sakinah family.

Abstract

This research investigates two crucial aspects of Indonesian culture, namely the inheritance division traditions in the Betawi and Minangkabau tribes, and how these traditions interact with the Islamic worldview. The research uses a qualitative approach, descriptive methods, and legal, sociological, and philosophical analyses to understand how the inheritance division traditions in these societies reflect the influence of the Islamic Worldview. The results show that both tribes retain elements of their distinctive culture in the division of inheritance, although the influence of Islam is visible in a number of aspects. Although there are differences with Islamic teachings in some respects, the principles of equality and justice remain an integral part of this tradition. Given the complexity of interpreting and implementing religious values in diverse cultural contexts, this research provides a deep insight into the interaction between Islam, adat and inheritance division in Indonesia. The findings of this study provide a basis for further comparisons with other cultural and religious contexts as well as practical implications for strengthening the principles of justice in inheritance systems in these societies. Penelitian ini menginvestigasi dua aspek krusial dalam budaya Indonesia, yaitu tradisi pembagian warisan dalam suku Betawi dan suku Minangkabau, serta bagaimana tradisi-tradisi ini berinteraksi dengan pandangan dunia Islam. Penelitian menggunakan pendekatan kualitatif, metode deskriptif, dan analisis hukum, sosiologis, serta filosofis untuk memahami bagaimana tradisi pembagian warisan dalam masyarakat ini mencerminkan pengaruh Islamic Worldview. Hasil penelitian menunjukkan bahwa kedua suku tersebut mempertahankan unsur-unsur khas budaya mereka dalam pembagian warisan, meskipun pengaruh Islam terlihat dalam sejumlah aspek. Walaupun terdapat perbedaan dengan ajaran Islam dalam beberapa hal, prinsip-prinsip kesetaraan dan keadilan tetap menjadi bagian integral dari tradisi ini. Dengan kompleksitas penafsiran dan implementasi nilai-nilai agama dalam konteks budaya yang beragam, penelitian ini memberikan wawasan yang mendalam mengenai interaksi antara Islam, adat, dan pembagian warisan di Indonesia. Temuan penelitian ini memberikan dasar bagi perbandingan lebih lanjut dengan konteks budaya dan agama lainnya serta implikasi praktis untuk memperkuat prinsip-prinsip keadilan dalam sistem waris di masyarakat ini.

Abstract

Berdasarkan data dari Asosiasi Pencegahan Bunuh Diri Indonesia, faktor utama yang menyebabkan terjadinya kasus bunuh diri adalah keluarga. Mereka terdorong untuk bunuh diri karena masalah yang dihadapi dengan keluarga mereka sendiri. Dalam banyak kasus di Indonesia, keluarga korban yang bunuh diri sering kali menjadi bahan cemoohan. Korban dianggap sebagai manusia yang gila, kurang iman, bahkan disebut sebagai orang kafir. Adapun keluarga korban bunuh diri sering kali menganggap bunuh diri sebagai hal tabu yang menjadi suatu aib. Sedangkan dalam realitanya, percobaan bunuh diri adalah fenomena umum di banyak belahan dunia. Upaya bunuh diri erat kaitannya dengan aspek psikologis dan pengambilan keputusan. Berdasarkan hal tersebut, penelitian ini menganalisa perbandingan perspektif antara Sivitas AkademikaPsikologi dan Hukum Islam di Yogyakarta terhadap kasus bunuh diri. Desain penelitian adalah kualitatif melalui pengisian formulir dan wawancara secara mendalam menggunakan pertanyaan terbuka untuk mendapatkan informasi yang dibutuhkan. Hasil dari penelitian ini menunjukkan bahwa terdapat beragam pandangan dari Para Sivitas AkademikaUniversitas di Yogyakarta. Gangguan mental yang terjadi pada setiap orang memiliki tingkatan yang berbeda- beda. Gangguan mental dengan dorongon untuk bunuh diri bukanlah suatu aib yang harus ditutupi, tetapi hendaknya dicari penyelesaian terbaik. Faktor keluarga yang mendominasi pengaruh seseorang untuk bunuh diri, disisi lain keluarga juga menjadi support system yang dapat mencegah seseorang untuk melakukan bunuh diri. Peran agama dalam pencegahan gangguan mental dan kecenderungan untuk bunuh diri menjadi faktor penting lainnya. Pendekatan yang dilakukan tidak hanya agama dilihat dari segi hukum melaikan juga dengan penekanan pada keberagamaan (religiositas). Penanaman ini juga dapat menggunakan beragam metode yang sesuai dengan penyandang gangguan kesehatan mental, tidak melalui ceramah ancaman, tetapi lebih kepada dorongan dan motivasi akan kebaikan dan kebahagiaan yang diajarkan oleh agama.

Penelitian akan mengupas persoalan poligami dalam kerangka hukum Nasional, yang secara normatif menghendaki terealisasikannya asas monogami, melalui redaksi formal undang-undang perkawinan No. 1/1974 Pasal 1 (3) dimana laki-laki dan perempuan menikahi satu pasangan dalam satu kurun waktu pernikahan dengan tidak ada tandingan dalam jumlah. Sedangkan faktualnya, ada tumpang tindih aturan, melihat poligami dalam paradigma fikih konservatif tidak pernah memasuki ranah "haram" selama dijalankan sesuai ketentuan yang meliputinya berlandaskan penafsiran ayat 3 Qur'an surah an-Nisā dengan indikasi kebolehan beristri lebih dari satu meskipun tidak menganjurkan dan mencegahnya, sesuai asbāb al-nuzūl-nya perlindungan hukum bagi anak-anak yatim yang disalahgunakan oleh para walinya setelah ditinggal mati kedua orang tua dalam peperangan. Maka tujuan yang hendak dicapai, adalah membedah konkret konsepsi poligami yang hendak disampaikan Qur'an dan keadilan yang menjadi syarat primernya, dikorelasikan dengan formalisasi hukum Islam di era modern dalam peraturan kompilasi perundang-undangan yang mentransformasikan hukum-hukum fikih. Penelitian menerapkan metode kualitatif berbasis pendekatan kepustakaan merujuk pada berbagai literatur ilmiah terhadap suatu norma hukum berlaku secara yuridis normatif (doctrinal) dari ragam sumber data terkini dan terdahulu yang masih relevan. Berangkat dari temuan seperangkat aturan hukum poligami dalam Kompilasi Hukum Islam (KHI) mengenai prosedural ketat yang mengarah pada kebolehan (Buku I Bab IX Pasal 55-59), UUP dan pelaksanaannya dalam PP No. 9/1974 Bab VIII (Pasal 41-44), sampai kultur masyarakat yang belum mengindahkan dan memandang hukum positif sebelah mata sehingga poligami ramai dilaksanakan di bawah tangan, saat tujuan sakīnah, mawaddah, dan raḥmah tidak lagi dirasakan pada satu istri. Syariat yang mulanya bertitik tolak pada bagaimana keadilan ditegakan dalam keluarga poligamis, mulai bergeser pada kemaslahatan lain sesuai perkembangan zaman.   The research will explore the issue of polygamy within the framework of national law, which normatively requires the realization of the principle of monogamy, through the formal wording of marriage law No. 1/1974 Article 1 (3) where men and women marry one partner in one period of marriage with no match in number. While in fact, there seems to be an overlap of rules, looking at the conservative fiqh paradigm polygamy never enters the realm of "haram" as long as it is carried out according to the provisions that cover it, based on the interpretation of verse 3 of the Qur'an surah an-Nisā with an indication of the permissibility of having more than one wife even though it does not encourage and prevent it, according to the asbāb al-nuzūl of legal protection for orphans who are abused by their guardians after the death of both parents in war. The purpose of this study is to dissect the conception of polygamy that the Qur'an wants to convey and the justice that is the primary requirement, correlated with the formalization of Islamic law in the modern era in the compilation of legislation that transforms the laws of fiqh. The research applies a qualitative method based on a literature approach referring to various scientific literature on a legal norm applicable juridically normative (doctrinal) from a variety of current and previous data sources that are still relevant. Starting from the findings of a set of legal rules for polygamy in the Compilation of Islamic Law (KHI) regarding strict procedures that lead to permissibility (Book I Chapter IX Articles 55-59), UUP and its implementation in PP No. 9/1974 Chapter VIII (Articles 41-44), to the culture of the community that has not heeded and underestimated positive law so that polygamy is often carried out under the hand, when the goal of sakīnah, mawaddah, and raḥmah is no longer felt in one wife. The Shari'ah, which was originally based on how justice was upheld in polygamous families, began to shift to other benefits according to the times.

Abstract

This paper discusses the role of obligatory bequests in the context of the relationship between a secret wife in the context of polygamous marriage outside the judicial procedure, with an emphasis on maintaining equality and justice, within the framework of understanding Maqasid Sharia. A secret wife is a complex issue in the implementation of Islamic family law in Indonesia, and this research outlines the concept of obligatory bequests and their role in maintaining a balance of inheritance between a legitimate wife and a secret wife. By using the principles of equality and justice in Islam as a guide, this research illustrates how the path of obligatory bequests can lead to a more equitable distribution of inheritance among heirs. Additionally, this paper integrates the concept of Maqasid Sharia as a philosophical foundation for understanding the importance of maintaining equality and justice in Islamic inheritance law. The results of this writing are expected to provide deeper insights into how the concept of obligatory bequests can contribute meaningfully to achieving the highest goals of Maqashid Sharia, including ensuring equality and justice in the distribution of inheritance for secret wives in polygamous marriages outside the judicial procedure.
