Abstract

It has become customary nowadays for the engagement event to be celebrated with an official ceremony that consumes large expenses accompanied by the giving of valuable and luxurious gifts. The question arises whether the expenses that may be incurred or any losses that may arise during the period before the engagement is called off can be claimed as well as whether the engagement gift may be returned due to humiliation and embarrassment that the party must bear in consequence of the cancellation of engagement. This study aims to explain the concept of breach of betrothal from Syariah and a legal perspective. The paper will analyse the issue from a Syariah point of view and at the same time evaluate the statute in Malaysia between Syariah and civil law related to the matter as well as supported by the case law. A qualitative methodology was employed to analyse the data including books, articles, websites, and the internet. This study conducted interviews with a lawyer and 2 academics. Results findings show that the Islamic Family Law Act or Enactment only applies to Muslims in the Syariah court while non-Muslims are dealt with under the Contract Act 1950 in Civil court relating to betrothal in Malaysia. This study recommends the resolution of the issue of breach of betrothal in Malaysia to create a harmonious Malaysian society as well as to reduce the cases of breaking a promise to marry in the society.

Abstract

Terdapat dasar pertimbangan dan amar putusan yang berbeda antara putusan Pengadilan Agama Bantaeng No. 329/Pdt.G/2020/PA.Batg jo Putusan PTA Makassar No. 82/Pdt.G/2021/PTA.Mks jo Putusan MA No. 34K/Pdt.G/2022 yang berkaitan dengan bagian ahli waris dzawil arham ketika pewaris meninggalkan wasiat yang melebihi 1/3 dari harta warisan. Hukum kewarisan Islam di Indonesia dalam KHI maupun yurisprudensi, belum mengatur secara jelas kedudukan ahli waris dzawil arham serta bagiannya ketika tidak ada ahli waris dzawil furudh dan ashabah, serta bagiannya ketika pewaris meninggalkan wasiat yang melebihi 1/3 harta warisan. Penelitian ini bertujuan untuk mengetahui kedudukan ahli waris dzawil arham dalam perspektif hukum kewarisan Islam. Jenis penelitian ini adalah penelitian yuridis normatif karena didominasi analisis terhadap data sekuder meliputi bahan hukum primer dan sekunder. Hasil penelitian memperlihatkan bahwa kedudukan ahli waris dzawil arham beserta bagiannya tidak secara spesifik ditegaskan dalam KHI dan Buku II MA. Putusan PA Bantaeng No. 329/Pdt.G/2020/PA hanya mempertimbangkan tentang pemberian wasiat kepada lembaga keagamaan yang melebihi sepertiga dari harta warisan yang tidak sesuai dengan ketentuan Pasal 201 KHI. Putusan PTA Makassar No. 82/Pdt.G/2021/PTA.Mks lebih mengadopsi pendapat Abu Hanifah dan Imam Ahmad yang memberikan hak waris kepada ahli waris dzawil arham ketika tidak terdapat ahli waris dzawil furudh dan ashabah, sedangkan Putusan MA No. 34K/Pdt.G/2022 menguatkan putusan Pengadilan Tinggi Agama Makassar.    There are different basic considerations and rulings between the decisions of the Bantaeng Religious Court No. 329/Pdt.G/2020/PA.Batg in conjunction with Makassar PTA Decision No. 82/Pdt.G/2021/PTA.Mks in conjunction with Supreme Court Decision No. 34K/Pdt.G/2022 which relates to the share of dzawil arham heirs when the testator leaves a will that exceeds 1/3 of the inheritance. Islamic inheritance law in Indonesia in KHI and jurisprudence does not clearly regulate the position of dzawil arham heirs and their share when there are no dzawil furudh and ashabah heirs, as well as their share when the heir leaves a will that exceeds 1/3 of the inheritance. This study aims to determine the position of dzawil arham heirs in the perspective of Islamic inheritance law. This type of research is normative juridical research because it is dominated by analysis of secondary data including primary and secondary legal materials. The research results show that the position of the heirs of dzawil arham and their shares is not specifically confirmed in the KHI and Book II of the MA. Bantaeng PA Decision No. 329/Pdt.G/2020/PA only considers granting a will to a religious institution that exceeds one third of the inheritance which is not in accordance with the provisions of Article 201 KHI. Makassar PTA Decision No. 82/Pdt.G/2021/PTA.Mks adopts the opinion of Abu Hanifah and Imam Ahmad which emphasizes the heirs of dzawil arham when there are no heirs of dzawil furudh and ashabah and Supreme Court Decision No. 34k/Pdt.G/2022 strengthens the decision of the Makassar Religious High Court.

Abstract

Perkembangan teknologi dalam bidang reproduksi telah menghasilkan praktik sewa rahim, yang memungkinkan kehamilan terjadi di luar cara alami. Namun, praktik ini sering menjadi subjek kontroversial yang melibatkan aspek hukum, terutama mengenai status anak hasil sewa rahim (surogasi). Artikel ini membahas masalah utama mengenai legalitas dan pembagian hak waris anak tersebut dalam konteks dualisme hukum di Indonesia. Metode penelitian yang digunakan adalah normatif dengan pendekatan Konseptual dan Perundang-undangan. Analisis yang digunakan bersifat preskriptif, yaitu memberikan argumentasi hukum melalui penilaian. Hadirnyaipenelitian ini adalah untuk memperoleh pemahaman yang lebih mendalam terkait suatu fenomena serta dapat memecahkan masalah. Hasil penelitian menunjukkan bahwa Indonesia memiliki dualisme hukum, yaitu hukum positif dan hukum Islam. Hukum positif diterapkan secara nasional tanpa memandang agama yang dianut masyarakat, sementara hukum Islam diterapkan khusus bagi masyarakat yang beragama Islam. Legalitas anak hasil surogasi dalam dualisme hukum ini memiliki kesamaan dan perbedaan. Dalam hal pembagian hak waris, terdapat kesamaan, yaitu mempertimbangkan status ibu pengganti (surrogate mother). Namun, penting untuk melakukan pemilihan hukum (choice of law) guna mencapai cita hukum.   The development of technology in the field of reproduction has resulted in the practice of surrogacy, which allows pregnancy to occur outside of natural means. However, this practice often becomes a controversial subject involving legal aspects, particularly concerning the status of children born through surrogacy. This article discusses the main issues regarding the legality and inheritance rights of such children within the context of the dual legal system in Indonesia. The research method used is normative with a Conceptual and Statute Approach. The analysis used is prescriptive, providing legal arguments through assessment. The purpose of this research is to gain a deeper understanding of a phenomenon and to solve related problems. The research findings indicate that Indonesia has a dual legal system, consisting of positive law and Islamic law. Positive law is applied nationally regardless of the religion of the community, while Islamic law is applied specifically to the Muslim community. The legality of children born through surrogacy within this dual legal system shows both similarities and differences. Regarding inheritance rights, there is a similarity in that the status of the surrogate mother is considered. However, it is important to make a choice of law to achieve justice, benefit, and legal certainty for the community.

Abstract

Tujuan penelitian ini adalah untuk menganalisis relevansi kedudukan advokat sebagai penegak hukum dalam perspektif hukum Islam. Jenis penelitian yang digunakan adalah penelitian kepustakaan dengan pendekatan normatif, sejarah, dan sosiologis. Hasil penelitian menyimpulkan bahwa relevansi kedudukan advokat sebagai penegak hukum perspektif hukum Islam dapat terbaca melalui dua analisis. Pertama, analisis peran advokat sebagai penegak hukum di Indonesia dalam perspektif Islam yakni: a. bahwa advokat memiliki peran yang sangat vital dalam memberikan pelindungan agar tercapainya maqâṣid syari’ah. b. bahwa Allah memerintahkan para hambanya (advokat yang beriman) untuk menjadi penegak keadilan, tidak cenderung kekanan maupun kekiri, bersungguh-sungguh dan tidak menyimpang pada aturan. Kedua, analisis kedudukan dan fungsi advokat dikaitkan dengan lembaga Hakam, Mufti, dan Muṣlih ‘alaih yang dikenal dalam Islam. Bahwa lembaga Hakam, Mufti, dan Muṣlih ‘alaih memiliki kesamaan fungsi dengan advokat. The purpose of this study was to analyze the relevance of the position of advocates as law enforcers in the perspective of Islamic law. The type of research used is literature research with normative, historical, and sociological approaches. The results of this study suggest that the relevance of the position of advocates as law enforcers from the perspective of Islamic law can be seen by means of analysis. First, the analysis of the role of advocates as law enforcers in Indonesia in the Islamic perspective is: a. that advocates have a very vital role so that they can be advocates for maqashid al-syari’ah. b.that Allah commands His servants (believing advocates) to be enforcers of justice, not inclined to friendship or leftists, earnest and not keeping the rules. Second, the analysis of the position and function of advocates is associated with the boards of Hakam, Mufti, and Muṣlih ‘alaih known in Islam. The Hakam, Mufti, and Muṣlih ‘alaih institutions function as advocates.

Abstract

Batasan usia perkawinan di Indonesia diatur oleh Undang-Undang dengan menyebut batas usia yang pasti, tetapi dalam Islam tidak ada menyebutkan terkait yang pasti mengenai batas usia perkawinan. Perbedaan pandangan antara hukum Islam dan positif menimbulkan keraguan terkait perkawinan anak khususnya pada kasus pasangan muda yang hamil diluar kawin. Dispensasi kawin menjadi alternatif bagi mereka yang tidak sesuai usia minimal untuk kawin. Penelitian ini bertujuan untuk menganalisis prosedur dispensasi kawin untuk yang kawin di bawah usia yang diperbolehkan dan akibat hukum akibat penetapan hakim menurut hukum perdata dan hukum Islam. Penelitian ini merupakan penelitian jenis yuridis normative, bersifat analitis deskriptif dengan pendekatan kasus (case approach) dan pendekatan konseptual (conseptual approach). Data sekunder, yang terdiri dari bahan hukum primer, sekunder, dan tersier yang relevan dengan masalah ini kemudian analisis data kualitatif. Hasil penelitian ini menjelaskan bahwa prosedur pengajuan dispensasi kawin melibatkan persyaratan administrasi dan tahapan pengajuan yang harus dilaksanakan. Kemudian, akibat hukum dari Hakim mengabulkan dan menolak dispensasi kawin meliputi akibat secara perdata dan hukum Islam. Dimana secara perdata adanya penetapan dari Hakim berupa ditolak dan diterima yang berguna untuk syarat melangsungkan perkawinan di KUA. Kemudian akibat secara Hukum islam berkaitan dengan status perkawinan, harta perkawinan, status anak, hak waris, nasab serta wali anak. The age limit for marriage in Indonesia is regulated by law by mentioning a definite age limit, but in Islam there is no mention regarding the exact age limit for marriage. The difference in views between Islamic and positive law raises doubts regarding child marriage, especially in the case of young couples who are pregnant outside of marriage. Dispensation of marriage is an alternative for those who do not meet the minimum age for marriage. This study aims to analyse the procedure for dispensation of marriage for those who marry under the permitted age and the legal consequences of the judge's decision according to civil law and Islamic law. This research is normative juridical research, descriptive analytical in nature with a case approach and conceptual approach. Secondary data, consisting of primary, secondary, and tertiary legal materials relevant to this issue then qualitative data analysis. The results of this study explain that the procedure for applying for marriage dispensation involves administrative requirements and the stages of submission that must be carried out. Then, the legal consequences of the Judge granting and refusing marriage dispensation include civil consequences and Islamic law. Where in civil law there is a determination from the Judge in the form of being rejected and accepted which is useful for the conditions for marrying at the KUA. Then the consequences in Islamic law are related to marital status, marital property, child status, inheritance rights, nasab and child guardians.

Abstract

Purpose - This study aims to analyze the implementation of marriage guidance in the Religious Affairs Office (KUA) of the East Padang Sub-district and identify the inhibiting factors. This study also examines the relevance of marriage guidance from the perspective of contemporary family law, especially in improving family resilience by understanding the rights and obligations of husbands and wives. Methods: This research is qualitative field research. Data were collected through interviews with the Religious Affairs Office Staff, prospective brides, and other resources involved in marriage guidance. The descriptive analysis method was used to understand the implementation patterns and constraints of this guidance program. Findings - The results showed that marriage guidance at the Religious Affairs Office (KUA) of East Padang Sub-district was conducted one week before the marriage contract. The material presented includes household development, responsibilities and obligations of husbands and wives, educating children, and worship in the household. The delivery of the material involved the KUA, the Health Office, BKKBN, religious counselors, and traditional leaders using lectures, questions and answers, and discussions. The main inhibiting factors were the discipline of the bride and groom and a lack of awareness of the importance of marriage guidance. Contributions/Limitations - This study contributes to understanding the role of marriage guidance in building family resilience when facing challenges in the contemporary era. The findings can serve as a reference for policymakers seeking to improve the effectiveness of marriage guidance in Indonesia.

Abstract

Purpose - This research aims to analyze the application of Maqāṣid al-Sharīʿah principles according to al-Shatibi in the context of the halal lifestyle in the digital era. The main focus of this research is how digital technology, such as halal e-commerce platforms and digital halal marker applications, can facilitate access and transparency of halal products. In addition, this study examines the relevance of Maqāṣid al-Sharīʿah principles in the contemporary Islamic legal framework in facing the challenges of regulation and validity of halal information. Methods - This research uses a qualitative method with a literature review approach and case analysis. Data is collected through literature studies related to digital halal regulations and studies on technology implementation in supporting halal lifestyles. Findings - The results show that digital technology plays a role in strengthening halal lifestyles through innovations that increase accessibility and transparency. However, challenges such as unverified information, evolving regulations, and potential deviations from Shariah principles must be addressed. Collaboration between government, industry, and society is key to overcoming these challenges. Contribution/Limitation - This research contributes to understanding the relationship between Maqāṣid al-Sharīʿah, digital technology, and contemporary Islamic law in supporting halal lifestyle. However, this research is still limited to literature analysis and does not include empirical research on halal technology users in Indonesia. Originality/Value - This research offers new insights into the integration of technology in the principles of Maqāṣid al-Sharīʿah in contemporary Islamic law.

Abstract

Kesadaran Hukum sering menjadi persoalan yang serius di sebuah negara, karena Hukum dan kesadaran merupakan hal yang saling berkaitan. Program desa sadar hukum menjadi sebuah Upaya untuk memberikan pemahaman dan kesadaran Masyarakat terhadap hukum. Seperti di Desa Kiarapedes yang telah menerapkan program Desa sadar hukum dari beberapa tahun ke belakang. Dengan itu program Desa sadar hukum diharapkan untuk bisa membantu menyelesaikan permasalahan hukum di lingkungan Masyarakat. Tujuan Penelitian untuk menganalisis implementasi Desa sadar hukum di Desa Kiarapedes Kecamatan Kiarapedes Kabupaten Purwakarta. Metode penelitian ini menggunakan pendekatan kualitatif yang bersifat deskriptif. Adapun peneliti melakukan wawancara untuk mencari data yang kemudian disusun secara deskriptif sehingga menemukan sebuah pemecahan masalah yang sedang diteliti. Implementasi Porgram desa sadar hukum di desa kiarapedes telah menghasilkan program yang bernama majelis budaya. Program tersebut bertujuan untuk membantu Masyarakat yang sedang terkena persoalan hukum seperti sengketa perdata, pidana, perbedaan pendapat dan peroslan hukum lainnya. Program desa sadar hukum bila ditinjau dari perspektif siyasah dusturiyah memiliki relevansi yang kuat. Bahwa dalam islam untuk membangun sebuah peradaban tentunya harus memiliki sebuah aturan dan norma hukum. Hal ini bertujuan untuk menjaga dari tindakan kesewenang-wenangan terhadap hak-hak individu Masyarakat. Maka dengan itu program desa sadar hukum bila ditinjau dari siyasah dusturiyah memiliki pengertian yang sama, yakni sama-sama sepakat bahwa untuk membangun sebuah peradaban harus memiliki aturan dan norma hukum, kemudian aturan dan norma hukum tersebut tentu lah harus di implementasikan dengan memiliki rasa kesadaran terhadap aturan dan norma yang berlaku. Kebaharuan dalam penelitian ini adalah pisau analisis yang digunakan untuk menganalisis implementasi desa sadar hukum di Desa Kiarapedes Kiarapedes Kecamatan Kiarapedes Kabupaten Purwakarta dengan menggunakan tinjauan siyasah dusturiyah.

Abstract

Perlindungan hak anak sangat penting, termasuk anak dari perkawinan siri. Pencatatan perkawinan diperlukanuntuk menjamin hak-hak istri dan anak secara hukum negara. Oleh karena itu, peneliti tertarik untuk menelititerkait bagaimana proses perlindungan hukum terhadap pengakuan dan pengesahan anak yang lahir dariperkawinan siri. Perlindungan hukum terhadap anak dari perkawinan siri dapat dilakukan melalui 2 (dua) carautama, yaitu penetapan asal usul anak yang memberikan status hukum dan hak keperdataan pada anak danpengesahan perkawinan/Itsbat nikah yang mengesahkan perkawinan siri secara hukum negara. Kedua proses inibertujuan untuk melindungi hak-hak anak yang lahir dari perkawinan siri dan pengakuan legal. Penelitian inidilaksanakan dengan menggunakan metode pendekatan yuridis normatif. Teknik pengumpulan data yangdigunakan peneliti yaitu interview dengan hakim pengadilan agama semarang. Metode analisis data dalampenelitian ini akan disusun secara sistematis dan pendekatan kualitatif. Fokusnya pada proses pengakuan danpengesahan anak, serta pentingnya pencatatan perkawinan untuk menjamin hak-hak keluarga. Hasil penelitianmenunjukkan bahwa pengakuan dan pengesahan anak dari perkawinan siri di Semarang semakin meningkat,melalui permohonan asal usul anak dan itsbat nikah di Pengadilan Agama Semarang. Proses ini memberikankepastian hukum, melindungi hak anak, dan memungkinkan penerbitan akta kelahiran. Pengadilan AgamaSemarang telah memfasilitasi proses pengakuan anak dan pengesahan perkawinan/Itsbat nikah, danmemungkinkan anak memperoleh akta kelahiran sebagai bukti keabsahan statusnya di Dispendukcapil. Bagihukum penelitian ini masyrakat hendaknya memahami dampak negatif dari perkawinan siri dan melakukanpencatatan perkawinan sesuai dengan perundang-undangan yang berlaku.

Abstract

This study aims to describe and analyze the recommended times for sexual intercourse as outlined in the bookQurrah Al-'Uyūn bi Syarḥ Naẓm Ibni Yāmūn. A common misconception exists that the best time forintercourse is solely on Friday night due to its supposed spiritual rewards. This research, which is of the libraryresearch type, utilizes secondary data sources, primarily the book Qurrah al-'Uyūn bi Syarḥ Naẓm Ibni Yāmūnby Shaykh Abū Muhammad At-Tihāmī bin Madānī. Content analysis was employed to examine the data. Thefindings reveal that Shaykh At-Tihāmī emphasized that there is no specific time restriction for sexual intercourse,meaning it can be conducted at any time, whether day or night. Despite the permissibility of intercourse at anytime, Shaykh At-Tihāmī identifies certain preferable times, including the beginning and end of the night, Fridaynight, Monday night, and the month of Shawwal. A sahih hadith narrated by Muslim corroborates this, notingthat the Prophet married and consummated his marriage with Aisha during Shawwal. This study contributes tothe theoretical understanding of recommended times for sexual intercourse.
