Abstract

The role and responsibility of fishing vessel captains in Indonesia, especially regarding the obligation to have a Sailing License (SPB) as a legal requirement to be able to sail. The captain as the main worker of the ship owner has a great responsibility in maintaining the safety of the ship, cargo, and crew. The SPB Ordinance is regulated by Law No. 17 of 2008, but violations of these obligations still often occur, resulting in marine accidents. This study aims to evaluate the effectiveness of criminal sanctions applied to skippers who sail without a license, as well as analyze the factors that affect the skipper's legal awareness. The legal research method used is an empirical legal approach by accumulating data through observation and interviews. The results of the study show that even though criminal sanctions have been implemented, violations still occur due to a lack of understanding of the law and economic challenges. Therefore, preventive efforts such as legal socialization and improvement of licensing services are needed to encourage compliance with regulations. This scientific paper is expected to be able to provide recommendations for policymakers in formulating more effective and sustainable law enforcement strategies in the fisheries sector.

Abstract

The natural stone industry in Cirebon Regency plays an important role in supporting local economic growth, but has the potential to cause environmental pollution due to suboptimal waste management. The Regional Government of Cirebon Regency has established Regional Regulation Number 6 of 2016 as the foundation for environmental management and protection. This study aims to evaluate the implementation of these regulations in the supervision and management of waste by natural stone industry players and examine the effectiveness of the role of local governments in its implementation. The method used is normative juridical with a qualitative approach through interviews, observations, and document studies. The results of the study show that there are still many industry players who dispose of waste directly into the environment without adequate treatment processes. Weakness in supervision, limited processing facilities, and low environmental awareness are the main causes. This study shows the need to improve the regional supervision system through cross-sector coordination, increasing the frequency of field inspections, and consistent enforcement of administrative sanctions. In addition, it is necessary to develop adaptive technical policies with a participatory approach, as well as improve communal WWTP so that waste management runs more effectively and equitably. This research also emphasizes the importance of building awareness of industry players through intensive socialization, community-based coaching, and encouraging the use of waste as an alternative raw material with economic value.

Abstract

The intensifying geopolitical competition amid the current multipolar global order has elevated the risk of interstate armed conflicts, exemplified by the Russia-Ukraine war in 2022. This conflict has triggered significant food and energy inflation worldwide, resulting in approximately 70 million people losing access to electricity. Understanding the interplay between geopolitical events and the energy crisis is essential for nations to develop effective anticipation, coping, and adaptation strategies aimed at preserving national energy security, particularly concerning petroleum commodities. This study explores critical energy security strategies focusing on supply-side measures such as energy diversification, energy transition, diversification of import sources, and the enhancement of strategic reserves. Additionally, the research examines the role of targeted subsidies as a fiscal tool to stabilize consumer purchasing power and maintain demand within the constraints of national fiscal capacity. Employing a qualitative approach through literature review and policy analysis, this study synthesizes existing frameworks and practices to propose comprehensive strategies for energy resilience in the face of geopolitical risks. The findings highlight the necessity of a multifaceted approach that integrates supply diversification with fiscal policies to ensure energy security. The implications underscore the importance for policymakers to strengthen energy systems' adaptability and fiscal mechanisms to mitigate the impacts of global geopolitical disruptions.

Abstract

Restorative Justice (RJ) is a non-litigation approach to resolving criminal cases that focuses on repairing the harm caused by the crime while fostering reconciliation between the victim and perpetrator. This study examines the implementation of RJ in a theft case under Article 363 of the Criminal Code in Cirebon in 2024. The purpose of this research is to evaluate how the police utilized RJ to address the theft and prioritize the rights of the victims while holding the perpetrators accountable. Using an empirical juridical method, this study analyzes the application of RJ through interviews conducted at the Kedawung Police Station, examining both legal frameworks and practical application. The results indicate that RJ offers an effective, faster, and more cost-efficient resolution for cases like petty theft, promoting victim recovery and perpetrator accountability. The case was successfully resolved when the perpetrator agreed to compensate for the stolen goods and return the victim’s losses through a family-based agreement, fulfilling both material and formal requirements as stipulated in the National Police Regulation No. 8/2021. The study concludes that RJ can be a progressive alternative for resolving criminal cases, though challenges such as community resistance and the need for law enforcement training remain potential barriers to its broader application.

Abstract

This study aims to examine in depth the implementation of green practices at Shanti Restaurant in North Jakarta as an effort to support sustainable tourism. Utilizing a qualitative approach with a case study method, data were collected through observation, documentation, and in-depth interviews with two main informants: the Head Store and the Barista. The findings indicate that Shanti Restaurant has applied three primary dimensions of green practices: Green Action, Green Food, and Green Donation. In terms of Green Action, the restaurant manages organic waste through a composting system, reduces the use of single-use plastics, and repurposes non-organic waste such as used skewers into handcrafted decorations. Regarding Green Food, the restaurant sources organic ingredients from its own garden and local producers, and creates flexible menus based on seasonal availability and garden yields. Meanwhile, Green Donation is realized through environmental activities such as mangrove planting, participation in community-based environmental programs, and the dissemination of educational messages through visual media to foster environmental awareness. The study recommends strengthening partnerships with local suppliers to ensure sustainable sourcing, allocating modest CSR (Corporate Social Responsibility) funding for environmental initiatives, and expanding educational engagement with consumers to enhance the overall impact of sustainability practices.

Abstract

This study aims to examine the implementation of food waste management practices in the pastry department of The Westin Jakarta Hotel by employing the food waste hierarchy framework, which encompasses five dimensions: prevention, reuse, recycling, recovery, and disposal. The research adopts an applied qualitative approach, utilizing data triangulation through observation, in-depth interviews, and document analysis. Key informants include the sous chef, chef de partie, and waste management staff. Data were analyzed using an interactive analysis model, which consists of data collection, data reduction, data display, and conclusion drawing. Findings indicate that, within the prevention dimension, production planning based on forecasting, along with the implementation of FIFO (First In, First Out) and FEFO (First Expired, First Out) systems, has proven effective in minimizing raw material waste. In the reuse dimension, efforts to repurpose leftover dough and unsold products have been implemented, although on a limited scale. For the recycling dimension, used cooking oil from pastry production is collected and handed over to relevant parties for further processing. The recovery dimension is reflected in the use of leftover pastry products as feed for maggots, albeit still at a small scale, while used oil is sold to an external partner for conversion into biodiesel. Waste disposal is carried out through the separation of organic and inorganic waste, in collaboration with third-party service providers to ensure environmentally responsible waste management. Overall, while a range of positive practices have been adopted, improvements are needed in technological integration and the establishment of more efficient partnerships to better support hotel operations and environmental sustainability.

Abstract

This study aims to analyze the effect of profit persistence, book-tax differences, and capital structure on profit quality, with accounting conservatism serving as a moderating variable. Utilizing secondary data from the financial statements of service companies listed on the Indonesia Stock Exchange during the 2021-2023 period, the research employs a quantitative method with a causal design. The findings indicate that profit persistence has a positive effect on profit quality, suggesting that stable earnings are perceived as high-quality profits. Conversely, book-tax differences do not significantly impact profit quality, indicating that legal policy differences rather than manipulation may explain this relationship. Additionally, capital structure is shown to have a negative effect on profit quality, as higher debt levels may raise financial risk and lower market reactions to profits. Importantly, accounting conservatism is found to moderate the relationship between profit persistence and profit quality, as well as between book-tax differences and profit quality. Furthermore, it enhances the relationship between capital structure and profit quality, indicating that conservative accounting practices can improve the reliability of reported profits. This research provides valuable insights for investors and corporate management, highlighting the importance of profit quality and the need for effective management strategies to enhance financial reporting.
