Abstract

This study aims to analyze the strategic role of the Inspectorate as the internal supervisor of the local government of Mandailing Natal Regency in supporting good governance. This study uses a qualitative approach with data collection techniques through in-depth interviews, document studies, and observations. The data was analyzed descriptively to identify the role of the Inspectorate, the legal basis that supports it, and the inhibiting factors faced. The results of the study show that the Inspectorate has a strong legal foundation, including Law Number 23 of 2014, Government Regulation Number 60 of 2008 concerning SPIP, and related regional regulations. The strategic role of the Inspectorate includes supervising the implementation of regional policies, preventing corruption, evaluating OPD performance, and early detection of potential risks. However, the implementation of the supervisory function faces several obstacles, such as limited human resources, lack of budget, suboptimal technology, and intervention from external parties. These findings are in line with the theory of internal oversight which emphasizes the importance of independence, transparency, and accountability in government management. This study recommends strengthening human resource capacity, optimizing information technology, increasing budget allocation, and protecting the independence of the Inspectorate. In conclusion, the Mandailing Natal Regency Inspectorate has an important role in creating a transparent and accountable government. However, to optimize this role, commitment from various parties is needed to overcome existing obstacles.

Abstract

This study aims to analyze the inhibiting factors of the performance of the Government Internal Supervisory Apparatus (APIP) in realizing the principles of good governance in the Mandailing Natal Regency Inspectorate. Good governance is one of the main pillars in creating a transparent, accountable, and responsive government to the needs of the community. However, its implementation often faces various obstacles that affect the performance of APIP as an internal supervisor. This research method uses a qualitative approach with data collection techniques through in-depth interviews, observations, and document studies. The results of the study indicate that there are several main inhibiting factors, including: limited competent human resources, lack of budget support, weak independence of APIP in carrying out its duties, and resistance from the supervised organization. In addition, the low utilization of information technology in the supervision process is also a significant obstacle. This study concludes that to improve APIP performance in realizing good governance, it is necessary to strengthen human resource capacity through training, increase budget allocation, guarantee APIP independence, and optimize information technology. Strategic recommendations from this study are expected to be a reference for local governments in improving the internal supervision system in order to achieve better governance.

Abstract

Fuel oil (BBM) subsidy policy in Indonesia has been an important element in economic policy since the era of President Soeharto's administration. Initially, this subsidy was aimed at maintaining energy price stability and protecting people's purchasing power, especially low-income groups. However, over time, fuel subsidies have created various economic and environmental problems, including a large burden on the State Revenue and Expenditure Budget (APBN), economic distortions, and obstacles to the renewable energy transition. This research uses a normative legal approach to analyze fuel subsidy policies within the framework of the welfare state in Indonesia, with the aim of formulating more effective regulations. The data used is primary, secondary and tertiary legal materials which are analyzed descriptively-analytically. The research results show that the fuel subsidy policy has not been effective and efficient, with most of the benefits being enjoyed by the middle and upper income groups, while those who should benefit, namely the poor, are left behind. Therefore, it is necessary to reformulate fuel subsidy policies with the principles of social justice, economic sustainability, transparency and accountability. Formulating more targeted policies, developing renewable energy, and implementing the principles of good governance will strengthen the welfare state and support more equitable and sustainable development.

Abstract

This article analyses the nuclear energy policy model relevant to such countries as the United States of America, Russia, France and Japan. Moreover, this article also considers the international organizations, for example the International Atomic Energy Agency, as the supervising body in the field of nuclear energy programs and their security. The process of developing nuclear energy program must be well planned and must incorporate security, safety and environmental factors. Consequently, this nuclear energy policy must address all factors technical, economic, social-political and environmental factors underlying nuclear energy production.In this case, the IAEA and other international organizations contributing to stable and secure nuclear power usage are quite significant to the fulfillment of this requirement.great potential as an energy source that can reduce dependence on the use of fossil energy sources that are increasingly scarce and are often claimed to cause environmental damage. However, the use of nuclear energy also has risks that must be managed properly, such as nuclear accidents and the risk of terrorism. Several countries have developed their nuclear programs with the aim of meeting domestic energy needs and also as a national defense strategy. However, the development of this nuclear energy program also poses challenges in terms of security and safety. This article discusses the nuclear energy policy model that has been implemented in countries such as the United States, Russia, France, and Japan.

Abstract

Binjai Mayor Regulation Number 9 of 2022 concerning the Protection of Women and Children from Violence is a strategic policy to overcome the high rate of violence against these vulnerable groups. This research aims to analyze the implementation of policies, the challenges faced, and the necessary improvement measures. The research uses a descriptive qualitative approach with in-depth interviews, observations, and documentation studies. The subjects of the study include government officials, field officers, non-governmental organizations, and victims of violence. The results of the study show that the implementation of the policy has resulted in several achievements, such as the formation of integrated services for victims of violence, increasing public awareness through educational campaigns, and cross-sector cooperation for case handling. However, the implementation of this policy has not run optimally due to various obstacles, such as limited human resources and budgets, low public awareness, patriarchal cultural barriers, and ineffective coordination between institutions. These obstacles have an impact on the slow process of handling cases and the lack of optimal support for victims of violence. Therefore, this study recommends increased budget allocation, professional training, strengthening cross-agency coordination mechanisms, and more intensive public campaigns to change cultural norms that support violence. In conclusion, although these policies have had a positive impact, further efforts are needed to improve their effectiveness. With integrated strategic steps, this policy has the potential to become a stronger instrument in protecting women and children from violence in Binjai City.

Abstract

The ASKIA CERIA (Smart and Friendly Child Population System Application) program is an innovative population administration service designed to accelerate the process of issuing Child Identity Cards (KIA) in Langkat Regency. This research aims to analyze the implementation of the ASKIA CERIA program, identify the challenges faced, and evaluate optimization strategies that can be carried out. A qualitative descriptive approach is used in this study with data collection techniques through interviews, observations, and documentation. The results show that the implementation of ASKIA CERIA in the issuance of KIA in the Disdukcapil of Langkat Regency still faces challenges in aspects of communication, resources, disposition, and bureaucratic structure. Improvement efforts are needed to improve communication strategies, the quality of human resources, budget allocation, motivation for implementers, as well as cross-level coordination and flexibility of procedures so that the program can run more optimally and the benefits are felt by the community. To overcome these challenges, optimization strategies include digital literacy training, improving technological infrastructure, and adding human resources. This study concludes that the digitization of public services through programs such as ASKIA CERIA can be a solution to improve service efficiency, as long as it is accompanied by an inclusive approach and adequate infrastructure support. This finding is expected to be a reference for the development of similar innovations in other regions.

Abstract

This study aims to analyze the effectiveness of the village apparatus empowerment program in village financial management in Mandailing Natal Regency. This empowerment program is designed to increase the capacity of village officials in managing and supervising the allocation of village funds to be more transparent and accountable. The method used in this study is a qualitative approach with case studies. Data collection was carried out through in-depth interviews, participatory observations, and documentation involving village officials, program assistants, and village communities. Data analysis was carried out using thematic analysis techniques. The results show that the effectiveness of the empowerment program is influenced by four main indicators, namely communication, resources, disposition, and organizational structure. Effective communication between the district government, assistants, and village officials supports the understanding of village financial management. However, there are obstacles in delivering information to the public. Limited human resources and technology are obstacles in the implementation of the program, especially in remote areas. The positive disposition of most village officials in applying the principles of transparency and accountability has had a positive impact, although there is resistance to change among more senior village officials. A clear organizational structure and good coordination between village officials have been proven to increase the effectiveness of village financial management. The conclusion of this study is that the success of the village apparatus empowerment program in village financial management is highly dependent on the synergy between communication factors, resources, disposition, and organizational structure.

Abstract

Law enforcement against children as perpetrators of violent theft is a complex issue that requires special attention, especially in the application of the principle of restorative justice in accordance with Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA). This study aims to analyze the applicable legal rules, the implementation of law enforcement by the Southeast Aceh Police, as well as the obstacles faced in handling cases of children as perpetrators of violent theft. The research method used is qualitative with a case study approach, which involves in-depth interviews, observations, and document studies. The results of the study show that the rule of law prioritizes the principles of child rehabilitation and protection through a diversion mechanism to prevent children from the formal criminal justice system. The Southeast Aceh Police has tried to apply this principle, despite facing various obstacles, such as limited facilities for children, lack of trained human resources, and low public understanding of the restorative approach. This research emphasizes the importance of a holistic approach that involves various parties to increase the effectiveness of law enforcement against children. Support in the form of training officials, improving child-friendly facilities, and community education is needed to ensure the success of a fair juvenile criminal justice system and support the social reintegration of child offenders. Thus, this system can function optimally to protect children's rights, create justice for victims, and restore social harmony.

Abstract

This study aims to analyze the legal regulation and law enforcement against the crime of absenteeism without permission (THTI) carried out by TNI soldiers at the Medan Military Court, as well as the relationship between the Military Criminal Code (KUHPM) and the Criminal Code (KUHP). The research methods used are normative juridical and empirical juridical, with legislative, case, and conceptual approaches, as well as data collection through document studies and interviews. The results of the study show that legal arrangements related to THTI have been comprehensively regulated in Article 87 of the Criminal Code, with sanctions aimed at maintaining military discipline. Law enforcement against the THTI case at the Medan Military Court is carried out through the stages of investigation, investigation, prosecution, and execution of the verdict. The relationship between the Criminal Code and the Criminal Code reflects the principle of lex specialis derogat legi generali, where the Criminal Code is prioritized for TNI soldiers. However, there are challenges in determining jurisdiction in cases involving civil society, so coordination between military courts and general courts is needed. This study recommends increasing the socialization of the rule of law to soldiers, strengthening the capacity of military legal officers, and moral development to prevent THTI violations. With this step, it is hoped that the handling of THTI cases can run more effectively and fairly in accordance with the principles of military law and general criminal law.

Abstract

Human life is said to be prosperous when all economic and social needs can be fulfilled without shortage. As a community living in a fairly large area of oil palm plantations in Indonesia, the majority of Krueng Itam villagers have jobs as oil palm farmers so that the price of palm oil greatly affects their income. This study aims to determine the impact of the decline in palm oil prices on the welfare of oil palm farmers in the village of Krueng Itam Tadu Raya, Nagan Raya Regency, West Aceh. The research method used is descriptive qualitative with a sample of 10 respondents. Data collection techniques were carried out through observation, questionnaires, interviews, and documentation. The results of the study stated that the decline in palm oil prices had a negative impact on welfare. This is evidenced by the results of the questionnaire which showed that 70% of farmers felt that the decline in palm oil prices had a negative impact on welfare.
