Abstract

Industrial relations dispute resolution is an important issue in the world of labor that requires the right legal approach. This study aims to analyze the role of advocates in resolving industrial relations disputes at the Medan City Manpower Office, especially in the mediation and litigation stages. The research method used is a qualitative approach with data collection through in-depth interviews, observations, and document studies. The data were analyzed descriptively by relating them to relevant theories and legal frameworks. The results of the study show that advocates have a strategic role in helping the parties to the dispute understand their rights and obligations, both through legal consultation, assistance in mediation, and legal representation in the litigation process at the Industrial Relations Court. In addition, advocates also contribute to the preparation of legal documents that support client claims. However, there are a number of obstacles faced by advocates, such as low legal understanding from the parties to the dispute, limited competence of mediators, and lack of supporting evidence. This obstacle often prolongs the duration of dispute resolution and reduces the effectiveness of mediation. This study concludes that the role of advocates is very important in creating a fair and efficient dispute resolution process. However, improvements are needed in the dispute resolution system, such as increasing legal literacy, training mediators, and optimizing mediation procedures. This finding is expected to contribute to the development of better industrial relations settlement practices, especially in the city of Medan.

Abstract

This study aims to analyze the factors that influence the behaviour intention of generation Z using the Cash Waqf Linked Sukuk (CWLS) platform by adopting the concept of the Unified Theory of Accaptance and Use of Technology (UTAUT) model. The CWLS platform acts as a financial endowment investment where the profits are directed by nadhir waqf to support the ummah. This study used the primary data that is collected by using the online survey questionnaires, and then the analysis is conducted using partial least squares (PLS) regression. The survey conducted on generation Z in in the city of Medan, sample used in this study 100 respondents. The empirical study shows that all the variables except for performance expectancy have a significant positive effect on the intention of generation Z to use Cash Waqf Linked Sukuk (CWLS) platform. The present study will help the waqf institutions and the government to develop more engaging waqf strategies for generation Z. Furthermore, this study will contribute to the existing literature especially on the factors influencing the adoption of the waqf-based platform mode.

Abstract

This study aims to examine the views of Imam An-Nawawi and Imam Ibn Hazm regarding the permissibility of touching the Qur'an for women who are menstruating (haid), with a focus on its implementation at Pondok Pesantren (Islamic Boarding School) Tahfiz Al-Faiz in Deliserdang Regency. The study analyzes the differing opinions of these two scholars on the issue. Imam An-Nawawi, in his al-Majmu', holds the view that menstruating women are not allowed to touch the Qur'an directly. In contrast, Imam Ibn Hazm, in al-Muhalla, argues that there is no prohibition against touching the Qur'an during menstruation, as there is no authentic hadith to support such a ban. This research employs a qualitative approach with a case study at Ponpes Tahfiz Al-Faiz, involving interviews with the administrators and students to understand the practices followed in the institution. The findings reveal that the majority of the administrators and students adhere to Imam An-Nawawi's opinion, although some are inclined to follow Imam Ibn Hazm's view, depending on their understanding and the approach practiced in their environment. This study is expected to contribute to the development of a more inclusive and contextually relevant understanding of Islamic jurisprudence in the context of religious education in Islamic boarding schools.

Abstract

This study aims to examine the construction of Guru Bakhiet's gender interpretation in his interpretation of a number of verses of the Qur'an, focusing on the theme of subordination and women's empowerment. Guru Bakhiet interprets Qur'anic verses related to women, such as Surah al-Baqarah [2]: 228, Surah an-Nisa [4]: 1 and 34, Surah al-An'am [6]: 137, and Surah al-Isra [17]: 1, with an approach that prioritizes justice, equality, and protection of women's rights. This research uses critical analysis methods and hermeneutic approaches, this research reveals how Guru Bakhiet interprets verses related to women, including the obligation to wear the hijab, the position of husband and wife, women's rights, and women's relationships with men in the context of marriage. The results of the study show that Guru Bakhiet's interpretation is influenced by the dynamics in gender understanding in his interpretation, which not only reflects local traditions and culture, but also shows the potential to formulate a more inclusive view and empower women within the framework of Islamic teachings. Guru Bakhiet's interpretation shows that there is a tendency to put women in a subordinate position and at the same time try to empower women through fair religious learning, as well as the affirmation of women's rights in the family. Although she emphasizes the obligation of women to maintain honor and maintain manners, the interpretation also includes aspects that support the education and protection of women, such as in her views on the treatment of girls and efforts to prevent injustice in husband-wife relationships. So, this interpretation emphasizes the importance of women's empowerment through education and fair treatment, as well as criticizing practices that have the potential to suppress the role of women in society. Thus, it can be concluded that Guru Bakhiet's tafsir combines aspects of subordination and empowerment, by fighting for women's rights within the framework of humanist and contextual Islamic teachings.

Abstract

Assessment center is a comprehensive method to assess the ability, competence and suitability of a person with a certain role or position, by measuring technical and non-technical competence. The North Sulawesi Provincial Government in supporting the bureaucratic reform process has the responsibility to implement employee development programs through the assessment center method before holding a position as a high-ranking official. This study was conducted to explain the utilization of assessment center results in career development (promotion, rotation/mutation, and competency development) of Civil Servants (PNS) in the North Sulawesi Provincial Government. Qualitative design was used in this study. The research findings that the utilization of assessment center results by the North Sulawesi Provincial Government in this case through BKD as the personnel management official has not been effective enough because there are still elements of subjectivity in the mutation/rotation of Officials/Employees. In terms of selection/filling of JPTP (Promotion), the North Sulawesi Provincial Government is committed to continuing to use the Assessment Center method even though in reality there are still elements of subjectivity when it is already in the selection committee. In addition, the results of interviews with informants indicate that the utilization of assessment center results has not been optimal due to various factors, including political intervention, lack of understanding of assessment centers, implementation of the merit system, organizational culture, talent management systems, and budget issues and availability of training, as well as regulations/legal umbrellas.

Abstract

The use of the e-Performance application will result in effectiveness and efficiency in ASN performance reporting. ASN employees no longer need to print their monthly performance results but can be directly entered into the application and can be directly assessed by the assessor without being limited by time, can be done anywhere and anytime. This study aims to determine what factors are the causes of the failure to implement the BKN e-Performance Application in the Southeast Minahasa Regency Government properly. Qualitative design was used in this study. The Human Resources Development and Personnel Agency as the research location. The focus of the study is based on aspects of communication, resources, attitudes of implementers and bureaucratic structure. Data analysis through the stages of data reduction, data presentation and preparation of conclusions and verification. The findings of the study were miscommunication in ASN in translating socialization materials, inadequate internet facilities, ASN who were still indifferent in reporting their monthly performance, and there were no standard binding rules regarding awards and sanctions regarding the use of the BKN e-Performance application for ASN.

Abstract

The use of the I'DIS Application in the implementation of the Imposition of Disciplinary Punishments for Civil Servants is indicated to be inconsistent between regulations and their implementation. Many Government Agencies in the working area of ​​the Regional Office XI BKN Manado still do not use the I'DIS Application and do not understand the input process or have not reached the stage of the process of making a Disciplinary Punishment Decree. This study aims to describe and analyze the Implementation of the I'DIS (Integrated Discipline) Application in the Imposition of Disciplinary Punishments for Civil Servants in Government Agencies in the Province of North Sulawesi. By using a qualitative design, it was found that the Implementation of the I'DIS Application in the imposition of disciplinary punishments for Civil Servants in Government Agencies in the Province of North Sulawesi still lacks a deeper understanding of the application, especially when technical guidance is carried out online. Likewise, resources including human resources, facilities and infrastructure are inadequate.

Abstract

Building an integrated electronic-based government system in personnel management is very important today. Transformation of the personnel management service process based on information technology is a mandate from the Regulation of the Head of BKN Number 20 of 2008 concerning the Personnel Service Application System (SAPK). Proposals for promotion are one form of service that is currently carried out through SAPK. The Regional Office XI BKN Manado has the responsibility in the process of determining the decision letter for the promotion of Civil Servants. This study was conducted to describe the existence of SIASN in the timeliness of determining the decision letter for the promotion of Civil Servants at Agencies in the Work Area of ​​the Regional Office XI BKN Manado and what aspects cause delays in determining the decision letter for the promotion of Civil Servants. By using a qualitative design, it was found that there were slight weaknesses in the criteria for bureaucratic compliance (compliance) which can be seen from the delay in the signing stage of the decision letter for the promotion by the authorized official even though the SIASN operator had tried to be on time. The delay in signing the SKKP, although not caused by the dysfunction of the SIASN system, this obstacle still has a significant impact on the credibility of SIASN as a system designed to accelerate the promotion process.

Abstract

A chatbot is a piece of technology that mimics a conversation between a software application and a human. This technology has advanced quickly in recent years, and this technology has undergone significant advancements in recent years, particularly education. For this purpose, the researcher used the Systematic Literature Review (SLR) method to examine how this technology has developed and evolved over the past five years in the educational field. The findings of this study are intended to enable educators who want to create a conversational assistant for their course and developers who want to create chatbot systems for the educational space with a concise overview of the information acquired.

Abstract

The phenomenon that is the object of research is the implementation of special autonomy policies in improving people's welfare in Jayawijaya Regency, Papua Mountains Province. This study aims to discuss the implementation of special autonomy policies in improving people's welfare in Jayawijaya Regency, Papua Mountains Province and to obtain a model from the analysis of the implementation of special autonomy policies in improving welfare in Jayawijaya Regency, Papua Mountains Province. This research method uses a qualitative descriptive method. The selection of informants was carried out using a purposive sampling technique consisting of elements of government leaders, traditional/community leaders, academics and stakeholders totaling 7 informants. By using Grindle's policy implementation theory. The results of the study indicate that the implementation of the policy to improve the welfare of the people of Jayawijaya Regency can be done through the provision of educational, health, economic and other social assistance to the people of Jayawijaya Regency and the Asymmetric Diversion Policy Implementation Model for Improving Community Welfare through the Provision of Educational, Health, Economic and Other Social Assistance to the People of Jayawijaya Regency which synergizes the implementation of asymmetric regional policies on the amount of social assistance budget allocation from the APBD for each budget year and asymmetric regional head policies on the provision of social assistance with the implementation of regulations and laws in regulating the provisions, procedures and methods for providing social assistance according to objective conditions of geographical remoteness, sociological backwardness and limitations of community human resources.
