Abstract

This article aims to determine the legal remedies available to the winner of a construction contract tender when its award is revoked through an invalid administrative court decision. This research is of a normative legal nature and involves a legislative approach and a case approach. The data sources used include primary legal materials related to the procurement of goods and services and principles of civil law, especially those related to compensation for wrongful acts and court decisions. Secondary legal sources were obtained from books and journal articles using a literature review data collection technique. The research findings indicate that a tender winner whose award has been revoked through an invalid administrative court decision can seek compensation by filing a lawsuit in a district court. The compensation obtained may include material compensation, which arises from actual losses suffered by the plaintiff, and immaterial compensation, which is calculated based on the expected profits that could have been obtained if there had been no wrongful act. In the judgment in case number 1/Pdt.G/2017/PN.Lbt, the judge determined that the defendant had committed a wrongful act but awarded the plaintiff only immaterial compensation.

Abstract

The growth of Islamic banking assets is one of the indicators of Islamic banking development. The total assets of Islamic banking are used to calculate the market share of Islamic banking. In recent years, Islamic banking has experienced a slowdown in asset growth. This study aims to determine the influence of internal factors represented by financing growth, growth of Third Party Funds (DPK), and Non-Performing Financing (NPF) levels, as well as external factors represented by the Rupiah/USD Exchange Rate on the growth of assets of Sharia Commercial Banks (BUS) and Sharia Business Units (UUS) in Indonesia in the 2008-2015 period. The research model used was multiple linear regression analysis using the SPSS 18.0 analysis tool, and classical assumption testing was carried out on the estimated model. To determine the effect, simultaneously used f test (f-test), while to determine the effect, partially used t-test (t-test). The results of this study show that financing growth, Third Party Fund (DPK) growth, Non-Performing Financing (NPF) rate and Rupiah/USD Exchange Rate have a significant effect on asset growth simultaneously. Of the four independent variables, when tested partially, it turns out that only three variables have a significant effect on asset growth, namely the variable of financing growth and the growth of Third Party Funds (DPK), which has a significant positive effect, and the level of Non-Performing Financing (NPF) which has a significant negative effect, while the variable of the Rupiah / USD Exchange Rate has an insignificant effect on asset growth

Abstract

Nowadays, technology is essential in various aspects of life, including education. Education is the right of all members of society, and the government is obliged to organize education to educate the nation's life. However, besides having a positive impact, technology can also have a negative impact. Thus, there is a need for legal protection against the negative impact of technology use on learning in elementary schools. The purpose of this study is to determine the legal regulation of the use of technology in learning in elementary schools. This research uses a qualitative approach and the Miles and Huberman interactive analysis model, which consists of 3 main things: data reduction, data presentation, and conclusion drawing. The results show that the use of technology in learning in primary schools requires legal regulations that maintain a balance between educational innovation and the protection of students' data. This regulation is essential to regulate the use of technology as a supporting tool, improve learning effectiveness, and create a safe environment. The protection of students' data and cybercrime monitoring should also be integrated into the regulation to create an efficient and ethical education in the digital era.

Abstract

The non-binary Trans identity is one of the marginal identities beginning to be recognized worldwide. Research articles and academic resources available on non-binarynonbinary Trans identities write about various aspects of the internal and external processes of self-acceptance of non-binary Trans individuals, including gender dysphoria, transphobic internalization, gender deconstruction, and environmental cisnormativity, with various concepts and theories that raise disparities and unanswered questions. In this literature review, the authors collected and critically analyzed 16 documents to fill theoretical gaps regarding research into non-binary Trans identities. It was found that research on non-binary Trans identities has gained popularity in the past decade. However, of the available sources of research articles, few studies have used queer theory to analyze experiences of non-binarynonbinary Trans identities
