Abstract

Penelitian ini menginvestigasi pencemaran Sungai Ciliwung, khususnya di sekitar Mall Seasons City di Jakarta, yang disebabkan oleh limbah domestik, limbah industri, dan sampah plastik. Penelitian ini menggunakan pendekatan yuridis normatif dengan menganalisis data sekunder dari dokumen hukum, studi sebelumnya, dan observasi lapangan. Hasil penelitian menunjukkan bahwa penyebab utama pencemaran adalah pembuangan limbah domestik yang tidak terkelola dengan baik dan limbah industri yang dibuang langsung ke sungai tanpa pengolahan yang memadai. Kadar BOD, COD, dan TSS yang tinggi menunjukkan bahwa kualitas air Sungai Ciliwung melampaui ambang batas yang diatur dalam Undang-Undang No. 32 Tahun 2009 dan Peraturan Pemerintah No. 82 Tahun 2001. Penelitian ini juga menunjukkan rendahnya kesadaran masyarakat tentang pengelolaan limbah dan kurangnya infrastruktur pengelolaan limbah yang efektif. Penelitian ini membahas dampak lingkungan, kesehatan, dan ekonomi dari pencemaran sungai, termasuk peningkatan penyakit seperti diare, infeksi kulit, dan penurunan keanekaragaman hayati. Temuan ini menekankan perlunya partisipasi masyarakat dalam program pengelolaan limbah serta penegakan hukum yang lebih kuat. Hasil penelitian menunjukkan bahwa kolaborasi antara pemerintah, sektor swasta, dan masyarakat sangat diperlukan untuk mengurangi pencemaran dan memulihkan kualitas lingkungan.

Abstract

This study examines defaults in credit agreements secured by land collateral at PT BPR Gajah Mungkur, with particular emphasis on legal protection mechanisms available to creditors when debtors fail to meet their obligations. Although credit agreements are supported by a strong legal framework, incomplete registration of mortgage rights can undermine the creditor’s legal standing. The objective of this research is to address gaps in existing studies concerning creditor protection in mortgage enforcement and to analyze the implications of the Supreme Court Decision No. 469 K/Pdt/2024 on the practice of credit agreements in Indonesia. A normative juridical approach was employed, utilizing data sources such as court decisions, statutory regulations, and pertinent legal literature on credit agreements. The findings indicate that incomplete or delayed registration of mortgage rights significantly impedes creditors’ ability to execute collateral. The case study of PT BPR Gajah Mungkur demonstrates that, despite the formal validity of credit agreements, failure to register as a preferred creditor adversely affects the creditor’s right to debt repayment. This research contributes to legal theory by reinforcing the critical role of mortgage registration in enhancing creditor protection. Practically, it offers valuable insights for legal practitioners, emphasizing the necessity of properly completing the mortgage registration process to safeguard creditor interests in cases of debtor default.

Abstract

Economic development across countries plays a crucial role in shaping an economic system that adapts to changing times. However, economic activities are inherently linked to various transactions, which may result in companies facing challenges, losses, or even bankruptcy. In Indonesia, bankruptcy regulations are governed by Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations. Indonesia adheres to a territorial principle in handling cross-border insolvency cases, which affects the authority of the trustee and the rights of creditors. This study aims to analyze the legal framework and implications of applying the territorial principle in cross-border insolvency. The findings suggest that the application of the territorial principle exacerbates difficulties and complexities for the trustee in managing the debtor’s bankrupt assets. Furthermore, creditors experience more significant losses. Thus, the territorial principle in cross-border insolvency tends to complicate the trustee’s responsibilities and place creditors at a disadvantage.

Abstract

This study aims to analyze the implementation of the Corporate Rescue Concept within Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (Bankruptcy Law) and to identify its weaknesses, as well as the urgency for legal reform to optimize the business rescue function. The research adopts a normative juridical approach, utilizing doctrinal analysis, comparative law, and a literature review of the Bankruptcy Law’s provisions and its practical implementation. The findings indicate that while the Bankruptcy Law incorporates the Corporate Rescue Concept through the PKPU mechanism and the peace plan, its provisions remain limited and predominantly focus on liquidation. Three critical issues were identified: (1) the lack of detailed provisions on debt restructuring mechanisms, (2) the absence of standards for business feasibility assessments, and (3) insufficient oversight in the implementation of rescue plans. The study concludes by recommending amendments to the Bankruptcy Law to better emphasize the principle of business rescue, including: (1) the regulation of comprehensive restructuring schemes, (2) the establishment of an independent supervisory body, and (3) the provision of incentives for creditors. These reforms are crucial to strike a balance between creditor protection and the continuity of debtor businesses.

Abstract

This study examines the validity of the Build, Operate, and Transfer (BOT) Agreement between the Indonesian Marine Corps and PT Karya Tumbuh Bersama Indo regarding the construction and management of Plaza Cilandak, as well as the impact of the implementation of the Minister of Finance Regulation No. 54/PMK.06/2015 concerning the management of State-Owned Assets (BMN) on the existing agreement. Using a normative legal approach, this research analyzes the agreement’s compliance with the essential elements of validity as regulated in the Civil Code and the implications of the new regulations on the already signed contract. The findings indicate that the BOT agreement is legally valid, but the implementation of the new regulation requires renegotiation between the private sector and the government. This study also highlights the importance of applying the Pacta Sunt Servanda principle to maintain legal certainty in the BOT agreement, and the necessity of dialogue between the private sector and the government to avoid disputes and ensure the project’s sustainability.
