Abstract

This research aims to determine the views of taharah jurisprudence towards people with disabilities who are blind and physically disabled in the book Fiqh Strengthening Persons with Disabilities. The problems raised in this research are; First, what is the concept of taharah for people with disabilities in the book Fiqh, Strengthening People with Disabilities. Second, what is the review of taharah jurisprudence towards people with disabilities in the book Jurisprudence for Strengthening Persons with Disabilities. This type of research is library research, with qualitative descriptive methods. The results of this research are mentioned in the book Fiqh on Strengthening Persons with Disabilities, namely; First, the concept of taharah for people with disabilities, if conditions make it impossible for them to purify themselves, then they can ask for help/assistance. In this case, people with visual impairments (blind) are assisted in the issue of water impurity and may make ijtihad regarding vessels. As for people with physical disabilities (note the body), when performing purification only the mahram can help. However, if there is no one to help him then he still has to complete his wudu when performing prayers according to his ability. Second, the review of taharah jurisprudence towards people with disabilities is the same as for sick people, because ḍawu al-'ażar (people who are elderly) have their own laws regarding this matter.

Abstract

Many classical and contemporary scholars use al-Maṣlaḥah al-mursalah as a source or method of adopting Islamic law on issues that have not been explained in detail in the texts, whether in the Al-Qur'an or hadith. The aim of the research is to find out the views of Imam al -Syāfi'ī regarding the position of al-maṣlaḥah al- mursalah as a source of law and his opinion about al-maṣlaḥah al-murlah as a source of law in the book al-Risālah. The formulation of the problem raised is; First, what is Imam al-Syāfi'ī's view regarding the position of al-maṣlaḥah al-mursalah as a source of law. Second, what is Imam al-Syāfi'ī's opinion in the book al-Risālah regarding al-maṣlaḥah al-mursalah as a source of law. Researchers use qualitative research with library research methods which focus on the study of manuscripts and texts, using normative and conceptual approach methods. The results can be concluded as follows; Firstly, Iman al-Syāfi'ī does not reject al-maṣlaḥah al-mursalah absolutely, but he considers that the use of this method must be based on several conditions. This opinion is strengthened by the opinion of the scholars of the Second Syāfi'ī school, the results of the researcher's analysis of al-maṣlaḥah al-mursalah as a source of law in the book al-Risālah, that Imam al-Syāfi'ī does not mention the rejection or permissibility of blaspheming with methods or sources the. It is hoped that the implications of this research will be a reference for a mujtahid when he wants to establish a law using the al-maṣlaḥah al-murlah method.

Abstract

This research aims to analyze the method of analogy between wiping over socks and wiping over leather footwear (khuf) from the perspective of Islamic jurisprudence (fiqh of worship). This study falls into the category of qualitative research using the library research method, which involves collecting data from books and previous literature or gathering data from other writings and sources, whether from scientific articles, primary data sources, secondary data sources, and other literature related to the method of analogy. The findings of the research are as follows: First, the type of analogy used in determining the ruling of wiping over socks by analogy with the ruling of wiping over leather footwear is 'illah analogy, by equating the effective cause (illat) of the subsidiary ruling with the original ruling, where the determination of the effective cause is done using the istinbat method through munasabah (suitability). Second, the analogy method used to determine the permissibility of wiping over socks in ablution as a substitute for washing the feet, by analogy with the ruling of wiping over leather footwear, is valid because it fulfills the pillars of analogy and also meets the conditions of each pillar.

Abstract

This research aims to find out and understand one of the health treatment methods that exist in the world of health, and this treatment method is music therapy. This research uses a type of qualitative descriptive research, namely an effort to reveal facts with the aim of accurately describing an existing situation or symptom, using a normative juridical approach method. The research results found are as follows: first, therapy using music media has many benefits for patient health, especially in helping and caring for patient health in addition to main treatment. Second, there are differences of opinion among Islamic scholars regarding the Islamic view of punishing music. However, the majority of Ulama forbid music based on the evidence originating from the Al-Quran, the hadith of the Prophet PBUH. and ijma̕ from four sect imams. Third, seeing that music is haram from the perspective of Islamic law, the use of music as a therapeutic method is haram based on the arguments in the Al-Qur'an, the Hadith of the Prophet SAW. and ijma` four sect imams. And there are also several reasons that support its haraam, such as the level of maṣlaḥatan, and the existence of treatment options that can be used to replace music therapy. It is hoped that the implications of this research will become a reference, literature or consideration for the academic world, as well as positive reference material and information for the government, health workers and society in general.

Abstract

This study aims to find out how Q.S. al-Żāriyāt verse 19 describes the condition of poverty in the perspective of Islam, to find out what the relationship is between this verse and the principles of welfare in the perspective of thematic interpretation, and to find out how Islam's solution to poverty is reflected in Q.S. al-Żāriyāt verse 19. This research is a library research. The results of this study are that Q.S. al-Żāriyāt verse 19 describes poverty in Islam as a condition that not only involves material deficiencies, but is also related to social, moral, and spiritual aspects. In the thematic interpretation of Q.S. al-Żāriyāt verse 19, the principles of welfare in Islam contained in this verse emphasize the importance of attention to those who do not beg, and the fulfillment of the rights of the poor as part of a greater social responsibility. In Q.S. al-Żāriyāt verse 19, there is an emphasis on paying attention to two types of poverty, namely those who beg and those who do not beg. Islam emphasizes the obligation to provide assistance to both, by maintaining their honor and paying attention to their overall welfare and offering solutions to create equitable prosperity in society.

Abstract

The problems that the author raises in this study are: first, What are the views of scholars regarding touching the opposite sex as a cause of ablution invalidation; second, How is the analysis of the evidence for the occurrence of scholars' ikhtilaf in the matter of touching the opposite sex as a cause of ablution invalidation; and third, What is the status of the validity of the ablution of people who touch the opposite sex during tawaf. This study uses a qualitative research method with library research, namely by collecting data from various sources such as books and other scientific works. In this study, the approach methods used are juridical-normative, sociological and comparative/comparative approaches. The results of the study were as follows: first, when touching the opposite sex, Imam Abu Hanifah did not see that this could invalidate ablution, Imam Malik stated that if this does not invalidate ablution but if accompanied by lust then it can be invalidated whether using a cloth barrier or not, while Imam Syafii absolutely views that this invalidates ablution, and the Hanbali school of thought views that touching the opposite sex does not invalidate ablution; second, differences of opinion occur because there are two words that have different interpretations by scholars, namely لاَمَسْتُمْ and لَمَسْتُمْ which are interpreted as having intercourse and touching hands, the opinion that makes it easier in daily practice is having intercourse; third, scholars disagree about the law of ablution when performing tawaf, but when observing the conditions that occur during tawaf, ablution can be done before performing tawaf, while if in the middle of tawaf the ablution is invalidated because of touching the opposite sex when jostling, then it is permissible to take the opinion that ablution is not obligatory, as a form of convenience in Islam. The implication of this research is that it is expected to be a reference, literature and reference material for readers in the problem of fiqh of worship for the community in general and especially for those who will perform the hajj and umrah.

Abstract

Indonesia is one of the countries with the most abundant natural resources. These resources include coal and minerals. However, their management often causes environmental damage and social inequality. One of the latest policies, Government Regulation No. 25 of 2024, grants religious community organizations permission to manage mines. This policy has sparked pros and cons, making it interesting to examine from the perspective of Maqāṣid al-Syarī‘ah, which emphasizes benefit and the prevention of damage. From this background, the author can raise the following research questions: First, what are the provisions contained in Government Regulation No. 25 of 2024 concerning the Granting of Mining Management Permits to Religious Organizations? Second, what is the view of Maqāṣid al-Syarī‘ah on this regulation? The type of research used in writing this thesis is library research, namely written research from various references conducted by collecting data, examining and analyzing data from various literature, analyzing theories, concepts, legal principles, rules, and regulations related to this research. The objective is to explain the perspective of maqasid syariah on the granting of mining management permits to religious organizations. The results of this study show that, first, based on the provisions of Article 6 paragraph (1) letter j of Law 3/2020, which explains that the central government is tasked with managing mineral mining and has the authority to prioritize WIUPK offers as the basis for granting mining business licenses to religious organizations, in accordance with the Explanation of Article 83A paragraph (1) of PP 25/2024. Second, based on the view of Maqāṣid al-Syarī‘ah, this regulation has a greater and more obvious mafsadah mu’tabarah (harm) than its potential maṣlaḥah (benefit).

Abstract

This study is part of Fiqh principles (Qawaid Fiqhiyyah), focusing on the second principal rule, al-yaqīn lā yazūl bi al-syak (certainty is not removed by doubt), which serves as an important epistemological safeguard in Islamic law and modern adjudication. The purpose is to analyze the rule's meaning, scope, and realization concerning contemporary issues, specifically the use of phone screen capture (screenshot) as court evidence. Employing a literature review with normative and historical approaches, the research utilizes classical texts, such as al-Asybāh wa al-Naẓāir by As-Suyūṭī, and relevant Indonesian positive law. The results confirm this is a magnificent rule, addressing approximately three-quarters of all Fiqh problems. Fundamentally, it establishes that doubt (which is lower in degree) cannot overturn an established certainty. In the context of the judiciary, this rule accommodates the use of screen captures as evidence, provided they can reach the degree of conviction (al-yaqīn or ghālib al-ẓann) through proper authentication, thereby allowing a judge to accept a lawsuit. This application aligns with Article 5 paragraph (2) of Law Number 19 of 2016 concerning Information and Electronic Transactions (ITE). The study contributes by providing a normative framework for calibrating the weight of digital evidence, ensuring judicial decisions are based on rational, procedural certainty rather than mere suspicion.

Abstract

This study aims to provide a comprehensive understanding of the Islamic economic ecosystem, encompassing its concepts, fundamental principles, pillars and actors, as well as instruments and strategies for its strengthening within the Indonesian context. The research employs a qualitative-descriptive approach based on an extensive literature review. The findings reveal that the main pillars of the Islamic economic ecosystem consist of the Islamic financial sector, the halal industry, ZISWAF, sharia-based micro, small, and medium enterprises (MSMEs), and the sharia-driven digital economy. These pillars are supported by key actors, including the government, regulators, academics, industry players, society, and Islamic institutions. Financial instruments (Islamic banks, sukuk, Islamic fintech), social instruments (zakat, infaq, sadaqah, waqf), and supporting infrastructure such as regulatory frameworks, halal certification, digital technology, and shariah-compliant human resources serve as crucial enablers of the ecosystem’s sustainability. The study also identifies Indonesia’s substantial potential to become a global hub for the Islamic economy, supported by its large Muslim population, expansive halal market, and national regulatory backing. Nevertheless, challenges remain, including low levels of shariah literacy, limited human resource capacity, suboptimal regulatory implementation, and intensifying global competition. Consequently, strategies for strengthening the ecosystem should focus on improving literacy and inclusion, fostering cross-sectoral collaboration, enhancing digital innovation, reinforcing adaptive regulation, and integrating education with the halal industry. Through these measures, Indonesia’s Islamic economic ecosystem has the potential to evolve into an inclusive, competitive, and sustainable system, contributing significantly not only to national development but also to the advancement of global civilization.

Abstract

This study aims to examine the legal position of mandre ade’ within the customary legal system of the Bugis ethnic group and to analyze the perspective of Islamic law regarding its practice in society. The research employs a qualitative descriptive method in the form of field research with a normative-shar‘i approach. Data were collected through observation, interviews, and documentation. The findings reveal that, first, mandre ade’ holds a significant position within the structure of Bugis customary law, particularly in customary events such as marriage, aqiqah, and other social activities. This tradition is regarded as an expression of respect for customary values that have been passed down through generations. Second, from the perspective of Islamic law, the practice of mandre ade’ can be accepted within the framework of the Sharī‘ah under certain considerations. First, it aligns with the principle of maintaining respect for the relationship between authority and society as taught in the Qur’an and Hadith. Second, mandre ade’ may be classified as a legitimate form of ‘urf (local custom) under Islamic law, as long as it does not involve elements that contradict Sharī‘ah principles, such as acts of shirk or other prohibited practices. The implications of this study are expected to contribute to strengthening integrative studies between customary law and Islamic law, as well as to serve as a reference for communities and customary institutions in preserving local traditions that do not conflict with Islamic principles.
