Abstract

Pendahuluan. Praktik gadai sudah lama di praktikan di tengah-tengah masyarakat Desa Sungai Tering Kecamatan Nipah Panjang Tanjung Jabung Timur. Penelitian ini bertujuan untuk mengetahui bagaimana praktik gadai tanah yang digadaikan kembali dan apakah praktik gadai tanah yang digadaikan kembali tersebut diperbolehkan menurut syariat islam. Metode. Penelitian ini merupakan penelitian dasar (Basic Research), sifat penelitian ini adalah deskriptif analisis. Analisis data dalam penelitian ini menggunakan metode analisis kualitatif. Metode ini digunakan untuk memahami fenomena tentang apa yang dialami oleh subjek penelitian. Hasil. Berdasarkan hasil penelitian dapat dikemukakan bahwa praktik gadai tanah yang digadaikan kembali yang dilakukan di Desa Sungai Tering atas sudah memenuhi rukun gadai. Akad yang dilakukan oleh rahin dan murtahin dalam perjanjian sudah sesuai dengan syariat Islam namun ada syarat yang tidak terpenuhi yaitu rahin menggadaikan kembali tanahnya tanpa izin dari murtahin mengingat syarat dari barang yang digadaikan adalah tidak terkait dengan hak orang lain, sedangkan dalam praktik ini terdapat hak dari murtahin yang pertama. Adapun mengenai praktik tanah gadai yang digadaikan kembali adalah tidak dibenarkan dalam hukum Islam. Karena penggadai (rahin) tidak memiliki izin dari (murtahin). Kesimpulan. Praktik gadai tanah di Desa Sungai Tering Kecamatan Nipah sudah sesuai dengan syariat islam, terdapat aspek yang tidak sesuai syariat islam yaitu ketika rahin (penggadai) menggadaikan kembali tanah kebun/barang jaminan kepada orang lain.

Abstract

One of the pillars of law (arkanul hukm) in the anatomy of Islamic law is al-Mahkum alaih, namely the party who is charged with carrying out the syara' laws. Thus, those who are obliged to carry out Islamic law, carry out the law, obey the rules are mahkum alaih. Meanwhile, the scope of the meaning of mahkum alaih in classical fiqh is only focused on mukallaf. The concrete meaning of mukallaf as stated in the classical fiqh books, is a Muslim who is mature and has common sense. However, in the development of human civilization, especially in modern times, those who can take legal action and have rights and obligations, not only humans, but "legal entities" can also be in a position like humans in terms of carrying out activities as legal subjects. Experts define a legal entity as an entity that can have assets, rights and obligations like an individual. According to classical fiqh, only humans have rights and obligations and act as legal subjects (mukallaf). Meanwhile, according to modern scientists, those who can become legal subjects or mukallaf, whose actions are recognized by law, and have rights and obligations are not only humans but also legal entities. The difference between these two theories requires academics to immediately conduct research to find out the position of legal entities that can actually act as legal subjects like humans, (such as buying and selling and others) whether they can be included in the legal forum instead of the anatomy of Islamic law or not. no. Then to clarify the direction and object of this research, it will be formulated with the following questions. First, is a legal entity including the meaning of mahkum alaih in the anatomy of Islamic law?. Second, what is the difference between a mukallaf and a non-mukallaf mahkum alaih in the anatomy of Islamic law? The results of this study suggest that there are similarities between the mukallaf and legal entities in terms of being Mahkum alaih in the anatomy of arkanul hukmi. So that a legal entity has the same rights and obligations as a mukallaf person, as well as being able to think about property and assets and other things that can be interpreted by and on behalf of the legal entity itself.

Abstract

Almost every time before Ramadan, Shawwal and Dhulhijjah Muslims are always busy with the issue of determining the beginning of the month, Indonesia is no exception. Has the new moon been seen or not?, will tomorrow turn into a month or not? and so forth. So we often encounter it in an area, different from other regions in determining the beginning and end of the month (hijri).There are two ways for Muslims to determine the beginning and end of Ramadan, namely: rukyat and reckoning. Rukyat is a method of determining the beginning of the month by watching the new moon rise into the sky at sunset towards the beginning of the month. While reckoning is a method to determine the beginning of the month by perfecting the previous month (to 30 days) when seeing the new moon is no longer possible.In the rukyatul hilal, it seems that the hilal cannot cover the entire existing hemisphere. This means that at the first sighting of the new moon, some parts of the earth can see the new moon and some cannot. This of course raises problems for regions that cannot see the hilal for the first time, is it also related to legal provisions and consequences (from regions that have seen the hilal appear)? or each region has its own provisions and laws without following other regions? In this study, the author will describe the problem (mazahib al-arba'ah perspective) by researching the type of library (library research) through data from books, books, journals, articles and so on.Scholars have different opinions regarding the application of matlak to other regions that do not witness the issuance of the new moon: a). According to the majority of scholars (Hanafi, Maliki & Hambali), the area that has seen the new moon can cover all existing places, so that the entire area also experiences a change at the beginning of the month. b). According to (the majority) Syafi'iyah, for areas that have seen the new moon experience the beginning of the month, while other areas (as far as four farsakh and above) have not, so that the area managed to see the new moon separately.

Abstract

Dosage is defined as a process of measuring to find out the level, weight, or price of certain goods. In the process of measuring activities, it is known as measuring. Measuring is often equated with weighing. Measuring or weighing is part of the trade that is often done by traders. Traders usually use tools to measure such as cans, hands, bottles, and others. While the tool used to weigh is a scale which is also called a balance because it has a balance. Measures and scales are two kinds of measuring tools that pay attention to being used properly and correctly in the perspective of Islamic economics. In this paper, it is concluded that the implementation of the premium dosing system in retail is allowed because it does not contain elements of Gharar due to the willingness of the buyer. Buyers also feel helped by the premium retail because they don't have to bother queuing at the gas station, while the seller only takes a little profit with the willingness of the buyer

Abstract

This paper is the result of field research on "Review of Islamic Law on Salam Contracts with Online Systems at the Indra CMP Asembagus Situbondo Online Shop", this study aims to answer questions about:, How is the implementation of salam contracts with online systems at Indra CMP Asembagus online shop Situbondo Asembagus Situbondo. and, How is the Islamic law review of the salam contract with the online system at Indra CMP Asembagus Situbondo's online shop. This study uses a qualitative method. The results of the study conclude that the relationship of the parties in the salam contract agreement with the online system is the same as the usual salam contract agreement. However, the sale and purchase of salam contracts with an online system does not meet directly between buyers and sellers, it's just that the perpetrators of the contract are brought together in one internet network site. In Islamic law, a sale and purchase contract is allowed to enter into a contract using writing (letters) on the condition that the two parties are far apart from each other or the contract actors are silent, for the perfection of the contract it is required that the other person addressed by the writing is willing to read the writing. A review of Islamic law on salam contracts with an online system can be concluded that online salam contracts are allowed as long as they do not contain elements that can damage them such as usury, injustice, fraud, fraud and the like and fulfill the pillars and conditions in buying and selling.

Abstract

Cryptocurrency is a form of innovation and creativity from the history of the human journey in creating a system of exchange. Shari'ah provides free space (innovation and creativity) for humans to create the most effective and efficient system (وسائل). Cryptocurrency is a form of innovation and creativity in finding a system of exchange and storage media for goods (commodities).The research uses a comparative approach (comparison). The comparison made in this study is a comparison between Cryptocurrencies with the concept of currency (shorf) and nuqud as a transaction concept that is widely applicable. Furthermore, cryptocurrency is compared with the concept of mu'amalah barter transactions, as the most ancient transaction concept in human history. Cryptocurrencies are further compared with rights recognized in Copyright. The view that says that cryptocurrency is haram is based on the point of view of comparing cryptocurrency with currency (either nuqud or short).Cryptocurrencies are seen from the point of view of copyright (حقوق الإختراع الإبتكار) and the concept of barter transactions (مبادلة ), so it can produce different conclusions. From the point of view of this comparison of barter transactions with cryptocurrencies, it can be concluded that cryptocurrency is HALAL. Likewise, if the cryptocurrency law is examined with a Copyright approach, it results in the conclusion that cryptocurrency works are protected by religion and the law. Keywords: ,

Abstract

Nusyuz is one of the themes discussed in the Quran. This study focuses on the disobedience of career women in the perspective of Islamic law which prioritizes justice and the relationship between husband and wife. It can be understood that nusyuz is an act of neglecting the obligations of husband and wife that causes estrangement of relations in the household with the provisions, nusyuz action is carried out with certain motives, and aims to degrade the dignity of one party. The more developed the situation, the more women's desire to move forward and develop their careers in the world of work. These working women are usually called career women, some of whom have different opinions regarding this, some allow it on conditions, and some do not absolutely allow it. The issue of women is indeed the most actual thing to talk about considering times have changed, the mindset of humans has also changed, in this modern era there are still people who look down on women, and discriminate against them. Although there are many who are interested in conducting research related to this case. The natural privileges possessed by men and women lead to differences in functions, and the main roles between the two. Islam obliges a man as a husband to provide for his wife and children, however, it does not necessarily rule out the possibility that a woman as a wife also earns a living to fulfill the family economy. Islam itself places men and women in a balanced and equal position. The problem behind the misunderstanding between the two is that there is a misunderstanding in constructing the social roles between men and women as a result of the interpretation of the Qur'anic text in particular and it seems incomplete. While basically the relationship between husband and wife, men and women is a partnership, which must support each other.

Abstract

Inheritance is the essence of causality (the main cause) in owning property, while property is the bandage of life, both individually and universally. With that treasure the soul of life always revolves. The results show that the practice of distributing inheritance that occurs in the community of Jangkar village, especially in the hamlet of the mosque, is distributed before the muwaris dies. This is done so that when the heirs have died, there will be no quarrels or disputes and enmity, so that between members who are considered heirs still have a good and connected relationship without any problems. According to the view of Islamic law, the distribution of inheritance that occurs in the hamlet community of the Masjid village of Jangkar is not the distribution of inheritance, but in practice it is more directed to grants, because the distribution of assets is given when the muwaris have not died. On the other hand, it is said to be a will, if the heir has the right to own the property given by the muwaris when the muwaris has died. So with regard to the distribution, it can be interpreted that if the distribution is carried out before the muwaris dies, there are two possibilities, namely the distribution is included in the category of grants or wills. And if the distribution is carried out after the muwaris dies, then it also has two possibilities, namely the division of the property is included in the category of wills or inheritance distributions.

Abstract

The marriage contract has the meaning to hold a marriage as an agreement to marry as a form of acceptance. Basically the marriage contract couldtake using any language that shows a desire, and can be understood by the parts and also can be understood by the witnesses. Fiqh scholars agreed regarding the use of non-Arabic languages in marriage contracts as long as both or one of the two parts could not understand Arabic and the translation of the marriage contract text from Arabic into Indonesian is in accordance with Arabic grammatical rules.

Abstract

Humans as social beings need each other and must complement each other. However, the relationship between humans will be well established if it is supported by the rules that govern the relationship. The relationship between parents and their children has meaning if between the two there are rights and obligations to each other. In the sense that parents have rights and obligations to their children, as well as a child to his parents. One of the actions that make a child and his parents better is the provision of grants. A grant is a legal act that results in the transfer of rights from one person to another. In general, grants can be understood as giving that is done voluntarily by transferring the rights to an object to another person. Both movable and immovable objects. But not infrequently grants given by people who know their children are withdrawn because there are several problems that occur. In this article, we will discuss the legal problem of withdrawing grants by parents to their children.
