Abstract

Sukuk was an investment instrument that provides opportunities for Muslim and non-Muslim investors to invest in Indonesia.It could be used to build the nation's economy and create society welfare. The facts showed that the market would be very responsive to the sukuk issuance. Almost all sukuk was issued, was absorbed by the market, even in some cases caused excess demand. The sale and purchase of sukuk on the Indonesia Stock Exchange was carried out in four processes, from the account opening and order submissionstage, the order processing stage, the transaction stage, and the clearing, guarantee and transaction settlement stages.They applied to all types of securities traded on the Indonesia Stock Exchange. The difference lies only in the specifications of transactions such as fractions and price limits, which are carried out by educating the public about the process. While the form of transactions was carried out at securities trading places based on precautionary principles and sharia principles which refered to the fatwa of the National Sharia Board - Indonesian Ulema Council (DSN-MUI) and the Financial Services Authority (POJK) as the institution that oversees and regulates the process of the Sukuk transaction mechanism on the Indonesia Stock Exchange in Surabaya.

Abstract

Along with the times, Islamic Banking is required to always make new and actual breakthroughs in the field of Islamic economic transactions in order to answer current financial needs. Among the many contemporary transactions carried out by Islamic Banking is a hybrid contract or better known as Multi Akad. The transaction seems to be a solution to contemporary financial needs. However, even so, there are still some Islamic economists who doubt the validity of the hybrid contract, so there is a need for a new approach in the perspective of Islamic law in order to answer the doubts of some experts, including Maqasidus Syariah.

Abstract

The development of information and communication technology is something that can’t be avoided in the current era of globalization, because the development of information and communication technology will run in accordance with the development of science. Information and communication technology causes the world to be borderless and significant social changes take place so quickly. The Internet, the biggest computer network in the world, is currently used by millions of people spread all over the world. Internet users with a variety of activities are already very different from the original purpose of this network. Since business related to the global network system or what is called the internet appeared on the surface, there has been a momentum of change to aspects of people's lives, especially in the field of trade transactions or what is known as e-commerce. Whatever doing by YLX as a supplier of Ayu online shop as a dropshipper who takes advantage of the development of the world of technology by buying and selling via the internet. The collaboration between YLX and Ayu Online shop is very good and does not violate Islamic law as their religion, where YLX provides facilities and trust to Ayu online shop to be her representative in online buying and selling transactions. Ijab and qabul are only carried out via the internet and have fulfilled the pillars and conditions of the wakalah contract. Transactions between the Ayu online shop and the buyer which is a greeting contract are also carried out via the internet. In Islamic law, a salam contract is allowed to carry out a contract using writing (letter) on the condition that the two parties are far apart from each other or the contract actors are silent, for the perfection of the contract it is required that the other person addressed by the writing wants to read the writing. Based on research on the review of Islamic law on online shop dropship systems, it can be concluded that buying and selling and representing something via the internet is allowed, as long as it does not contain elements that can damage it such as riba, tyranny, fraud, cheating and the like and meet the pillars and conditions. In line with this conclusion, it is recommended for online buyers to understand the clarity of item specifications and choose a trusted online shop that presents testimonials, and dropshippers are expected to be open about their status as second hand.

Abstract

At this time there are many emerging Islamic banking with the many developments of sharia. The birth of Islamic financial institutions in Indonesia brings an interesting competitive atmosphere in the banking business discourse. In addition to the presence of conventional banks, our society is now presented with alternative options to invest their funds, of course through the presence of Islamic banking services. Islamic banking services offer products with a different scheme from conventional banks. In accordance with the title "sharia" it bears, Islamic banking claims the principle of justice in accordance with Islamic teachings as a differentiator of its identity from conventional banks. Including one of the Islamic banks in Situbondo, namely Bank Mandiri Syariah which is currently changing its name to Bank Syariah Indonesia Of all the products available at BSI, there is one financing product that is currently in great demand by the public, especially at the Bank Shariah Indonesian Cabang Situbondo Branch, namely the Griya financing product. Griya financing is short, medium, or long term financing to finance the purchase of residential (consumer) houses, both new and used, in the developer environment with a murabahah system. In relation to the murabahah concept in Fiqh Mu'amalah, it is necessary to combine its conformity with the practice of home financing transactions at BSI KCP Situbondo, where in practice the margin provisions obtained by BSI are not transparent, when purchasing property uses the practice of debt. , the delivery of money is directly given to the customer, not the BSI party who buys the needs of the customer and many other things that the author does not know. According to the author, this is not appropriate if the contract used is murabahah.

Abstract

The community in Pajanangger Village, Arjasa District, Sumenep Regency, has often seen cooperation in implementing the mukhabarah contract, which they know as Nelon. The agreement is usually carried out orally, without presenting witnesses and does not mention the conditions or pillars that must be met in the contract. The time period for implementing this mukhabarah contract is not clear. In fact, many harvests and years between rice field owners and rice field managers continue to work together for mukhabarah. The collaboration carried out by the community in Pajanangger Village, Arjasa District, Sumenep Regency is Nelon rice field management, namely the application of the implementation of the mukhabarah contract, according to the Islamic Law Perspective, the application of the mukhabarah contract to the management of rice fields in Pajanangger Village, Arjasa District, Sumenep Regency is valid because there has been an agreement from the parties involved. concerned even without having to fulfill certain formalities.

Abstract

In this study, the author will present a unique phenomenon about the marriage process in Kedungdowo Village, Arjasa District, Situbondo. In this society, when getting married, the groom will bring a set of household tools to present to the prospective bride. This is not a request from the bride but because of the customary factor. The items they carry are very many such as chairs, tables, cupboards, and others. Then the concern of the researcher is when their marriage relationship breaks up in the middle of the road or is divorced then what happens? Before we continue the results of this study, that this research is field with a qualitative approach. The focus of the discussion is how the above incident is viewed from the perspective of Islamic law and positive law or the Civil Code. And in extracting the data sources of researchers Then in looking for data sources, the authors use primary data sources in the form of: observations, interviews, and documentation. And the author will also optimize secondary data, namely additional data such as from books, books and others. From the analysis and studies conducted by the researchers, it can be concluded that: In Islamic law, it is permissible to withdraw the property given by a husband to his wife after a divorce in Kedungdowo Village, Arjasa Situbondo District, because the gift does not include a grant. And in Positive law, grants may be withdrawn if they have fulfilled the three things mentioned in the Civil Code article 1688.

Abstract

In the life of the community is a lot of things that we can take advantage of One of the most common things in society is the habit of people who need money to fulfill their lives and one of their ways is to borrow money. The habit has become a deep rooted tradition in the midst of social life including in Kedungdowo Village, Arjasa subdistrict, Situbondo district. Which money loan is allocated by the Activity Management Unit (UPK) Bangkit Mandiri Arjasa. So, the problem formulation was born such as : (1) What is the implementation of program DAPM (Dana Amanah Pemberdayaan Masyarakat) in Activity Management Unit (UPK) Bangkit Mandiri Arjasa? (2) How is the perspective of Islamic law on the implementation of program DAPM (Dana Amanah Pemberdayaan Masyarakat) in Activity Management Unit (UPK) Bangkit Mandiri Arjasa? To answer the problem formulation, this research uses qualitative analysis method. That’s research is explain object which related with problem research without related with variable research relationship. Method of collecting data which used researcher is observation method, interview method, and dokumentation method. Based on the results of this research, can be seen that implemntation of community empowerment intruction fund program (DAPM) in Activity Management Unit (UPK) Bangkit Mandiri Arjasa isn’t allowed in islam because it requires the practice of accounts payable (loan) in Activity Management Unit (UPK) Bangkit Mandiri Arjasa is not allowed because it require the addition of money back at the beginning of the contract.

Abstract

YouTube is a social media that is in demand by many people of all age groups. Because of this, many people make YouTube a source of income. The way to make money from YouTube or called the Monetization system, requires YouTubers to enter into a cooperation agreement with the YouTube Partner Program. YouTubers who have made a contract by agreeing to all the rules from the YouTube Partner Program, but in practice they often violate these rules, in practice sometimes many YouTubers whose content violates Islamic Sharia and violates the rules of the YouTube community. The final conclusion from this research according to the Sharia Economic Law Perspective on creator content income on the YouTube Channel is allowed, because the agreement made by YouTubers and the YouTube Partner Program is with the pleasure of YouTubers by agreeing to the terms made by the YouTube Partner Program by clicking " Agree" to all the rules. on the channel there is no content that is prohibited by Islamic law and does not violate the approved rules of the YouTube community guidelines. So, the law of the contract remains valid because the principles and conditions have been meet.

Abstract

Pegadaian is a formal financial institution tasked with channeling financing in the form of providing loans to the public based on Sharia principles called pawning (rahn) in Fiqh Muamalah. To get a loan, the community must surrender the valuable objects they have to the pawnshop as collateral for their debt. The community in general recognizes a pawn with one of the debt agreements with collateral, where Rahn's party must return the debt with a period determined by both parties, if Rahn cannot repay the debt then the collateral will become the property of the murtahin. Usually, among the people, the collateral is used until Rahn can redeem the pawned item back. Thus the focus of this research is to find out the perspective of Islamic law on the practice of pawning goods in the form of houses in Sragi Village, Songgon District, Banyuwangi Regency. To answer the focus of this research, the researcher uses a qualitative method based on a doctrinal approach and interpretation of the sources and data obtained. Based on the results of this study, it can be seen that the practice of using pawned goods that occurred in Sragi Village, Songgon District, Banyuwangi Regency, if the murtahin occupies or uses the pawned goods is allowed, as long as the murtahin has obtained permission from the rahin and of course it has all been agreed in the initial agreement.

Abstract

Prilaku korupsi terjadi dimanapun dan ditempat manapun karena korupsi bisa terjadi disemua tempat dan waktu. Korupsi adalah juga merupakan kejahatan luar biasa karena didalamnya mengerogoti keuangan negara . Rakyat adalah yang dirugikan dalam prilaku korupsi . Di Indonesia korupsi politik semakin mewabah dan dilakukan oleh pelaku yang mempunyai kekuasaan politik. Pimpinan partai politik punya kuasa dan punya peran sentral dalam kekuasaan pimpinan politiknya. Bisa dikedudukan sebagai menteri atau jabatan birokrasi lainnya. Ada karakter hukum dalam korupsi politik dalam melakukan tindakan korupsinya. Di Indonesia punya karakter hukum tersendiri dalam prilaku korupsinya. Budaya ingin hidup mewah dan ingin cepat kaya itu salah satu mengapa melakukan sikap korupsi. Di Amerika Serikat juga terjadi korupsi politik karena pelaku punya kuasa dalam jabatannya. Prilakunya bermacam-macam salah satunya karena punya kuasa dalam jabatanya. Prilaku dan karakter hukum dalam korupsi politik di Indonesia dan Amerika Serikat ada kesamaan prilaku hukumnya. Tentunya dua duanya antara Indonesia dan Amerika Serikat ada sikap hukum dari pemerintah yakni korupsi yang dialkukannya harus ditindak secara hukum. Karakter korupsi politik ada arah dan dampaknya yakni merugikan keuangan negara.
