Abstract

Land registration is intended to ensure legal certainty through the issuance of land title certificates, which serve as legally recognized evidence of land rights. Article 32(2) of Government Regulation No. 24 of 1997 provides legal protection to landowners and certificate holders who acquire land rights in good faith and exercise actual physical possession of the land, provided that the certificate has been lawfully issued. However, the regulation does not specify the legal parameters of the phrase "lawfully issued," giving rise to normative ambiguity. This study examines the legal standards governing the validity of land title certificates under Article 32(2) of Government Regulation No. 24 of 1997 and evaluates their implications for legal certainty. The research employs a normative legal research method using statutory, conceptual, and case approaches. The findings demonstrate that the phrase "lawfully issued" may be interpreted as referring to either administrative validity or substantive validity, resulting in divergent interpretations in judicial practice. Accordingly, administrative and substantive validity should be construed as complementary and cumulative requirements in order to strengthen legal certainty and ensure effective protection of land rights.

Abstract

Perkembangan ekonomsi berbasis digital telah membuat munculnya model bisnis berlangganan yang banyak digunakan dalam layanan digital, seperti streaming, cloud storage, dan software as a service. Salah satu klausul yang umum digunakan dalam perjanjian berlangganan adalah klausul perpanjangan otomatis (auto-renewal), yaitu ketentuan yang secara otomatis memperpanjang masa berlangganan dan melakukan penagihan apabila konsumen tidak membatalkan layanan sebelum masa berlangganan berakhir. Dalam praktiknya, klausul tersebut sering dicantumkan dalam klausula baku dengan tingkat transparansi yang rendah sehingga berpotensi merugikan konsumen. Penelitian ini memiliki tujuan untuk mengevaluasi jenis perlindungan hukum yang tersedia bagi konsumen dalam kontrak berlangganan digital yang menggunakan sistem auto-renewal menurut hukum positif di Indonesia dan merumuskan langkah-langkah untuk memperkuat regulasi. Studi ini menerapkan metode normatif yuridis dengan dua pendekatan, yakni pendekatan perundang-undangan dan pendekatan konseptual. Temuan penelitian mengungkapkan bahwa perlindungan hukum bagi konsumen telah diatur dalam Undang-Undang Nomor 8 Tahun 1999 mengenai Perlindungan Konsumen, terutama pada ketentuan yang melarang klausul baku yang tidak dijelaskan secara transparan, yang didukung oleh Peraturan Pemerintah Nomor 80 Tahun 2019 mengenai Perdagangan Melalui Sistem Elektronik dan Undang-Undang Nomor 27 Tahun 2022 mengenai Perlindungan Data Pribadi. Namun, regulasi yang berlaku belum mengatur secara khusus kewajiban pemberitahuan sebelum penagihan otomatis maupun mekanisme pembatalan yang mudah. Kondisi tersebut menunjukkan pentingnya pembentukan regulasi teknis yang mengatur keterbukaan klausul perjanjian, kewajiban pelaku usaha untuk memberikan notifikasi, serta penyediaan prosedur pembatalan yang sederhana demi menjamin perlindungan hukum bagi konsumen layanan berlangganan digital.

Abstract

This article discusses law enforcement against political corruption in the budgeting process of the Regional Budget (APBD) within the local government. The research uses normative legal methods with statutory, conceptual, and case study approaches. Political corruption in APBD budgeting is not only in the form of bribes or gratuities, but also involves project manipulation and the use of budgets for political interests, which has direct implications for regional financial integrity and public services. Law enforcement against this practice is regulated in various regulations, including Law Number 31 Year 1999 jo. Law No. 20/2001 on the Eradication of Corruption as well as the Law on Local Government and technical regulations related to local financial management. Despite the availability of adequate legal instruments, in practice, enforcement is often hampered by weak proof of quid pro quo elements, political intervention, limited capacity of investigators in the regions, and low protection for whistleblowers. This article emphasizes the need for a more strategic and integrated approach to law enforcement, including strengthening synergies between law enforcement agencies, reforming internal control systems, digitizing budget processes, and the active role of civil society and the media as external watchdogs. Legal effectiveness in cracking down on political corruption can only be achieved through strong institutional commitment, political courage, and critical public participation in transparent and accountable local financial governance

Abstract

Waste management issues are closely linked to efforts to preserve environmental quality. The continued practice of open dumping at Final Processing Sites (TPA) shows that the implementation of an environmentally sound final waste processing system has not been running as it should. This has driven the need to examine the regional legal provisions that serve as the basis for the operation of TPA facilities in Buleleng Regency. This study focuses on the regulation of TPA facilities under Buleleng Regency Regional Regulation Number 1 of 2013 concerning Waste Management, as well as its relationship with national-level legal provisions. The study was conducted using a normative legal research method, using legislation and legal concepts as the basis for analysis. Relevant legal materials were collected through literature review, then analyzed qualitatively to identify the interconnections between legal provisions. The results of the study show that Buleleng Regency Regional Regulation Number 1 of 2013 has positioned final processing as one stage within the overall waste management process, while also placing restrictions on open dumping practices. The substance of this regulation is consistent and in line with Law Number 18 of 2008, Law Number 32 of 2009, and Government Regulation Number 81 of 2012. Therefore, it can be concluded that this regional regulation has provided a legal basis for the operation of TPA facilities directed toward proper waste management and environmental protection.

Abstract

The reform of Indonesia’s business licensing system through Risk-Based Business Licensing as regulated under Goverment Regulation No. 5 of 2021 aims to establish a conducive investment climate by simplifying licensing procedures based on the level of risk associated with the business activity. Nevertheless, the implementation of business licensing must remain consistent with spatial planning as stipulated under the regulations in Goverment Regulation No. 21 of 2021 concerning Spatial Planning Administration and the Bali Provincial Regulatian Number 2 of 2023 concerning the Bali Provincial Spatial Plam (RTRW) for 2023-2043, particularly regarding the protection of conservation areas. This research is motivated by the potential disharmony between the regulation Risk-Based Business Licensing and spatial palnning provisions, particularly in connection with the issuance of busniness licenses within areas adjacent to protected areas. This issue is reflected in the business activities associated with the issuance of Business Identification Number (NIB) through the Online Single Submission Ris-based Approach (OSS-RBA) system in the Pemutih Beach ares, Pecatu Village, Badung Regency, raising questions regarding the comformity of licensing system with the applicable spatial planning regulations. this study is intended to analyze the harmonization between the regulation of Risl-based Business Licensing and the Bali Provincial Spatial Plan in protecting conservation areas, as well as to examine the consistency among Goverment Regulation No. 5 of 2021, Goverment Regulation No. 21 of 2021, and Bali Provinsiap Regulation No. 2 of 2023 in ensuring legal certainly a normative legal research method using both the statutory approach and the conseptual approach, with qualitative analysis based on library research. The findings of this study are expected to contribute to the harmonization of business licensing plicies and spatial planning regulations in order to ensure legal certaintywhile safeguarding protectedareas as part of sustainable development

Abstract

This study focuses on evaluating the legal framework of the Sale and Purchase Binding Agreement (PPJB) for uncertified land in Indonesia and formulating an ideal regulatory model to ensure legal protection and certainty for all parties involved. The primary driver of this research is the lack of specific regulations governing PPJB on uncertified land, which forces its practical implementation to rely merely on general contract law, overall agrarian provisions, and customary notarial practices. This circumstance creates a normative void that risks causing inconsistent procedures and legal disputes. Utilizing statutory and conceptual approaches, this normative legal research analyzes primary, secondary, and tertiary legal sources through qualitative examination. Findings reveal that current Indonesian laws do not comprehensively govern PPJB for uncertified land, leaving its enforceability dependent strictly on the freedom of contract principle under the Civil Code. Consequently, dedicated regulations are urgently required to define the legal standing of PPJB, land eligibility standards, mandatory contractual terms, notarial duty of care, protections for good-faith buyers, and dispute resolution channels. Such legislation is expected to establish legal certainty, procedural uniformity, and enhanced legal safeguards.

Abstract

Difficulties concerning land persist, impeding the achievement of legal assurance and effective community administration. The government endeavors to address this via the PTSL (Complete Systematic Land Registration), aiming to furnish land certificates that serve as evidence of land ownership for citizens and offer robust legal safeguards. This research adopted a normative legal methodology, characterized by its descriptive approach. The investigative framework incorporated the statute, conceptual, and case approaches. Among the identified legal impediments to the execution of the 2026 PTSL in Buleleng Regency is the issue of incomplete legal documentation, such as land certificates. Community land registration is hindered by legal challenges, impeding their ability to secure official land certificates. Effective program execution necessitates an equilibrium between legal assurance and tangible advantages, facilitated by a verification process that adheres to established legal frameworks. This approach will more effectively achieve the program's objective of providing legal protection and certainty to the community
