Abstract

The development of digital gaming industry has led to a surge in game top-up transactions that involve not only adult consumers, but also minors. The characteristics of top-up transactions, which are instant, repetitive, and directly integrated with the game mechanism, have the potential to encourage impulsive consumption behavior in children who are psychologically and legally immature in making economic decisions. This article aims to analyze game top-up transactions made by minors from the perspective of consumer protection law and child protection law. This study uses a normative legal research method with a legislative and conceptual approach, through analysis of the Civil Code, the Consumer Protection Law, and the Child Protection Law. The results of the study indicate that game top-up transactions by children raise issues of contract validity due to the lack of the element of legal capacity, and place children as digital consumers who are vulnerable to harmful economic practices. Furthermore, the absence of specific regulations regarding digital transactions involving children means that the responsibilities of game operators and digital platforms are not clearly defined. Therefore, it is necessary to strengthen regulations and clarify the responsibilities of operators to ensure effective legal protection for children in game top-up transactions.

Abstract

Narcotics as a special criminal offense under Law No. 35 of 2009 has distinct characteristics compared to general crimes in the Indonesian Penal Code, such as minimum sentencing, reversed burden of proof, and the principle of ultimum remedium. However, law enforcement practice in Indonesia still shows imbalance between repressive approaches through imprisonment and restorative approaches through rehabilitation for users and addicts. This study aims to analyze the urgency of law enforcement and the optimization of rehabilitation policies for narcotics crimes as special criminal offenses. The research method used is normative juridical with statutory, conceptual, and court decision analysis approaches. The findings indicate that the urgency of law enforcement remains necessary to create a deterrent effect on traffickers and dealers, while rehabilitation should be prioritized for users and addicts in accordance with the objectives of the Narcotics Law and Supreme Court Circular Letter No. 4 of 2010. The lack of consistency in judicial decisions, limited rehabilitation facilities, and social stigma are the main obstacles to optimizing rehabilitation policies. It is concluded that narcotics law enforcement in Indonesia needs to integrate a dual paradigm: repressive toward perpetrators of illicit trafficking and rehabilitative toward victims of abuse, so that the objectives of punishment and recovery can be achieved proportionally.

Abstract

Marriage signifies a lifelong bond between a man and a woman, legally and religiously regulated in accordance with the couple's intentions and applicable rules, and maintained throughout their lives within the institution of marriage (Tuti, 2006). According to Thalib (1996), marriage is a sacred and binding agreement for a man and a woman to live together legally, with the hope of building an enduring family characterized by mutual respect, love, peace, and happiness. The amendment of Law Number 1 of 1974 by Law Number 16 of 2019 established a minimum marriage age of 19 for both men and women, an effort aimed at protecting children's rights and curbing early marriage rates. Nevertheless, the provisions for marriage dispensation—as regulated by Supreme Court Regulation (PERMA) Number 5 of 2019—still allow for underage marriages through court rulings based on urgent grounds. This study aims to analyze the handling of marriage dispensation applications at the Denpasar District Court following the enactment of PERMA Number 5 of 2019, specifically regarding child protection, and to identify the challenges faced and potential solutions. The study employs an empirical legal research method with a qualitative approach. Primary data were obtained through observation and interviews with Denpasar District Court officials, while secondary data were derived from relevant legislation, literature, and scientific journals. The findings indicate that judges have applied the principle of the "best interests of the child" by assessing psychological, health, and physical readiness aspects, as well as social conditions and the child's future, prior to granting a marriage dispensation. However, implementation still faces various obstacles, such as the public's limited legal understanding, difficulties in proving "urgent grounds," the practice of marriage occurring prior to the court ruling, socio-cultural pressures, and administrative hurdles. Therefore, it is necessary to strengthen the capacity of judges, foster inter-agency synergy, provide psychological assessment services, and conduct continuous outreach so that marriage dispensations truly serve as an instrument for child protection and are granted only in highly urgent circumstances, in accordance with the principle of the best interests of the child.

Abstract

The modernization of criminal case administration is part of the judiciary’s digital transformation through the Electronic Integrated Criminal Case File (e-Berpadu) application. This study aims to examine the implementation of e-Berpadu in criminal case administration and the utilization of its services at the Denpasar District Court based on Criminal Registry Office data for 2024–2025. This research employed an empirical legal research method with a descriptive qualitative approach. Data were collected through observation, interviews with officials of the Criminal Registry Office, and library research. The findings indicate that e-Berpadu has been effectively implemented since 1 January 2023 through an integrated administrative system supported by document verification, regular monitoring and evaluation, and coordination among law enforcement agencies. The increasing utilization of most e-Berpadu services during 2024–2025 demonstrates its contribution to more effective, efficient, transparent, and accountable criminal case administration.

Abstract

Administrasi pertanahan telah mengalami transformasi digital yang mendorong penggunaan sertifikat tanah elektronik menjadi bentuk dari modernisasi sistem pendaftaran tanah di Indonesia. Kehadiran sertifikat elektronik menimbulkan berbagai implikasi yuridis, khususnya terkait penguatan dalam pembuktian materiil pada sengketa kepemilikan hak terhadap tanah. Penelitian ini bertujuan untuk menganalisis perubahan sertifikat tanah elektronik dalam sistem pendaftaran tanah di Indonesia, mempelajari posisinya sebagai bukti hak atas tanah, serta meninjau dampak hukumnya terhadap kekuatan bukti dalam permasalahan sengketa kepemilikan tanah. Penelitian ini menggunakan metode hukum normatif dengan mendekati peraturan perundang-undangan serta konsep-konsep yang relevan. Hasil penelitian menunjukkan bahwa sertifikat tanah elektronik merupakan bentuk modernisasi administrasi pertanahan yang tidak mengubah substansi hak atas tanah maupun prinsip dasar pendaftaran tanah. Secara yuridis, sertifikat tanah elektronik memiliki posisi yang sah sebagai alat bukti hak atas tanah berdasarkan ketentuan hukum pertanahan dan pengakuan dokumen elektronik dalam peraturan perundang-undangan. Transformasi tersebut tidak mengubah nilai pembuktian materiil sertifikat, namun memperluas aspek pembuktian yang tidak hanya berkaitan dengan kebenaran data fisik dan data yuridis, tetapi juga mencakup integritas, keamanan, dan keandalan sistem elektronik yang mengelola data pertanahan. Oleh karena itu, fektivitas sertifikat tanah elektronik dalam memberikan kepastian hukum sangat bergantung pada akurasi data, keamanan sistem informasi, serta pengawasan yang mampu menjamin keautentikan dan validitas data pertanahan.

Abstract

The use of electronic monitoring devices (EMDs) or electronic ankle bracelets as a tool for supervising detainees under city custody is part of efforts to modernize Indonesia’s criminal justice system in order to address the problem of overcrowding in state detention centers (rutan) and correctional institutions (lapas). This study aims to analyze the effectiveness of implementing electronic ankle monitors as a tool for supervising pretrial detainees at the Sidoarjo District Attorney’s Office and to identify the challenges encountered in their implementation. The method used is empirical legal research with a descriptive qualitative approach. Primary data were obtained through direct observation and in-depth interviews with the Head of Intelligence Subdivision I at the Sidoarjo District Attorney’s Office, while secondary data were sourced from relevant laws and regulations and official documents. The research findings indicate that the APE system has been implemented at the Sidoarjo District Attorney’s Office since 2025 in accordance with the Attorney General of the Republic of Indonesia’s Guideline No. 4 of 2023, with a total of 4 cases as of June 2026. Supervision is carried out in multiple layers through a real-time GPS monitoring system integrated with institutional oversight by the Intelligence Division, including the deployment of the TABUR Team to address violations in the field. Mechanisms involving monetary or personal guarantees further reinforce the defendants’ compliance. Challenges identified include violations of designated zones, defendants forcibly removing the devices, and delays in implementation at the work unit level. This study concludes that the APE is generally effective as a more modern and measurable instrument for supervising defendants under city detention compared to conventional mechanisms; however, it requires strengthening in terms of defendant compliance and broader, more equitable implementation across all district attorney’s offices.

Abstract

This study aims to analyze the implementation of Article 3 Paragraph (1) of Law Number 2 of 1960 concerning Sharecropping Agreements in Kintamani Village, Kintamani District, Bangli Regency, and to identify the obstacles affecting its implementation. This research employed an empirical legal research method with a descriptive empirical juridical approach. Primary data were collected through field observations and interviews with the Village Head, traditional community leaders, landowners, and sharecroppers, while secondary data were obtained through a literature review of legislation, books, and scholarly journals. The findings indicate that the implementation of Article 3 Paragraph (1) of Law Number 2 of 1960 has not been effective. A total of 87.5% of respondents still conduct sharecropping agreements orally through the traditional nyakap system, which is based on mutual trust, kinship, and long-standing customary practices, while only 12.5% execute written agreements as required by the law. These findings demonstrate a discrepancy between the applicable legal norms (das sollen) and the actual practices within the community (das sein). The primary obstacles to implementation include the strong legal culture that continues to uphold customary practices, the limited public understanding of the legal requirement to establish written agreements, and the lack of effective dissemination, supervision, and legal guidance from the village government and relevant authorities. The study concludes that improving the effectiveness of Law Number 2 of 1960 requires strengthening public legal awareness, enhancing the government's role in legal education and supervision, and promoting harmony between state law and the living law practiced within the community. Such efforts are essential to ensure legal certainty and legal protection for both landowners and sharecroppers in the implementation of agricultural sharecropping agreements.

Abstract

The principle of simple, speedy, and low-cost justice is a fundamental element in ensuring effective civil dispute resolution, including cases of breach of contract. This study aims to analyze the implementation of these principles in resolving breach of contract disputes at the Denpasar District Court, identify the factors affecting their effectiveness, and formulate optimization efforts. This research employed an empirical juridical approach with a descriptive qualitative method. Primary data were obtained through interviews with a judge of the Denpasar District Court, while secondary data were collected through literature and legal document reviews. The findings indicate that the implementation of these principles has been supported by the adoption of e-Court and electronic litigation, which improve administrative efficiency and reduce litigation costs. However, their effectiveness is influenced by the parties' good faith, compliance with the court calendar, the success rate of mediation, infrastructure limitations, and the outdated civil procedural law. Therefore, strengthening digital infrastructure and reforming civil procedural law are essential to optimize judicial services.

Abstract

Republic of Indonesia Prosecutor's Office Regulation Number 15 of 2020 regulates the termination of prosecution based on restorative justice as an effort to achieve a more restorative-oriented resolution of criminal cases. However, several provisions still contain vague norms that have the potential to lead to differing interpretations and reduce legal certainty. This study aims to analyze the forms of vague norms in Prosecutor's Office Regulation Number 15 of 2020 and their implications for legal certainty. The study uses normative legal methods with a statutory and conceptual approach, supported by a literature review of primary, secondary, and tertiary legal materials. The results indicate that the phrases "legal interest," "victim's interest," "community response," and the regulation of exceptions to the requirements for termination of prosecution lack clear parameters, thus opening up broad discretion for prosecutors. This situation has the potential to create disparities in the application of the law and reduce legal certainty. Therefore, improvements to norms and clearer technical guidelines are needed to ensure the consistent implementation of restorative justice and provide legal certainty

Abstract

Land is an object of property rights that has important economic, social, and legal value for the community.However, the geographical conditions in Indonesia are often prone to natural disasters, which can cause land to change physically or be lost permanently.This results in the land being unable to be identified, used, or developed as it should be. The government is trying to provide legal certainty in this situation.Through Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Office Number 17 of 2021 on the Procedures for Determining Lost Land, the government has set out how the status of lost land is determined, along with the legal basis, which includes removing the land rights.However, the regulation still raises important issues regarding the state's responsibility towards land rights holders who lose their rights. This rule only deals with the provision of religious funds to the land rights holders, but it does not explain what the funds are, how much they are, the basis for calculating them, the process of giving them, or who is responsible for distributing the money.
