Abstract

Buying and selling are essential economic activities integral to fulfilling daily needs. In the community of Kuala Stabas, Pesisir Barat Regency, Lampung, Indonesia, a unique system for trading seaweed using plastic bags without prior weighing is prevalent. The legality of this system under Sharia economic law remains unclear. This study aims to address this research gap by evaluating the legitimacy of the seaweed trading system using plastic bags from the perspective of Sharia economic law while also examining the local wisdom inherent in the practices of the Lampung community. This field research employs a qualitative descriptive approach, gathering primary data through interviews with key informants and supplementing it with secondary data. The uniqueness of this study lies in its in-depth analysis of local practices that have been scarcely studied. Findings indicate that the practice of trading seaweed using plastic bags in Kuala Stabas is lawful and permissible under Sharia economic law, as it aligns with the principles, requirements, and conditions of trade in Sharia, including Aqidain, Sighat (ijab qabul) and Ma'qud 'alaih. This research significantly contributes new insights into the local trading dynamics within the framework of Sharia economic law, enriching the existing literature and providing a foundation for further research.

Abstract

This study aims to evaluate the impact of the delay in Mie Gacoan’s halal certification on consumer loyalty. The delay in halal certification can influence consumer perception and loyalty, yet there is limited research exploring its impact on the food industry in Indonesia. This study employs field research methods, using direct observation and a descriptive qualitative approach to collect and analyze data. The results indicate that most Mie Gacoan consumers know about the delay in halal certification. Despite this, consumers remain highly interested in visiting and purchasing Mie Gacoan products, as they trust that 100% of the raw materials used are safe and have been certified halal. These findings suggest that the delay in halal certification does not significantly affect purchase intentions and consumer loyalty. This research provides new insights into consumer responses to the delay in halal certification, demonstrating that consumer trust in the quality and safety of raw materials can mitigate concerns related to the delay, thus maintaining consumer loyalty to the product.

Abstract

Women significantly contribute to the national economy through their Micro, Small, and Medium Enterprises (MSMEs) roles. However, they face inadequate support from government and private sectors in accessing formal financial services. This research addresses the gap in gender-inclusive financial support by exploring the potential of productive Zakat within the framework of Sharia Economic Law in Indonesia and social fiqh. The study aims to evaluate how productive Zakat can mitigate gender inequality and promote economic inclusion for women. A qualitative methodology with a normative approach was employed to address this issue, utilizing the social fiqh paradigm for analysis. As a legal product, the findings reveal that fiqh evolves with societal changes. Social realities, such as the discrimination women face in accessing financial resources, necessitate the adaptive allocation of Zakat. Precisely, dedicating Zakat to women reflects their unique economic challenges and highlights the need for specialized management structures to distribute productive Zakat effectively. This study contributes to the existing literature by demonstrating the practical application of Sharia Economic Law in Indonesia and social fiqh in addressing contemporary gender disparities in economic participation. The novelty lies in proposing a structured and professional management system for productive Zakat to empower women, fostering economic inclusivity.

Abstract

This study examines the practice of qardhul hasan funded by zakat through the perspective of maqasid sharia, focusing on case studies in Indonesia and Malaysia. Qardhul hasan, defined as an interest-free loan, presents a promising method for effectively utilizing zakat funds; however, its implementation within the framework of Islamic law remains a subject of ongoing debate. A qualitative approach was employed, including content analysis and semi-structured interviews with experts in zakat and Islamic law. The findings indicate that maqasid sharia provides a strong foundation for implementing qardhul hasan, particularly in supporting post-pandemic economic recovery. It is crucial to establish clear parameters and guidelines to ensure that qardhul hasan practices adhere to sharia principles and achieve the goal of social justice. This research advances the current understanding of qardhul hasan by highlighting its potential impact on zakat management and economic recovery. Additionally, it encourages zakat policymakers and practitioners to focus on developing effective systems aligned with maqasid sharia and emphasizes the need for ongoing evaluation and trials to enhance zakat's role in societal welfare.

Abstract

The existence of a legal relationship often underlies collaboration between parties, including between TikTok affiliates and TikTok sellers. The enactment of Ministry of Trade Regulation No. 31 of 2023 has changed the mechanism of TikTok's affiliate system, affecting the legal relationship between these parties. However, previous studies have not adequately explored the legal implications of these changes, particularly from the perspective of Sharia economic law. This study is a normative-empirical legal research employing a qualitative method and a juridical-sociological approach. Data were collected through observation, literature review, and interviews. The study distinguishes itself by combining doctrinal legal analysis with field-based empirical insights and by incorporating Islamic legal principles into digital commercial practices. The findings categorize TikTok affiliate mechanisms into two types. First, commission-based affiliates do not require prior approval from sellers, thus lacking a formal legal relationship. Second, affiliates who enter into cooperation contracts with sellers, which implies a legal relationship, although often weakened by the informal nature of these agreements. From the perspective of Sharia economic law, the first category aligns with a ju’alah contract, while the second involves a valid work-based contract. The study contributes new insights into the classification and legal strength of digital affiliate relationships under both state and Sharia law, especially in light of recent regulatory reforms
