Abstract

Global Awareness of Halal Products in Relation to the Economic Behavior of the Indonesian Society in the Industrial Revolution 4.0 Era, nowadays it has become a demand of the times whose cause is the existence of a great opportunity for the existence and development of the halal industry (sharia economy) in Indonesia. Where an indicator of awareness of halal products in Indonesia is the behavior of consumers or non-Muslim communities in consuming halal products. This library research was obtained from various primary and secondary sources from various literacy such as books, journals and the internet. The results of the study prove that the relevance of global awareness of halal products is related to the economic behavior of the Indonesian people in the era of the industrial revolution 4.0 as it is today, as evidenced by the many potential attractions of halal food in Indonesia which have their own variants in meeting market demand for halal products so that Indonesia as a The largest Muslim population in the world should be aware of their behavior in consuming halal products on the market, meaning that they are not inferior to non-Muslims in developing these halal products. Equally important in forming global awareness of halal products, the economic behavior of the Indonesian people, especially in this all-digital era (4.0), should carry out halal labeling and halal certification in order to be able to compete with market share.

Abstract

This study wants to reveal how the western world responds to the existence of Islamic banking in Indonesia?; and what is the contribution of the western world to the existence of Islamic banking in Indonesia? This type of research is a normative juridical research. This study is intended to explore the response of the western world to Islamic banking that exists in Indonesia. This study, resulted that the western world's response to Islamic banking in Indonesia, namely the Western economic system is intended to embrace the Islamic economic system in the field of Islamic banking and support the existence of Islamic banking, it is proven that the western world implements a free business system based on capitalism which prioritize capital in order to build the economy in the Islamic economic system. Second, the contribution of the western world to the existence of Islamic banking in Indonesia is a necessity which in fact is not an Islamic State. However, in its scope, Islamic law in Indonesia in this case the sharia economy is subject to the national economic system, although in Indonesia itself the sharia economic system and conventional economics in Indonesia have their own legal umbrella. So that the Islamic economic system in Indonesia until this moment is an alternative concept (progressive Islamic law) for a prosperous economic system in Indonesia, one of which is a capitalist economic system. derived from sources of Islamic law, especially the Koran and al-Hadith.ABSTRAKPenelitian ini ingin mengungkap terkait bagaimana respon dunia barat terhadap eksistensi perbankan syariah di Indonesia?; dan apa sumbangsih dari Dunia barat terhadap eksistensi perbankan syariah di Indonesia ?. Jenis penelitian ini merupakan penelitian yuridis normative. Penelitian ini dimaksudkan guna mengeksplorasi respon dunia barat terhadap perbankan syariah yang eksis di Indonesia. Penelitian ini, menghasilkan bahwa respon dunia barat terhadap perbankan syariah di Indonesia yaitu sistem ekonomi Barat ini dimaksudkan merangkul system ekonomi islam dalam bidang perbankan syariah dan mendukung dengan eksisnya perbankan syariah tersebut, hal ini terbukti bahwa Dunia barat menerapkan sistem usaha bebas yang dilandaskan pada kapitalisme yang mengedepankan modal dalam rangka membangun ekonomi didalam system ekonomi islam. Kedua, Sumbangsih dari Dunia barat terhadap eksistensi perbankan syariah di Indonesia merupakan sebuah keniscayaan yang notabene Negara Indonesia bukan Negara Islam. Namun pada lingkupnya Hukum islam di Indonesia dalam hal ini ekonomi syari’ah tunduk pada sistem ekonomi nasional, walaupun di Indonesia sendiri sistem ekonomi syariah dan ekonomi konvensional di Indonesia memiliki payung hukum tersendiri. Sehingga sistem ekonomi Islam di Indonesia sampai detik ini merupakan konsep alternatif (hukum islam progresif) bagi sistem ekonomi di Indonesia yang sejahtera yaitu salah satunya adalah sistem ekonomi kapitalis hal ini diharapkan dapat membawa hal-hal positif dari keduanya dengan batasan tidak bertentangan dengan syariah Islam yang berasal dari sumber-sumber hukum Islam, khususnya al-Quran dan al-Hadis.

Abstract

Purpose – This study investigates the integration of productive waqf into Sharia insurance in Indonesia and its contribution to investment benefits and life protection. It aims to explore how waqf can enhance the economic and social impacts of Sharia insurance products.Methodology – A qualitative approach was employed, involving a comprehensive review of the literature on waqf, Sharia insurance, and Islamic finance. Additionally, interviews were conducted with experts in Sharia insurance and waqf management to gather insights into the current practices and challenges.Findings – This study reveals that productive waqf initiatives within Sharia insurance have the potential to significantly improve investment returns and expand the scope of life protection benefits offered to participants. It identifies key areas in which waqf funds can be deployed effectively, such as long-term investment projects and social welfare programs.Implications – The findings have practical implications for policymakers, Sharia insurance providers, and waqf administrators in enhancing collaboration to maximize the socio-economic benefits of waqf. By integrating waqf into insurance products, stakeholders can foster sustainable development and financial inclusivity.Originality – This study contributes to the literature by offering insights into the innovative use of waqf within the dynamic context of Sharia insurance. It underscores the originality of leveraging waqf assets to address contemporary socioeconomic challenges and promote ethical finance principles.

Abstract

This study aims to analyze how the state regulates the administration of unregistered marriages (nikah sirri) in Muslim minority communities in Jayapura City, with a focus on the practice of mass weddings organized to facilitate the registration of marriages. Unregistered marriages, which are not recorded by the state, are still found among Muslim minorities in Jayapura. Factors influencing the practice of unregistered marriages include economic limitations, lack of awareness about administrative procedures, and difficulty in accessing official marriage registration services. To address these issues, the Jayapura City government, through the Religious Affairs Office (KUA), the Religious Court (PA), and the Directorate General of Population and Civil Registration (DUKCAPIL), has initiated a mass wedding program aimed at simplifying the legalization process for couples who have not yet registered their marriages. This research uses a qualitative approach with interviews and observations of couples participating in the mass wedding program. The findings indicate that this program is effective in raising public awareness about the importance of marriage registration. However, challenges remain in terms of legal understanding and the readiness of couples to comply with the applicable administrative procedures. The study suggests the need for increased education about the importance of marriage administration and strengthening access to marriage registration services to reduce the practice of unregistered marriages. With the mass wedding program, it is hoped that all marriages in Jayapura City can be legally registered according to state law, providing optimal legal protection for married couples

Abstract

The archery extracurricular program at MI Plus Nurul Huda Cijurey aims to shape students' character by integrating the principles of Islamic education. Archery activities not only teach physical skills, but also instill the values ​​of discipline, calmness, precision, and patience. This study uses the research and development (R&D) method to design and develop an effective extracurricular program in strengthening students' character and spirituality. The results of the study showed that the archery program increased concentration, togetherness, self-confidence, and the ability to be patient. This program also supports the formation of noble morals and strengthens the attitude of tawakal, which is in line with the principles of Islamic education. Overall, this program has a positive impact on the physical, mental, and spiritual aspects of students.

Abstract

This article aims to uncover and explore: 1) Prospects of developing a halal tourism industrial area in West Java; 2) Review of sharia economic law in the development of the halal tourism industrial area in West Java. The legal research method used is normative legal research, including statutory regulations in the form of the Tourism Law, Minister of Tourism Regulations, Governor Regulations, Regional Regulations, and the MUI Fatwa on the Implementation of Halal Tourism. The legal research approach used in this study, namely the library research approach obtained from various library sources such as journals, the internet, books, and other documents relevant to Islamic business ethics, in the development of the halal tourism industrial area in Java. West. The theory used in this research uses the Maqashid Syariah theory and Islamic business ethics. The results of the study show that: 1) the prospect of developing a halal tourism industrial area in West Java has several development prospects in several aspects, in Bandung City and Bandung Regency developing Muslim-friendly tourism where the implementation is through the development of Halal Tourism Destinations in a more progressive, directed, and sustainable manner, in Ciamis Regency developed the concept of superior tourism by prioritizing excellent service and increasing professional and sustainable tourism potential, meanwhile in Pangandaran Regency developing a tourism concept which includes 5A (attractions, accessibility, amenities, available packages, activities, ancillary services) namely attractions, accessibility, facilities, available packages, activities, additional services. 2) Thus the review of sharia economic law in the development of the halal tourism industrial area in West Java is included in the recommended tourism concept, this is because the majority of the population is Muslim, in addition to maqashid sharia and Islamic business ethics that the concept of halal tourism in West Java including the concept of complementary tourism that prioritizes Islamic services in the implementation of its business, this can be seen from the availability of halal food, places of worship, and hotels that provide various needs of Muslim tourists.   Artikel ini bertujuan untuk menguak serta menggali tentang : 1) Prospek Pengembangan kawasan industri pariwisata halal di Jawa Barat; 2) Tinjauan hukum ekonomi syariah dalam pengembangan kawasan industri pariwisata halal di Jawa Barat. Metode penelitian hukum yang digunakan adalah penelitian hukum normatif, meliputi peraturan perundang-undangan berupa UU Kepariwisataan, Peraturan Menteri Pariwisata, Peraturan Gubernur, Peraturan Daerah, dan Fatwa MUI tentang Penyelenggaraan Pariwisata Halal. Adapun pendekatan penelitian hukum digunakan dalam penelitian ini, yakni pendekatan penelitian kepustakaan (library research) yang diperoleh dari berbagai sumber kepustakaan seperti jurnal, internet, buku-buku, dan dokumen lainnya yang relevan tentang etika binsis islam, dalam pengembangan kawasan indutri pariwisata halal di Jawa Barat. Adapun teori yang digunakan dalam peneliti ini menggunakan teori Maqashid Syariah dan etika bisnis islami. Hasil penelitian menunjukkan bahwa : 1) prospek pengembangan kawasan industri pariwisata halal di Jawa Barat memiliki beberapa prospek pengembangan dalam beberapa aspek, di Kota Bandung dan Kabupaten Bandung mengembangkan wisata ramah muslim dimana pelaksanaannya melalui pengembangan Destinasi Pariwisata Halal secara lebih progresif, terarah, dan berkesinambungan, di Kabupaten Ciamis mengembangkan konsep pariwisata unggulan dengan mengedepankan pelayanan prima dan meningkatnya potensi kepariwisataan yang profesional dan kesinambungan, sementara itu di Kabupaten Pangandaran mengembangkan konsep pariwisata yang meliputi 5A (attractions, accessibility, amenities, available packages, activities, ancillary services) yakni atraksi, aksesibilitas, fasilitas, paket yang tersedia, aktivitas, layanan tambahan. 2) Dengan demikian tinjauan hukum ekonomi syariah dalam pengembangan kawasan industri pariwisata halal di Jawa Barat termasuk pada konsep pariwisata yang dianjurkan, hal ini dikarenakan mayoritas penduduknya adalah muslim, selain itu secara maqashid syariah dan etika bisnis islami bahwa konsep pariwisata halal yang ada di Jawa Barat termasuk pada konsep pariwisata pelengkap yang mengedepankan pelayanan islami dalam pelaksanaan bisnisnya, hal ini dapat dilihat dari tersedianya makanan halal, tempat ibadah, dan hotel-hotel yang menyediakan berbagai kebutuhan wisatawan muslim.

Abstract

Pembahasan tentang kewarisan di Indonesia masih menjadi persoalan yang sering menjadi perbedatan. Dimana dalam hukum Islam sebagaimana disinggung dalam Al-Qur’an surat an-Nisa ayat 11 Pembagian waris yakni 1:2, namun hal ini dirasa belum adil, sehingga keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia perlu dikedepankan. Tujuan penelitian ini adalah untuk membahas tentang prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia. Melalui pendekatan teori maslahah Ibnu Qayyim Al-Jauziyah, peneliti memusatkan perhatian pada masalah pembagian waris yang berlaku di Indonesia dan pendistribusianya dilaksanakan secara berkeadilan (maslahah). Penelitian ini menyimpulkan bahwa : 1) prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia adalah konsep berdasarkan prinsip kesepakatan (musyawarah); 2) penerapan prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia dapat dilakukan dengan cara menerapkan Prinsip kesetaraan gender secara Islami yakni dengan mengedepankan konsep rahmatan lil’alamin. Discussion of inheritance in Indonesia is still an issue that often becomes a matter of debate. Where in Islamic law as alluded to in the Qur'an letter an-Nisa verse 11 the distribution of inheritance is 1: 2, but this is felt to be unfair, so that gender-friendly based justice (maslahah) in the distribution of inheritance in Indonesia needs to be put forward. The purpose of this study is to discuss the principles of gender-friendly justice (maslahah) in inheritance distribution in Indonesia. Through the maslahah theory approach of Ibn Qayyim Al-Jauziyah, the researcher focuses on the problem of inheritance distribution that applies in Indonesia and its distribution is carried out in a fair manner (maslahah). This study concludes that: 1) the principles of gender-friendly justice (maslahah) in the distribution of inheritance in Indonesia are concepts based on the principle of agreement (deliberation); 2) application of the principles of gender-friendly justice (maslahah) in the distribution of inheritance in Indonesia can be carried out by applying the principle of Islamic gender equality by prioritizing the concept of rahmatan lil'alamin.

Abstract

Purpose - This research aims to analyze the application of Maqāṣid al-Sharīʿah principles according to al-Shatibi in the context of the halal lifestyle in the digital era. The main focus of this research is how digital technology, such as halal e-commerce platforms and digital halal marker applications, can facilitate access and transparency of halal products. In addition, this study examines the relevance of Maqāṣid al-Sharīʿah principles in the contemporary Islamic legal framework in facing the challenges of regulation and validity of halal information. Methods - This research uses a qualitative method with a literature review approach and case analysis. Data is collected through literature studies related to digital halal regulations and studies on technology implementation in supporting halal lifestyles. Findings - The results show that digital technology plays a role in strengthening halal lifestyles through innovations that increase accessibility and transparency. However, challenges such as unverified information, evolving regulations, and potential deviations from Shariah principles must be addressed. Collaboration between government, industry, and society is key to overcoming these challenges. Contribution/Limitation - This research contributes to understanding the relationship between Maqāṣid al-Sharīʿah, digital technology, and contemporary Islamic law in supporting halal lifestyle. However, this research is still limited to literature analysis and does not include empirical research on halal technology users in Indonesia. Originality/Value - This research offers new insights into the integration of technology in the principles of Maqāṣid al-Sharīʿah in contemporary Islamic law.

Abstract

Purpose – This study explores the transformation of zakat distribution principles as outlined in Nahdlatul Ulama’s Fatwa Bahtsul Masail and its implications for Indonesia's legal regulations. The goal is to understand how these principles can enhance zakat management by addressing social inequality and poverty alleviation.Methodology – A normative juridical approach was used, with a descriptive analytical study based on a literature review. The research focuses on four main aspects: analyzing zakat distribution principles in the context of Indonesian law, examining the legal reasoning (istinbath hukum) behind these principles, identifying factors driving and hindering the transformation, and assessing the significance of implementing these principles in Indonesian legal frameworks.Findings – This study identifies three main principles—justice, equality, and regionality—that should be integrated into regulatory frameworks. It also highlights challenges, including a lack of public participation in zakat distribution through official institutions, such as NU CARE-LAZISNU.Implications – The findings suggest the need for increased socialization of zakat management principles by the National Amil Zakat Agency (Badan Amil Zakat Nasional, BAZNAS), based on both Sharia and secure legal regulations, to enhance the effectiveness of zakat management in Indonesia.Originality – This research provides valuable insights into the evolving principles of zakat distribution and their integration into legal frameworks, contributing to the adaptation of zakat management practices to contemporary challenges in Indonesia.

Abstract

This study examines the practice of qardhul hasan funded by zakat through the perspective of maqasid sharia, focusing on case studies in Indonesia and Malaysia. Qardhul hasan, defined as an interest-free loan, presents a promising method for effectively utilizing zakat funds; however, its implementation within the framework of Islamic law remains a subject of ongoing debate. A qualitative approach was employed, including content analysis and semi-structured interviews with experts in zakat and Islamic law. The findings indicate that maqasid sharia provides a strong foundation for implementing qardhul hasan, particularly in supporting post-pandemic economic recovery. It is crucial to establish clear parameters and guidelines to ensure that qardhul hasan practices adhere to sharia principles and achieve the goal of social justice. This research advances the current understanding of qardhul hasan by highlighting its potential impact on zakat management and economic recovery. Additionally, it encourages zakat policymakers and practitioners to focus on developing effective systems aligned with maqasid sharia and emphasizes the need for ongoing evaluation and trials to enhance zakat's role in societal welfare.
