Abstract

The government currently supports creative business actors by providing facilities for designing intellectual property rights financing, with the aim of enabling creative entrepreneurs, especially YouTubers, to use their YouTube channel copyrights as collateral through financial institutions such as banks and non-banking institutions. This research discusses the legal regulations related to copyright that apply to YouTube channels as objects of fiduciary guarantees and identifies the obstacles in making YouTube channels eligible for such guarantees. The study uses a normative legal research approach, supported by a literature study. The research methodologies include the statutory approach, conceptual approach, and Sharia economic law analysis. Secondary data was obtained through library research. The findings from the literature review conclude that YouTube channel copyrights have the potential to be used as objects of fiduciary guarantees in accordance with the provisions set forth in Article 16 of Law Number 28 of 2014 on Copyright, Law Number 42 of 1999 on Fiduciary Guarantee, and Government Regulation Number 24 of 2022 on the Provisions for the Implementation of the Creative Economy.

Abstract

This study examines the role of infaq and sadaqah in community economic empowerment, specifically focusing on how these practices contribute to the economic welfare of individuals, particularly those with disabilities. Infaq refers to the management or distribution of assets to fulfill needs that are pleasing to Allah SWT, while sadaqah involves the voluntary donation of assets or non-assets, beyond zakat, for the benefit of society. The research employs a qualitative approach utilizing a phenomenological method, with data collection through observation, interviews, and documentation. The findings indicate that the economic empowerment of communities through infaq and sadaqah is achieved by supporting Micro, Small, and Medium Enterprises (MSMEs) owned by individuals with disabilities, whether these businesses are established or non-existent. The economic impact of this initiative is significant, as it provides financial assistance to vulnerable groups. A review of Shariah economic law confirms that community economic empowerment through infaq and sadaqah aligns with Islamic principles, including the principles of monotheism, justice, honesty, truth, public interest (al-maslahah), and goodness, all of which are in harmony with the tenets of Shariah economic law.

Abstract

The development of the Islamic finance industry continues to experience good the choice of Islamic financial products is increasingly diverse. Sharia bank financing products consist of buying and selling, leasing, and profit-sharing schemes. Financing in Islamic banks is still dominated by consumptive financing with Murabaha contracts. Islamic banks have financing products with profit-sharing schemes that can be used for productive financing. This study aims to describe the application of musyarakah contracts in working capital financing at Bank Panin Dubai Syariah Branch Makassar. As well as outlining the application of the musyarakah contract in conformity with sharia principles. The research method used is qualitative research with field research, related to musyarakah contract financing for working capital at Bank Panin Dubai Syariah Makassar. The data sources used are primary data, data obtained directly by interviews, and secondary data from data previously presented. Data collection techniques by direct interviews with parties related to musyarakah financing and through documentation from several relevant sources. The data analysis technique used is descriptive qualitative which describes the application of musyarakah contracts in working capital financing at Bank Panin Dubai Syariah. The study results show that applying a musyarakah contract for working capital is adjusted to the type of business owned by the customer. Financing intended for a project provided that both the bank and the customer contribute capital to run a business project with profits divided according to the capital contribution portion (nisbah). The application of the musyarakah contract for working capital financing at Bank Panin Dubai Syariah branch Makassar is by Sharia principles.

Abstract

Piracy facilitated by digital technology has become increasingly prevalent due to the lack of awareness among perpetrators regarding the responsible use of digital tools. The rapid advancement of technology has made it easier for individuals to engage in piracy, particularly through digital media. This type of piracy often involves websites or platforms that provide plagiarized works. One of the most common forms of piracy in the digital era is the piracy of electronic books (e-books). In Indonesia, book piracy is a widespread issue, with pirated content ranging from partial to full copies of books. The growing perception that using pirated books is acceptable, particularly when they are offered at lower prices, has contributed to the proliferation of this practice. The findings of this study highlight the significant role of digital platforms in the distribution of pirated e-books, revealing that the ease of access and the economic motivations behind using pirated books are major factors driving this phenomenon. The study also identifies a lack of awareness about the legal and ethical implications of piracy, as well as the challenges in enforcing copyright laws in the digital age.

Abstract

This article examines the breach of contract issue related to delays in food delivery by GoFood couriers, a rapidly growing food delivery service in Indonesia. Despite the increasing popularity of such services, there is a significant research gap regarding the impact of delivery delays on customer satisfaction. This study aims to analyze the impact of delivery delays on customer satisfaction and identify the factors contributing to these delays. Using a case study analysis method explores specific instances of breach of contract due to delivery delays by GoFood couriers. The results indicate that delivery delays significantly negatively impact customers' perception of GoFood's service. Contributing factors to the delays include traffic conditions, order volume, and company policies. These findings provide valuable insights for GoFood and similar services to enhance delivery efficiency and customer satisfaction. The practical implications of this study include recommendations for improving delivery processes, courier training, and better communication with customers. This research contributes to understanding how delivery delays can affect brand image and customer satisfaction in the context of an evolving food delivery service. In conclusion, the corrective actions taken by the company can help improve service quality and minimize potential conflicts with customers.

Abstract

Policies related to the minimum wage are a contentious issue in employment across both developed and developing countries, aiming to meet community needs and benefit families. However, a research gap exists in applying justice and moral principles to wage determination from the perspective of Sharia economic law in Indonesia. This study aims to analyze fair wage components according to Islam and the role of business ethics in protecting workers and determining wages. Employing a literature review method, data were gathered from various sources such as books, journals, and previous research findings, which were reviewed and analyzed using descriptive analysis techniques. The study emphasizes the importance of justice and moral components in Islamic wage determination, rooted in the absolute essence granted by God, essential for morality. Business ethics in work protection and wage determination are crucial to ensure fair treatment and prevent exploitation. Recommended steps include optimal labor protection and wage determination, timely payment of agreed wages, recognition and guarantee of labor, fair wage determination without harm, and providing worker freedom. The study's novelty lies in integrating Islamic principles of justice and morality into minimum wage policies and developing practical business ethics guidelines for labor protection and wage determination under Sharia economic law in Indonesia.

Abstract

Investment is a compelling topic, especially in the capital market context. In Indonesia, which has the largest Muslim population in the world, the Islamic capital market plays a significant role in economic development under Sharia economic law. However, many Muslim investors still use conventional investment accounts, indicating a gap in understanding and adherence to Sharia principles. This study aims to examine the behavior of Muslim investors in making investment decisions based on Sharia principles and the factors influencing these decisions. This research employs a literature review method, with data from various journals, books, documentation, and internet sources over the past five years. The findings reveal that perceived behavioral control significantly influences investor decision-making, and attitudes toward perceived risk also impact investment decision-making. This study identifies a gap in the literature regarding Muslim investors' understanding of Islamic investment products and contributes new insights by integrating behavioral investment analysis with adherence to Sharia principles. These findings are expected to provide practical recommendations for developing the Islamic capital market in Indonesia and enhance Muslim investors' awareness and understanding of the importance of Sharia-compliant investments under Sharia economic law.

Abstract

In the current context of economic globalization, Indonesia's Sharia-based economic system faces significant challenges in developing itself amidst the dominance of capitalist and socialist economic systems. This article aims to analyze the challenges faced by Indonesia's Sharia-based economic system and explore the maslahah mursalah approach as a conceptual framework to address these challenges. Through this approach, the article presents several strategic steps to strengthen the position of Sharia economics in Indonesia, including efforts to maintain the identity of Sharia economic law in a global environment dominated by capitalism, gathering empirical evidence on the advantages of Sharia economics, and increasing dialogue and collaboration between the academic community and practitioners of Sharia economics. This study fills the research gap by providing empirical comparative studies on the advantages of Sharia economics over capitalist and socialist systems, offering strategic solutions for practical implementation, and emphasizing the importance of academic-practitioner collaboration. This research's novelty is applying the maslahah mursalah conceptual framework, strategically reinforcing Sharia economic law identity, and enhancing academic-practitioner interaction. This article contributes to understanding the potential and challenges of developing Sharia economic law in Indonesia, offering new perspectives and concrete steps to strengthen Sharia economics in a dynamic global context. The findings enrich theoretical discussions and provide practical solutions to bolster the Sharia-based economic system amidst the prevailing global economic paradigms.

Abstract

Islamic insurance has become a popular investment choice among Muslim communities, as it offers a means to mitigate future risks. The success of Islamic insurance companies is closely linked to the community's understanding of the importance of Islamic insurance. This study aims to identify and analyze the factors influencing societal behaviour towards Islamic insurance from a sociological and anthropological perspective on Sharia economic law. The analytical methods include data reduction, fact presentation, and conclusion drawing. The study's findings indicate that the most significant factor influencing the decision to adopt Islamic insurance is the level of understanding of Sharia principles, followed by the quality of the products. However, indicators such as premiums and promotional activities are less known among respondents, suggesting that insurance companies must enhance their efforts to promote Islamic insurance to the public. This research provides a deeper understanding of the factors influencing societal behaviour towards Islamic insurance and offers relevant recommendations for developing effective marketing strategies for Islamic insurance in Indonesia from both sociological and anthropological perspectives.

Abstract

Despite its substantial zakat potential, economic inequality remains a significant challenge in Indonesia. This study examines the impact of productive zakat on the economic empowerment of mustahiq (zakat recipients) at the Modern Islamic Boarding School Darul Ilmi Indonesia. The research employs a mixed-method approach, combining quantitative income analysis before and after receiving zakat with qualitative insights from beneficiary interviews. The Wilcoxon signed-rank test results indicate a significant increase in mustahiq income post-zakat. This highlights the effectiveness of productive zakat in enhancing economic self-sufficiency. The study's novelty lies in its comprehensive evaluation of zakat's role in socio-economic upliftment within an Islamic educational context. These findings underscore the potential for replicating such models in similar institutions to mitigate economic disparities.
