Abstract

This research is qualitative, the type of research is library research and uses normative juridical and syar'i normative approaches. The data collection method used is a literature study. The research results show that; (1) Profession in the Islamic view is working professionally based on faith, knowledge, and charity to gain worldly and ukhrawi benefits (2) professions are run based on high-level skills or expertise and this can only be carried out for those who have attended level technical training advanced, expertise that always experiences development following the needs of the community, and institutions and institutions that are developed through the profession as a means of controlling expertise or proficiency in functioning while still referring to the principles of responsibility and sincere intentions in serving. High expertise or proficiency is certainly supported by a trustworthy and honest attitude in work which is a portrait of the professionalism of a Muslim. (3) Characteristics of the profession, namely services carried out on an honorary basis, high expertise in carrying out a profession and therefore it is required for professional actors to undergo formal special education and work references by what is aspired to and supported by the ideals social ethical records are worldly and ukhrawi oriented towards oneself and others. Abstrak Penelitian ini adalah penelitian kualitatif, jenis penelitian adalah library research dan menggunakan metode pendekatan yuridis normatif dan normatif syar’i. Metode pengumpulan data yang digunakan adalah studi literatur. Hasil penelitian menunjukan bahwa; (1) Profesi dalam pandangan Islam adalah bekerja secara profesional berdasarkan iman, ilmu, dan amal untuk meraih keuntungan duniawi dan ukhrawi (2) profesi dijalankan dengan dasar kemahiran atau keahlian dengan level tinggi dan hal tersebut hanya dapat dijalankan bagi yang telah mengikuti diklat teknis level lanjutan, keahlian yang selalu mengalami perkembangan mengikuti kebutuhan masyarakat, dan pranata dan lembaga yang dikembangkan melalui profesi sebagai alat kontrol terhadap keahlian atau kemahiran berfungsi dengan tetap mengacu pada prinsip tanggung jawab dan niat tulus dalam mengabdi. Keahlian atau kemahiran yang tinggi tentu didukung dengan sikap amanah dan jujur dalam bekerja yang menjadi potret profesionalisme seorang muslim. (3) Ciri khas profesi Ciri khas profesi yaitu Layanan jasa dijalankan atas atas honoraris, keahlian yang tinggi dalam menjalankan suatu profesi dan olehnya itu diharuskan bagi pelaku profesi menjalani pendidikan khusus yang bersifat formal dan acuan kerja sesuai yang dicita-citakan dan didukung oleh cita-cata etis sosial beriorientasi pada duniawi dan ukhrawi terhadap diri sendiri dan orang lain. Abstract

This research aims to reveal the history of the ahlu ra’yi and ahlu hadith priests and reveal the legal istinbath methods of ahlu ra’yi and ahlu hadith. This research is qualitative, and the type of research is library research. The data collection method used is a literature study. The research results show that; 1) Imam ahlu Ra’yi is Imam Abu Hanifah and Imam Ahlu Hadith is Imam Malik bin Anas with a different style of life, including his educational history, which influenced the Istinbath method between ahlu ra’yi and ahlu hadith. 2) The method of istinbath ahlu ra’yi is to take ascent by using and making the basis of the Qur'an, al-Sunnah, Opinions of the Companions, Qiyas, Istihsan, Ijma', and al-'Urf. As for the method of Istinbath Ahlu Hadith, that is taking as a basis by using and making the basis of the Qur'an, al-Sunnah, Ijma ahlu al-Madinah, Fatwa of the Companions, Khabar ahad, Qiyas, Istihsan, Maslahah mursalah, Sadd zara'i, Istishab , and Syar'u man Qablana. Keywords: Ahlu Ra’yi, Ahlu Hadis, Istinbat.   Abstrak Tujuan penelitian ini untuk mengungkap sejarah imam ahlu ra’yi dan ahlu hadis  dan mengungkap metode istinbath hukum ahlu ra’yi dan ahlu hadis. Penelitian ini merupakan penelitian kualitatif, jenis penelitian adalah library research. Metode pengumpulan data  yang digunakan adalah studi literatur. Hasil penelitian menunjukan bahwa; 1) Imam ahlu Ra’yi adalah imam Abu Hanifah dan Imam Ahlu Hadis adalah imam Malik bin Anas dengan corak kehidupan berbeda, diantaranya dalam riwayat pendidikan yang mempengaruhi metode Istinbath antara ahlu ra’yi dan ahlu hadis. 2) Metode istinbath ahlu ra’yi, yaitu beristinbat dengan menggunakan dan menjadikan sebagai dasar al- Qur’an, al-Sunnah, Pendapat para sahabat, Qiyas, Istihsan, Ijma’,dan  al-‘Urf.  Adapun metode Istinbath Ahlu Hadis, yaitu beristinbat dengan menggunakan dan menjadikan sebagai dasar al-Qur’an, al-Sunnah, Ijma ahlu al-Madinah, Fatwa para sahabat, Khabar ahad, Qiyas, Istihsan, Maslahah mursalah, Sadd zara’i, Istishab, dan Syar’u man Qablana. Abstract

Abstract The purpose of this research is to reveal MUI's fatwa method in the study of fatwa covid 19. This research is qualitative research, the type of research is library research. The data collection method used is literature study. The research results show that; 1) There are seven fatwas that generally discuss covid 19, namely fatwa numbers 14, 17, 18, 28, 31, 36 in 2020 and number 14 in 2021. With the classification of fatwas issued in 2020, it generally discusses the organization of worship for people affected by covid 19, medical personnel who carry out their duties and worship. The organization of worship will regulate prayer in the mosque or at home, stretching the prayer sash, changing Friday prayers to rawatib prayers. All of these provisions are based on the arguments of the Qur'an, Hadith, and fiqh rules.  2) Based on the existing classification, fatwa covid 19 is a fatwa related to worship and permits aztrazeneca products. On the issue of worship, it can be seen that the fatwa pattern used is to use sharia concessions on the basis of difficult or emergency situations that occur. As for the use of astrazeneca that contains pork trypsin, MUI does not legalize it but only permits it based on the five conditions mentioned in the fatwa. The loss of the five supporters of permissibility results in the loss of emergency and makes astrazeneca haram again. Keywords: Fatwa, MUI, Covid 19. Abstrak Tujuan riset ini untuk mengungkap metode fatwa MUI dalam kajian terhadap fatwa covid 19. Riset ini merupakan riset kualitatif, jenis riset  adalah riset kepustakaan. Metode pengumpulan data  yang digunakan adalah studi literatur. Hasil riset menunjukan bahwa; 1) Terdapat tujuh fatwa yang secara umum membahas covid 19, yaitu fatwa nomor 14, 17, 18, 28, 31, 36 pada tahun 2020 dan nomor 14 tahun 2021. Dengan klasifikasi fatwa yang keluar pada tahun 2020 secara umum membahas tentang penyelenggaraan ibadah orang yang terkena covid 19, para tenaga medis yang melaksanakan tugas dan ibadahnya. Penyelenggaraan ibadah nantinya mengatur shalat di masjid atau di rumah, perenggangan saf shalat, perubahan shalat jumat menjadi shalat rawatib. Keseluruhan ketentuan ini didasarkan pada dalil-dalil al-Quran, Hadis, dan kaidah fikih.  2) Berdasarkan klasifikasi yang ada pada fatwa covid 19 adalah fatwa berkaitan ibadah dan membolehkan produk aztrazeneca. Pada persoalan ibadah, maka terlihat pola fatwa yang digunakan adalah menggunakan keringanan-keringanan syariat atas dasar keadaan sulit atau darurat yang terjadi. Sedangkan pada penggunaan astrazeneca yang mengandung tripsin babi, MUI tidak menghalalkan juga tetapi hanya membolehkan berdasarkan lima ketentuan yang telah disebutkan dalam fatwa. Hilangnya kelima pendukung kebolehan mengakibatkan hilangnya kedaruratan dan membuat astrazeneca kembali haram.

Abstract

The aim of this research is to find out how the Community Aspiration and Complaints Service (SIDUMAS) program is implemented in public complaints at the Badung Regency Communication and Information Service. This research uses a qualitative research method with a descriptive approach that collects data through observation, interviews and documentation. This research uses public policy theory with indicators of program implementation by Charles O. Jones with three (3) types of indicators, namely, organization, interpretation or understanding, and application or application. For the three indicators of program implementation, the results showed that all of these indicators were running, but there were several indicators that were not running optimally, namely organizational indicators and application or implementation. Abstrak Tujuan penelitian ini untuk mengetahui bagaimana implementasi program Layanan Aspirasi dan Pengaduan Masyarakat (SIDUMAS) dalam pengaduan masyarakat di Dinas Komunikasi dan Informatika Kabupaten Badung. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan deskriptif yang mengumpulkan data melalui observasi, wawancara serta dokumentasi. Penelitian ini menggunakan teori kebijakan publik dengan indikator implementasi program oleh Charles O. Jones dengan tiga (3) jenis indikator yaitu, organisasi, interpretasi atau pemahaman, serta aplikasi atau penerapan. Dengan menggunakan ketiga indikator implementasi program tersebut, didapatkan hasil yang menjelaskan bahwa seluruh indikator tersebut telah berjalan, namun terdapat beberapa indikator yang belum berjalan secara optimal yaitu indicator organisasi dan aplikasi atau penerapan. Abstract

The Online Registration Website for Population and Civil Registration Administration (Taring Dukcapil) is service innovation introduced by the Population and Civil Registration Office of Denpasar City. This website was established as an effort to provide online civil administration service during the large-scale social restrictions and continued to be used post-pandemic. The method used in this research is qualitative with descriptive approach. The data for this research was gathered through observations, interviews, and documentations. This research utilized the dimensions of digital government proposed by Lee, which consist of data, technology, service, people, and governance. The result of this research shows that the implementation of the Taring Dukcapil website as a platform for delivering online civil administration services has been working. However, there are still some aspects that are not optimal. Therefore, measures are required to enhance these five dimensions so that the implementation of digital government through the website can run more optimally.

Abstract

The purpose of this study was to determine how the performance of the Badung Regency Regional Revenue Agency after the organizational restructuring carried out in 2017. This research uses a qualitative research method with a descriptive approach that collects data through observation, interviews, and documentation methods. This study uses the performance theory by Iwan Novarian (2020) with 4 (four) types of indicators, namely input, process, output, and outcome. Using these four performance indicators, the results explain that all indicators have been running, but there are still some indicators that are not fully optimized. This shortcoming requires strengthening for each indicator. Abstrak Tujuan penelitian ini untuk mengetahui bagaimana kinerja Badan Pendapatan Daerah Kabupaten Badung pasca restrukturisasi organisasi yang dilaksanakan pada tahun 2017. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan deskriptif yang pengumpulan data melalui metode observasi, wawancara, dan dokumentasi. Penelitian ini menggunakan teori kinerja oleh Iwan Novarian (2020) dengan empat (4) jenis indikator, yakni indikator masukan, indikator proses, indikator keluaran, dan indikator hasil. Dengan menggunakan keempat indikator kinerja tersebut, didapatkan hasil yang menjelaskan bahwa seluruh indikator telah berjalan, namun masih terdapat beberapa indikator yang belum sepenuhnya optimal. Adanya kekurangan tersebut memerlukan penguatan bagi setiap indikator. Kata Kunci: Restrukturisasi Organisasi, Kinerja, Badan Pendapatan Daerah, dan Pendapatan Asli Daerah (PAD).

Abstract

Ibn Taymiyyah is known as the inspiration of the Wahhabi movement that aims to the purification of the teachings of Islam. This movement departs from the separation between the ‘ubūdiyyah and un-‘ubūdiyyah teachings, which are also inspired by Ibn Taymiyyah's thought. In 'ibādah, Ibn Taymiyyah holds the rule that as long as there is no ordered argument it should not be done. However, the notion of ibādah according to Ibn Taymiyyah is not limited to mahdlah worship but more broadly. Whereas in mu'āmalah, he holds the rule of allowing doing anything as long as there is no prohibition against it. In shaping the concept of 'ibādah and mu'āmalah, at first, Ibn Taymiyyah accepted it as something normative from the thought of Ahmad ibn Hanbal. But when he saw the social reality with the number of deviations' in ibādah done by Muslims, the concept that has been obtained normatively from the thought of Ahmad ibn Hanbal is reaffirmed and expanded to become a sociological concept, in addition to being normative.

Abstract

This research uses qualitative research with a descriptive approach. The data sources used are primary and secondary data. The technique for determining informants in this research uses purposive sampling. This research is measured by the performance measurement theory of publik organizations according to Agus Dwiyanto (2006). The results of the research show that the performance of the Pempatan Village Government in inclusive village development is quite good, namely in terms of productivity indicators, the performance of the Pempatan Village Government in inclusive village development has not run optimally because there is a need to optimize the number of human resources and budget. In terms of service quality indicators, the performance of the Pempatan Village Government in inclusive village development has gone well. On the responsiveness indicator, the performance of the Pempatan Village Government is not yet optimal because there is a need to optimize the training program which is still lacking. On the responsibility indicator, the performance of the Pempatan Village Government in inclusive village development has been running optimally. Then in terms of accountability indicators, the performance of the Pempatan Village Government in inclusive village development has been running optimally. Abstrak Penelitian ini mengunakan jenis penelitian kualitatif dengan pendekatan deskriptif. Sumber data yang digunakan aitu data primer dan sekunder. Teknik penentuan Informan dalam penelitian ini menggunakan purposive sampling. Penelitian ini diukur dengan teori pengukuran kinerja organisasi publik menurut Agus Dwiyanto (2006). Hasil penelitian menunjukkan kinerja Pemerintah Desa Pempatan dalam pembangunan desa inklusif cukup baik, yaitu pada indikator produktivitas, kinerja Pemerintah Desa Pempatan dalam pembangunan desa inklusif belum berjalan dengan optimal karena perlu adanya pengoptimalan terhadap jumlah SDM dan anggaran. Pada Indikator kualitas layanan, kinerja Pemerintah Desa Pempatan dalam pembangunan desa inklusif sudah berjalan dengan baik. Pada indikator responsivitas, kinerja Pemerintah Desa Pempatan belum optimal karena perlu adanya pengoptimalan pada program pelatihan yang masih kurang, Pada indikator responsibilitas, kinerja Pemerintah Desa Pempatan dalam pembangunan desa inklusif sudah berjalan dengan optimal. Kemudian pada indikator akuntabilitas, kinerja Pemerintah Desa Pempatan dalam pembangunan desa inklusif sudah berjalan dengan optimal. Abstract

ABSTRACT Public services are an important aspect of the government system, because the government is basically a servant of the community. Population Administration Services are one of the basics of the public service system, however, the problem of heterogeneous conditions causes problems for the community in population administration services. Therefore, DISDUKCAPIL Buleleng Regency implemented the SIMELIK program with a pick-up and drop-off system in population administration services. This research was conducted in 8 sub-districts in Buleleng Regency. The informants for this research consisted of 1) Head of SIMELIK's population administration and civil registration services in Buleleng Regency; 2) Head of population registration services; 3) Coordinator of SIMELIK population administration services; 4) the target community for the SIMELIK program. Data collection techniques were carried out by conducting interviews and observations. The data analysis technique used was qualitative descriptive analysis. The results of this research show that the program implementation has been running effectively and efficiently because it has been able to increase service targets to the community. The community can be reached more widely and more evenly through scheduled services. However, there are obstacles in implementing the program where the socialization carried out does not reach a wide range so that most people do not know about the program being implemented. Another obstacle is that the equipment used is classified as old, so it is necessary to rejuvenate the equipment used to provide services. Another obstacle is the lack of energy used so that it has not been able to reach a wider and optimal reach.

Abstract

This research examines the crucial role of consumer protection law in building market trust. Through a case study of the implementation of consumer protection regulations in the electronic industry in Indonesia, this study demonstrates that government efforts to safeguard consumers have successfully enhanced trust in electronic products and aims to provide a better understanding of how consumer protection laws can play a major role in building consumer confidence and advancing the global economy. This research was conducted using normative juridical methods which involved the study and interpretation of various regulations and laws related to consumer protection in various countries or regions. In describing the implications of consumer protection laws, researchers use case studies to provide concrete illustrations of how these laws are applied in real situations. The research findings also highlight positive economic impacts, as increased consumer trust stimulates market growth and provides incentives for manufacturers to improve the quality of their products. This study underscores the importance of strengthening and maintaining consumer protection systems to ensure a healthy and sustainable market in the future. Abstrak Penelitian ini membahas peran penting hukum perlindungan konsumen dalam membangun kepercayaan pasar. Melalui studi kasus implementasi regulasi perlindungan konsumen di industri elektronik di Indonesia, penelitian ini menunjukkan bahwa upaya pemerintah untuk melindungi konsumen telah berhasil meningkatkan kepercayaan konsumen terhadap produk elektronik dan bertujuan untuk memberikan pemahaman yang lebih baik tentang bagaimana hukum perlindungan konsumen dapat memainkan peran utama dalam membangun kepercayaan konsumen dan memajukan ekonomi global. Penelitian ini dilakukan dengan metode yuridis normatif yang melibatkan pengkajian dan interpretasi berbagai regulasi dan hukum yang terkait dengan perlindungan konsumen di berbagai negara atau wilayah. Dalam menggambarkan implikasi hukum perlindungan konsumen, peneliti menggunakan studi kasus untuk memberikan ilustrasi konkret tentang bagaimana hukum ini diterapkan dalam situasi nyata. Hasil penelitian juga menyoroti dampak positif secara ekonomi bahwa kepercayaan konsumen yang meningkat dapat mendorong pertumbuhan pasar dan memberikan insentif bagi produsen untuk meningkatkan kualitas produk mereka. Penelitian ini menekankan pentingnya penguatan dan pemeliharaan sistem perlindungan konsumen untuk memastikan pasar yang sehat dan berkelanjutan di masa depan.
