Abstract

This study aims to examine the role of administrative law as an academic discipline in strengthening transparency and accountability in the public sector through a systematic literature review. A qualitative approach was employed using a Systematic Literature Review (SLR) design, focusing on the search, selection, and analysis of scholarly publications and international reports related to administrative law, public information disclosure, and governance. The literature reviewed covers works published between 2010 and 2024, obtained from reputable scientific databases. The findings reveal that administrative law plays a dual role: as a normative framework and as a regulatory mechanism to ensure public information disclosure, prevent abuse of authority, and enhance bureaucratic accountability. Three key findings are identified: (1) legal frameworks governing public information disclosure provide legitimacy for transparency practices; (2) administrative law contributes to anti-corruption efforts through the implementation of digital systems such as e-procurement; and (3) the integration of administrative law with bureaucratic reform and global governance standards supports the development of modern, accountable governance. This study concludes that the success of transparency and accountability in the public sector is strongly influenced by the presence of a clear, consistent, and internationally aligned administrative legal framework.

Abstract

Penelitian ini mengevaluasi keselarasan regulasi perhutanan sosial dalam sistem hukum agraria nasional Indonesia. Kajian ini mengangkat dualisme hukum yang persisten antara sektor kehutanan dan agraria yang telah menyumbang pada konflik agraria dan marginalisasi masyarakat hutan. Perhutanan sosial muncul sebagai solusi kebijakan untuk menyelesaikan konflik tersebut dengan mengakui hak akses dan pengelolaan masyarakat atas sumber daya hutan. Penelitian menggunakan pendekatan yuridis normatif, menganalisis peraturan perundang-undangan, putusan pengadilan, dan literatur hukum terkait untuk mengevaluasi harmonisasi regulasi perhutanan sosial dengan prinsip fungsi sosial tanah dan hak masyarakat menurut hukum agraria nasional. Temuan penelitian mengungkapkan tantangan signifikan termasuk tumpang tindih kewenangan antar kementerian, status tanah, dan hambatan implementasi di tingkat akar rumput. Meski demikian, bukti empiris mendukung dampak positif perhutanan sosial dalam mengurangi konflik, meningkatkan kesejahteraan masyarakat, dan meningkatkan konservasi hutan. Penelitian menyimpulkan bahwa butuh harmonisasi hukum yang lebih kuat antara UU Agraria dan UU Kehutanan sangat untuk memastikan kepastian hukum dan keadilan sosial bagi masyarakat yang bergantung pada hutan.

Abstract

This study discusses the legal review of the sale of inherited land by minors in Decision Number 154/Pdt.P/2022/PN Mlg. The purpose of this study is to analyze the judge's legal considerations when deciding the sale of inherited land by minors in case number 154/Pdt.P/2022/PN Mlg. This study uses a type of normative juridical legal research, namely research that focuses on examining the application of rules or norms in positive law collected through library research, by referring to documents or literature related to cases of the sale of inherited land by minors. This study uses a case approach and a statute approach. The results of the study show that the panel of judges in Decision Number 154/Pdt.P/2022/PN Mlg in their considerations have based the principle of the best interests of the child by using the literature of the book Guidelines for the Implementation of Duties and Administration of the Court in Four Judicial Environments Book II 2007 Edition printed in 2009, and Articles 1320, 1329 and 1330 of the Civil Code which allow Guardian Erna Widyawati to represent her children to sign the Deed of Sale and Purchase of property inherited from her husband.

Abstract

This study examines the implementation of Article 11 Paragraph 1 Letter a of North Lampung Regency Regional Regulation Number 4 of 2022 on Public Order through the lens of Siyasah Tanfidziyah. A descriptive-analytical qualitative approach was employed through field research and empirical juridical methods, with data gathered via in-depth interviews with Civil Service Police Unit (Satpol PP) officers, vehicle owners, and open-truck drivers, complemented by direct field observation. The findings reveal that normatively, the regulation is aligned with the principles of hifzh al-nafs, Maslahah Mursalah, and maqashid al-syariah, qualifying it as a legitimate and accountable policy issued by Ulil Amri. Field realities, however, indicate that implementation has yet to reach its optimal level, constrained by five key inhibiting factors: limited socialization in remote areas, community dependence on open-bed vehicles as the primary means of transporting agricultural produce and materials, weak deterrent effect of sanctions, narrow patrol coverage, and a complaint mechanism that has not been adequately publicized. This study advances a new proposition that the effectiveness of maqashid al-syariah-based policy cannot rely solely on the quality of its legal substance, but equally requires genuine commitment and consistency from enforcement officers in carrying out the Siyasah Tanfidziyah function. Equitable socialization, consistent enforcement, and expanded supervisory coverage are recommended as key measures to realize public welfare in agrarian regions.

Abstract

The enactment of Law Number 1 of 2023 concerning the Criminal Code (KUHP) has brought significant changes to the formulation of sanctions for corruption perpetrators. The implementation of these sanctioning norms has become increasingly urgent to examine following the ratification of Law Number 20 of 2025 concerning the Criminal Procedure Code (National KUHAP), which takes effect simultaneously with Law No. 1 of 2023. The integration of these two regulations marks a total transformation within the Indonesian criminal justice system, necessitating an in-depth analysis of the national legal instrument's readiness to accommodate Islamic justice principles toward corruption offenses. One of the primary controversies is Article 603, which sets the minimum prison sentence at 2 years, lower than the previous regulation. This study aims to analyze the construction of sanctions in Article 603 of the new Criminal Code and review them through the perspective of Islamic Criminal Law (Jinayah). The research method employed is normative legal research with a statutory approach and a comparative approach. The results indicate that corruption in Islamic law is classified as jarimah ta’zir because it constitutes an act that destroys the social order (fasad fil ardh). Normatively, the sanctions in Article 603 of the Criminal Code remain within the realm of the ruler's authority (ulil amri) to determine the severity of the punishment. However, the Jinayah perspective emphasizes that the imposition of sanctions must fulfill the elements of zawajir (deterrent effect) and zawabir (atonement). The reduction of the minimum sanction in the new Criminal Code is feared to weaken the zawajir aspect, thus requiring judicial ijtihad in sentencing to remain oriented toward the public interest (mashlahah mursalah) and the protection of property (hifzh al-maal).

Abstract

This study examines the special status of the Special Region of Yogyakarta (DIY) within the framework of the regional government system from a constitutional perspective. Historically, the special status of DIY is rooted in the existence of the Ngayogyakarta Hadiningrat Sultanate and the Pakualaman Duchy, which had their own governance systems before becoming part of the Unitary State of the Republic of Indonesia. This integration was affirmed through the 1945 political mandate that became the basis for the legitimacy of DIY's special status. From a legal perspective, recognition of DIY's special status is stated in the 1945 Constitution of the Republic of Indonesia, specifically Article 18 and Article 18B, which provides space for regions with certain special or special characteristics. Law Number 13 of 2012 stipulates that special authority includes institutional aspects, culture, land, spatial planning, and the mechanism for filling the gubernatorial position. The results of the study indicate that DIY's special status is a form of asymmetric decentralization that has constitutional legitimacy. Although the appointment of regional heads contains elements of monarchy, this does not conflict with the principles of democracy and the rule of law, as it remains within the constitutional framework and the national government system. The Special Region of Yogyakarta (DIY) reflects a blend of historical values, local culture, and a modern legal system within the context of a pluralistic nation. DIY can be viewed as an ideal model for implementing regional governance based on special rights, in line with the principles of the Indonesian constitution.

Abstract

Pengakuan masyarakat hukum adat dan tanah adat di Indonesia merupakan isu strategis dalam reformasi hukum agraria yang berkaitan erat dengan keadilan sosial, konflik tanah, dan kesejahteraan masyarakat adat. Penelitian ini bertujuan menganalisis efektivitas pengakuan hukum terhadap tanah adat serta implikasinya secara multidimensional. Metodologi yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan perbandingan, yang didukung analisis teoritik dan data empiris. Hasil penelitian menunjukkan bahwa meskipun pengakuan masyarakat hukum adat telah diatur dalam konstitusi dan berbagai undang-undang, implementasinya masih bersifat formal dan prosedural. Disharmoni antara Undang-Undang Pokok Agraria, Undang-Undang Kehutanan, serta mekanisme administratif pasca putusan Mahkamah Konstitusi menyebabkan ketidakpastian hukum dan konflik agraria. Analisis teoritik menggunakan teori hukum pengakuan, teori sistem hukum Werner Menski, dan economic analysis of law menunjukkan bahwa dominasi hukum negara menyebabkan kegagalan integrasi dengan hukum adat, meningkatnya biaya transaksi, serta inefisiensi dalam pengelolaan sumber daya. Data empiris dari kasus di Kalimantan, Papua, dan Aceh menunjukkan bahwa pengakuan yang tidak substantif memperlemah keamanan tenurial dan kesejahteraan masyarakat adat. Penelitian ini menyimpulkan bahwa diperlukan pergeseran menuju pengakuan berbasis komunitas yang lebih substantif, integratif, dan efisien. Implikasinya, diperlukan reformasi mekanisme pengakuan Masyarakat Hukum Adat melalui penyederhanaan dan standardisasi proses verifikasi serta penetapan, perubahan prosedur administratif lintas sektor agar lebih cepat, partisipatif, dan akuntabel, serta integrasi data pertanahan, kehutanan, dan wilayah adat dalam satu basis data yang terpadu untuk menciptakan sistem pengakuan tanah adat yang berkeadilan dan berkelanjutan.

Abstract

In international commercial transactions, the Issuing Bank issues Letters of Credit through banking services. The bank is required to make payments to exporters. Documentary credit is a common and secure payment technique used by parties interested in international trade. However, the Issuing Bank failed to pay the L/C, thus the advising bank exercised its recourse rights by issuing a letter of indemnity. The difficulty in this article is to determine when the advising bank's recourse rights are exercised and the method for sending a letter of indemnity. The normative legal research method was applied in this study. According to the discussion, recourse rights can be used by including them in the L/C contract or trade contract and sending a letter of indemnity to the exporter as a form of payment guarantee, and recourse rights are made with a notification letter to the issuing bank stating the grace period for orderly payment.

Abstract

This study provides an in-depth analysis of the role of prosecutors as dominus litis in demanding and executing restitution as a vital instrument for restoring the rights of victims of sexual violence crimes. Although Law Number 12 of 2022 on Sexual Violence Crimes (TPKS Law) has affirmed restitution as a fundamental right of victims, its implementation in practice continues to face serious challenges. This research focuses on the gap between normative promises and practical realities, highlighting the central role of prosecutors as both executors of court decisions and guardians of victims’ rights. The research method employed is normative legal research, using statutory, case, conceptual, and theoretical approaches. The findings indicate that the optimization of the prosecutor’s role is hindered by procedural and institutional constraints, such as the absence of consistent technical guidelines, weak coordination with the Witness and Victim Protection Agency (LPSK), the high workload of prosecutors, the lack of internal standard operating procedures (SOPs) within the Prosecutor’s Office, and sectoral ego among institutions. The availability of substitute penalties that undermine the spirit of victim recovery also constitutes a significant obstacle. A case study, particularly the Herry Wirawan case, reinforces these findings by demonstrating inconsistencies in judicial decisions and a vacuum in the execution of restitution against offenders who are unable to pay. This study concludes that optimizing the role of prosecutors requires a paradigm shift from merely acting as public prosecutors to becoming proactive guardians of victims’ rights. Such a shift must be supported by concrete policy reforms, including the development of clear technical guidelines, strengthened institutional coordination, and the establishment of state-guaranteed mechanisms such as a Victim Trust Fund, as mandated in Article 35 of the TPKS Law.
