Abstract

The digital Gold Bank service from Bank Syariah Indonesia (BSI) presents a sharia-compliant gold investment innovation that makes it easier for people to access, buy, sell, and transfer gold digitally through the BSI Mobile application. This product is designed in accordance with sharia principles, using clear contracts such as murabahah and wadiah, and is supervised by the Financial Services Authority (OJK) and the Sharia Supervisory Board (DPS) to ensure the halal status and certainty of gold ownership. The use of digital technology supports increased sharia financial literacy and inclusion, offering easy access, security, and efficiency in gold transactions without the need to store physical gold directly. While offering potential stability and investment benefits for the Muslim community, this service faces challenges such as annual administration fees, taxes on gold transactions, and the need for further education regarding financial technology. Overall, BSI Gold Bank is a modern solution that is relevant to the contemporary Islamic economic and financial context, while also supporting the achievement of the maqasid sharia objectives of wealth preservation and economic justice.

Abstract

This study analyzes the economic dispute in the palm oil sector concerning the price disparity between smallholder farmers and export markets in Central Kalimantan. Palm oil, as one of Indonesia’s main export commodities, significantly contributes to national income but also presents persistent inequality in its value chain. Farmers often receive low Fresh Fruit Bunch (FFB) prices due to dependence on middlemen, lack of land legality and institutional capacity, poor FFB quality, inconsistent government regulations, and limited market information. The research employs a qualitative descriptive approach with a case study design supported by a normative Islamic economic perspective emphasizing justice (‘adl), benefit (maslahah), and the prohibition of injustice (dzulm). Data were collected through interviews with farmers and relevant stakeholders, as well as secondary sources such as official reports and literature reviews. The results reveal that structural imbalances in price distribution and weak bargaining power of farmers lead to social and economic inequality. From the perspective of Islamic economics, these practices reflect elements of monopoly (ihtikar), fraud (ghishsh), and uncertainty (gharar), all of which contradict the principles of justice and transparency. Therefore, dispute resolution should prioritize non-litigation methods such as conciliation (al-sulh) and arbitration (tahkim) under Islamic arbitration bodies like Basyarnas. Moreover, the implementation of transparent and fair trade contracts—such as Salam and Istishna’—and government intervention based on maslahahare necessary to ensure equitable price mechanisms and improve the welfare of palm oil farmers sustainably.

Abstract

This study analyzes the implementation of muzara'ah contracts in shallot farming in Ketapang Village, Kademangan District, Probolinggo City as a community empowerment effort. Using a qualitative descriptive approach with case studies, this research involved 20 respondents consisting of 10 landowners and 10 cultivating farmers through in-depth interviews, non-participant observation, and documentation. The results show that muzara'ah practices have been implemented generationally through a 90:10 profit-sharing pattern based on oral agreements grounded in trust and kinship values, where landowners provide land, seeds, fertilizers, and other agricultural inputs, while cultivating farmers contribute labor and some equipment. The implementation of muzara'ah contracts is substantially in accordance with Islamic economic law principles, fulfilling the pillars and conditions including aqidain (100%), ma'qud 'alaih (85%), ijab qabul (100%), timeframe (95%), and profit-sharing proportion (100%), as well as applying the principles of an-taradhin (mutual consent), proportional justice, maslahah (public interest), and ta'awun (mutual cooperation). The integration of muzara'ah concepts has contributed to community empowerment through the enabling dimension with average income ≥IDR 5,000,000 per season allowing basic needs fulfillment and children's education, the empowering dimension with 85% farmers reporting improved cultivation knowledge, 90% capable of cost analysis, and 60% involved in farmer groups, and the protecting dimension that protects cultivating farmers from crop failure losses borne entirely by capital owners. However, challenges remain including lack of formal documentation (100% oral agreements), limited access to capital (75%), price fluctuations (90%), limited access to modern agricultural technology (65%), and limited understanding of muamalah fiqh aspects (35%).

Abstract

Marosok is a traditional bargaining practice using hand signals that characterizes livestock markets in Minangkabau. This study aims to analyze contract practices, profit-sharing mechanisms, and the potential risk of gharar within the marosok tradition through a case study approach, integrating interview data with findings from a Systematic Literature Review (SLR). The results reveal that marosok aligns with Islamic principles and local customary values (adat salingka nagari) as long as the process is followed by verbal confirmation and conducted with honesty. The role of the intermediary (joki) is permissible according to both adat and Islamic law through the concept of samsarah, yet it can generate gharar when information is manipulated or hidden margins are involved. The study concludes that marosok represents a form of ‘urf shahih custom validated by Islamic law provided that transparency, trustworthiness, and contractual clarity are upheld. The risk of gharar does not stem from the tradition itself but from individual deviations from ethical norms in adat and sharia.

Abstract

The tradition of uang japuik in the Pariaman community is often misunderstood as a form of “purchasing a groom” or as an economic burden imposed on women. In reality, this tradition carries profound philosophical meaning as a symbol of respect, honor, and social responsibility within the Minangkabau matrilineal system. This article seeks to correct these misconceptions through a descriptive qualitative approach that integrates field data, academic literature, official documentation from Indonesia’s Intangible Cultural Heritage (WBTB), and Islamic economic analysis. The findings reveal that uang japuik functions as both a social and spiritual mechanism that strengthens inter-clan relationships, regulates cultural economic redistribution, and maintains the balance of honor (marwah) between the male and female parties. From an Islamic perspective, this tradition qualifies as ‘urf shahih, as it is practiced based on mutual agreement, sincerity, and shared benefit. Thus, uang japuik is not a transactional economic practice, but rather a harmonious integration of custom and religious principles affirming the Minangkabau philosophy: adat basandi syarak, syarak basandi Kitabullah.

Abstract

This study aims to analyze the relevance of maqasid al-shariah in microfinance through a comparative dialogue between classical fiqh and the practices of contemporary Islamic Microfinance Institutions (IMFIs). Using a qualitative descriptive-comparative approach based on library research, the study examines classical sources such as al-Ghazali, al-Syatibi, and Ibn ‘Ashur, alongside modern literature on Islamic microfinance. The findings reveal that classical fiqh emphasizes normative protection of the five essential dimensions of maqasid through simple contracts such as qardh, mudharabah, and musyarakah. In contrast, contemporary IMFIs apply maqasid in a more practical manner, focusing on financial inclusion, economic empowerment, and sustainable development. The study also identifies challenges in consistent implementation due to limited resources and market competition, yet highlights opportunities through innovative Islamic financial instruments and the legitimacy of DSN-MUI fatwas. Thus, maqasid al-shariah can be viewed as a dynamic framework that balances shariah compliance with socio-economic welfare, positioning IMFIs as agents of just, inclusive, and sustainable transformation.

Abstract

The performance of human resources (HR) in Micro, Small, and Medium Enterprises (MSMEs) in Probolinggo Regency remains low, as indicated by limited production skills, weak managerial capabilities, and inconsistent service quality. Data from the Department of Cooperatives and MSMEs (2023) show that 62% of MSMEs experience stagnation due to insufficient competencies and the limited implementation of training outcomes. Despite various training programs provided by the local government, their effectiveness has not yet produced measurable improvements. Furthermore, empirical studies on rural MSMEs characterized by distinct socio-cultural contexts and limited governmental support remain scarce, creating an important research gap. This study aims to analyze the influence of training and competence on HR performance among MSMEs in Probolinggo Regency. A quantitative approach was employed using a survey of 100 MSME actors selected through purposive sampling, with data analyzed using multiple linear regression. The findings reveal that training has no significant effect on HR performance, while competence exerts a significant and dominant influence. These results indicate that improving MSME HR performance is more effectively achieved through strengthening technical and managerial competencies rather than short-term, generic training programs. The study recommends evaluating existing training designs and developing competency-based HR strategies aligned with the operational needs of MSMEs in Probolinggo.

Abstract

Zakat shows great potential as an instrument of wealth redistribution to support the achievement of Sustainable Development Goals (SDG 4), although its implementation still faces obstacles related to limited funds, suboptimal targeting, and variations in institutional capacity that contribute to unequal access to education. This study aims to analyze the impact of zakat on access, motivation, and quality of education for those who are entitled to receive zakat, and to formulate strategies to strengthen zakat management in education. By applying a descriptive qualitative approach, data were collected through in-depth interviews with Amil zakat, teachers, and beneficiaries at MA and STIE in Depok using a purposive sampling technique. The results revealed that zakat in education contributes to improving access to learning, motivation, discipline, and achievement of students and is managed through a long-term empowerment approach that is aligned with Human Capital Theory and Philanthropy Theory. The research recommendations emphasize the need to strengthen the results-based monitoring system, expand skills guidance and career guidance, and intensify cross-sector collaboration to create an inclusive education ecosystem that supports the sustainable achievement of SDG 4.

Abstract

This study aims to examine the issue of Mediation as an Alternative Dispute Resolution (ADR) in Cases of Lost/Damaged Packages in Shopee Express Pamekasan Hub. Consumer disputes in expedition services are a crucial issue, given that business actors are fully responsible for losses suffered by consumers. This study applies a normative legal method that focuses on the analysis of legal norms, principles, doctrines, and applicable laws and regulations. This study uses a descriptive qualitative approach with a case study method. As a solution, this dispute is resolved through mediation. The mediation process usually occurs if internal resolution through the return feature or direct contact with customer service fails or is rejected by one of the parties. This process involves a third-party mediator who is tasked with bridging communication between consumers and Shopee Express representatives to reach a peaceful and fair mutual agreement.

Abstract

Studi ini mengkaji penerapan prinsip-prinsip Islam dalam operasional INTAN COMPUTER, sebuah usaha mikro percetakan dan digital printing di Karangrejo, Tulungagung, dan menganalisis pengaruhnya terhadap pengambilan keputusan konsumen. Bertempat di bidang etika bisnis Islam dan perilaku konsumen, studi ini bertujuan untuk mendeskripsikan bagaimana ṣidq (kejujuran), amanah (kepercayaan), 'adl (keadilan), dan tablīgh (transparansi) diterapkan dan bagaimana nilai-nilai ini membentuk kepercayaan dan loyalitas pelanggan. Metode kualitatif deskriptif digunakan melalui observasi, dokumentasi, dan pengalaman langsung peneliti di tempat kerja. Temuan penelitian menunjukkan bahwa penerapan nilai-nilai etika Islam yang konsisten mendorong persepsi konsumen yang positif, rasa aman, dan keterlibatan emosional yang lebih kuat. Faktor agama dan psikologis terbukti lebih berpengaruh daripada pertimbangan ekonomi dalam membentuk pilihan konsumen. Studi ini berkontribusi pada literatur tentang etika bisnis Islam dengan menyajikan bukti empiris dari sebuah usaha percetakan skala mikro. Hasil penelitian ini menyoroti pentingnya nilai-nilai Islam sebagai strategi bisnis yang berkelanjutan dan kompetitif.
