Abstract

Penelitian ini membahas implementasi permodalan syariah dalam Perseroan Terbatas (PT) sebagai bentuk integrasi antara hukum perusahaan modern dan prinsip-prinsip hukum ekonomi syariah. Permasalahan utama yang dikaji adalah bagaimana konsep permodalan syariah diterapkan dalam struktur PT yang secara normatif diatur oleh Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Penelitian ini bertujuan untuk menganalisis kesesuaian konsep permodalan syariah dengan karakteristik PT serta mengidentifikasi mekanisme implementasi yang sesuai dengan hukum positif dan prinsip syariah. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan analitis. Hasil penelitian menunjukkan bahwa permodalan syariah dapat diimplementasikan dalam PT melalui instrumen saham syariah, akad musyarakah, akad mudharabah, dan penerbitan sukuk, dengan syarat dilakukan penyesuaian anggaran dasar, penerapan tata kelola perusahaan berbasis syariah, serta pengawasan Dewan Pengawas Syariah. Penelitian ini memberikan kontribusi akademik berupa penguatan dasar yuridis PT syariah serta kontribusi praktis bagi pelaku usaha dalam mengembangkan badan usaha yang sesuai prinsip syariah. Abstract

The development of contemporary Islamic economics has grown significantly; however, it still faces fundamental challenges related to its epistemological foundation and scientific orientation. The dominance of legal-formal and technical approaches in both academic discourse and practical implementation often leads to the marginalization of substantive welfare objectives, which constitute the core purpose of Islamic law. This study aims to analyze the concept of maslahah as a paradigmatic foundation for contemporary Islamic economics. Employing a qualitative approach with a library research method, this study critically examines classical and contemporary literature derived from authoritative books, accredited national journals, and reputable international journals. The findings indicate that maslahah holds strong potential as a paradigm for Islamic economics, as it shapes foundational assumptions, scientific objectives, and methodological orientations grounded in collective welfare, social justice, and sustainability. Nevertheless, existing studies tend to position maslahah merely as a normative or limited applicative principle rather than as a comprehensive epistemological framework. This study underscores the urgency of reconstructing Islamic economics based on the maslahah paradigm to address contemporary economic challenges in a more holistic and equitable manner

Abstract

This study analyzes the product innovation and branding strategies of Es Teler Kuy MSMEs in increasing business competitiveness in Sukamaju Village, Baregbeg District, Ciamis Regency. The purpose of this study is to examine the application of product innovation and strengthening brand identity as an effort to expand the market and maintain business sustainability. The method used is qualitative research with a case study approach through in-depth interviews, observation, and documentation, with data analysis using the Miles and Huberman model. The results show that innovation is carried out through the transformation of traditional es teler into a modern dessert with a creamy sauce, the use of premium fruit, a variety of toppings, and biodegradable packaging that increases consumer appeal and drives an increase in demand of up to 40%. Branding strategies are built through a locally distinctive visual identity, memorable slogans, and the use of consumer-driven social media to expand market reach and strengthen product image. The impact is seen in increased sales, price affordability, and socioeconomic contributions in the form of job creation and strengthening village economic identity. However, limited distribution and low digital literacy remain obstacles. This study confirms that the integration of product innovation and contextual branding effectively increases the competitiveness of rural MSMEs

Abstract

The distribution of wealth in Islam is a strategic instrument for achieving social justice and equitable welfare. One important mechanism in this distribution is the inheritance system (faraidh), which not only functions as a mechanism for transferring wealth between generations, but also as a means of maintaining economic balance and family harmony. This study aims to analyze the optimization of inheritance utilization in supporting family economic empowerment and to identify various challenges faced in its management. This study uses a qualitative approach based on literature review by examining various research results related to productive inheritance management. The results of the study show that transparent, fair, and Sharia-compliant inheritance management has the potential to improve the welfare of heirs, strengthen family solidarity, and create sustainable business opportunities. However, a lack of understanding of faraidh law, conflicts between heirs, and weak legal documentation are major challenges that often hinder the optimization of inheritance assets. Therefore, education, open communication, and professional asset management are needed so that inheritance assets can contribute maximally to the economic development of the community.

Abstract

The development of e-commerce in Indonesia shows rapid growth, especially in the fashion product category, which is one of the sectors with the highest transaction rates on digital platforms. This condition encourages consumers to be more selective in making purchasing decisions by considering various factors that influence consumption behavior. Discounts are one of the effective marketing strategies in attracting consumer interest, while customer experience plays an important role in building satisfaction, comfort, and trust in online shopping platforms. This phenomenon is also seen among Shopee platform users in Cisaat District, who are increasingly active in purchasing fashion products online. This study aims to analyze the influence of discounts and customer experience on fashion product purchasing decisions on the Shopee platform in Cisaat District. The research method used is a quantitative approach with a survey method through the distribution of questionnaires to 100 respondents selected using purposive sampling techniques. Data analysis was performed using multiple linear regression with hypothesis testing through t-tests, F-tests, and determination coefficients. The results of the study indicate that discounts and customer experience, both partially and simultaneously, have a positive and significant effect on purchasing decisions. These findings confirm that the right discount strategy and improving the quality of customer experience can be important factors in driving consumer purchasing decisions on e-commerce platforms.

Abstract

The development of the platform-based digital creative economy has created new forms of transactions involving complex contractual relationships among economic actors. One emerging practice is paid video clipping in digital campaigns, where content creators distribute promotional clips through platform-based task mechanisms. Although increasingly used, the underlying contractual construction has not been widely analyzed from the perspective of Islamic economic law. This study aims to analyze and formulate the multi-contract structure in paid video clipping practices within platform-based digital campaigns. It uses a library research method with a descriptive qualitative approach through conceptual analysis of literature on muamalah fiqh and digital economic studies. The results show that this practice forms a multi-contract configuration involving a wakālah bi al-ujrah contract between the brand and the digital platform and a ju‘ālah contract between the platform and the content creator. Both operate simultaneously in interconnected platform-based transactions. This study demonstrates that the multi-contract approach is a relevant framework for explaining the complexity of transactions in the non-financial digital creative economy and expands its application in Islamic economic law to contemporary digital practices.

Abstract

This study examines the implementation of key doctrines in corporate law related to directors’ liability in limited liability companies in Indonesia. The doctrines analyzed include Piercing the Corporate Veil, Business Judgment Rule, Ultra Vires, and Fiduciary Duty. This research employs a normative legal method with statute, conceptual, and case approaches. Legal materials were collected through literature studies and analyzed qualitatively to understand the application of these doctrines in corporate legal practice in Indonesia.  The findings indicate that these doctrines play an important role in determining the limits of directors’ responsibilities in corporate management. The doctrine of Piercing the Corporate Veil allows courts to impose personal liability when the corporate entity is misused, as illustrated in the case involving PT Effem Foods Inc. The Business Judgment Rule provides legal protection for directors in making business decisions in good faith, as reflected in the case of PT Merpati Nusantara Airlines. The Ultra Vires doctrine emphasizes that corporate actions must remain within the scope of the company’s objectives, as shown in the PT Condato Grup Indonesia case. In addition, the Fiduciary Duty doctrine highlights directors’ obligations to act with due care and loyalty in managing the company, as seen in the PT Bakara Bumi Energi case.

Abstract

This study analyzes the fair pricing strategy of Irvan WiFi Blitar, a local Internet Service Provider (ISP), through the lens of Maqashid Shariah and its impact on competitive advantage. Facing aggressive competition from national providers, this research uses a descriptive qualitative case study approach, gathering data through in-depth interviews and observations. The findings reveal that Irvan WiFi integrates the five pillars of Maqashid Shariah into its business model: protecting religion (contract transparency), life (price stability), intellect (information accessibility), lineage (safe domestic digital environment), and property (social benefit distribution). This maslahah-based approach creates a unique service differentiation and fosters high customer loyalty, providing a sustainable competitive advantage. The study contributes a theoretical model for MSME resilience in the technology sector by transforming theological values into strategic business instruments. In conclusion, fair pricing serves not only as a profit mechanism but as a foundation for business longevity and community welfare. These results offer a vital reference for local ISPs to thrive amidst corporate hegemony by prioritizing ethical and social value.

Abstract

The global ecological crisis stems from the ontological failure of the linear economic system, which separates material activity from spiritual values. This study aims to formulate an integrative framework between the Islamic prohibition of isrāf (excessiveness) and contemporary circular economy transformations to foster a regenerative model. Using a qualitative library research method, this research analyzes authoritative Islamic texts alongside regenerative economic discourses. The results confirm that while the circular economy provides technical mechanisms for resource retention, the concept of isrāf acts as a vital "moral brake" against overconsumption. This synthesis creates "Transcendental Circularity," shifting the paradigm from secular anthropocentrism to a theocentric-khilafah approach. The findings demonstrate that integrating transcendental values corrects the systemic "rebound effect" of modern technology and provides a solid ethical foundation for sustainable production and consumption. This research contributes to the Islamic economic discourse by offering a holistic guide for green policy-making. In conclusion, the synergy between modern science and spiritual ethics is essential to resolve the ontological failures of modern economics and ensure ecological justice for future generations.
