Jurnal Siyasah wa Qanuniyah diterbitkan oleh Lembaga Penelitian dan Pengabdian kepada Masyarakat (LPPM) Ma'had Aly Raudhatul Ma'arif, Aceh Utara, Indonesia, Takhassus Fiqh Wa Ushuluhu dengan konsentrasi Fiqh siyasah wa Qanun. Jurnal ini memuat artikel-artikel hasil penelitian yang menjawab persoalan-persoalan politik dan hukum yang aktual dengan merujuk pada teori-teori fikih dan Ushul fikih yang terpercaya dalam lingkup mazhab. Pengiriman artikel pada jurnal ini ditujukan ke website jurnal.mahadalyraudhatulmaarif.ac.id Informasi lengkap untuk pengiriman artikel dan petunjuk penulisan artikel tersedia di setiap edisi. Artikel yang masuk akan melalui proses seleksi oleh editor dan reviewer. Jurnal Siyasah Wa Qanuniyah ini merupakan jurnal ilmiah dan referensi yang menjadi sumber informasi resmi bagi masyarakat umum, cendekiawan, akademisi, dan profesional di bidang hukum Islam. Jurnal ini diterbitkan dalam bentuk cetak dan online yang dapat diunduh secara gratis. Terbit secara berkala dua kali dalam setahun. Jurnal ini diharapkan dapat memberikan kontribusi bagi para akademisi dalam mempelajari hukum Islam khususnya di bidang Fiqh Siyasah baik dari aspek hukum Islam maupun hukum tata negara yang telah berlaku di Indonesia. Jurnal ini telah menjadi Anggota CrossRef sejak tahun 2023. Ruang lingkup artikel ilmiah yang diterbitkan dalam jurnal ini adalah topik yang luas di bidang Hukum Islam dan Hukum Tata Negara Islam (Siyasah). Dengan demikian, jurnal ini mencakup kajian-kajian hukum islam terkhusus seperti Ilmu Politik Islam, Perkembangan Politik Islam, Teori Politik Islam, Filsafat Politik, dan Politik Praktis Berbasis Syariah. Jurnal ini menyambut baik kontribusi dari para sarjana dari disiplin ilmu terkait.

Abstract

The Village Head Election is a manifestation of village democracy aimed at selecting a qualified leader. This study aims to analyze community participation and political behavior leading up to the voting process in the Village Head election in Matang Kumbang Village, Makmur Subdistrict, Bireuen Regency. The research questions are: (1) What is the technique of selecting the Village Head in Matang Kumbang Village? and (2) What is the political behavior of the community during the election? This research uses a qualitative method with a field research approach, and the collected data is analyzed using a descriptive-analytic method. Conclusions are drawn through a deductive approach. The results show that the Village Head election in Matang Kumbang Village was conducted by a committee formed by the Village Consultation Body (BPD), consisting of village officials, community organization leaders, and local figures. The election process was optimal, and no violations of the Bireuen Regency regulations, such as money politics, were found. From the perspective of Islamic political law (siyasah), the implementation of the Village Head election in Matang Kumbang is justified and aligns with Islamic teachings. However, there are still aspects that need improvement, such as the criteria for selecting a leader and the unsporting actions of some village head candidates.

Abstract

This article aims to investigate the competence of the Religious Courts in handling Islamic Economic cases. A significant change that recently occurred is the expansion of the Religious Court's jurisdiction in accordance with Law No. 3 of 2006, particularly concerning the handling of Islamic Economic cases in Indonesia. The Religious Courts are now authorized to handle cases related to Islamic financial services, including Islamic banking disputes. This amendment not only broadens the authority of the Religious Courts but also provides a clear scope for Islamic economic disputes. The scope extends beyond banking issues to include Islamic microfinance institutions, Islamic insurance, reinsurance, Islamic mutual funds, Islamic bonds, medium-term Islamic securities, Islamic securities, Islamic multifinance, Islamic pawnshops, and other Islamic financial institutions and businesses.

Abstract

Based on the General Election Commission Regulation (PKPU) of the Republic of Indonesia No. 23 of 2018 on Election Campaigns, Article 35 paragraphs 1 to 4 regulates campaigns on social media. Paragraph 1 states, "Election participants may conduct campaigns through social media as referred to in Article 23 paragraph (1) letter e." Social media is widely used to disseminate information, often without verifying its accuracy, and is prone to fake news and hate speech. The increasing use of social media in Indonesia reflects its growing influence. This study examines: 1) How election campaigns on social media are regulated under PKPU No. 23 of 2018, and 2) How these campaigns align with Fiqh Siyasah. The qualitative research adopts a library research method with a descriptive-analytical approach, using secondary sources like legal texts and academic references. The findings reveal that PKPU No. 23 of 2018 requires participants to register official campaign accounts, limiting them to a maximum of ten accounts per platform. These accounts must be registered no later than one day before the campaign period starts and deactivated on the last day. From the Fiqh Siyasah perspective, social media campaigns are permissible if they avoid slander, adhere to ethical values, and comply with regulations like PKPU No. 23 of 2018. The regulation supports the effective dissemination of campaign information, such as candidates’ visions and missions, while minimizing falsehoods, hate speech, and other violations. This ensures campaigns align with Islamic principles, focusing on public benefits (maslahah). Anything promoting maslahah is permissible in Islam, showing how the regulation fosters positive outcomes for society. PKPU No. 23 of 2018 demonstrates the compatibility between ethical governance and Fiqh Siyasah, balancing modern electoral practices with Islamic values.

Abstract

This research raises about the fiqh thinking of Imam Ja'far Asshiddiq (tracing the development of the ja'fariyah madhhab). In this research, the author uses library research, and data collection is done by studying books and books about Fiqh Ja'fari, ushul fiqh Ja'fariyah as primary material, and other books related to the discussion of this research as secondary material, so this pattern is qualitative. In addition, the analysis that the author uses is descriptive analysis. From the results of this research, it is concluded that Imam Ja'far Asshadiq is the founder of the Ja'fariyah school. he was born in 80 AH and died in 148 AH. The titles Imam and Shadiq were given to him because: Firstly, Imam Ja'far was known to be a truly shadiq person, truthful in his words and deeds, nothing was known from Ja'far other than the trait of shidq (honest, truthful). Secondly, because of the depth and breadth of his knowledge. The sources of law of this madhhab are the Qur'an, Sunnah, Ijma', and Reason. In terms of fiqh, this school is very close with only 17 differences with the fiqh of the sunnah experts (Hanafiyah, Malikiyah, Shafi'iyah, and Hambaliyah). One of the most important of these is the issue of legalising mut'ah marriage. Ahl as-Sunnah are all agreed that mut'ah marriage is haram and is no different from zina.

Abstract

The enactment of Law No. 18/2001 granted the Aceh government special autonomy, enabling it to implement Sharia principles through the drafting of Qanuns grounded in Fiqh. This autonomy distinguishes Aceh as a region where Islamic law is uniquely integrated into modern governance. One significant example is Qanun No. 6 of 2014 on Jinayat Law, which regulates criminal acts based on Sharia principles. This study examines the role of Fiqh in shaping and applying this Qanun, focusing on two main questions: how Fiqh is represented in Qanun No. 6 of 2014 and whether its implementation aligns with Fiqh principles. Employing a qualitative approach and library research methods, the study draws on primary sources such as legal texts and books, supplemented by academic journals and related studies. The findings reveal that the Jinayat Qanun incorporates key Fiqh principles, reflecting Aceh’s commitment to upholding Islamic law. Legal provisions and punishments within the Qanun are primarily aligned with classical Fiqh guidelines. However, certain aspects deviate or fall short of fully adhering to Fiqh norms due to challenges in adapting traditional jurisprudence to contemporary legal and societal contexts. In conclusion, the study highlights the significance of Islamic law in Aceh’s governance, emphasizing its strengths and identifying areas for improvement. The implementation of Qanun No. 6 of 2014 illustrates the dynamic interplay between Fiqh and local governance, positioning Aceh as a unique example of contemporary siyasah rooted in Islamic principles.

Abstract

Diskursus mengenai penerapan dan penetapan hukuman mati masih belum menemukan titik temu. Hukuman mati merupakan pidana yang paling berat dalam sistem pemidanaan. Meskipun demikian, hukuman mati banyak diterapkan dalam hukum pidana di berbagai negara, dengan berbagai cara eksekusi, mulai dari pancung, gantung, suntikan mati, hingga tembak mati. Di Indonesia, hukuman mati sebelumnya diterapkan dengan cara digantung dan dipancung. Namun, berdasarkan Undang-undang No. 2 Pnps Tahun 1964, tata cara pelaksanaan hukuman mati diatur, dimulai dari penetapan kejaksaan tinggi hingga eksekusi yang dilakukan di tempat yang tersembunyi dari masyarakat. Perdebatan mengenai hukuman mati sudah ada sejak dimuatnya ketentuan pidana dalam KUHP Hindia Belanda dan terus berlanjut hingga kini. Beberapa alasan dipertahankannya hukuman mati adalah untuk memberikan efek jera yang luar biasa bagi pelaku kejahatan. Hal ini sejalan dengan tujuan sistem peradilan pidana, yaitu: (i) mencegah masyarakat menjadi korban kejahatan, (ii) memastikan keadilan ditegakkan dan pelaku dihukum, dan (iii) mencegah pelaku mengulangi kejahatan. Oleh karena itu, hukuman mati masih dianggap perlu sebagai upaya menakut-nakuti penjahat. Penelitian ini menggunakan pendekatan hukum normatif dengan sifat deskriptif dan preskriptif, dengan sumber data berupa bahan hukum sekunder. Hasil penelitian menunjukkan bahwa kebutuhan akan hukuman mati secara normatif terasa lebih diperlukan, mengingat hukuman penjara yang tidak efektif dalam menekan angka kejahatan. Penjara kadang dianggap sebagai "sekolah tinggi kejahatan." Perspektif HAM tidak sepenuhnya dapat dijadikan alasan untuk menghapuskan hukuman mati, meskipun menghilangkan nyawa adalah pelanggaran terhadap prinsip dasar HAM. Namun, prinsip dasar HAM juga mengatur hak untuk tidak ditahan secara sewenang-wenang dan menjamin hak-hak dasar lainnya yang harus dilindungi oleh negara.

Abstract

This paper discusses the views of Islamic scholars (ulama fiqh) on apostasy before reaching the age of maturity (baliqh) and its relation to the inheritance of the wealth left by the deceased. There is a difference in understanding between the Hanafi and Shafi’i schools of thought regarding the legal status of apostasy before baliqh in relation to inheritance. The issues addressed in this paper include the perspectives of both schools on apostasy before baliqh and its connection to inheritance, whether a person who commits apostasy before baliqh is entitled to inherit, and the evidences cited by each school. This study aims to explain the differences in the Hanafi and Shafi’i schools of thought regarding apostasy before baliqh and their stance on inheritance. The research employs a qualitative descriptive method with a library-based literature review approach. The findings indicate significant differences between the Hanafi and Shafi’i schools. According to the Hanafi school, apostasy before baliqh is considered valid, and the person who commits apostasy is not entitled to inherit.

Abstract

This paper aims to explore the concept of leadership in Islam. The research employs a library research method by gathering various written sources and references to reach specific conclusions. Leadership is defined as the method of leading a group, while Islamic leadership is based on the teachings of the Quran and Sunnah. This paper explains that Islamic leadership has specific duties and obligations that must be observed by the leader. It also discusses the characteristics of an Islamic leader and the principles of Islamic leadership. Islamic leadership plays a crucial role in ensuring that a leader follows the commands of Allah SWT and the Prophet Muhammad SAW. What is observed by Muslims, particularly in the actions of a leader, can influence the alignment and trust of the followers in their leadership.

Abstract

This study, titled Ta’zir bi Ihlakil Mal According to Wahbah Zuhayli in the Book of Fiqh al-Islamiah wa Adillatuh in the Chapter on Ta’zir, aims to foster a peaceful, orderly, obedient, and consistent life in accordance with religious teachings, while avoiding conflicts, disputes, and bloodshed. To achieve this, Allah SWT has set specific laws and promises rewards for obedience, along with punishments for disobedience. The research focuses on two main issues: 1) What is the legal stance on ta’zir bi ihlakil mal according to Wahbah Zuhayli in Fiqh al-Islamiah wa Adillatuh in the chapter on ta’zir? and 2) What is the relevance of implementing ta’zir bi ihlakil mal in modern society according to the book? This study uses a qualitative research method with a normative legal approach. The findings conclude that, according to the majority of scholars from the Maliki, Hanbali, and other schools of thought, the punishment of ta’zir bi ihlakil mal is permissible under Islamic law, and wealth can be destroyed if it becomes a means of causing corruption. Additionally, ta’zir remains relevant in modern times as it is part of the Maqashid Syar'iyyah, just like other Islamic laws.

Abstract

The Republic of Indonesia regulates the requirements for presidential and vice-presidential candidates in Law No. 7 of 2017, Article 169. This law is interesting to analyze from the perspective of whether it aligns with the qualifications outlined by Imam al-Mawardi in his work al-Ahkam as-Sulthaniyah and Imam al-Ghazali in al-Tibru al-Masbuk Fi Nashihati al-Muluk. These two scholars established criteria that a head of state must possess. This research uses a library research method with a descriptive qualitative approach. The results of the study show that, first, the criteria for a head of state according to Imam al-Mawardi consist of seven: (1) justice, (2) knowledge, (3) healthy senses, (4) healthy body, (5) a clear vision and mission, (6) courage and strength, (7) descent from the Quraysh. In contrast, the criteria for a head of state according to Imam al-Ghazali are ten, summarized into seven: (1) justice, (2) knowledge, (3) good religion and morals, (4) health, (5) trustworthiness, (6) receptive to the advice of scholars, (7) simplicity and closeness to the people. Second, the relevance of the ideas of Imam al-Mawardi and al-Ghazali concerning leadership requirements in Indonesia can be actualized and applied within the existing positive law in Indonesia, such as in the requirements for presidential and vice-presidential candidates as well as regional head candidates. The ideal leadership concepts from both scholars can serve as guidelines for leaders in Indonesia to implement in their leadership agenda.
