Jurnal Siyasah wa Qanuniyah diterbitkan oleh Lembaga Penelitian dan Pengabdian kepada Masyarakat (LPPM) Ma'had Aly Raudhatul Ma'arif, Aceh Utara, Indonesia, Takhassus Fiqh Wa Ushuluhu dengan konsentrasi Fiqh siyasah wa Qanun. Jurnal ini memuat artikel-artikel hasil penelitian yang menjawab persoalan-persoalan politik dan hukum yang aktual dengan merujuk pada teori-teori fikih dan Ushul fikih yang terpercaya dalam lingkup mazhab. Pengiriman artikel pada jurnal ini ditujukan ke website jurnal.mahadalyraudhatulmaarif.ac.id Informasi lengkap untuk pengiriman artikel dan petunjuk penulisan artikel tersedia di setiap edisi. Artikel yang masuk akan melalui proses seleksi oleh editor dan reviewer. Jurnal Siyasah Wa Qanuniyah ini merupakan jurnal ilmiah dan referensi yang menjadi sumber informasi resmi bagi masyarakat umum, cendekiawan, akademisi, dan profesional di bidang hukum Islam. Jurnal ini diterbitkan dalam bentuk cetak dan online yang dapat diunduh secara gratis. Terbit secara berkala dua kali dalam setahun. Jurnal ini diharapkan dapat memberikan kontribusi bagi para akademisi dalam mempelajari hukum Islam khususnya di bidang Fiqh Siyasah baik dari aspek hukum Islam maupun hukum tata negara yang telah berlaku di Indonesia. Jurnal ini telah menjadi Anggota CrossRef sejak tahun 2023. Ruang lingkup artikel ilmiah yang diterbitkan dalam jurnal ini adalah topik yang luas di bidang Hukum Islam dan Hukum Tata Negara Islam (Siyasah). Dengan demikian, jurnal ini mencakup kajian-kajian hukum islam terkhusus seperti Ilmu Politik Islam, Perkembangan Politik Islam, Teori Politik Islam, Filsafat Politik, dan Politik Praktis Berbasis Syariah. Jurnal ini menyambut baik kontribusi dari para sarjana dari disiplin ilmu terkait.

Abstract

During Soekarno's administration, several significant events took place, including the emergence of the DI/TI movement led by Sekarmadji Maridjan Kartosuwirjo. This movement, also known as DI/TII, operated under the Tentara Islam Indonesia (TII) and aimed to establish an Islamic State of Indonesia. Concurrently, Islamic parties debated not only the desired form of an Islamic state but also the legitimacy of President Soekarno as ulil amri (leader deserving of obedience) due to the government not being Islamic. Amidst ongoing debates within the Islamic factions in the Constituent Assembly, President Soekarno convened approximately 500 ulama from Java and two prominent ulama from Aceh, Teungku M. Hasan Krueng Kalee and Abuya Muda Wali al-Khalidy, at Istana Cipanas on October 14, 1957. They discussed the status of the Indonesian state and its president under Islamic jurisprudence, deliberating on whether his leadership was legitimate according to Islamic principles. Out of this meeting emerged the concept of "Waliyul Amri Dharuri Bisy Syaukah", bestowed upon President Soekarno, affirming his legitimacy as the head of state despite Indonesia not being an Islamic nation. The scholarly work discussed in this context employs library research as its method, gathering theoretical insights by studying relevant literature. The research findings underscore the proposal of "Dharuri Bisy Syaukah," a consensus reached among the attending ulama, which solidified President Soekarno's legitimacy as the national leader.

Abstract

In modern legal thought, the relationship between Islam and politics is often debated, with some scholars arguing that Islam does not regulate politics, while others view it as a comprehensive religion that encompasses the formation of the state and its political apparatus, with supreme power originating from God. This study aims to analyze Abdul Wahhāb Khallāf’s perspective on Islamic politics and its application within Indonesia’s democratic system, using a library research method and a descriptive-analytical qualitative approach, referring to Khallāf’s main work As-Siyāsah As-Syar’iyyah Fī Syu’ūn Ad-Dustūriyyah Wa Al-Khārijiyyah Wa Al-Māliyah. The findings show that Khallāf sees a symbiotic relationship between Islam and politics, with his leadership theory emphasizing justice, public participation, and the protection of individual rights, which aligns with the principles of democracy in Indonesia. Khallāf’s thinking also supports a balanced distribution of power between the executive, legislative, and judiciary, in accordance with the principles of checks and balances in a democratic system. Thus, this study concludes that Abdul Wahhāb Khallāf’s ideas can provide significant contributions to strengthening Indonesia’s democratic system, provided they are applied with contextual interpretation and responsiveness to changing times.

Abstract

This research aims to examine the thoughts of the jurists regarding the formulation of ta'zīr by the government. So far, ta'zīr has been understood as a form of unlimited punishment; its determination does not refer to a standard rule. If a crime of ta'zīr occurs, the government undertakes ijtihad to determine the appropriate sentence for the act. Conditions like this are not relevant to the context of law enforcement today. This research uses two approaches as a basis for analysis: 1) socio-historical, namely understanding the formulation of ta'zīr criminal law carried out by fuqaha' from the past to the present period. 2) Content analysis, namely, analysis of fiqh texts and positive legal science. This step aims to obtain the basis or tools available from the scientific treasures to understand the formulation of the ta'zīr criminal law by the government. The research results show that ta'zīr is a criminal law concerning criminal acts and punishments which must go through a formulation process before being implemented. The ta'zīr penalty that is made must meet the criteria of a regulation that is suitable to be implemented

Abstract

Leadership (imamah) in Islam plays a vital role in maintaining the ummah's social order, justice, and moral integrity. This study aims to explore the hadiths concerning the mandate and responsibility of Islamic leaders, particularly focusing on the principles of shura (consultation) and amanah (trust), and to contextualise them within modern leadership theories. Using a qualitative library research method, this paper conducts a thematic and comparative analysis of prophetic traditions related to leadership. It examines their relevance in light of contemporary theories such as deliberative democracy and ethical leadership. The findings show that while the Qur'an does not explicitly mention "leadership," it emphasises values such as consultation, trust, and justice, principles further reinforced in the Hadith. These values serve as the moral foundation of leadership in Islam and align with modern concepts of participatory governance, accountability, and servant leadership. This study concludes that Islamic leadership, rooted in the principles of shura, amanah, and ‘is, offers a value-based, participatory, and transformative leadership model. These principles align with modern theories such as deliberative democracy, ethical leadership, and good governance, but also provide a relevant alternative to address contemporary leadership challenges such as ethical crises, lack of public trust, and weak participation.

Abstract

The Mirror for Princes genre comprises works by scholars and religious figures designed to offer guidance and advice to rulers. This genre was widespread in both Europe and the Islamic world during the classical and medieval eras. In the Islamic world, these works aimed to provide moral guidance and practical advice to leaders under various titles. One notable example is Imam al-Ghazali's “al-Tibrul al-Masbuk fi Nasihat al-Mulk.” This paper employs a literature study approach to analyze the text, examining the book's manuscript to understand how scholars conveyed advice to Islamic rulers in the Middle Ages. The text can be seen as a persuasive form of political thought, offering rulers theological, ethical, and practical guidance. Al-Ghazali's manuscript on al-mulk comprises an introduction and seven chapters, addressing topics such as Sunni theology, justice and politics, the structure of ministries and the ethical conduct of their secretaries, the titles of kings, the wisdom of philosophers, the significance of reason and thinkers, and a discussion of the position of women. The existence of mirror for princes' manuscripts in the Islamic world shares similarities with political texts from the Persian and Roman empires. One of al-Ghazali's important advice to rulers is that justice is closely related to the permanence of power.

Abstract

Family law reform in Egypt is an important response to social dynamics and the demands of modernity that require adjustments to Islamic legal regulations to be more contextual and responsive to the current conditions of society. This research uses a juridical-normative method with a literature review approach to analyse the historical development, reform process, and implementation of family law regulations in Egypt, especially those based on the principle of benefit (maslahah) in siyasah shar’iyyah. The results of the study show that Egypt has undergone various stages of family law reform, ranging from initial codification, amendments, to regulatory innovations that emphasise the protection of women’s and children’s rights, regulation of bride and groom’s consent, restrictions on polygamy, and the establishment of a minimum age of marriage. This reform succeeded in harmonising the principles of sharia with contemporary social demands through an adaptive and progressive model of siyasah shar’iyyah. In conclusion, family law reform in Egypt is not just a formal adjustment, but also a substantive transformation that strengthens legal certainty and social justice. This study makes a significant contribution to the study of Islamic law and family law reform in Muslim countries by offering a contextual and applicable model of siyasah shar’iyyah implementation.

Abstract

Quality public services are a key pillar in realizing good governance. However, government administration practices in Indonesia still face various obstacles in implementing this principle. This study aims to analyze the urgency of reforming state administrative law from the perspective of fiqh siyasah (Islamic political jurisprudence) on public services in Indonesia. The method used is normative juridical research with a legislative, conceptual, and theological-normative approach, through a literature review of legal and fiqh siyasah literature. The results of the study indicate the need to integrate Islamic values such as justice (al-'adl), benefit (al-maslahah), and trustworthiness (amanah) in the delivery of public services in order to strengthen the principle of good governance. The novelty of this study lies in the combination of the modern state administrative law paradigm and fiqh siyasah, which provides a conceptual contribution to the renewal of the administrative law and public service systems in Indonesia.

Abstract

This study examines freedom of expression in democratic systems from the perspective of maqāṣid asy-syarī‘ah, aiming to analyze the relevance and limitations of the right to express opinions for citizens and their relation to public welfare. The research employs a qualitative library research approach, reviewing classical and contemporary literature on Islamic law, political jurisprudence, the Indonesian constitution, and democratic principles. Analysis focuses on identifying relevant concepts, values, and normative arguments linked to the protection of religion, life, intellect, lineage, and property. The findings indicate that freedom of expression is a fundamental right enabling active citizen participation in public decision-making and governmental oversight. From an Islamic perspective, this right aligns with maqāṣid asy-syarī‘ah, particularly hifẓ al-‘aql, requiring responsible development of intellectual capacity. Freedom of expression is relative and must be exercised with ethics, law, and social responsibility, supporting the achievement of collective welfare without harming individuals or society.
