Abstract

The research is aimed at finding, understanding, and analyzing the juridic components that cause counterfeit goods to circulate to the public. In addition, the study also investigates how governments and brand owners can prevent counterfeits. This study uses a normative or normative jurisprudential approach; or in other words, this study is about favorable legal norms as the topic of legal research as well as the Hadith perspective of Ahmad's history. The existence of free trade produces an unlimited trade market, which produces a wider distribution of goods and services in society. Brands play an important role inining healthy competition as trade in products and services has grown. The owner’s as the only proprietor of the goods is to prevent the violation of the trademark. For example, the common and increasing public violation is counterfeiting of goods, which affects the increased public demand for counterfeit goods. In addition, the economic and cultural factors of communities also contribute to the circulation of counterfeit goods in communities. The study’s findings demonstrate that brand owners and the government have not fully protected their right to prevent the circulation of counterfeit goods. Until now, only the original brand owners have been active in preventing the spread of the counterfeit

Abstract

The marriage of women who are pregnant out of wedlock or due to adultery is a complex issue within the context of Islamic law itself. Article 53, in the view of Islamic law regarding such marriages, becomes a significant subject of debate in contemporary Islamic legal discussions. This article will present the perspective of Islamic law on the marriage of pregnant women out of wedlock, with an emphasis on Article 53 and its correlation with the Hadith narrated by Muslim. Marriage in Islam is governed by certain principles that emphasize the importance of justice, honor, and responsibility. Marriage is a legal bond between two individuals who mutually agree and commit to each other. However, pregnancy out of wedlock introduces its own complexities within the context of Islamic law. Article 53, in some interpretations, reflects views on how Islamic law treats such marriages. The correlation between Article 53 and the Hadith narrated by Muslim adds to the complexity of understanding Islamic law related to the marriage of pregnant women out of wedlock. The Hadith narrated by Muslim is one of the primary sources in Hadith literature that is often cited to show the views of Prophet Muhammad (PBUH) on various aspects of life, including marriage and family. An analysis of this Hadith helps interpret the Islamic view on marriage out of wedlock. This article aims to comprehensively analyze these two perspectives. The correlation between Article 53 and the Hadith narrated by Muslim will be explored to understand a comprehensive Islamic legal perspective on the marriage of pregnant women out of wedlock. The legal and moral implications of this perspective will be discussed, considering various interpretations and social contexts. A better understanding of Islamic law related to such marriages is essential for addressing contemporary issues related to morality, justice, and responsibility in Muslim societies.

Abstract

Community empowerment is one of the efforts to achieve community economic prosperity. Which is linked to issues of poverty and development. BUMDesma is a step from the government by collaborating with villages related to productive business and economy. The aim of this research is to identify Community Empowerment through the Management of BUMDesma Sumberrejo Berkah Mandiri Sejahtera (SBMS) Lkd Sumberrejo Bojonegoro District. The research method used is qualitative with descriptive methods. Based on the results and discussion using the ACTORS Theory by Sarah Cook and Steve Macualay, the resulting findings are that the authority is based on PDTT Ministerial Decree No.11 of 2021 and is already a legal entity. The formation of a business unit must be jointly approved through an Inter-Village Deliberation (MAD) as well as accountability for activities and financial management every 1 year. Capital participation from the village government and the private sector is very necessary to create new businesses apart from revolving funds (SPP) so optimal management is needed. BUMDesma is expected to achieve independence and create businesses where fifty-fifty is needed, meaning 50% of BUMDesma and 50% of the community. So there is a need for coordination and assistance or coaching.

Abstract

Child-Friendly Schools are essentially schools that provide all children with full rights, as well as classroom and school management that must be supported by positive physical, psychological, social, healthy and safe conditions. Child-Friendly Schools are also an ideal concept for school-aged children. This program is related to the Child Friendly Regency/City launched by the government. The aim of developing Child Friendly Schools is to prevent violence against children and other school residents, prevent children from getting sick due to food poisoning and an unhealthy environment, prevent accidents in schools caused by infrastructure or natural disasters, prevent children from becoming smokers, alcohol drinkers and users. NAPZA, creates good relationships between school members, makes it easier to monitor children's conditions while they are at school, and makes it easier to achieve educational goals.

Abstract

This study discusses the role of Islamic economic law in regulating Islamic business transactions by emphasizing the principles of justice, transparency, and compliance with Islamic values. Islamic economic law functions to create Islamic regulations and guidelines that must be adhered to in every business transaction, prohibiting practices such as usury, maysir, and gharar. Within this framework, the principles of tauhid, khilafah, justice, tazkiyah, and al-falah become the main foundations underlying all economic activities. This study uses a qualitative method with a literature study to analyze various related literature sources. The main findings show that Islamic economic law not only provides a clear legal framework but also effectively prevents haram practices, resulting in fairer and more ethical transactions. The application of Islamic principles in business transactions can increase trust and stability in the Islamic business ecosystem. This study contributes in the form of concepts and methods that can be used to implement Islamic economic principles. The limitation of this study lies in its focus mainly on general theory and principles, while further research can explore more deeply the practical implementation of Islamic economic law in various business sectors. The implication of this study is the importance of education, regulatory development, and increasing transparency in business transactions to create a fairer and more sustainable business environment.

Abstract

In the digital era, Micro, Small, and Medium Enterprises (MSMEs) face various challenges and opportunities. Social media and Search Engine Optimization (SEO) are promising solutions to increase brand awareness and sales conversions. This study aims to determine the effectiveness of implementing social media and SEO article optimization on the brand awareness and sales conversions of Rumah Kapas MSME. The results showed that optimizing Instagram and Tiktok social media content, as well as SEO articles, successfully increased the brand awareness and sales conversions of Rumah Kapas MSME. This is evidenced by the increase in the number of followers, reach, and engagement on social media, as well as website traffic and sales.

Abstract

This research was motivated by the urgent case of stunting toddlers in Indonesia, including in the city of Surabaya. This stunting has a very negative impact on the health and growth and development of toddlers. The East Java BKKBN initiated the Great Parent School program and collaborated with the local government to implement this policy in the community. Continuing, the Mayor of Surabaya has formulated the policy of Mayor Regulation Number 106 of 2023 concerning Schools for Great Parents to support the acceleration of reducing stunting cases in the City of Surabaya. Sukolilo District is part of Surabaya City, so Sukolilo District also implements this policy. This program focuses on education for parents in parenting their children well and correctly. In implementing the SOTH program in Sukolilo District, researchers found that this program had a big influence on reducing the number of stunting cases currently in Sukolilo District in 2023-May 2024. Support from the public and the Mayor of Surabaya is one of the supporting factors for the success of this program. And parents should always apply the parenting patterns they have been taught so that their children avoid stunting. In this research the researcher used the Mazmanian and Sebatier model of policy implementation theory to describe the implementation of the policy, and the researcher used a descriptive-qualitative research approach in his research

Abstract

Customary law is a legal system formed from the traditions and customs of local communities, which has evolved over centuries and become an integral part of the cultural identity of these communities. In the modern context, customary law faces significant challenges to remain relevant amidst the currents of globalization and the dominance of national law. This article explores the application and relevance of customary law in the contemporary era with a focus on case studies in several regions of Indonesia. This research employs qualitative methods with a hermeneutic approach to analyze data obtained from in-depth interviews with community leaders, academics, and legal practitioners. The findings indicate that customary law still plays a crucial role in dispute resolution and the maintenance of cultural identity in local communities. However, there are significant challenges related to harmonizing customary law with national law, especially regarding human rights protection and gender equality. This article also discusses efforts made by various stakeholders to sustain and develop customary law to be in line with contemporary developments, including formal recognition within the national legal system. In conclusion, customary law has great potential to contribute to the development of a more inclusive and diverse legal system, provided there is a commitment to addressing existing barrier.

Abstract

This article is the result of a literature and empirical study adapted to developments in employee disciplinary law. The purpose of this writing is simply to provide an overview of information about the disciplinary laws of government agencies in carrying out their duties and responsibilities to improve performance in services to the community. This research uses a literature review and empirical study approach. Discipline of Wanggarsari village officials to improve performance in accordance with Law Number 9 of 2015 as a result of amendments to Law Number 23 of 2014 concerning regional government and Law No. 30 of 2014 concerning Government Administration has not been implemented optimally, because work is not disciplined, not in accordance with the accuracy of completing tasks and so on, so that performance improvements have not been achieved according to expectations, both community expectations and the expectations of the law. The performance of Wanggarsari village officials will improve if Wanggarsari village officials in Wanggar District are aware of and practice work discipline continuously in accordance with applicable laws and regulations.
