Abstract

Providing information through advertisements offered by business actors has the potential to mislead consumers because it is not in accordance with the facts. Several cases have occurred and potentially violate Law No. 8 of 1999 on Consumer Protection (UUPK) as well as violations in the Criminal aspect. The case presented in this research is Ludmilla Arief vs PT Nissan Motor Indonesia (PT NMI). The advertisement containing misleading information published by PT NMI encouraged Ludmilla to buy a Nissan March car. The advertisement conveyed that the Nissan March had the advantage of being fuel-efficient, but in reality, this was not the case. Ludmilla filed a lawsuit against PT NMI at the Jakarta Consumer Dispute Settlement Board (BPSK) for disseminating misleading advertisements. BPSK granted the lawsuit, but PT NMI objected and the case reached the Supreme Court. The research questions are: how is consumer protection under Law No. 8 of 1999 on Consumer Protection?; and what are the criminal sanctions based on Law No. 8 of 1999 on Consumer Protection? This research uses a normative juridical approach, which focuses on examining the application of the principles or norms in positive law. The research findings show that this case involved a promise that the Nissan March car promoted as fuel-efficient at 18.5 km/liter, which encouraged consumer Ludmilla Arief to buy the car. However, this promise was not in line with the actual situation. Viewed from the characteristics of misrepresentation conducted by the business actor, this action qualifies as misrepresentation done deliberately to mislead consumers (fraudulent misrepresentation).

Abstract

Social security for workers is very important, and can aim to create welfare for workers and their families. An effective social security system can not only provide protection against risks, such as the risk of work accidents, illness or other things. There are laws that have been in effect, which discuss this. Implementation of a good social security system can increase the productivity of the workforce. Not only that, it can also aim to reduce social inequality and create very harmonious industrial relations between the two parties. Of course, in that case, it is not free from challenges, the main challenge is the implementation of this system, namely the awareness of informal workers about the importance of protection from this guarantee. Not only that, compliance in employers can also register their employees in this program. Therefore, synergy between the government and related institutions is needed.

Abstract

This research discusses the principle of prudence in Islamic banking and the level of health implemented. This research uses normative legal research by examining the research approach used is conceptual approach. This prudential principle must be carried out by banks, not only because it is associated with obligations so that banks do not harm the interests of customers This evaluation aims to enable the public to assess the performance of an Islamic bank. A bank that is considered healthy is a bank that can run its operations smoothly, fulfill its financial obligations, ensure the security of funds placed by the public, and has the ability to develop the resources that have been entrusted by the owner to its management.

Abstract

Spaylater is a payment method that provides loans to its users. When carrying out transactions on Shopee e-commerce, legal protection is very necessary when there is a problem with late payments by users, viewed from the perspective of consumer protection law and civil law. The focus of this research is: 1) What is the Shopee application spaylater agreement system according to consumer protection law and civil law. 2) What is the impact of delays in Sypalater payments for Shopee users and Spaylater owners according to consumer protection law and civil law? 3) What is the legal protection against delays in spaylater payments for Shopee users according to consumer protection law and civil law. This research uses a sociological approach to law and legislation, with an empirical research type. The research results and conclusions are: 1) the Spaylater agreement system has aspects that require more attention from the perspective of consumer protection law and civil law. Although in general this agreement is valid according to civil law, there are still several inconsistencies with the principles regulated in the UUPK. 2) SPayLater payment delays can have a bad impact on Spaylater users. For loan service providers, late payments can be considered a breach of contract on the loan agreement. However, the application of sanctions or fines must still take into account the principles of consumer protection and must not burden consumers unreasonably. A balance is needed between protecting consumer rights and the interests of loan service providers in the context of late SPayLater payments. 3) Legal protection for Spaylater users who experience delays in payment must pay attention to the provisions in the Consumer Protection Law and Civil Law. In the UUPK, SPayLater service providers are required to provide clear and transparent information, and treat users fairly without discrimination. Meanwhile, in Civil Law, although late payment can be considered a breach of contract, the imposition of sanctions must still take into account the principles of propriety and good fait

Abstract

Auction is a mechanism for the open sale of goods with the highest price bidding system regulated in various regulations, including the Minister of Finance Regulation Number 122 of 2023 which updates auction governance in Indonesia. One important aspect of this regulation is the role of Class II Auction Officers, who are generally held by Notaries, in organizing voluntary non-execution auctions. This research uses a normative juridical method to analyze the role and authority of Class II Auction Officers in conducting auctions based on the latest regulations. The results show that Class II Auction Officers are responsible for leading the auction process, preparing minutes of the auction as an authentic deed, and ensuring legal certainty for the parties involved. In addition, the implementation of the electronic auction system presents new challenges related to technical aspects, legal validity, and transaction security. With these regulatory changes, the auction system in Indonesia is expected to become more efficient, transparent, and accountable in order to provide better legal protection for all stakeholders.

Abstract

Digital technology not only makes it easier to access information, but also creates new opportunities in various fields, such as economics, education and entertainment. However, on the other hand, this progress also opens up opportunities for illegal practices that utilize digital platforms, one of which is online gambling. This research aims to analyze criminal law regulations in Indonesia governing the prevention and eradication of online gambling and the politics of criminal law can be strengthened to increase the effectiveness of law enforcement against online gambling in Indonesia. This research is a type of normative research. The approach used is a statutory approach. and conceptual approaches. The research results show that criminal law regulations in Indonesia have provided a strong basis for cracking down on online gambling, but technological challenges make implementation difficult. Strengthening criminal law politics through regulatory reform, increasing apparatus capacity, and synergy between institutions is needed to effectively eradicate online gambling and maintain societal stability.

Abstract

This paper discusses the relationship between green constitution and ecocracy in the context of environmental management in Indonesia. In the modern era, the importance of maintaining a balance between economic development and environmental sustainability has become increasingly urgent. The issues raised include the need for a deep understanding of environmental legal norms adopted in the 1945 Constitution, as well as the challenges faced in its implementation across various sectors, particularly in the management of Nature Tourism Parks. The aim of this research is to explore the role of the green constitution in supporting sustainable development and environmental protection, as well as to analyze the impact of existing policies on ecosystems and communities. The method used is a normative legal approach with descriptive analysis, involving the collection of secondary data from various literature sources, laws, and related documents. The findings indicate that although the green constitution has provided a strong foundation for environmental protection, its implementation still faces challenges, such as a lack of legal awareness among the public and inconsistent enforcement of regulations. Additionally, challenges in managing Nature Tourism Parks are often caused by increasing pressures from tourism activities that can damage ecosystems. The conclusions drawn emphasize the importance of better regulatory integration and ongoing supervision of the management of Nature Tourism Parks. This is necessary to ensure ecosystem sustainability and environmental preservation, as well as to support active community participation in maintaining environmental integrity. This research highlights that collaboration between the government, society, and other stakeholders is crucial for effectively implementing the principles of ecocracy and the green constitution.

Abstract

The rapid growth of online marketplaces in Indonesia has brought significant economic opportunities but also posed new challenges in the realms of criminal law and criminology. This study aims to analyze online marketplace crimes from a criminological perspective and examine the development of Indonesia's criminal law to address these challenges. Utilizing a qualitative approach with a literature review method, this research explores various types of online marketplace crimes, including fraud, identity theft, intellectual property violations, and tax evasion. The study applies criminological theories such as Strain Theory, Rational Choice Theory, Routine Activity Theory, Social Control Theory, and Social Learning Theory to understand the motivations and behaviors of offenders in digital transactions. The findings indicate that the legal framework in Indonesia, including the Electronic Information and Transactions Law (UU ITE) and Consumer Protection Regulations, still contains gaps that allow cybercriminals to exploit marketplace platforms. Therefore, this study suggests strengthening legal harmonization, enhancing consumer protection, improving tax regulations, and implementing effective law enforcement strategies. By integrating criminological insights into legal reforms, Indonesia can create a safer and more just online marketplace environment, contributing to sustainable digital economic development.

Abstract

Modern legal thought is often dominated by the positivism school, which emphasizes legal certainty through written rules and formal procedures. However, this approach often overlooks the substantial aspect of justice, namely the sense of justice that lives within society. Fransiscus Budi Hardiman, in his work Melampaui Positivisme dan Modernitas (Beyond Positivism and Modernity), offers sharp criticism of formal justice that focuses solely on legality without considering morality and human values. This study aims to analyze Hardiman’s thoughts in the context of criticism against positivism and its impact on legal life in Indonesia. Using a philosophical approach and a qualitative-descriptive method, this study finds that Hardiman encourages a reinterpretation of law that is not only legal-formal but also humanistic and contextual. This perspective is relevant in addressing various legal cases in Indonesia, which often reveal a gap between legal decisions and the public's sense of justice. This study is expected to contribute to the development of a legal theory that is more responsive and adaptive to social dynamics.

Abstract

The norms contained in a rule reflect the morals of the rule or lead to the morals of the legislator. The problem of wages for workers/labourers has become a hot legal issue to be criticised and discussed, since the issuance of Government Regulation Number 51 of 2023 as part of the revision of Government Regulation Number 36 of 2021 concerning Wages. Minimum wage and living wage provisions are an important part of the labour aspect, which is an absolute right for workers/labourers. Article 36 of the regulation regulates wage exemptions for micro and small entrepreneurs, where micro and small entrepreneurs in Government Regulation No. 7 of 2021 are listed as having capital and output of up to billions. In ratio legis, it is impossible to say that micro and small businesses with capital and sales up to billions of rupiah. So that the legal research used is a normative method, which studies the norms in the rules discussed based on the statutory approach and conceptual approach as the basis for thinking in this article. Therefore, this research provides legal solutions related to the issues discussed concerning minimum wage eligibility without any exceptions.
