Abstract

The principle of Good Corporate Governance, is a guideline or reference for running a company in a structured and effective manner in order to create a company that can survive and be sustainable. The application of the principle of Good Corporate Governance in a company will certainly have an impact on the interests of the parties, one of which is the workers in the company. Therefore, to manage and run a company properly, it must be based on the principle of Good Corporate Governance as a guideline so that the company can be run optimally and not in conflict with laws and regulations so that workers' rights can be fulfilled. The purpose of this study is to determine the application of the principle of Good Corporate Governance in accordance with laws and regulations in Indonesia regarding the fulfillment of workers' rights. The research method used in this article is a normative legal approach by reviewing and analyzing laws and regulations and legal literature related to workers' rights and the principle of Good Corporate Governance. The influence of the application of the principle of Good Corporate Governance on the fulfillment of workers' rights is closely related. The application of the principle of Good Corporate Governance will have an impact on workers' rights being fulfilled so that workers' welfare can be guaranteed.

Abstract

The implementation of the principle of transparency in personal data protection is a crucial aspect in ensuring data subjects right to information relating to the processing of their data. Indonesia has enacted the Personal Data Protection Law (PDP Law) as a legal framework to protect citizens personal data. However, the implementation of the transparency principle in the PDP Law still faces various challenges, including the lack of notification data breach. This research aims to analyze the implementation of the principle of transparency in the event of personal data breach in Indonesia by taking the practice in Ireland as a benchmark for comparison. Ireland, as part of the European Union that adopted the General Data Protection Regulation (GDPR), has a higher level of a transparency and more rigorous enforcement mechanisms. In this research, the author uses a normative juridical method with a descriptive-analytical approach and collects data through literature study and semi-structured interviews. The results of this research show that although the PDP Law regulates the obligation regarding transparency in the event of a data breach, its implementation has proven to be ineffective due to the lack of awareness of data controllers and the absence of implementing regulations. This contrasts with Ireland, which has a better implementation as it is equipped with several supporting factors, including the existence of an independent authority. Therefore, it is necessary to strengthen regulations, establish independent supervisory institutions, and increase the awareness and compliance of data controllers to achieve a more optimum protection of personal data.

Abstract

Ransomware attacks are an increasingly complex and costly global threat. International reports show a 300% increase in the frequency of ransomware attacks in the last five years (for example, data from IBM Security or Kaspersky). This threat not only blocks data access through encryption, but also jeopardizes privacy. This research will also examine the criminal law aspects associated with ransomware attacks, including the possible prosecution of the perpetrators of the attacks and the legal liability for victimized organizations. The theoretical study in the research titled "Personal Data Protection in Ransomware Cases: What Does the Law Say?" covers the theory of legal protection of personal data. The research method uses normative legal research that examines applicable regulations, namely the Criminal Code, ITE Law, PDP Law. This research refers to the case of a ransomware attack that hit Bank Syariah Indonesia (BSI), where the Lock Bit hacker group managed to steal the personal data of more than 15 million customers. This attack resulted in significant operational disruption to the bank's services. Ransomware is categorized as an act of extortion in accordance with Article 368 of the Criminal Code and Article 27 paragraph (4) of the ITE Law. The ITE Law and the Criminal Code are not considered to specifically regulate ransomware, although the articles (such as extortion and hacking) can be used to ensnare the perpetrators Collaboration between the government, the private sector, and the cybersecurity community is needed to build an early detection system for ransomware threats.

Abstract

This study examines the government's accountability for the collapse of the National Data Center (Pusat Data Nasional, PDN) due to a cyber attack from an Administrative Law perspective. The increasing reliance on digital technology has made e-government systems more vulnerable to cyber threats, as evidenced by the PDN Surabaya incident in June 2024. The objective of this research is to analyze the government's responsibility in safeguarding personal data and ensuring the continuity of public services. This study explores key legal frameworks, including the Personal Data Protection Law, Presidential Regulations on the Electronic-Based Government System (Sistem Pemerintahan Berbasis Elektronik, SPBE), and other relevant regulations governing cybersecurity and administrative responsibility.The research employs a normative legal research method with a statutory approach, analyzing legal provisions and their application in addressing cyber incidents affecting government-operated databases. The findings reveal that the government can be held accountable through various administrative measures, including the imposition of administrative sanctions, mandatory public notifications, and legal proceedings in administrative courts. However, the study also identifies significant challenges in implementing these measures due to the absence of a dedicated supervisory agency responsible for overseeing the security and resilience of e-government infrastructure. The lack of clear mechanisms for enforcement further complicates accountability efforts.Therefore, this study highlights the urgency of strengthening cybersecurity governance, establishing an independent supervisory body, and enhancing legal frameworks to ensure better protection of personal data and the reliability of digital public services. By addressing these gaps, the government can improve public trust and minimize future cyber risks.

Abstract

This study aims to find out and analyze the forced withdrawal of bad vehicle loans by leasing parties who do not have a fiduciary certificate based on the decision of the Constitutional Court number 18/PUU-XVII/2019. This research is a normative legal research supported by a legislative approach and a conceptual approach that uses primary legal materials, secondary legal materials and tertiary legal materials collected using literature study methods and case studies after which they are analyzed qualitatively descriptively. The results of the study show that the application of sanctions against leasing companies that forcibly recall vehicles without having a fiduciary certificate is still not fully effective. Although there have been legal provisions that regulate such as Law number 42 of 1999 concerning Fiduciary Guarantees, Civil Code, Consumer Protection Law, and Constitutional Court Decision Number 18/PUU-XVII/2019, in practice there are still many leasing companies that continue to execute guarantees unilaterally without going through the correct legal procedures.

Abstract

Corruption is a serious problem that hampers the development process and creates social and economic instability in Indonesia. In an effort to tackle increasingly disturbing criminal acts of corruption, the Indonesian government has taken concrete steps by enacting various regulations, one of which is Law Number 1 of 2023 concerning Law Enforcement Against Corruption. This research aims to conduct an in-depth analysis of various factors that influence the effectiveness of law enforcement against corruption, especially in the context of implementing Law no. 1 of 2023. In order to achieve this goal, this research uses a qualitative approach with descriptive analysis methods, which aims to thoroughly understand the role and influence of this law on improving the quality of law enforcement against criminal acts of corruption. Several factors analyzed in this research include institutional aspects involved in law enforcement, the quality and competence of human resources, the law enforcement policies implemented, as well as various challenges and obstacles faced by law enforcement officials in implementing this law effectively. Through this analysis, it is hoped that this research can provide deeper insight into the effectiveness of the implementation of Law no. 1 of 2023 in overcoming corruption, as well as providing constructive recommendations to improve the law enforcement system in Indonesia to achieve more optimal results in eradicating corruption.

Abstract

This study aims to analyze the implementation of local government policies in the management of the Setu Babakan Betawi Cultural Village from the perspective of spatial planning law. The research method employed is empirical legal research with a descriptive nature and a qualitative approach, involving document studies and interviews. The results show that the policy implementation has been carried out through various regulations; however, it still faces challenges such as fragmented authority among agencies, lack of coordination, and limited resources. To optimize the management and preservation of the area, strategic efforts are needed, including strengthening regulations, preparing a Detailed Spatial Plan (RDTR), increasing resources and budget allocation, involving the local community, and utilizing technology. Through these measures, the Setu Babakan Betawi Cultural Village is expected to remain a sustainable center for cultural preservation amidst Jakarta’s urban development.

Abstract

This study investigates the increasing divorce rate in Indonesia, particularly among the poor, by identifying key factors and exploring the role of face-to-face legal socialization in addressing this issue. Using a descriptive qualitative approach, the research includes a case study of a female informant who experienced divorce. The findings indicate that divorce is not attributed to a single cause but results from a combination of factors, including incompatibility from the outset of the marriage, the husband's absence, economic instability, conflicts with extended family, and poor communication within the household. Furthermore, the study reveals that face-to-face legal socialization proves more effective in enhancing legal understanding and creating an open space for discussion, despite challenges such as limited access and community participation. The research emphasizes the need for a more empathetic and communicative approach in divorce prevention efforts, particularly at the grassroots level, to address the underlying issues contributing to divorce.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) are the backbone of the Indonesian economy, but in digital business practices, they often face legal challenges in business contracts, whether with suppliers, distributors, or marketplace platforms. This article examines aspects of legal protection for MSMEs in digital business contracts and identifies inequalities that occur in business relationships with large companies. This study uses a normative-juridical research method by analyzing business contract regulations in Indonesia as well as comparative studies with legal systems in other countries. This study concludes that MSMEs need more proactive regulations in ensuring fairness in digital business contracts so as not to experience exploitation from more dominant parties.

Abstract

Corruption is a structural problem that undermines government governance and weakens public trust. To address this issue, the use of information technology has emerged as a promising solution to enhance transparency and accountability in the public sector. This study aims to analyze the role of technology in preventing and detecting corruption through the implementation of digital systems such as e-government, e-budgeting, and e-procurement. Using a normative juridical and conceptual approach, this study shows that digitalization can reduce corruption opportunities and strengthen both internal oversight and public participation. However, the success of technology implementation depends greatly on the integrity of implementers, supportive regulations, and the readiness of digital infrastructure. This research emphasizes that the integration of technology with the principles of good governance is a strategic step toward building a clean, efficient, and responsive government.
