Abstract

Abstrak: Pembatasan Otoritas Kepala Negara dalam Menentukan Kebijakan Politik dalam Perspektif Fikih Siyasah Islam. Sasaran besar yang ingin dibidik dalam tulisan ini ialah bahwa Islam telah menjelaskan secara terang benderang hal-hal yang mesti dipatuhi oleh seorang pemimpin dalam menentukan suatu kebijakan politik. Hal tersebut dimaksudkan agar seorang pemimpin dalam setiap kebijakannya tidak dilakukan secara sewenang-wenang. Terlebih lagi jika kebijakan yang dimaksud diklaim sebagai keinginan Tuhan agar masyarakat menerima begitu saja seperti yang pernah terjadi di Erofa pada abad pertengahan di mana para pemimpin mengklaim dirinya sebagai wakil- wakil Tuhan yang mengakibatkan perseteruan yang berlangsung beberapa abad antara pemimpin dengan rakyatnya. Karena Islam memandang pemimpin sebagai manusia biasa dan tidak terlepas dari kekeliruan yang mesti diluruskan oleh masyarakatnya, maka tulisan ini akan menjelaskan hal-hal yang mesti dindahkan oleh para pemimpin agar masyarakatnya tidak merasa dirugikan.Kata Kunci: Otoritas Kepala Negara, Kebijakan Politik, Fikih Siyasah Islam.Abstract: Limiting the Authority of Heads of State in Determining Political Policy in terms of siyasah Islamic Jurisprudence. A major goal to be targeted in this paper is that Islam has been clearly explained, some points to be considered by a leader in taking a political policy. It is intended to be implicated in order that a leader in each of his policies is not rule   arbitrarily. Moreover, if all the policies are claimed as God’s desire to make society directly receive them as that was happened in medieval Europe, where all leaders claimed themselves as the representatives of God. That action caused a dispute between the leaders and their society that was happened in several centuries. As Islam has seen a leader as a human being who is not in spite of mistakes those should be rectified by society, this paper will clearly describe the things those should be heeded by the leaders so that the society will not feel disadvantaged.Keywords: Authority of Heads of State, Political Polic, Islamic Jurisprudence.DOI: 10.15408/ajis.v12i1.974

Abstract

This paper aims at examining the advancement of modern technology and its intersection with Islamic law. Some areas discussed are related to worship, family law, and medical treatment using organ transplantation. This study finds that some areas of Islamic law are statics, while others are dynamics. The modern technology has provided convenience for human beings such as the use of technology in pilgrimage; the determination of paternity; having baby through IVF, and the medical treatment for patients with heart failure. On the other hand, modern technology cannot change Islamic provisions on worship. Penelitian ini mencoba membahas kemajuan teknologi modern dan dampaknya terhadap hukum Islam, termasuk di bidang ibadah, hukum keluarga, dan perawatan medis seperti penggunakan transplantasi organ. Beberapa bidang hukum Islam bersifat statis sementara yang lain bersifat dinamis. Teknologi modern telah memberikan kemudahan bagi manusia seperti penggunaan teknologi dalam berhaji; penentuan ayah terhadap bayi melalui IVF, dan perawatan medis untuk pasien dengan gagal jantung. Di sisi lain, teknologi modern tidak dapat mengubah ketentuan Islam tentang ibadah.

Abstract

Assumption that the door of ijtihad was closed, despite ever becoming conspicuous in general, has never been universally accepted by all scholars. In the period after the fourth century BC /10 AD—during the opinion was evolving—history still noted the emergence of figures not only by showing their thought on ijtihad but also by showing their firm rejection to the view which said that the door of ijtihad was closed. By reviewing the position of ijtihad and its development in the history of Islamic jurisprudence (fiqh), this article proves that ijtihad is a must in the dynamics of the Islamic law. With the spirit of ijtihad, various reform ideas in Islamic jurisprudence in modern times have become possible and kept open for discourse, such as the approach between schools, collective ijtihad, ijtihad in the field of principles (ushûl) , and a review toward the qualification of mujtahid in modern times.DOI: 10.15408/ajis.v16i1.2896

Abstract

Reinterpretation of Women’s Economic Rights in Islam. Islam prescribes equal rights for men and women, including economic rights. However, patriarchal interpretations of Alquran and Suna texts have contributed to a gender gap in which Muslimah women face difficulties in accessing their economic rights. Patriarchal structures that prescribe role divisions in society marginalise women from economic participation and property ownership. Contemporary Muslimah women also face similar problems of gender gap in economy. Therefore progressive Muslims offer reinterpretation of texts regarding women’s rights, including economic rights, using women’s perspectives. Such reinterpretation is also complemented with strategies of women’s economic empowerment to assist them to access their economic rights, particularly their rights of economic participation and access to paid employment.DOI: 10.15408/ajis.v14i1.1245

Abstract

Indonesian Ulama Council (MUI) is an organization for Muslim scholars who provide guidance for the Muslim community in the form of fatwās on a particular situation on which the community can rely. In the ongoing situation relating to the COVID-19 pandemic since March 2020, MUI released a fatwā as to how to face the pandemic. This research is aimed to measure the level of people’s obedience to the fatwā. To obtain an accurate measurement, this research involves two others MUI's fatwās - a fatwā related to bank interest and a fatwā related to interfaith marriage – by way of making a comparison. This research uses mixed methods which combined the quantitative method using SPSS and the qualitative method. This research finds that the young unmarried Muslim, mostly under-25- year-old university students, have the highest level of obedience to the fatwā related to COVID-19. The fatwā related to interfaith marriage is the most obeyed fatwās, and fatwā related to COVID-19 is the least one among three fatwās in this research.    AbstrakMajelis Ulama Indonesia (MUI) merupakan wadah bagi para ‘ulamā’ yang memberikan pembinaan bagi umat Islam dalam bentuk fatwā tentang situasi tertentu yang dapat diandalkan oleh masyarakat. Terkait pandemi COVID-19 sejak Maret 2020, MUI mengeluarkan fatwā tentang cara menghadapi pandemi tersebut. Penelitian ini bertujuan untuk mengukur tingkat kepatuhan masyarakat terhadap fatwā. Untuk mendapatkan pengukuran yang akurat, penelitian ini juga melibatkan dua fatwā MUI lainnya - fatwā terkait bunga bank dan fatwā terkait perkawinan beda agama - dengan cara membuat perbandingan. Penelitian ini menggunakan metode campuran yang memadukan metode kuantitatif dengan SPSS dan metode kualitatif. Penelitian tersebut menemukan bahwa pemuda Muslim yang belum menikah, kebanyakan berusia di bawah 25 tahun, memiliki tingkat kepatuhan tertinggi terhadap fatwā terkait COVID-19. Fatwā terkait perkawinan beda agama merupakan fatwā yang paling banyak ditaati, dan fatwā terkait COVID-19 merupakan yang paling sedikit di antara tiga fatwā dalam penelitian ini.

Abstract

The Concept of Halal Food in Sharia Perspective and Product Responsibility of Halal Industry. Sharia provisions regarding halal and haram food, beverages, and goods are integral parts of Islamic teachings. Halal and haram foods also have become a necessity related to the comfort and safety of the Muslims as the largest consumers in Indonesia. This need should be enforced by halal industry. Every manufacturer of halal foods should have an understanding and awareness to ensure their halal products by implementing a Halal Assurance System as the implementation of sharia concept of halal and haram on food and drinks. Abstract

Abstract: Measuring the Justice of Islamic Inheritance Law by Drawing upon the Text and Context of al-Nushûsh. Accusations against the Islamic inheritance distribution system are surfacing again. Several groups are finding fault with the 2:1 distribution for Islamic inheritors. They suggest this distribution method be converted into 1:1, like it is in the Western system of inheritance and like it is to some extent in Adat inheritance law. This study points out that theoretically Islamic inheritance law looks very clear, comprehensive and fair, from whatever angle you look at it. This takes into account, in a balanced way, the distributions that use the 2:1 approach for joint male and female heirs. The key to understanding this is inheritance has to be treated entirely as a sub-system of the family law system, and even has to be understood as an integral part of the whole Islamic legal system, which is sound and comprehensive.Keywords: justice, inheritance law, textual, al-nushûshAbstrak: Menakar Keadilan Hukum Waris Islam Melalui Pendekatan Teks dan Konteks al-Nushûsh. Gugatan mengenai sistem pembagian kewarisan Islam kembali muncul ke permukaan. Beberapa kalangan mempermasalahkan perimbangan waris Islam 2:1. Mereka menawarkan metode perimbangan ini menjadi 1:1, sebagaimana pada sistem hukum kewarisan Barat dan sebagian hukum kewarisan Adat.  Studi ini menunjukkan bahwa dari sisi mana pun hukum kewarisan Islam secara teoretik tampak sangat jelas, lengkap, dan adil. Termasuk dalam konteks perimbangan pembagiannya yang menggunakan pendekatan 2:1 untuk ahli waris laki-laki dan ahli waris perempuan. Kunci untuk memahaminya harus menempatkan posisi kewarisan sebagai sub sistem dari sistem hukum keluarga secara keseluruhan bahkan harus dipahami sebagai bagian integral dari keseluruhan sistem hukum Islam yang bersifat utuh dan menyeluruh.Kata Kunci: keadilan, hukum kewarisan, tekstual, al-nushûshDOI: 10.15408/ajis.v12i1.965

Abstract

Tis study fnds that the Indonesian Marriage Law, especially inthe section about the age of marriage, still contains the ambiguity in termsof the language. Tis leads to the gaps in the law that can potentially lead tothe violation of the law. It is stated in the Compilation of Islamic Law thatthe couple who have not reached the age of twenty should obtain a consentfrom both parents to marry. Based on this stipulation, every couple, whoare underage, can marry as long as they obtain their parent’s consent. Tispractice is not considered a violation of the law; the involving parties cannotbe penalized. Te article argues that there is a need to review the law to preventthe practice of underage marriage

Abstract

Abstract: Fiqh for Minorities: a Theoretical Study. Fiqh for Minorities—which in Arabic is called Fiqh al-Aqaliyyât— is a fiqh model that maintains legal association of sharia and the dimensions of a particular community, namely minority Muslim communities in western countries. Fiqh for Minorities is a product of reinterpretation of the existing arguments on the basis of the benefit whichis the spirit of sharia. The designers of this fiqh are Taha Jabir al-’Alwani in his book, Toward a Fiqh for Minorities: Some Basic Reflection, and Yûsuf al-Qarâdawî in his book, Fî Fiqh al-Aqalliyât al- Muslimah. Fiqh for Minorities originated from the accumulation of the concerns of Muslim minority communities in western countries when it should be doing something related to their religion. This fiqh is designed to provide guidance and a handle on the things that are prohibited and permissible for Muslim minorities living in western countries to carry out their obligations as a Muslim.Keywords: fiqh, minority, shariaAbstrak: Fikih Minoritas: Suatu Kajian Teoretis. Fikih minoritas—yang dalam bahasa Arab disebut dengan Fiqh al- Aqalliyât—merupakan model fikih yang memelihara keterkaitan hukum shar‘î dengan dimensi-dimensi suatu komunitas tertentu, yaitu masyarakat minoritas Muslim di Barat. Fikih minoritas adalah sebuah produk hasil reinterpretasi atas dalil-dalil atas dasar kemaslahatan yang memang menjadi spirit syariah. Penggagas fikih ini adalah Tâhâ Jâbir al- ‘Alwânî dalam bukunya, Toward a Fiqh for Minorities: Some Basic Reflection dan Yûsuf al-Qarâdawî dalam bukunya, Fî Fiqh al-Aqalliyât al-Muslimah. Fikh minoritas lahir berawal dari akumulasi kegelisahan masyarakat minoritas Muslim di Barat ketika harus melakukan sesuatu yang berkaitan dengan keagamaan mereka. Fikih ini didesain untuk memberikan panduan dan pegangan tentang hal-hal yang dilarang dan yang boleh bagi minoritas Muslim yang tinggal di Barat untuk menjalankan kewajiban-kewajiban mereka sebagai seorang Muslim.Kata Kunci: fikih, minoritas, syariahDOI: 10.15408/ajis.v13i2.932
