Abstract

This research aims to analyze defense cooperation between Indonesia and Germany in weapons procurement. This research involves an analysis of the history of defense cooperation between the two countries, the types of weapons that have been purchased, and the political and military implications of this cooperation. The research method used is the historical study method, namely by reviewing the topic through historical evidence, both written and unwritten, as a reference source. The research results show that defense cooperation between Indonesia and Germany has a significant impact on Indonesia's defense capabilities, but also has political and diplomatic consequences that need to be considered. It is hoped that this research will provide better insight into the dynamics of international defense cooperation and bilateral relations between Indonesia and Germany.

Abstract

Trademarks have a very important function, namely as a differentiator from goods or services from other trademarks as well as a reputation for the goods or services being traded. Trademarks must be protected to prevent infringement in the form of unfair competition. The aim of this research is to understand the implementation of regulations and criteria regarding violations of brand similarity in essence as well as the use of marks that are not in accordance with those registered under brand law in Indonesia. The research method used in this research is a normative juridical approach, namely by using library materials in the form of positive law as the main material and then examining its implementation into practice. The primary legal material used by the author is Law Number 20 of 2016 concerning Marks and Geographical Indications, Law Number 15 of 2001 concerning Marks, Commercial Court Decision at the Surabaya District Court Number 2/Pdt.Sus-HKI/Merek/2022/ PN.Niaga.Sby, and Supreme Court Decision Number 161 K/Pdt.Sus-HKI/2023 as well as secondary legal materials, namely related literature, to analyze the decision.

Abstract

In current conditions, foreign nationals in Indonesia are not becoming fewer and fewer, but are actually increasing in number. There are several reasons why there are so many foreigners in Indonesia, one of which is the global flow and modernization factor, and another reason is to Increase multilateral cooperative relations with other countries, so it is felt necessary to provide easy access for foreigners to visit or live in Indonesia. However, foreigners are not allowed to control land with ownership rights, where if foreigners obtain ownership rights then the land is controlled by the state. The research method used in this research is a qualitative descriptive method with a normative juridical approach which analyzes legal norms from the perspective of literature study. Data was obtained through literature study, interviews and documentation. The research was carried out to find out how land rights are controlled by foreign citizens according to the UUPA and how the use rights and the end of legal relations for residential homes for foreign citizens are carried out. Land ownership for foreign citizens in Indonesia is generally limited and regulated by Law Number 5 of 1960. They can obtain use rights to land, but ownership rights are limited to certain forms of foreign investment. This is intended to protect national interests and prevent foreign investment or accumulation of land by foreign parties.

Abstract

This research aims to examine (1) the reality of criminal acts of narcotics abuse in Indonesia, (2) what government policies are in controlling narcotics abuse against teenagers. This research uses qualitative research with bibliometric analysis methods, Google Scholar Publish or Perish (PoP) and VOS Viewer. Bibliometric analysis is a form of model that is carried out by exploiting research data that has been published online regarding the number of publications and authors of scientific publications. Publish or Perish (PoP) is a saying that describes the pressure to publish academic work in order to succeed in an academic career. Google Scholar, or commonly called Google Scholar, is a service provided by the technology giant Google which allows researchers around the world to search for learning materials in the form of text in various publication formats. The research results in this article examine the reality of drug crimes in the youth environment and analyze the policies that have been carried out by the government in an effort to handle these cases.

Abstract

This research aims to find out how legal certainty is in customary land and the UUPA which regulates customary land. The importance of legal certainty is also closely related to the concept of sustainable development. By providing legal clarity regarding customary land, the government can create a conducive environment for sustainable investment, while still paying attention to the welfare and rights of indigenous communities. This legal certainty also involves a fair and transparent resolution mechanism, so that land-related conflicts can be resolved without harming either party. Customary land is land that is regulated and managed based on the customary law of a customary law community. Customary land is usually owned and used communally by members of the indigenous community. The strong ties between traditional lands and traditional communities have been formed for hundreds of years and have been passed down from generation to generation. Traditional land has multifunctions, not just land for farming, but also being an integral part of the culture and identity of indigenous peoples. Land for them has very important social, economic, political and even religious values. Therefore, the relationship between indigenous peoples and land is magical-religious and institutionalized in everyday life. In Indonesia, customary land is still quite extensive, although it is not yet known exactly how much. The research methodology used in this research is descriptive qualitative. Three stages of research were carried out: (1) observation; (2) interview; and (3) documentation. The results of this research show how legal certainty is regarding traditional land in the Toba area through the sources interviewed

Abstract

The Republic of Indonesia is a legal state where power is subject to law. The consequence of the rule of law is that law has the highest position in government. "Ubi Societas Ibi Ius", When there is society there is law. The aim of establishing a state is to create social welfare which the government as state administrator formulates in responsive, aspirational and progressive legislation in accordance with the interests of society. The role of law in realizing social welfare must be visible in the material of the law and the moral integrity of law enforcement officers (law actors), especially judges, when adjudicating cases.

Abstract

Corruption has now become a cultural behavior, even a matter of debate and is always a hot topic, especially in Indonesia. In fact, corrupt practices are also rooted among students in various fields. Students can be said to be the seeds of corruption, if their behavior does not reflect anti-corruption behavior. This will affect the psychological condition of future generations of militants. Lack of supervision from both parents and educational institutions (campuses) is one of the factors causing corruption. The method for implementing anti-corruption education, which is based on the principle of building an anti-corruption culture, is a collaborative process, the implementation of which must involve students as agents of change. Anti-corruption education is considered to be one of the strategies for eradicating corruption because it can create an anti-corruption cultural ecosystem and strengthen the character of the younger generation. The aim of this community service activity is to increase the awareness and responsibility of students as the younger generation to behave anti-corruption and students are expected not to engage in corrupt practices even if the opportunity arises.

Abstract

Nowadays, student internship programs are increasingly being held by start-up companies. However, in practice there are still many students participating in internships who have not received their rights as agreed in the internship agreement. Apart from that, there is no clear regulation regarding student internship programs in labor regulations in Indonesia, especially in Law of the Republic of Indonesia no. 6 of 2003 concerning Employment and Regulation of the Minister of Manpower of the Republic of Indonesia Number 6 of 2020 concerning the Implementation of Domestic Apprenticeships. This research aims to analyze the legal relationship between student interns and start-up companies and to find appropriate legal protection for student interns to defend their rights. This research was written using a normative juridical approach. The research results show that there is no employment law relationship between student interns and start-up companies. The legal relationship that occurs is a legal relationship that arises because of an internship agreement which is civil in nature and is subject to the Civil Code agreement law. Intern students whose rights are not fulfilled can seek repressive legal protection to defend their rights through non-litigation dispute resolution through negotiation. If non-litigation efforts are not achieved, litigation efforts can be pursued by filing a lawsuit, with the basis of the lawsuit being default and prioritizing mediation efforts in court first.

Abstract

Cases of crimes involving children as perpetrators of crimes bring their own phenomena. Considering that children are individuals who are still emotionally unstable have become legal subjects, the handling of crime cases with child perpetrators needs special attention, starting from the Criminal Procedure Law applicable to children. The Code of Criminal Procedure of the child regulates in particular the obligations and rights acquired by the child. The handling of children as perpetrators of criminal acts from year to year has always drawn criticism from academics, practitioners and the public. This is more due to the culture that is maintained from generation to generation in the mindset of law enforcement in dealing with criminal offenders. Regarding the systematics or legal order that in fact discusses about children, the existence of child criminal law if a child is committing a criminal act while he is still relatively underage or not legally competent. Children commit immoral acts that are currently happening in Gorontalo. This case really happened and the way the punishment turned out to be very different from adults in general. Abstract

Indonesia, as a country with the philosophical foundation of Pancasila, embraces the Pancasila Economic System that prioritizes social values, justice, and people's welfare. In its development, the Indonesian economy has undergone significant transformation, especially with the adoption of digital technology. One of the recent phenomena that characterizes this change is the emergence of online business models, including Affiliate TikTok Shop. As the foundation of the state, Pancasila affirms the human rights of citizens, especially the freedom to pursue economic prosperity and progress. It is hoped that in this situation, the Pancasila Economic System will serve as the foundation for implementing economic changes that advance the welfare of all citizens. Therefore, a thorough examination of the implementation of the Pancasila Economic System is needed to protect the rights of citizens through Affiliate TikTok Shop. The TikTok Shop Affiliate business model, which combines a digital business component with affiliate network marketing, has developed into an important component in the ecosystem that supports the digital economy. An important topic is how the Pancasila Economic System responds and adapts to these processes. Measuring how well the ideals of Pancasila and the rights of the people are upheld in the era of digital economic change will become easier with an understanding of the functioning of the Pancasila Economic System in TikTok Shop Affiliation. In an effort to explore the possibility of economic rejuvenation, this research becomes relevant when analyzing the interactions between the Pancasila Economic System, the Indonesian Rule of Law, and the TikTok Shop Affiliation. By gaining a deeper understanding of these interactions, strategies that facilitate the establishment of a just and inclusive digital economy in Indonesia can be developed.
