Abstract

When two people, a woman, a man, have different beliefs, marry while practicing their respective religions, it is known as an interfaith marriage. However, interfaith unity raises unique problems, especially those related to children's rights. Marriage results in the birth of a child. In essence, sons or daughters who have offspring from a marriage bond must receive protection from laws in the social and state environment. This journal uses empirical or sociological research methods to find out how society and the law respond to interfaith marriages and the religious choices made by their descendants. Primary and secondary data regarding child safety and religious freedom—namely, that parents have no right to force their children to convert to their religion—were collected from legal materials found in books, journals, and online sources. That parents who have different beliefs are prohibited from forcing their children to practice their religion, especially if there are differences of opinion that have a negative impact on the children themselves. So, as parents, we must care for and advise with high dedication to our sons and daughters about religion and set a good example for them, and the state must defend the rights of children regardless of the child's legitimacy, religious beliefs, physical and mental health, or position. in a social environment.

Abstract

With the coming of the internet, a new approach has been ushered in which would restate and redefine the concept of sovereignty in states through algorithmic regulation and the mighty transnational digital networks it makes possible. The social media are essentially the decentralized spacesfor legal and political controversy, which tear down the constitutional validity and transform the construction of legitimacy. This study examines how the principle of sovereignty is transformed within a digital legal state by analyzing the interaction between constitutional norms, digital participation, and the growing role of non-state digital actors. A qualitative thematic approach was applied, using data from constitutional documents, court rulings, social media narratives (such as #ReformasiDikorupsi), and semi-structured interviews with legal experts and digital rights advocates. NVivo software program was used to apply thematic coding and categorization. Outcomes are four significant themes: disruption of constitutional sovereignty, digital mediation of sovereignry, coexistence between digital corporations and states, and reinterpretation of constitutional values. Implications are that sovereignty is no longer mapped or geographically located but dynamically negotiated in digital spaces. According to the research, conventional legal models are inadequate and prescribing co-regulatory legal models based on constitutional values is recommended. Citing Indonesia's PDP Law and the EU's Digital Services Act, it emphasizes ASEAN-level collaboration in pushing toward inclusive and accountable digital governance and protecting sovereignty in the post-national setting.

Abstract

This study explores the revitalization of customary law as a mechanism for resolving environmental disputes in Eastern Indonesia. Through a comparative analysis of three indigenous regions—Central Maluku, Papua, and West Timor—the research reveals how traditional legal practices adapt to contemporary ecological and socio-political challenges. The findings demonstrate that customary law is not merely preserved but is actively transformed to maintain cultural relevance and environmental sustainability. Revitalization efforts are shaped by local contexts, external pressures, and the interaction between indigenous communities and state institutions. This study fills a critical gap in the existing literature, which often focuses solely on the formal recognition of customary law without addressing its dynamic role in conflict resolution. Although the research offers significant insights, it acknowledges limitations related to geographical scope and methodology, suggesting that future studies should adopt longitudinal approaches and broader regional coverage. The results contribute to the discourse on legal pluralism and offer practical implications for policy-making aimed at strengthening indigenous participation in environmental governance.

Abstract

The increasing integration of digital evidence into civil litigation processes in Indonesia reflects a significant shift towards modernization of the judicial system. This study examines the effectiveness of digital evidence in civil case proceedings by analyzing court decisions, conducting expert interviews, and reviewing applicable regulations. The findings reveal that while digital evidence is increasingly accepted, challenges remain regarding authentication, technical capacity of legal practitioners, and the absence of standardized procedures. Regulatory advancements such as the enactment of Law Number 11 of 2008 on Electronic Information and Transactions (ITE Law) and Supreme Court Regulation Number 1 of 2019 have bolstered the legal recognition of digital evidence. However, inconsistent application and limited forensic capabilities hinder optimal utilization. This research contributes to the discourse by emphasizing the need for capacity building, procedural standardization, and a more robust technological infrastructure within the judicial framework. Future studies are encouraged to adopt broader and comparative approaches to strengthen digital evidence practices in civil litigation.

Abstract

The rapid evolution of cyberspace has transformed it into a strategic domain of international relations, raising complex legal challenges regarding state responsibility in preventing cross-border cyber attacks. This study explores the implementation of the due diligence principle in international law as a normative foundation for evaluating a state’s obligation to prevent harmful cyber activities originating from its territory. Utilizing a normative-legal approach, the research analyzes global legal instruments, state practices, and Indonesia’s position in relation to due diligence. Findings reveal a significant gap between the doctrinal recognition of due diligence and its operational application, especially in developing countries lacking institutional and regulatory capacity. The study proposes practical recommendations for integrating due diligence into national cybersecurity strategies while contributing to the broader development of binding international cyber norms. By focusing on Indonesia, the research aims to strengthen both national legal preparedness and its international legal standing in cyberspace governance.

Abstract

The massive scale of environmental destruction globally highlights the urgent need for a stronger legal response, particularly through criminal law. This research aims to formulate the crime of ecocide within Indonesia's national criminal law framework by adapting international principles while aligning with the fundamental doctrines of Indonesian law. Employing a normative legal research method and comparative analysis, this study reveals a significant legal gap in the current regulatory system, which inadequately addresses large-scale ecosystem damage. A conceptual model for the formulation of ecocide crimes is proposed, including the definition of criminal elements, the scope of liable subjects, and the appropriate sanctions. The results contribute to the academic discourse by offering a structured and applicable legal framework, while practically providing policymakers with a concrete foundation for legal reforms that respond effectively to the global environmental crisis.

Abstract

This study analyze the application of the concepts of breach of contract (wanprestasi) and unlawful act/ tort (perbuatan melawan hukum) in decision No. 79/Pdt.G/2023/PN. Yyk, with critical focus on the panel of judges formalistic approach. The research employs a normative method through a case study approach. The results indicate that although the plaintiff’s lawsuit was declared inadmissible due to formal defect (obscuur libal and plurium litis consortium), the cout proceedings actual revealed strong indications of an unlawful act by the defendant, namely the installation of “for sale/ rent” banner on a property that was still under lease. Theoretically, this action fulfills the elements of acticle 1365 of the indonesian civil code. The study concludes that the judge was incorrect in ther role as a seeker of substantive justice by fixaing on procedural rigiditly and neglecthing the principle of ius curia novit. Therefore, this research recommends the necessity of balancing formal legal certainty with the achievement of material justice in civil court practices.

Abstract

With advances in blockchain technology, smart contracts have emerged as automated digital instruments for cross-border transactions. Yet, their automation and rigidity do create serious hindrances to civil law's fundamental principles, especially in terms of enforceability and dispute resolution. This research seeks to study discrepancies between the characteristics of smart contracts themselves and international civil law systems, and to unveil the legal obstacles on their path to implementation. By employing a normative juridical approach and comparative analysis from 50 legal and academic documents sourced from Indonesia, the United States, and the European Union, this research reveals regulatory divergences and the absence of a harmonized international standard. Results show that the European Union is far ahead of the United States and Indonesia in regulatory preparedness. Essentially, this research proposes a hybrid legal system, which is a combination of national and international provisions (for example, the UNCITRAL Model Law) for the establishment of blockchain-based digital dispute resolution. The outcome enlarges the horizon of digital contract law theory and serves as a handy guide for policymakers in managing legal complexities of smart contracts across jurisdictions.

Abstract

Penelitian ini menganalisis implementasi doktrin piercing the corporate veil pada perseroan terbatas dalam sistem hukum Indonesia dan Malaysia sebagai upaya perlindungan hukum terhadap kreditor dan pihak ketiga yang dirugikan. Doktrin ini memungkinkan pengadilan untuk menembus tabir perusahaan dan membebankan tanggung jawab pribadi kepada pemegang saham atau direksi ketika terjadi penyalahgunaan badan hukum perseroan. Meskipun kedua negara memiliki latar belakang hukum yang berbeda, Indonesia dengan sistem hukum civil law dan Malaysia dengan sistem common law, keduanya menghadapi tantangan serupa dalam penerapan doktrin ini. Penelitian ini mengkaji landasan hukum, kriteria penerapan, dan praktik peradilan di kedua negara melalui analisis peraturan perundang-undangan dan putusan pengadilan yang relevan. Temuan menunjukkan bahwa penerapan doktrin piercing the corporate veil di Indonesia masih terbatas dan belum memiliki regulasi yang eksplisit, sedangkan Malaysia memiliki preseden yudisial yang lebih mapan melalui pengaruh sistem common law. Terdapat perbedaan signifikan dalam hal ketegasan pengadilan, parameter penyalahgunaan badan hukum, dan mekanisme pembuktian antara kedua yurisdiksi. Oleh karena itu, penelitian ini menyimpulkan bahwa Indonesia perlu memperkuat kerangka hukum dan mengembangkan yurisprudensi yang konsisten untuk memberikan kepastian hukum dan keadilan yang lebih efektif dalam penerapan doktrin piercing the corporate veil.

Abstract

Economic globalization has created legal complexities in cross-border bankruptcy disputes, particularly when involving foreign nationals who inherit debts. This study analyzes the application of the lex loci and lex fori principles in bankruptcy cases related to the inheritance of debts by foreign nationals in Indonesia, using the case study of PT. Krama Yudha. The research employs a normative-juridical approach with descriptive-analytical analysis of the Central Jakarta District Court Decision No. 226/Pdt.Sus-PKPU/2023 and the Supreme Court Decision No. 1103 K/PdtSus-Pailit/2024. The findings reveal inconsistencies in the application of private international law principles concerning the jurisdiction and liability of foreign heirs for the deceased’s debts. The lex loci principle provides protection for domestic creditors by subjecting assets located in Indonesia to national law, while lex fori emphasizes the application of Indonesian procedural law. However, the conflict between these principles creates legal uncertainty and disparities in protection for both creditors and heirs. This study recommends the harmonization of cross-border inheritance and bankruptcy laws, the adoption of the UNCITRAL Model Law on Cross-Border Insolvency, and the inclusion of clearer lex successionis provisions in the revision of the Bankruptcy Law to ensure justice and legal certainty.
