Abstract

Cases of crimes involving children as perpetrators of crimes bring their own phenomena. Considering that children are individuals who are still emotionally unstable have become legal subjects, the handling of crime cases with child perpetrators needs special attention, starting from the Criminal Procedure Law applicable to children. The Code of Criminal Procedure of the child regulates in particular the obligations and rights acquired by the child. The handling of children as perpetrators of criminal acts from year to year has always drawn criticism from academics, practitioners and the public. This is more due to the culture that is maintained from generation to generation in the mindset of law enforcement in dealing with criminal offenders. Regarding the systematics or legal order that in fact discusses about children, the existence of child criminal law if a child is committing a criminal act while he is still relatively underage or not legally competent. Children commit immoral acts that are currently happening in Gorontalo. This case really happened and the way the punishment turned out to be very different from adults in general. Abstract

Indonesia, as a country with the philosophical foundation of Pancasila, embraces the Pancasila Economic System that prioritizes social values, justice, and people's welfare. In its development, the Indonesian economy has undergone significant transformation, especially with the adoption of digital technology. One of the recent phenomena that characterizes this change is the emergence of online business models, including Affiliate TikTok Shop. As the foundation of the state, Pancasila affirms the human rights of citizens, especially the freedom to pursue economic prosperity and progress. It is hoped that in this situation, the Pancasila Economic System will serve as the foundation for implementing economic changes that advance the welfare of all citizens. Therefore, a thorough examination of the implementation of the Pancasila Economic System is needed to protect the rights of citizens through Affiliate TikTok Shop. The TikTok Shop Affiliate business model, which combines a digital business component with affiliate network marketing, has developed into an important component in the ecosystem that supports the digital economy. An important topic is how the Pancasila Economic System responds and adapts to these processes. Measuring how well the ideals of Pancasila and the rights of the people are upheld in the era of digital economic change will become easier with an understanding of the functioning of the Pancasila Economic System in TikTok Shop Affiliation. In an effort to explore the possibility of economic rejuvenation, this research becomes relevant when analyzing the interactions between the Pancasila Economic System, the Indonesian Rule of Law, and the TikTok Shop Affiliation. By gaining a deeper understanding of these interactions, strategies that facilitate the establishment of a just and inclusive digital economy in Indonesia can be developed.

Abstract

This research discusses the application of Kerinci customary criminal law to criminal acts of abuse and its comparison with national criminal law in Indonesia. There is a conflict between Article 351 paragraph (3) of the Criminal Code and the practice of resolving customary abuse in Kerinci Regency. The research method used is normative legal research with a conceptual and analytical approach. The research results show differences in the application of customary and national crimes, with an emphasis on the principle of deliberation in Kerinci customary law. The application of Kerinci's customary crime involves three levels of sanctions, adjusted to the level of the violation, with a Restorative Justice approach. Differences arise in the resolution of minor criminal cases, where customary law involves traditional judges, ninik mamak, and traditional leaders. Harmonization between customary law and national law is crucial to achieving holistic justice.

Abstract

The research explores the resolution of customary criminal disputes in the context of the Baduy tribe, an ethnic group in Banten Province, Indonesia, with a focus on harmonization between local customary law and national criminal law. Through normative juridical methodology and analytical descriptive analysis, this study explores the mechanisms for resolving customary criminal disputes and their relationship with national criminal law. The results reveal the challenges in achieving harmony between traditional values and modern criminal law principles, as well as the implications for legal justice and human rights. The statutory approach and case approach help to comprehensively describe these dynamics, provide in-depth insight into the interaction between Baduy tribal customary law and Indonesian national criminal law and highlight the need for improved policies that are more inclusive and just.

Abstract

This research aims to determine the implementation of restorative justice in narcotics crimes at the Gorontalo City Resort Police, based on the title raised in this research. This research uses empirical legal research, because this research is based on the reciprocal relationship between law and other institutions. It is said to be empirical because it is based on real data or facts. This research aims to look for primary data or what can also be called field data on the implementation of restorative justice in drug crimes. The results of this research show that the implementation of restorative justice in drug crimes is not solely for all drug users, but there are several provisions in accordance with Perpol number 8 of 2001. The provisions so that restorative justice can be carried out include: the person is not involved in a drug network, drugs that are there is only personal use, not resale, not a resinipis, namely a second arrest, and the evidence does not exceed the amount and so on. So apart from these provisions, RJ cannot be carried out. In accordance with prosecutor's guidelines number 18 of 2021 concerning the resolution of handling criminal cases for victims of narcotics abuse, it is carried out through rehabilitation with a restorative justice approach. Apart from that, the obstacles in implementing restorative justice, according to information, are several factors, namely internally, namely obstacles in the BNN reporting or assessment process due to inappropriate time, namely exceeding the 3x24 hour time frame, and external factors, namely the lack of cooperation with the community, which causes delays in reporting. and when the arrest was made, the perpetrators did not admit that the items belonged to them, so 2 witnesses were needed in the form of the local RT head so that the process could continue.

Abstract

As stated in Article 27 paragraph 2 of Law Number 19 of 2016 on Electronic Information and Transactions, Indonesia has created a legal framework for online gambling. According to this legislation, it is illegal for anybody to knowingly and without permission distribute, transmit, or make electronically stored information or documents accessible that include gambling material. That being said, it is nevertheless true that Indonesia has certain online gambling sites; Sbobet is one such instance. The author highlights the difficulties in implementing laws intended to eradicate internet gambling in Indonesia and the problem of punishing foreign online gambling providers in accordance with Indonesian criminal law. The writer hopes to make a contribution to the field of legal science, namely in the area of criminal law. To handle the many concerns examined, the author uses a normative method in conjunction with a doctrinal research strategy. This paper's author utilized information from international agreements (black letter law), corporate crime theories, and legislative statutes. The results of this research confirm that Law Number 19 of 2016 on Information and Electronic Transactions, Article 27, paragraph 2, governs the behavior of online gambling service providers inside the Indonesian legal framework. However, a number of internal and external factors obstruct advancement inside the law enforcement process. Law Number 19 of 2016 about ITE has extraterritorial jurisdiction, which means that legal actions taken both within and outside of Indonesia's borders are covered by it. This covers actions taken by foreign or Indonesian nationals, as well as actions taken by foreign or Indonesian legal organizations, provided that they have Indonesian legal ramifications.

Abstract

Child maintenance is an important aspect that needs to be considered in the divorce process. The aim of this writing is to find out the Settlement of Child Maintenance Disputes (Alimentation for Post-Divorce Consequences). The research method used is normative legal research (normative law research) using normative case studies, namely in the form of legal behavioral products, which are based on legal norms or legal rules that apply in Indonesian society. The main aim of resolving child maintenance disputes is to ensure the welfare and best interests of the child. This involves ensuring the child receives adequate financial support from the parent who does not live with them. In some cases, resolving child maintenance disputes involves legal proceedings involving family courts. This process involves the filing of documents, a hearing, and a court decision that will determine the amount and method of child support payments.

Abstract

Bankruptcy exists to guarantee that creditors obtain the rights attached to them in accordance with statutory regulations, this is in accordance with the main objective of bankruptcy, namely to divide the debtor's assets among creditors to avoid separate executions and inconsistent distribution. in accordance with applicable legal proportionality. The curator is one of the parties authorized to manage and settle bankruptcy assets after the debtor is declared bankrupt. In this process, the curator is supervised by a supervisory judge who is appointed by the Commercial Court Judge at the time the decision to declare bankruptcy is declared to the debtor. The curator is not completely free in carrying out the settlement or distribution of bankruptcy assets, the supervisory judge in this case has the authority to supervise the management and settlement of bankruptcy assets carried out by the curator.

Abstract

Teacher administration is an important aspect in the implementation of education, because teacher management is a strategic factor that has a big influence on improving the quality of education. The main problem in this research is "is the implementation of teacher administration running effectively? Based on preliminary research, it is known that there are symptoms of ineffective teacher management, which stand out among others in terms of planning, teacher placement, excessive teacher staff and improving teacher welfare. In planning activities, acceptance and selection planning, induction planning, compensation planning, assessment planning, development planning, transfer planning and employment termination planning have not been made. In teacher placement activities outside their field of study expertise, especially in rare fields of study, teacher development and lack of reference to improving the quality of education in schools. Meanwhile, in the field of teacher welfare, there has been no improvement from previous conditions. Moving on from these conditions, the main question asked in this research is: what is the condition of the teacher administration management institutions and how effective are the teacher administration functions. This study uses a qualitative research approach, with several data collection techniques in the form of interviews, observation and documentation studies. The reason for using a qualitative approach is because this observation is carried out on human behavior interacting in the process of managing teacher administration, starting from the implementation of the planning function to termination of employment. With this approach, the writer/researcher also acts as the main research instrument and is involved in the management process, thereby obtaining the necessary data and information from primary sources, both from the human resources department and related agencies as managers or from teachers as managed employees. Based on research findings and the results of the discussion, it is concluded that it does not yet describe conditions that are conducive to improving the quality of education. Meanwhile, the implementation of teacher management does not fully meet the criteria for the effectiveness of teacher management functions.
