Abstract

The stated purpose of the state is articulated in the Preamble of the 1945 Constitution (UUD 1945), specifically in the fourth paragraph. "Following that, establish an Indonesian State Government that safeguards the entire Indonesian nation and the bloodshed of all Indonesians, promotes the general welfare, educates the populace, and aids in the implementation of a global order founded on independence, lasting peace, and social justice, as delineated in the 1945 Constitution's articles, wherein one facet delineates the condition of a nation's economic development success." As stated in Article 33 of the 1945 Constitution, the following are provisions of the national economy's structure: (2) It is a collaborative effort based on the principle of kinship; (2) The state exercises control over critical sectors of production that have a significant impact on the lives of numerous individuals; (3) It is the state's responsibility to manage the land, water, and natural resources within for the greatest good of the people; and (4) The economic democracy that underpins the organization of the national economy. The Intellectual Property Rights Law of Indonesia governs the implementation, application, and procedure pertaining to intellectual property rights. The Intellectual Property Rights Act is designed to provide additional oversight over an individual's rights to their work and has the potential to apprehend those who commit offenses related to intellectual property rights

Abstract

One of the criminal regulations that adheres to a special minimum system is Law Number 35 of 2009 concerning Narcotics, with the threat of a special minimum penalty, the judge may not impose a penalty under the special minimum provisions. In the case of narcotics crime decided by the court, namely in verdict number 58/Pid.Sus/2022/Pn.Jmr, the panel of judges actually imposed punishment under the special minimum provisions. This study aims to determine the consideration of judges in imposing imprisonment under the special minimum provisions in narcotics crimes in decision number 58/Pid.sus/2022/Pn.jmr. in this study using normative juridical research methods with a legal, case, and conceptual approach. Based on the results of this study, the judge in deciding a case should be guided by the laws that have been established and the Supreme Court Circular Letter (SEMA) Number 3 of 2015 as a guideline for the implementation of duties for the court, but the judge in his decision imposed a sentence under a special minimum provision, based on this statement it can be concluded that the judge in imposing imprisonment under a special minimum provision in decision number 58/Pid.Sus/2022/Pn.Jmr is not in line with and contradicts Law Number 35 of 2009 concerning Narcotics and SEMA Number 35 of 2015

Abstract

People who commit legal errors and cause the consequences of these legal actions must be able to take responsibility for the consequences of their actions. Murder is the act of taking another person's life intentionally and the aim is to take someone's life, while the crime of assault is a crime whose target is the human body. The aim of this research is to find out how the judge views the death of the victim in the crime of murder. This research uses normative juridical methods, meaning library research that uses library legal material sources using a legal approach and a case approach. In this case the researcher does not agree with the judge's decision because according to the researcher what is meant by the crime of murder is the victim who should have died when the incident occurred, but at that time the victim also died. did not die immediately, therefore the appropriate charge is for committing a criminal act of serious abuse which resulted in death. The results of the research discussion can be concluded that the judge's consideration in handing down and determining the death of the victim was incorrect.

Abstract

The provisions of Article 1 point 21 of the Criminal Procedure Code state that detention is the placement of a suspect/defendant in a certain place by an investigator, public prosecutor or judge with his or her determination and in a regulated manner. in this law. Detention is the placement of a suspect/defendant in a certain place by an investigator, public prosecutor, or judge with his or her determination, with the conditions and methods regulated in this law. Therefore, detention is a form of deprivation of a person's freedom of movement and is a threat aimed at giving a feeling of regret to someone who has committed an offense. Detained suspects/defendants have several rights, one of which is the right to submit a request for suspension or the right to transfer detention. According to the provisions of Article 31 of the Criminal Procedure Code, a suspension of detention can be granted by investigators, public prosecutors or judges in accordance with their respective authorities with or without cash collateral or personal guarantees, based on predetermined conditions. The purpose of this research is to determine the responsibility of the guarantor if a suspect or accused who is detained or transferred to detention escapes. The research method uses normative juridical with a statutory and conceptual approach. The result of this research is that a suspension of detention can be granted by the police investigator as the detention institution, if the suspect/accused or guarantor has fulfilled the conditions that have been set. However, during the suspension of detention, the suspect/defendant escapes and is not found within a period of 3 (three) months, then (the guarantor) is responsible for bearing all risks and consequences that arise, namely by depositing the security deposit. in the amount specified in the agreement at the beginning. granting suspension of detention

Abstract

Peaceful resolution of disputes is the main goal in the modern legal system. One form of peaceful resolution, namely arbitration, is recognized as an effective way to resolve disputes firmly and bindingly. Arbitration is part of Alternative Dispute Resolution (ADR), which includes various methods of resolution outside of court or litigation. In the context of resolving default disputes, the Indonesian National Arbitration Board (BANI) is an efficient option. This research aims to analyze the role and benefits of arbitration in handling default disputes, especially those related to BANI. The research method used is normative legal research by collecting and analyzing secondary data such as laws, regulations, arbitration decisions and related literature. The research results show that the default dispute resolution process through BANI involves several steps, including arbitration selection, trial process, and final decision. The advantages of resolving default disputes through BANI include speed, legal certainty through arbitration awards, and the diversity of arbitrators who can provide different points of view in resolving disputes. Based on research findings, the decision of the Denpasar District Court Class I A Number 3/Pdt.G/2017/PN.Dps is based on Article 3 of Law no. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. The judge stated that the District Court did not have the authority to decide disputes between two parties who were bound by an arbitration agreement. This shows that if a dispute occurs, the parties must resolve it through deliberation. If deliberations are unsuccessful, the resolution will be handed over to the Indonesian National Arbitration Board (BANI).

Abstract

This article is devoted to the topic of subordination, which is one of the oldest and most relevant institutions of civil procedural law, the content of this topic includes which body is competent to consider disputes (cases), its criteria and conditions, as well as the limits of the competence of the court and other bodies in this area. The task of subordination in a broad sense determines the forms of protection (judicial or extrajudicial resolution) of the rights and interests of individuals (individuals and legal entities). In a narrow sense, it is understood to belong to a number of state bodies and organizations empowered to protect violated and disputed subjective rights of individuals and legal entities and their legally protected interests. The subordination of cases plays a key role in delineating their powers from each other. The article also includes aspects of subordination, which is a broad concept in relation to jurisdiction, similarities and differences with this procedural institution. At the same time, the article provides detailed information and analysis of several types of subordination in civil procedural law, including alternative, contractual, imperative and exceptional types. At the end of the article, problems related to the topic of subordination, suggestions and recommendations for their solution, and the author's conclusions are presented.

Abstract

Economic law and sustainable development are two interrelated concepts that influence public policies in ASEAN countries. This research aims to analyze the relationship between economic law and sustainable development in ASEAN countries, as well as the challenges and opportunities faced by these countries in implementing the principles of sustainable economic law. The research method used is a normative juridical approach, namely by examining laws and regulations, official documents, and related literature relating to economic law and sustainable development in ASEAN countries. The results show that there are variations in the level of engagement and commitment of ASEAN countries in realizing economic law and sustainable development, depending on factors such as social, political, economic, and environmental conditions in each country. The research also identifies several important issues that need to be addressed by ASEAN countries, such as the need for legal harmonization, enhanced regional cooperation, protection of human rights, community empowerment, and effective law enforcement. This research provides recommendations to improve the quality and effectiveness of economic law and sustainable development in ASEAN countries, and its implications for social welfare and justice in the region.

Abstract

Perkawinan Sesama Jenis di Indonesia, sejatinya belum diatur oleh Peraturan Perundang-Undangan sehingga banyak pasangan sesama jenis yang memilih menikah di luar negeri contohnya Ragil. Ragil Mahardika menikah dengan seorang pria Jerman berusia 35 tahun yaitu Frederik Vollert. Keduanya menikah di Jerman, negara yang memungkinkan persatuan sesama jenis. Setelah menikah, keduanya tinggal di Bayern, Jerman. Perkawinan yang telah dilakukan oleh Ragil Mahardika sudah jelas merupakan perkawinan sesama jenis, perkawinan ini tergolong perkawinan beda kewarganegaraan dikarenakan Ragil Mahardika terlebih dahulu menikah dengan Frederik Mollert pada tahun 2018 yang kemudian disusul pindah kewarganegaraan menjadi Warga Negara Jerman pada tahun 2021. Tujuan dari penelitian ini adalah untuk mengetahui prosedur perkawinan antar bangsa menurut Hukum Perdata Internasional serta untuk mengetahui keabsahan perkawinan campuran sesama jenis yang dilakukan di luar Indonesia. Metode penelitian yang digunakan ialah metode penelitian normatif, dengan jenis penelitian yang digunakan ialah penelitian deskriptif dan teknik pengumpulan data dilalukan melalui studi kepustakaan. Penelitian ini menggunakan teori hukum perdata internasional yang dimana didalamnya telah memuat fakta yang valid atau relevan baik dalam aspek subjek hukumnya maupun dalam aspek objektifnya. Hasil penelitian ini dapat menemukan fakta bahwa perkawinan sesama jenis pada pasal 1 Undang-Undang Perkawinan berbunyi demikian: “Perkawinan ialah ikatan lahir bathin antara seorang pria dengan seorang wanita sebagai suami isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha esa”. Menurut pasal tersebut pasangan sesama jenis, baik gay atau homoseksual (pasangan pria dengan pria) maupun lesbian (pasangan wanita dengan wanita), tidak sah menurut hukum perkawinan Indonesia

Abstract

Advokat mempunyai hak dan kewajiban dalam menjalankan profesinya sesuai Undang-Undang Advokat dan Kode Etik Advokat Indonesia. Salah satu hak yang melekat pada advokat adalah hak imunitas. Dalam praktik peradilan pidana perlu dipahami bagaimana pembelaan hukum yang ditawarkan kepada advokat dalam proses pidana di penghakiman Indonesia. Tujuan dari penelitian ini adalah untuk mengetahui hak imunitas advokat dalam praktek peradilan pidana. Penelitian ini menggunakan metode dengan jenis yuridis normatif serta metode pendekatan berupa pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Berdasarkan hasil penelitian, menunjukkan bahwa, meskipun Undang-Undang Nomor 18 Tahun 2003 terkait Pasal 16 Advokat melarang penuntutan pidana atau gugatan perdata bagi advokat yang bertindak dengan niat baik atas nama kliennya selama persidangan, akan tetapi secara bersamaan menunjukan bahwa implementasi hak imunitas advokat masih kurang berjalan dengan semestinya meskipun penjelasan tentang frasa dari pasal 16 UU Undang-Undang Nomor 18 tahun 2003 telah di perluas maknanya oleh Putusan Mahkamah Konstitusi nomor 26/PUU-XI/2013.

Abstract

Setiap orang yang melakukan tindak kejahatan akan dilakukan penuntutan serta dikenakan sanksi apabila terbukti bersalah berdasarkan dengan ketentuan hukum yang berlaku. Dalam perkara nomor 649/Pid.B/2022/PN.Mtr, penuntutan yang merupakan kewenangan Penuntut Umum dalam penerapannya terdapat kekeliruan sejak tahap penyusunan surat dakwaan yaitu tidak mendakwa Terdakwa sesuai dengan tindak pidana yang dilakukannya. Riset ini bertujuan untuk mengetahui mekanisme penuntutan dan bentuk surat dakwaan yang digunakan dalam perkara nomor 649/Pid.B/2022/PN.Mtr. Riset ini menggunakan jenis normatif dengan menerapkan metode pendekatan berupa pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Berdasarkan hasil riset ini, bagi Penuntut Umum hendaknya faktor kecermatan dan ketelitian perlu ditingkatkan karena seharusnya Penuntut Umum dalam perkara tersebut mendakwa Terdakwa sesuai dengan tiga tindak pidana yang dilakukan, yakni perzinahan yang diatur pada Pasal 284 KUHP, pembunuhan yang diatur oleh Pasal 338 KUHP, dan pencurian biasa yang diatur oleh Pasal 362 KUHP yang dilakukan secara perbarengan perbuatan (concursus realis), sehingga bentuk surat dakwaan yang tepat digunakan adalah kumulatif. Akan tetapi, dalam perkara ini Penuntut Umum hanya mendakwa terkait hilangnya nyawa korban saja yang didakwa dalam bentuk dakwaan alternatif, oleh karena itu kekeliruan Penuntut Umum dalam melakukan penuntutan mencederai rasa keadilan bagi keluarga korban karena tidak mendakwa Terdakwa sesuai pada tiga tindak kejahatan yang telah dilakukan.
