Abstract

This article examines the apparent conflict (ta‘āruḍ al-nuṣūṣ) between QS. al-Baqarah [2]:180 on wills (waṣiyyah) and QS. al-Nisā' [4]:11–12 on the provisions of a fixed inheritance share (farā’iḍ) through the perspective of maqāṣidī interpretation. Most classical commentators view the will verses as having been abrogated (mansūkh) by the inheritance verses or by the hadith “lā wasiyyata li-wārith”. At the same time, many contemporary scholars reject the concept of total abrogation and prefer to understand it as a relationship of takhṣīṣ, taqyīd, or normative harmonization. Using a hermeneutical approach based on the maqāṣid al-syarī‘ah and a semantic analysis of the wording of the verses, this article argues that the conflict perceived so far is not a substantive conflict between texts, but rather a consequence of differences in interpretation methodologies and in the meanings of linguistic elements. Therefore, the provisions of wills and inheritance are not in a mutually exclusive relationship but complement each other to achieve the objectives of sharia. This article concludes that the Qur'anic legal system regarding wills and inheritance constitutes an integrative legal-ethical unity, oriented towards the protection of property, distributive justice, social solidarity, and the balance of family relations, in accordance with the objectives of maqāṣid al-syarī‘ah.

Abstract

This article examines the istikhlaf verses of QS. Al-Baqarah [2]: 30, QS. Al-An'am [6]: 165, QS. Hud [11]: 61, and QS. al-Rum [30]: 41. From the perspective of ecological inheritance law, arguing that future generations have the right to Islamic law (huquq shar'iyyah) over a clean and sustainable earth, just as heirs have the right to undivided inheritance. Using a qualitative approach grounded in a literature review and the Maudhu'i interpretation method, this study examines the interpretations of classical and contemporary exegetes. Then it develops a legal analogy (qiyas) between the structure of Islamic inheritance law (faraid) and the rights of future generations over the environment. The results of the study show that the concept of amanah, mizan, and the prohibition of fase fi al-ard} places the current generation as wasi (will holder) of the earth's assets, not absolute owners, so that exploitation that reduces the rights of future generations is equivalent to itlaf mal al-ghair in muamalah fiqh. This study finds a conceptual meeting point with Edith Brown Weiss's doctrine of intergenerational equity. It concludes that the ecological rights of future generations can be formulated as part of the maqashid sharia, especially hifz al-bi‘ah as an extension of hifz al-nasl.

Abstract

The involvement of subcontractors in construction contracts is a practical necessity for carrying out work that requires specialized expertise. However, the position of subcontractors in contractual relationships still faces problems due to unequal bargaining positions and potential imbalances in contractual clauses. This study aims to analyze legal protection for subcontractors under the principle of pacta sunt servanda and to examine the role of the principle of contractual justice in maintaining the balance of the parties' rights and obligations. The results of the study indicate that the principle of pacta sunt servanda provides certainty regarding the validity of the contract, but has not fully guaranteed protection for subcontractors in an unbalanced contractual relationship. Positive legal regulations still leave room for ambiguity regarding the position and fulfillment of subcontractor rights. Strengthening the principles of contractual fairness, good faith, and proportionality is necessary to create fairer, more balanced contractual relationships and provide legal certainty for subcontractors in construction work contracts.
