Abstract

This study aims to analyze the supervisory function of the House of Representatives (DPR) in international treaties and to examine the legal validity of Indonesia’s participation in the Board of Peace (BOP) within the framework of constitutional law. The research addresses two main issues: the form of DPR supervision in international agreements and the validity of the BOP agreement in relation to such supervision. This study employs a normative juridical method with statutory and conceptual approaches, based on the 1945 Constitution, Law Number 24 of 2000, and relevant legal literature. The results show that DPR supervision is theoretically exercised in two stages, namely before and after the agreement is concluded. However, in practice, such supervision tends to be ineffective. In the BOP case, the absence of DPR approval at both stages results in procedural defects. Based on the theory of legal validity, this condition leads to the invalidity of the agreement and implies nullity, rendering it legally non-binding within the national legal system.

Abstract

This study examines the effectiveness of parliamentary oversight by the House of Representatives (DPR) over political party financial assistance within the context of Indonesia’s multiparty system following the 2024 legislative election. The study focuses on two main issues: how the multiparty configuration affects the effectiveness of DPR oversight and how structural conflicts of interest and regulatory design contribute to weak accountability in the use of public funds by political parties. This research employs normative legal research using statutory, conceptual, and case approaches. Primary legal materials consist of legislation concerning DPR oversight functions and political party financing, while secondary materials include scholarly journals, books, and relevant official documents. The findings indicate that a multiparty system does not automatically weaken oversight; however, in the Indonesian post-2024 legislative election context, political configurations that encourage pragmatic coalitions reduce substantive opposition. Furthermore, the DPR faces structural conflicts of interest because it politically represents parties that are themselves recipients of public funding. In addition, the regulatory framework remains oriented toward administrative compliance rather than substantive accountability based on outcome evaluation. Therefore, weak oversight is primarily caused by institutional and regulatory design flaws rather than merely the number of political parties.

Abstract

This research examines the structural weakening of the Indonesian House of Representatives' (DPR) oversight function in relation to the privatization of public functions within political parties. Using a socio-legal approach that combines doctrinal normative analysis with empirical examination of how law operates in practice (law in action), this study identifies the root cause of parliamentary dysfunction not merely as procedural deficiency but as a systemic problem originating from party governance structures. The research analyzes three interconnected phenomena: (1) the concentration of financial control within political party oligarchies due to inadequate audit mechanisms limited to state-sourced funds, which leaves private funding channels unaccountable; (2) the use of inter-term replacement mechanisms as a tool for political control that constrains legislators' independence in executing oversight functions; and (3) the structural subordination of party members to party elites through patron-client relations. The findings demonstrate that the limitation of state audits under Government Regulation No. 36 of 2018 has created a governance vacuum that allows financial oligarchies to consolidate control, thereby transforming political parties from public institutions into entities operating according to private capital logic. Consequently, legislators become structurally subordinated to party elites, compromising their ability to exercise critical oversight of executive power. This research proposes institutional reconstruction through comprehensive financial audit reforms, restructuring of party courts with independent external elements, and implementation of leadership term limits to restore legislative independence. The solutions offered are implementable, measurable, and aimed at strengthening constitutional democracy through reformed party governance systems.

Abstract

This study examines the urgency of limiting the object of the House of Representatives’ right of inquiry in exercising its oversight function so that it does not exceed constitutional boundaries. The right of inquiry is an important instrument within the checks and balances mechanism; however, its regulation and implementation still raise legal problems because the objects and subjects that may be summoned by the House are formulated too broadly. This condition may create legal uncertainty, distort the oversight function, and transform the right of inquiry into a political pressure instrument. This research employs normative legal research using statutory, case, and conceptual approaches. The findings show that the broad interpretation of the object of inquiry affects legal certainty, weakens the rule of law, and shifts the House’s oversight function from constitutional control to political maneuvering. Constitutional Court Decisions Number 36/PUU-XV/2017 and Number 16/PUU-XVI/2018 emphasize the need for constitutional limits in the use of the right of inquiry, particularly to prevent interference with pro justitia processes or the independent functions of certain institutions. Therefore, the right of inquiry should be limited to the implementation of laws and/or government policies that are important, strategic, broadly impactful, and allegedly contrary to statutory regulations. It should also be exercised gradually, proportionally, and directed toward policy improvement and strengthening governmental accountability.

Abstract

This study examines the persistent weakness of the Indonesian Parliament oversight function. Although this oversight function is explicitly enshrined in the constitution and legislation, in practice it remains dependent on political calculations and the pragmatic stance of political parties. The aim of this study is to identify the causes of the weakness in the Indonesian Parliament’s oversight function and to propose measures to strengthen it in accordance with Indonesia’s constitutional framework, to ensure that Indonesian Parliament’s oversight function can be restored. This tudy employs a doctrinal method, combining an analysis of legislation with a conceptual approach. The research findings confirm that political parties are highly prone to engaging in practical politics by prioritising party interest, which hinders the Indonesia Parliament’s oversight function. This study concludes that these obstacles include party cartelisation, power relations, high parliamentary thresholds, conflicts of interest, and the urgent need to revise thr Political Parties Act and the Election Act

Abstract

This study aims to analyze the changing function of the House of Representatives (DPR) from a supervisory institution to a partner of power in the context of the dominant political consensus, and to formulate an appropriate institutional reform model. The method used is normative legal research with a regulatory and conceptualization approach, using secondary data in the form of legislation, legal literature and scientific journals. The results of the study indicate that normatively, the DPR's supervisory function has been firmly regulated in Article 20A of the 1945 Constitution and Law Number 17 of 2014 concerning the MD3. However, in practice, the dominance supported by the government has weakened the role of the opposition and the suboptimal use of the rights of interpellation, inquiry, and the right to express opinions. This results in a gap between legal norms (das sollen) and political reality (das sein) which has an impact on decreasing accountability, increasing the potential for covering up power and weakening the quality of democracy. Therefore, institutional reform is needed that includes strengthening the role of minorities/opposition, restructuring the apparatus of the House of Representatives (DPR), increasing accountability and transparency and strengthening the ethics and accountability of the institution to restore the supervisory function according to the constitutional mandate.

Abstract

The Public Hearing (Rapat Dengar Pendapat Umum/RDPU) serves as a parliamentary oversight mechanism of the House of Representatives (DPR) within the framework of checks and balances. In practice, however, RDPU has expanded beyond its original function of supervising public policies and has increasingly been used to address ongoing judicial cases. This shift raises constitutional concerns as it blurs the boundary between legislative and judicial powers and potentially undermines judicial independence. This study aims to analyse the constitutional limits of RDPU, examine its deviation in concrete cases, and formulate a constitutional boundary model for its use within Indonesia’s constitutional system. This research employs a normative legal method with statutory, conceptual, and case approaches. The findings reveal that the use of RDPU in ongoing cases constitutes an expansion of legislative power into the adjudicative domain, generating political pressure that may affect judicial processes and compromise the principle of fair trial. Accordingly, this study proposes a reconstruction of RDPU through substantive limitations, the application of the sub judice principle, and the strengthening of ethical and constitutional control mechanisms. This model ensures that RDPU remains an effective democratic oversight tool without infringing upon judicial independence.

Abstract

The dissolution of the State Civil Apparatus Commission (KASN) through Law Number 20 of 2023 concerning State Civil Apparatus has transferred the oversight functions of the merit system and ASN neutrality to the National Civil Service Agency (BKN) and the Ministry of Administrative and Bureaucratic Reform. This study aims to analyze the urgency of strengthening the oversight function of the House of Representatives (DPR) over BKN following the dissolution of KASN, particularly in the context of the Constitutional Court Decision Number 121/PUU-XXII/2024 which mandates the establishment of an independent supervisory body within two years. Using a normative juridical (doctrinal) legal research method with a statutory approach, a conceptual approach, and a case approach, this study finds that the transfer of KASN's functions to BKN has created a structural conflict of interest, as BKN simultaneously serves as both the executor and supervisor of civil service management. The DPR, through its Komisi II, possesses constitutional authority to exercise political oversight through interpellation rights, inquiry rights, and working meetings, yet the effectiveness of such oversight is constrained by the oversized coalition dynamics. This study recommends strengthening the DPR's oversight role through structured monitoring mechanisms, activating parliamentary inquiry instruments, and accelerating the formation of an independent supervisory institution as mandated by the Constitutional Court.Keywords: Keywords consist of a minimum of 3 and a maximum of 5 words.
