Abstract

The establishment of the Investment Management Agency Daya Anagata Nusantara (Danantara) under Law Number 1 of 2025 marks a paradigm shift in Indonesia’s state wealth management. However, Danantara’s institutional design raises normative concerns, including the ambiguity of its sui generis legal status, weak independent oversight, and unclear public accountability. This study compares Danantara’s institutional regulations with Temasek Holdings (Singapore) and Khazanah Nasional Berhad (Malaysia), and formulates an ideal model of oversight and legal accountability. Using a normative legal method with statutory, comparative, and conceptual approaches, this study finds that Danantara fundamentally differs from Temasek and Khazanah in three aspects: the legal regime of establishment, the degree of separation between ownership and management functions, and clarity of institutional mandate. Based on best practices from both institutions, this study proposes an ideal oversight model for Danantara built on three pillars: strengthened internal oversight through independent board restructuring, multilayered external oversight encompassing mandatory independent audit and parliamentary reporting, and structured public transparency through adoption of the Santiago Principles and mandatory annual public reporting.

Abstract

Program makan bergizi gratis (MBG) oleh Pemerintahan Prabowo-Gibran membawa harapan sebagai upaya menuju Indonesia Emas 2045, namun terdapat persoalan serius dalam legalitas, tata kelola, akuntabilitas. Akibatnya ribuan pelajar mengalami keluhan kesehatan dari program ini sampai dengan kasus keracunan yang merupakan kerugian telah diderita oleh para pelajar sebagai bagian dari warga negara. Penelitian ini bertujuan untuk menganalisis kritis program makan bergizi gratis berdasarkan konsep good governance, dan probabilitas penggunaan citizen lawsuit sebagai alat partisipatoris warga negara terhadap perbaikan program ini. Penelitian ini menggunakan jenis penelitian yuridis normatif dengan pendekatan perundangan, konseptual, dan kasus; penggunaan data sekunder yang terdiri dari tiga bahan hukum dengan teknik studi pustaka dan studi dokumen akan digunakan dalam penelitian ini, didukung dengan teknik analisis preskriptif kualitatif. Program MBG ini lemah dalam pelaksanaan, bahkan persiapannya karena tidak mengindahkan nilai-nilai akuntabilitas, partisipatif, transparansi, dan legalitas – sebagaimana dimaksud konsep good governance. Akibat yang muncul yang disebabkan abainya pemerintah dalam program ini dapat dimintakan pertanggungjawabannya melalui mekanisme hukum di pengadilan: citizen lawsuit/action popularis.

Abstract

The escalating climate crisis has exposed structural weaknesses in the national and international legal systems, particularly in the protection of environmental rights as part of human rights. The tension between economic globalization and ecological preservation shows that environmental degradation is not only a scientific issue, but also a legal issue. This study examines how environmental law can be reconstructed to integrate the principles of environmental justice and intergenerational justice within the framework of human rights. This study critically reviews the environmental regulatory regime in Indonesia in the context of global commitments such as the Paris Agreement, by identifying challenges in law enforcement, institutional coordination, and the integration of ethical norms into binding legal standards. In addition, this study emphasizes the need for a paradigm shift in the law from anthropocentric to ecocentric, which recognizes the intrinsic rights of nature. Through normative research methods with comparative and legislative approaches, this research proposes a responsive and equitable environmental governance model, which combines state sovereignty, human dignity, and environmental sustainability as a reflection of the evolution of the role of law in the anthropocentric era.

Abstract

This research analyzes the phenomenon of legislative populism within the supervisory function of the Indonesian House of Representatives (DPR RI), which increasingly tends to intervene in the judicial sphere. Following the enactment of the National Criminal Code (Law No. 1 of 2023) and the Criminal Procedure Code (Law No. 20 of 2025), a trend has emerged where Commission III of the DPR RI acts reactively toward viral legal cases on social media, such as the cases of Andrie Yunus, Amsal Sitepu, and Fandi Ramadhan. This normative legal research employs statutory, conceptual, and case approaches to dissect the demarcation line between political oversight and judicial intervention. The findings indicate that populist and casuistic supervisory practices implicate the erosion of the due process of law principle and create a "chilling effect" on judicial independence. The DPR often exceeds its authority (ultra vires) by providing specific instructions regarding sub-judice cases. This study recommends a reconstruction of the DPR's supervisory model toward a structural-systemic approach by strengthening "Sub Iudice Rule" protocols within the MD3 Law, ensuring that the system of checks and balances functions without compromising the supremacy of law.

Abstract

This study aims to explore the impact of the expansion of the authority of the People’s Representative Council of the Republic of Indonesia through amendments to the Rules of Procedure on the independence of state institutions and the balance of power within the Indonesian system of government. The method used in this study is normative legal analysis with a qualitative approach, utilizing data from secondary legal sources such as laws, books, and academic journals. The findings of this study indicate that the expansion of authority, particularly regarding the evaluation mechanisms for officials appointed by the DPR, can lead to political interference in state institutions that are supposed to be independent, thereby threatening their autonomy. Furthermore, this expansion of authority also has the potential to undermine the balance of power by strengthening legislative dominance beyond the constitutional limits of authority as stipulated in the 1945 Constitution of the Republic of Indonesia. This situation has the potential to create legal uncertainty and also threatens the principle of checks and balances within Indonesia’s governmental structure.

Abstract

The formation of the composition of the composition of the commission membership in the institution of the House of Representatives is confirmed the dominance of the Political Party Faction significantly, this causes the basis for the placement of members of the House of Representatives in commissions is often not based on competence but rather on pragmatic political calculations which are certainly not ideal for democracy. The research method applied in writing this paper is normative or doctrinal legal research that specifically examines the sources of legal materials, as well as non-legal materials that are relevant to the theme and framework of the research carried out. The purpose of this research itself is to obtain a more ideal and coherent concept with democracy and the principle of constitutionalism in terms of the mechanism for forming the composition of the composition of the field commission membership in the DPR institution. The result of this study is that the mechanism for determining the membership of the commission must be based on the will of the members of the House of Representatives in principle, where the members of the House of Representatives propose 4 (four) desired commission choices to the leadership of the House of Representatives accompanied by the rationality of the choice, as well as evidence of experience and competence that is coherent with the desired field, which then the leadership of the House of Representatives with the assistance of the Expert Body conducts an open selection to decide on the placement each member of the House of Representatives

Abstract

This paper examines the crisis of the DPR’s supervisory function in the recruitment of public officials through the fit and proper test mechanism. In practice, the DPR’s constitutional oversight function has shifted into an arena of political compromise rather than substantive supervision. This research employs normative legal methods using statutory, conceptual, and case approaches. Primary legal materials include the 1945 Constitution and laws related to the Constitutional Court, Judicial Commission, and Corruption Eradication Commission, supported by constitutional law literature and Al-Mawardi’s Al-Ahkam al-Sulthaniyyah. The study finds that the DPR’s fit and proper test creates dualism of selection, conflict of interest, and politicization of public office, weakening the merit system. From the fiqh siyasah perspective, particularly the concepts of wizarat al-tafwidh and hisbah, public officials should be appointed based on amanah, kafaah, and maslahah. This study proposes limiting the DPR’s role to integrity and constitutional ethics oversight rather than duplicating technical selection processes.

Abstract

The Indonesian House of Representatives (DPR) plays a strategic role in maintaining democratic accountability through its oversight function. However, the domination of political parties within parliamentary structures often weakens substantive representation and limits the effectiveness of legislative oversight. Members of parliament frequently prioritize party directives over the interests of their constituents, resulting in the marginalization of various social groups in the political decision-making process. This research examines the phenomenon of party domination in the Indonesian parliament and explores the potential of asymmetric representation as an alternative institutional mechanism to strengthen democratic representation and oversight. This study uses normative legal research with statutory, conceptual, and comparative approaches. The research analyzes constitutional provisions related to parliamentary representation and oversight while examining comparative practices of minority representation in several democratic systems.The findings suggest that the dominance of political parties in parliamentary processes has contributed to the limited representation of marginalized groups, such as women, indigenous peoples, informal workers, and persons with disabilities. The introduction of asymmetric representation mechanisms, including reserved seats and minority quotas, may serve as an institutional corrective to enhance inclusivity and strengthen the oversight function of parliament. Strengthening representation is essential to ensure that parliamentary oversight reflects broader public interests rather than partisan agendas

Abstract

The educational requirements of prospective members of the House of Representatives (at least high school) in Law No. 7 of 2017 are the object of testing at the Constitutional Court (MK). The petitioners argued that the standard was too low for the complex legislative function, but the Constitutional Court consistently rejected the doctrine of Open Legal Policy. This research method using normative law (doctrinal legal research) uses legislative, case, and conceptual approaches, by analyzing several Constitutional Court decisions as well as Alexy's theory of proportionality and Habermas' deliberative democracy. The novelty of this research lies in the integration of criticism of inconsistencies in the implementation of Open Legal Policy by the Constitutional Court comparatively across decisions (age requirements, parliamentary thresholds, thresholds for candidacy of regional heads) as well as the incorporation of proportionality tests and other related theories to deconstruct the Constitutional Court's arguments about political positions, experts who have so far escaped academic attention in testing the educational requirements of legislative candidates that the Constitutional Court should have been more judicial activism rather than restraint. The Constitutional Court interprets the education requirements as an Open Legal Policy on the basis of the protection of the right to be a candidate, the representative nature of legislative positions, and the existence of experts. The use of this doctrine is inconsistent because in other cases (presidential age requirements, parliamentary thresholds, thresholds for candidacy for regional heads) the Constitutional Court actually intervenes in legislation policies. The arguments of experts also do not reflect the institutional reality of the House of Representatives and have the potential to create technocratic displacement. The use of the Open Legal Policy doctrine by the Constitutional Court is inconsistent and has the potential to result in constitutional abdication. The Constitutional Court should act judicial activism with a proportionality test to assess the balance between political rights and the quality of legislation.

Abstract

This study analyzes the crisis of the House of Representatives of the Republic of Indonesia’s oversight function in Indonesian democracy, as well as the factors behind its ineffectiveness and the measures needed to address it. The study employs a qualitative method using a normative legal approach and library research. The findings show that the oversight crisis is reflected in the weakening of checks and balances, the ineffectiveness of post-legislative scrutiny, and the low level of transparency and public participation in parliamentary oversight. The main contributing factors include the dominance of political oligarchy, the legacy of authoritarian parliamentary governance, the normalization of collusion and political-business practices, and power disparities among representative institutions. To overcome this crisis, the study recommends strengthening post-legislative scrutiny, improving transparency through civil society participation, digitizing oversight with public engagement, balancing the bicameral system, and reinforcing civilian control over strategic sectors. Therefore, DPR RI oversight must be reoriented to function effectively as an instrument of people’s representation within Indonesia’s democratic system.
