Abstract

ABSTRAK. Pasal 2 PBI 10/1/2008 menyatakan bahwa sengketa antara Nasabah dengan Bank yang disebabkan tidak dipenuhinya tuntutan finansial Nasabah oleh Bank dalam penyelesaian pengaduan Nasabah dapat diupayakan penyelesaiannya melalui Mediasi perbankan. Namun di dalam kenyataan di temukan penyelesaian sengketa perbankan dengan nominal dibawah ketentuan PBI serta peraturan Bank Mandiri, dengan tujuan untuk memberikan perlindungan terhadap hak-hak nasabah. Tujuan penelitian ini untuk mengkaji sengketa yang terjadi antara bank dengan nasabah, untuk mengkaji proses mediasi dalam penyelesaian perselisihan antara bank dan nasabah serta untuk mengkaji kekuatan hukum dari keputusan mediasi. Penelitian ini menggunakan  metode  penelitian empiris dan metode  penelitian normatif. Meskipun secara de facto, proses mediasi berakhir dengan kesepakatan damai diantara para pihak yang bersengketa yang tertuang didalam akta perdamaian yang mengikat kedua belah pihak. Kekuatan hukum dari akta kesepakatan adalah sama dengan Putusan yang berkekuatan hukum tetap dan terhadap putusan tersebut tidak dapat diajukan banding maupun kasasi. Dalam menjalankan proses mediasi perbankan diharapkan mengikuti ketentuan-ketentuan dari Peraturan Bank Indonesia Nomor 10/1/PBI/2008. Mediation Law Implementation in Settling the Dispute between Bank and Its Customers  ABSTRACT. Article 2 of PBI Number 10/1/2008 states that the dispute between Banks and its customers, which is caused by the unfulfilled financial demands by banks in solving the reports of the customers, could be solved through Banking Mediation. However, there is the fact that the settlement of the disputes nominal under the provisions of the PBI as well as the regulation of Bank Mandiri, aiming to provide protection to the rights of customers. This research aims to examine the disputes between the Aceh’s Bank of Mandiri and the customers, the mediation process in the settlement of disputes between the banks and the customer, and the legal force of the mediation process. This is empirical and normative legal research. Despite of de facto, the process of mediation is final by the peace agreement between the parties written in the act binding both parties. The legal force of the document is equal with a final judicial decision, and the decisions cannot be appealed to the appeal or the supreme courts. In conducting the process of banking mediation, the bank is expected to follow the comprehensive provisions of Indonesia Bank Regulation Number 10/1/PBI/2008.

Abstract

ABSTRACT: Nowadays, Indonesia known as one of the huge democracy country in the world. The basic characteristic of democracy country is rule of law.  Indonesia is a country that by law, put all the policies based on the source of all sources of law in Indonesia, namely the 1945 Constitution. Based on the law in idea, law in books and law in action can be concluded that based on the principle of religious divinity Almighty philosophical basis of the 1945 Constitution which concluded there is a strong recognition of the existence of the Islamic religion and Islamic law as a legal authority in Indonesia. Furthermore, in the perspective of the constitution there is a strong correlation between the state and Islam, including Islamic law that has become living law in the life of nation and state. The principles in the constitution to have any relevance to the principles that exist in Islamic law that stipulated in the Qur'an and Alhadits including the principles of justice, equality, and welfare. Abstract

ABSTRACT: Payment for Environmental Service (PES) is an environmental regulatory concept that as a voluntary transaction where a well-defined environmental service is being “bought” by at least one environmental service buyer from at least one environmental service provider, if and only if the environmental service buyer secures the environmental service as a conditionality. There is increasing interest and experience in PES in both developed and developing countries. In Asia, PES concept is manifested in forest and/or water resources management policy, such as in China, Japan. In the present state of the world, PES has come to the fore in step with concerns to save the environment in a holistic manner. Now, PES has become a way or a mechanism of stakeholders to maintain and manage the environment by providing economic incentives/compensation from users to providers of environmental services. In Aceh, this mechanism is implemented for protecting river stream area, such as in Krueng Montala, Great Aceh. PES mechanisms should be supported with force of law, also synergized with policies and projects related to integrated water resources management, rural development and rural livelihoods, and land use zoning. Abstract

Under the Indonesian Presidential Decree Number 6 of 2021, the government formed a task force to deal with the problem of the state claiming rights over the distribution of Bank Indonesia Liquidity Assistance (“BLBI”) funds received by obligors in 1998. During the Task Force's three-year operational period, collections have only reached about 27% of the outstanding target of IDR 110.45 trillion. This study evaluates the effectiveness of the collecting program's implementation under the applicable laws and regulations. The article indicates that the collection of BLBI receivables, as per the regulations outlined in GR 28/2022, has not been executed efficiently. This can be attributed to various factors, encompassing both the content and the context. The article proposes several viable alternatives, such as upgrading the legal framework for collecting BLBI receivables from being governed by GR to being embedded in law, and extending the BLBI Task Force's working period to achieve the best results for the welfare of the Indonesian people.

Abstract

Maxim is a short sentence with deep meaning related to value and purpose of law include agrarian law. This article analyse the meaning of fiat justitia ruat caelum and fiat justitia ne pereat mundus as well as its relation to agrarian justice and its contextuality. Both of those maxim are paradigmatically analysed. This is a normative juridical research, use conceptual and historical approach with secondary data then qualitatively analysed. Concluded that fiat justitia ruat caelum and fiat justitia pereat mundus is part of legal formalism. The agrarian justice is achieved when the law is enforced as the text and its acontextual. In contrast, fiat justitia ne pereat mundus consider law is valid when it is according to the purpose and agrarian justice exist when it bring out prosperity for all people. Paradigmatically, fiat justicia ruat caelum and fiat justitia pereat mundus fall in positivism paradigm, consider rule is perfect, no interpretation, separation of law and morality, impossibility of interdisciplinary approach. In another hand, fiat justitia ne pereat mundus falls in post positivism paradigm which consider law is imperfect, interpretation is possible, no separation of law and morality and interdisciplinary approch is opened. The law is acontextual.

Abstract

Adanya ketidakseimbangan dalam penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan di Kota Banda Aceh memberi perlindungan hak kepada penjual daripada pembeli, sehingga lebih banyak risiko kerugian yang harus dipikul oleh pembeli. Pokok permasalahan dalam artikel ini adalah apakah klausula baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan melanggar ketentuan peraturan perundang-undangan tentang perlindungan konsumen. Jenis metode penelitian yang digunakan dalam artikel ini adalah jenis metode penelitian hukum normatif. Pendekatan penelitian hukum yang digunakan dalam artikel ini terdiri dari, pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa perjanjian baku pada perusahaan pembiayaan PT ADMF bertentangan dengan ketentuan KUH Perdata, khususnya dalam Pasal 1266, Pasal 1267, Pasal 1337, Pasal 1338 ayat (1), ayat (2), dan ayat (3), Pasal 1339 KUH Perdata, dan juga bertentangan dengan ketentuan UUPK, khususnya dalam Pasal 4, Pasal 7, Pasal 18 ayat (1), dan ayat (2) UUPK. Oleh karena itu, penggunaan perjanjian baku dalam perjanjian sewa beli kendaraan bermotor pada perusahaan pembiayaan harus ditinjau dan disesuaikan agar tidak bertentangan dengan ketentuan undang-undang.  Standard Agreement in The Hir-Purchase Agreement for the Motor Vehicles in a Finance Company in Banda Aceh  The existence of an imbalance in the use of standard agreement in the hire-purchase agreement for motor vehicles in a finance company in Banda Aceh gives protection to the seller rather than the buyer, thus more risk of loss to be borne by the buyer. The main issue in this article is whether the standard clause in the hire purchase agreement of motor vehicles in the finance company violates the provisions of legislation on consumer protection. The research method used in this article was the normative legal research method. The legal research approaches used in this article consist of, statutory approach, case approach and conceptual approach. The results showed that the standard agreements used by PT ADMF was contradictory to the provisions of the Civil Code, particularly in Article 1266, Article 1267, Article 1337, Article 1338 Paragraph (1), Paragraph (2), and Paragraph (3), Article 1339 Civil Code, and also contrary to the provisions of UUPK, particularly in Article 4, Article 7, and Article 18 paragraph (1) and paragraph (2) UUPK. Therefore, the standard agreements in the hire-purchase agreement of motor vehicles in the finance company should be reviewed and adjusted so as not violates the provisions of legislation.

ABSTRAK. Tulisan ini bertujuan untuk menjelaskan perspektif gender dalam penyusunan qanun dan pandangan ulama serta cendikiawan muslim tentang bagaimana sebaiknya qanun yang berperspektif gender. Dalam pembentukan qanun, Pancasila sebagai dasar negara dijadikan parameter kesetaraan gender, disamping beberapa ketentuan lain berupa undang-undang, perjanjian dan konvensi internasional yang melindungi hak-hak perempuan. Pemahaman terhadap hakikat keberadaan teks al Qur’an dan hadist tentang nilai-nilai keislaman perlu mendapat kajian khusus dan mendalam guna menemukan ruh syariah (nilai filosofis) dari suatu ketentuan hukum dalam upaya formalisasi syariat Islam berperspektif gender. Gender Perspective in Formalization of Islamic Law in Aceh  ABSTRACT. This paper aims to explain the gender perspective in law making and the views of Muslim scholars on how best Qanun gender perspective. In establishing the Qanun, Pancasila as the state used as a parameter for gender equality, as well as several other provisions in the form of laws, international treaties and conventions that protect women's rights. Understanding of the nature of the text where the Qur'an and hadith about Islamic values deserve special assessment and due diligence to find the spirit of sharia (philosophical) of a provision of the law in an effort formalization of Islamic law with a gender perspective.

Abstract

ABSTRACT: The protection for children rights is absolute right and parents of the children have responsibility to protect their children but if there are no parents or other people who can be responsible for taking care of them; hence the state has to take this duty. The convention regarding children rights aims to improve and protect the interest and children rights as human; therefore they can develop their live mentally, socially and physically. Based on this fact, this paper look at to which extent the law protect their rights in the human rights view. Every child has rights to enjoy health service and social security based on the need of their physic mental and spiritual. Each child has a right to have parents protection, family, community and state. The humankind has to provide to children by the best service. Therefore, the right and the obligation is a cause that cannot be forgotten that it becomes the duty of the adult to provide them the protection. The obligation for them is on their family and this role is recognized by the convention. ABSTRAK: KUHP yang berlaku di Indonesia adalah Wetboekvanstrafrecht. Tuntutan akan adanya KUHP Nasional yang mencerminkan nilai-nilai ke-Indonesiaan sudah lama dirasakan dan sudah diupayakan, kini rancangan KUHP tersebut sudah dilimpahkan kepada DPR untuk dibahas. Di sini lain, perubahan paradigma dalam ketetanegaraan telah memberikan kekuasaan lebih besar kepada daerah untuk membuat kebijakan yang sesuai dengan kondisi masing-masing daerah. Provinsi Aceh yang memperoleh kekhususan berdasarkan beberapa Undang-undang dan terakhir dengan Undang-undang No. 11 tahun 2006 tentang Pemerintahan Aceh telah mengeluarkan beberapa Qanun syariat dan di dalamnya terdapat ancaman pidana yang tidak terdapat di dalam KUHP sebagai induk dari Hukum Pidana materil. Dalam perspektif pembangunan Hukum Pidana, maka kebijakan pidana Qanun NAD dapat dijadikan dasar bagi pembangunan hukum pidana nasional yang berwawasan Bhineka Tunggal Ika sebagai salah satu wawasan pembangunan hukum yang berwawasan nasional. Disarankan hendaknya pidana cambuk dijadikan sebagai pidana alternatif, bukan satu-satunya pidana, dan  segera membuat hukum pidana formil serta segera melakukan  revisi qanun syari’at dengan mencantumkan sanksi berupa tindakan. KUHP Nasional  sebagai induk dari Hukum Pidana materil hendaknya memuat aturan yang dapat dijadikan payung hukum sehubungan dengan tuntutan beberapa daerah dalam menerapkan ketentuan hukum yang hidup di dalam masyarakat. Criminal Law Policy on Qanun Aceh in the Criminal Law Prescriptive ABSTRACT: Aceh Province has been granted specificity bu several laws and the latest by the Act Number 11, 2006 on Aceh Government which has issued several Qanuns (local laws) and included criminal sanctions that does not exist in the Criminal Code as the main materiel of the Criminal Law. In the development perspective of the Penal Code, the criminal policy Qanun NAD can be the foundation for the development of national criminal law-minded unity in diversity as one of the legal development insights national vision. It is suggested that criminal whip should be used as an alternative punishment, is not the only criminal, and immediately mode a formal criminal law and immediately revise by stating qanuns shari’ah sanctioned action. The National Criminal Code as the main materiel of the Penal Code should contain rules that can be used as an umbrella law with respect to the demands of some areas in applying the laws of life in society.

Abstract

This article examines the dynamics of traffic violations in Pekanbaru, where community has been accustomed to it. The research method used is legal normative and legal-empirical, where  data was obtained through surveys involving respondents from the community on  how far understanding of traffic violations is percieved. Research findings indicate that frequent traffic violations have various consequences, such as an increase in incidents. Data obtained from the Pekanbaru Police Department over the last 4 years shows an increase in accident cases that stem from frequent traffic violations have become a common behavior in Pekanbaru communities, where people often perceive them as ordinary and even as part of everyday life. This is supported by survey results showing that 46% of respondents stated that the main reason for their traffic violations is because they are accustomed to doing so. In cultural criminology, the behavior of traffic offenders is considered a form of traffic crime culture. This is due to the high frequency and patterns of criminal activities that occur every day, even at all times, making it a deviant culture and an accepted habit in society. This would need to legal culture interventions to raise legal awareness on traffic law and the risks of violation to it.
