Abstract

ABSTRACT: Legal recognition of adat forests has long been established through Decision of the Constitutional Court No. 35/PUU-X/2012 correcting terminology of adat forests in the Forestry Law. However, the recognition has been still not running as expected to date. This article will explore about what are legal implications of recognition of adat forests associated with plantation concessionaires. The study found a number of unfair articles in the Plantation Act, even though they had been corrected by two Decisions of the Constitutional Court. The injustice appeared in regulation to plantation concessionaires who can be entitled to land for plantation business. On the one hand, such regulation showed injustice, especially with orientation of partiality. On the other hand, it would potentially generate a conflict between plantation business and community. A number of cases occurred between communities and plantation enterprises are potentially taking small community away from justice. Pengakuan Hutan Adat dan Konsesi Perkebunan di Indonesia ABSTRAK: Pengakuan hukum atas hutan adat sudah lama diteguhkan, melalui Putusan Mahkamah Konstitusi Nomor 35/PUU-X/2012, yang mengoreksi terminologi hutan adat dalam Undang-Undang Kehutanan. Akan tetapi hingga sekarang pengakuan tersebut masih belum berjalan sebagaimana yang diharapkan. Artikel ini ingin menelusuri bagaimana implikasi hukum atas pengakuan hutan adat terhadap pemegang konsesi perkebunan. Penelitian ini menemukan bahwa dalam Undang-Undang Perkebunan, terdapat sejum-lah pasal yang tidak berkeadilan, walau sudah diperbaiki dengan dua Putusan Mahka-mah Konsitusi. Ketidakadilan tampak pada pengaturan pelaku usaha perkebunan yang dapat diberi hak atas tanah untuk usaha perkebunan. Pengaturan demikian memperlihatkan ketidakadilan di satu pihak, terutama dengan orientasi keberpihakan. Di pihak lain, berpotensi memunculkan konflik usaha perkebunan dengan masyarakat. sejumlah kasus terjadi antara masyarakat dan usaha perkebunan, yang berpotensi menjauhkan masyarakat kecil dari keadilan.

Abstract

ABSTRACT: This article explores principles that must be focused in managing the management of natural resources and legal politics that must be run to fulfill the implementation of the principles in managing it in the Act of Natural Resources. Sveral policies of law have been issued by the state both the Act of Environment and the Act of Natural Resources. From such rules, the principles and norm of management fair environment, democratic and sustainable has not been accommodated and integrated fully. Abstract

Companies need funding for business growth. Syndicated financing is financing in large amounts of funds and projects that require extensive and long-term financing. Syndi-cated financing has grown since the 1960s. Participating financial institutions have compliance and knowledge of syndicated financing agreements. Customers have low compliance and understanding of financing agreements. This discrepancy has given rise to several communication problems, which resulted in legal events. This research aims to examine syndicated financing agreements between financial institutions and customers from the juridical side. This research uses a normative juridical method. This research concludes that the financing agreement is a single agreement between customers and many financial institutions. Financial institutions cannot deal directly with customers in the syndicated financing agreements. The facility agent or trustee represents the financial institution in negotiations with the customer if there is a difference or discrepancy with the financing agreement.

Abstract

Artikel ini bertujuan mengungkapkan mekanisme penyelesaian sengketa melalui peradilan gampong. Idealnya keberadaan peradilan gampong untuk memberikan kemudahan bagi masyarakat agar dapat menyelesaikan perselisihan dengan jalan yang lebih mudah, sesuai dengan asas peradilan cepat, sederhana dan biaya murah. Namun praktiknya, masyarakat justru lebih memilih menyelesaikan perselisihan melalui mekanisme peardilan pidana. Dengan menggunakan metode penelitian yuridis empiris dan bersifat deskriptif analitis, penelitian ini menemukan bahwa mekanisme penyelesaian tindak pidana ringan belum berjalan secara optimal. Penyelesaian perselisihan dengan peradilan gampong masih memperlihatkan lemahnya peran lembaga adat di gampong, akibat sejumlah kesepakatan lembaga penegak hukum tidak sampai hingga ke bawah. Dispute Settlement Through Gampong Court This article aims to reveal the mechanism of dispute resolution through village courts. Ideally the existence of the village court to provide facility for community to be able to resolve disputes in an easier way, in accordance with the principle of justice which is fast, simple and inexpensive. However, in practice, community prefers to resolve disputes through a criminal justice mechanism. By using an empirical juridical research method and descriptive analytical method, this study founds that the mechanism for resolving minor criminal offenses has not run optimally. Dispute resolutions through village court is still shows weaknesses particularly the role of traditional institutions, due to a number of agreements by law enforcement agencies did not reach to the lower levels.

Abstract

ABSTRAK. Undang-Undang Perlindungan Anak menegaskan bahwa pertanggungjawaban orang tua, keluarga, masyarakat, pemerintah, dan negara merupakan rangkaian kegiatan yang dilaksanakan secara terus-menerus demi terlindunginya hak-hak anak. Kalau ditilik secara cermat, pada Undang-Undang Nomor 32 Tahun 2002 tentang Penyiaran, tampak adanya kesadaran dari pembuat undang-undang untuk melindungi masyarakat/ konsumen penyiaran dari ekses-ekses negatif yang kemungkinan akan timbul. Terlepas dari kontroversi dari UU Penyiaran, yang banyak mendapat kritikan dari penyelenggara jasa siaran tentang terkekangnya kebebasan dalam menyelenggarakan jasa siaran, namun kalau dilihat dari sisi perlindungan yang diberikan oleh undang-undang ini terhadap masyarakat dan konsumen anak pada umumnya juga belum  memadai. Children's Rights Activity in Television Broadcasting ABSTRACT. Child Protection Act confirms that the responsibility of parents, families, communities, governments, and the state is a series of activities carried out continuously for the sake of protection of children's rights. If we scrutinize carefully, the Law No. 32 of 2002 on Broadcasting, appears the awareness of legislators to protect the public / consumer broadcasting of negative excess that is likely to arise. Regardless of the controversy of the Law No. 32 of 2002 on Broadcasting, which heavily criticized the organizers of the broadcast services on terkekangnya freedom in organizing broadcast services, but judging from the protection afforded by this Law to the public and consumers of children in general is inadequate.

Abstract

ABSTRACT: This research aims to explain the percentage of the contribution of Regional Own Revenues to Local Government Budget. In every establishment of new autonomy region, it is assumed that it would make the community prosperous by exploring and using all available resources. Apart from that, this research also aims to describe the steps that have been taken by the governments in improving Regional Own Revenues. The research finds that the realization of the budget in 2006, 2007 and 2008 shows that the percentage of such contribution to local government budget is very little compared to the contribution comes from other sources. As a result, the income of such areas is mostly depended on the budget given by central government through the balancing budget known as the General Allocation Grant. According to the data of the realization of Regional Own Revenues for the Local Government Budget in 2006, 2007 and 2008, there was no district or municipality which the contribution higher than 10%. The average contribution during the years had been 5.04%. Ideally, all local government budget especially the regular budget, should be similar to the Regional Own Revenues. This lack of contribution indicates that such local governments were really strongly depended on central government in terms of regular budget and budget for development through the balancing budget. In other words, it could be said that the local governments that are unable to balance between the regular budget and the Regional Own Revenues do not deceive to be called as autonomy governments.        The Contribution of Regional own Revenues as a Success Indicator of Regional Autonomy’s Implementation

Abstract

ABSTRACT: Press is an institution that has a strong influence on the forming of public opinion and efficacy of spreading information. Therefore, it is really strategic if press is empowered to spread positive information for public. However, in many cases crime of press in the Act Number 40, 1999regarding Press is not imposed by the reason of lex specialist. This article is going to answer the juridical problem in enforcing law regarding press. It shows that the act has not fulfilled the criteria as the act with lex specialist as it has no qualification of a crime as KUHP states it as KUHP is the main rule of crime regulation. Thus, in terms of trial involving press, judges persist to impose KUHP is correct. it is recommended that the act of Press as lex specialist should be revised on the Act by fulfilling the requirements that are proper to KUHP as the main source of criminal law for other laws.  Juridical Matters on The Act Number 40, 1999 on Press

Abstract

This article discusses the possibility of non-ratifying states to the Rome Statute to be refered to International Criminal Court (ICC) with reference to Sri Lanka, where war crimes and crimes against humanity has been occured. This study employed the doctrinal method to analyze the issue. Sri Lanka is unable to deal with perpetrators who must be responsible for humanitarian conflicts, despite of a sovereign State. This paper found that the United Nations has a responsibility in addressing war crimes and crimes against humanity in Sri Lanka when dealing with war crimes due to its non-ratification of the Rome Statute. Sri Lanka can propose the formation of an Ad Hoc Tribunal to the United Nations, adopting a judge composition inspired by hybrid models used in Sierra Leone and Cambodia. However, the legality of foreign judges must be clarified beforehand.

Abstract

Konversi PT. Bank Aceh berdampak terhadap beberapa perubahan produk perbankan, dan salah satunya adalah peralihan rekening tabungan nasabah. Kendala yang timbul akibat pengalihan rekening nasabah yang berasal dari dana pihak ketiga adalah tidak diketahui lagi keberadaan pemiliknya. Akibatnya status rekening tersebut menjadi rekening pasif. Penelitian ini merupakan penelitian yuridis normatif dan sumber dan jenis data studi kepustakaan yang bersumber pada bahan hukum primer dan bahan hukum sekunder. Analisis data yang digunakan dalam penelitian ini adalah analisis kualitatif. Penyelesaian masalah rekening pasif telah mendapat opini dari Dewan Pengawas Syariah (DPS) PT. Bank Aceh Syariah. DPS memandang Surat Keputusan Direksi PT. Bank Aceh Syariah dapat menjadi landasan yuridis terhadap penyelesaian tabungan pasif nasabah dari dana pihak ketiga yang tidak diketahui keberadaan pemiliknya. Penyelesaian dan status hukum rekening pasif nasabah yang berasal dari dana pihak ketiga menggunakan kerangka hukum mafqud (orang hilang) pada perkara hak milik. DPS memandang bahwa bank dapat mengelola dana pihak ketiga atas rekening pasif, dengan tetap memberikan bagi hasil kepada dana pihak ketiga yang menggunakan akad mudharabah muthlaqah. Legality and Legal Result of PT. Bank Aceh Syariah in Managing Customers Passive AccountConversion of PT. Bank Aceh has had an impact on several changes in banking products, one of which is the transfer of customer savings accounts. The obstacle that arises due to the transfer of a customer's account from third party funds is that the owner is no longer known. As a result, the account status becomes a passive account (dormant account). This research is a normative juridical research and the sources and types of data for library research are primary and secondary legal materials. The data analysis used in this research is qualitative analysis. Passive account settlement has received opinion from the Sharia Supervisory Board (DPS) PT. Bank Aceh Syariah. DPS views the Decree of the Board of Directors of PT. Bank Aceh Syariah as a juridical basis for settling customers' passive savings from third party funds whose owners are unknown. Settlement and legal status of customers' passive accounts originating from third party funds using the Mafqud (missing person) legal framework in property rights cases. DPS views that the bank can manage third party funds on passive accounts, while still providing profit sharing to third party funds using the mudharabah muthlaqah contract.

Abstract

Penelitian ini bertujuan untuk mengetahui tentang implementasi pemenuhan hak bagi penyandang disabilitas di bidang ketenagakerjaan di Kota Semarang berdasarkan Pasal 53 UU No. 8/2016 tentang Penyandang Disabilitas. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris. Hasil penelitian ditemukan bahwa Pertama, implementasi pemenuhan hak bagi penyandang disabilitas di bidang ketenagakerjaan di Semarang belum sepenuhnya berjalan sebagaimana mestinya. Kedua, terdapat beberapa faktor yang menjadikan Pemerintah Kota Semarang belum cukup dalam mengim-plementasi pemenuhan hak bagi penyandang disabilitas ketenagakerjaan di Semarang. Implementation of the Fullfilment of Rights for People with Disability in the Employment in Semarang This study aims to find out examine the implementation of the fulfillment of rights for people with disabilities in the employment field in Semarang based on Article 53 the Law Number 8 year 2016 on People with Disability. This research used empirical juridical method. The results study found that First, the implementation of the fulfillment of rights for disabilities in Semarang has not been fully implemented properly. Secondly, there are several factors that make the Government of Semarang has not properly implemented the rights for people with disabilities in Semarang.
