Abstract

Tujuan pokok setiap pelabuhan, memenuhi kebutuhan para pelanggan pelabuhan. Secara umum, para pelanggan jasa pelabuhan memerlukan fasilitas dan pelayanan untuk kapal, barang, barang, penumpang, dan transportasi darat dapat dilakukan secara efektif dan efisien. Jadi terdapat suatu keterkaitan yang erat antara pelabuhan dan kapal-kapal sebagai pengguna jasanya, karena pelabuhan merupakan lingkungan kerja dimana kapal-kapal dapat berlabuh dengan aman dan murah, terhindar dari bahaya-bahaya yang mengancam kapal yang ditimbulkan oleh gelombang, angin dan sebagainya, dalam melaksanakan kegiatan bongkar barang, hewan dan penumpang. Suatu pelabuhan dapat dikatakan efektif dan efisien apabila kapal tidak menunggu lama di laut, dapat melakukan bongkar muat dengan cepat dan lancar serta didukung dengan fasilitas peralatan atau sarana dan prasarana yang memadai, karena hal tersebut sangat penting bagi perusahaan pelayaran. Sudah menjadi kewajiban pelabuhan untuk menyumbang-kan devisa bagi Negara. Indonesian Ports as a Country Devised in Business Legal Perspective The main goal of each port, meeting the needs of port customers. In general, port service customers need facilities and services for ships, goods, goods, passengers, and land transport can be done effectively and efficiently. Thus there is a close connection between the port and the ships as its service users, since the port is a working environment where ships can be docked safely and cheaply, avoiding the dangers that threaten the vessel caused by waves, winds and so forth, in carry out unloading activities of goods, animals and passengers. A port can be said to be effective and efficient if the ship does not wait long in the sea, can perform loading and unloading quickly and smoothly and supported by facilities equipment or facilities and adequate infrastructure, because it is very important for shipping companies. It is the duty of the port to contribute foreign exchange to the State.

Abstract

ABSTRACT: The exixting of Islamic law regulations are the rule regulated in the sharia law and a small number are found in the decision of the National Sharia Board and in the Indonesia Bank Regulation. In terms of settling the dispute between Islamic bank and its problem, the board applies two different approaches; namely the decision of the board and the Indonesian Civil Law. Therefore, this paper explores the dispute in the Islamic economic law outside the court in accordance to sharia law. The method applied is analysis content from the relevant sources. The non-litigation dispute settlement ruled in the holy book of Quran are very that can be applied in solving the disputes of economy and finance. Abstract

 The community in Batang Hari Regency exploits petroleum without a cooperation contract by drilling a well and then taking the oil contained in the well. This is one of the issues arising from oil and gas mining in Indonesia. This study aims to determine how law enforcement can be used to combat illegal petroleum extraction in Batang Hari Regency. This research employed a descriptive-analytical research design and an empirical legal methodology. According to research findings, the Batang Hari Police in the Batang Hari District implements preventative and punitive law enforcement measures that are quite effective at reducing the number of annual cases. Without a cooperation agreement, these actions target illegal petroleum exploitation. The law in Batang Hari Regency prohibits the exploitation of petroleum without a cooperation contract, which includes difficulty to access sites of illicit oil wells and the participation of individuals.

Abstract

Penelitian ini bertujuan untuk menganalisis Rekrutmen calon Anggota Dewa Perwakilan rakyat, Permasalahan yang timbul adalah bagaimanakah penataan hukum mekanisme rekruitmen calon anggota Dewan Perwakilan Rakyat yang dengan pendekatan teori hukum dan perbandingan hukum. Hasil Penelitian menunjukkan rekruitmen calon anggota legislatif yang dilakukan oleh partai politik tidak melaksanakan amanat undang undang partai politik, dengan dalil bahwa partai politik  tidak mencantumkan  dalam Anggaran Dasar Anggaran Rumah Tangga (AD/ART) partai politik yakni: mekansime rekrutmen bakal calon anggota Dewan Perwakilan Rakyat, adanya ketentun seleksi kaderisasi yang dilaksanakan secara demokrasi, seleksi yang dilakukan secara terbukan, penetapan rekrutmen yang dilakukan oleh pengurus partai politik bahwa Kedaulatan Rakyat atau demokrasi.  Sehigga mekanisme rekrutmen calon anggota Dewan Perwakilan Rakyat cenderung tidak aspiratif. Sebagai perbandingan di beberapa negara rekrutmen dilakukan dengan berdasar pada konstitusi negara masing-masing  memasukkan unsur  aspek usia, kompetensi akademik, agama, kelompok etnis untuk menjadi calon anggota legislatif. Legal Administration of Mechanism Recruitment of Aspiration People's Representatives This study aims to analyze the recruitment of candidates for the House of Representatives. The problem that arises is how the legal arrangement of the recruitment mechanism for members of the House of representatives with a legal theory and legal comparison approach. The results indicate that the recruitment of legislative candidates conducted by political parties did not carry out the mandate of the Law on Political Party, with the argument that political parties do not include political parties' statutes bylaws, namely: recruitment mechanism for prospective members of the House of Representatives, there are provisions for cadre selection which are carried out democratically, open selection, determination of recruitment carried out by political party management that is People's Sovereignty or democracy. So the mechanism for recruiting candidate tends not to be aspirational. For comparison in several countries recruitment is based on the state constitution by including elements of age, academic competence, religion, ethnic groups to become legislative candidates.

Abstract

The research on the arrangement process of spatial planning to keep the environmental function sustainability in Central Java Province is purposed at exploring (1) whether the process of the arrangement of spatial planning has been in accordance with the rules? (2) how is the position of the planning on the sustainability of the environment? (3) how is the participation of people in the arrangement in Central Java Province? This is juridical empirical research by applying secondary and primary data. The data then analysed descriptive qualitatively. The research shows the planning of Central Java between 2003-2018 is not optimal yet as demanded by the rules. It results from lack of attention on integrated principle, sustaionability, transparency and legal protection. Abstract

ABSTRACT: Zona Ekononi Eksklusif (ZEE) merupakan suatu rezim hukum baru yang diatur dalam Konvensi Hukum Laut 1982. Kepada Negara-negara pantai, seperti Filipina dan Indonesia diberikan hak berdaulat di ZEE yang jaraknya 200 mil dari garis pantainya untuk mengeksploitasi dan mengeksplorasi sumber kekayaan alam di laut atau memanfaatkan kekayaan hayati ikan. Dan hanya negara yang bersangkutanlah yang berhak memanfaatkan kekayaan ikan di ZEE, sedangkan negara-negara lain tidak boleh kecuali ada izin. Karena itu diperlukan kerjasama antar negara untuk melindungi dan melestarikan sumber kekayaan alam tersebut, namun perlindungan tersebut kurang diperhatikan oleh negara-negara di kawasan tersebut. Penulisan ini bertujuan untuk mengetahui tentang aspek-aspek yang relevan dilakukan melalui kerjasama antar negara dalam melindungi sumber-sumber perikanan di ZEE dan tentang pengaturan hukum internasional, regional dan hukum nasional dalam mengantifikasi perlindungan sumber-sumber perikanan di ZEE. Dalam kenyataannya perlindungan dan pelestarian sumber-sumber perikanan di ZEE diantara negara-negara ASEAN itu belum berjalan sebagaimana mestinya, meskipun usaha kearah tersebut dilakukan guna pelestarian ikan di laut ZEE. Namun perlindungan tersebut tidak efektif karena banyak kapal, baik dari Indonesia maupun dari Negara  ASEAN lainnya yang menangkap ikan tanpa memperdulikan tentang perlindungan dan pelestarian sumber ikan di ZEE, bahkan banyak kapal ikan asing tersebut menangkap ikan di ZEE Indonesia secara illegal, sehingga unsur kepentingan perlindungan dan pelestarian  sumber  ikan tersebut diabaikan oleh kapal-kapal perikanan tersebut.  The Protection and the Conservation of Fishery Resources in the Economic Exclusive Zone Among the Asean States

Abstract

ABSTRACT: This study aims to identify and explain the venture capital financing as an alternative capital for SMEs, constraints faced by SMEs in order to obtain venture capital financing in Banda Aceh. The data consist of primary and secondary data. The primary data are obtained through interviews with PMV (PT Sarana Aceh Ventura) and SMEs which are the PPU of the PMV. While the secondary data obtained through secondary research by studying books or articles as well as legislations relating to venture capital. The research shows that the distribution of venture capital financing in Banda Aceh is not effective as an alternative capital for SMEs. Financing provided by PMV in practice is equal to bank credit. It is not in the form of capital but in the form of loans that have been specified number of installments of principal and interest and late fees. Abstract

Water Treatment Plant (WTP)companies experience dilemma between the obligation to provide healthy drinking water and the company's limitations in providing water infrastructure. This encourages state water companies to collaborate with the private sector to procure infrastructure. This study raises issues related to the concept of state control over water and its implications for cooperation schemes for drinking water supply, as well as the legal aspects of cooperation in the management of drinking water treatment plants. This study uses normative research method with statute and conceptual approach. The result shows that considering the status of state water companies are subject to public finance accountability, that parties must design and implement the cooperation with due care, that is the principles of good corporate governance. This principle remains difficult to implement as many challenges facing. Hence the more efforts and cooperation with associated stakeholders should be taken into account.

Abstract

Penelitian ini bertujuan untuk mendeskripsikan penemuan hukum oleh hakim di Indonesia dengan kajian paradigma konstruktivisme. Ajaran legisme sangat kuat di Indonesia yang mempengaruhi para ahli-ahli hukum, akademisi, dan penegak hukum termasuk hakim. Pasca-Indonesia merdeka, terdapat ketentuan peraturan perundang-undangan yang mewajibkan hakim untuk menggali nilai-nilai hukum dan keadilan yang hidup dalam masyarakat. Ontologi paradigma konstruktivisme adalah relativis, realisme memiliki konstruksi mental yang beragam di antaranya korban, pelaku, saksi, tokoh masyarakat, jaksa penuntut umum, dan termasuk hakim. Epistemologi paradigma konstruktivisme adalah transaksional dan subjektif. Peran hakim dan objek perkara terhubung secara interaktif sehingga hasil putusan dibuat saat proses persidangan berlangsung. Metodologi paradigma konstruktivisme adalah hermeneutis dan dialektik. Konstruksi mental hakim serta objek perkara ditafsirkan menggunakan teknik herme-neutikal/penafsiran untuk menghasilkan putusan berupa konsensus atau resultante. Dengan demikian para hakim harus menggunakan paradigma konstruktivisme untuk menciptakan putusan yang memenuhi rasa keadilan masyarakat. Rechtvinding by Judge Based on the Constructivism Peradigm  This study aims to describe the rechtsvinding by judges in Indonesia. Many people are influenced by the flow of legism, they are legal experts, academics and law enforcement including judges. However, there is an Act for judges must explore the values of law and justice in society. Then there are three questions in the constructivism paradigm; (1) the Ontology is a relativist, it means that realism has a variety of mental constructs including victims, perpetrators, witnesses, the public figure, prosecutors and judges. (2) The epistemology is transactional and subjectivist. It means that the role of the judge and the object of the case are interactively connected. (3) The methodology is hermeneutical and dialectical. The mental construction of the judge using interpretation to produce a decision in the form of consensus or resultant. Thus, the judge must use a constructivism paradigm to create decisions that justice of the community.

Abstract

This article aims to explore the fulfilment of males’ prisoner rights at the Correctional Service Centre Banda Aceh. The indicators used to measure it are registration process, accommodation, sanitary facilities, clothes and beds, sport, health service, abuse by the guards, interaction with outside, worship facilities, case information, complain of prisoners, workshop, education and prisoners’ separation. The research reveals that the availability of clothes and beds, health service, education and prisoners’ separation at the centre are not maximally provided yet at the centre. The Fulfilment of Males’ Prisoner Rights at the Banda Aceh Correctional Service Centre
