Abstract

Penelitian ini bertujuan untuk menjawab bagaimanakah implementasi Qanun tentang Taman Pendidikan Al-Quran di Kabupaten Simeulu. Apakah yang menjadi kendala yuridis dan sosiologis pemerintah kabupaten dalam melaksanakan qanun tersebut? Qanun ini memerintahkan agar pemerintah kabupaten membangun Taman Pendidikan Al-Quran pada setiap desa. Pemerintah kabupaten juga diperintahkan agar dibangun sarana dan prasarana yang refresentatif. Dengan menggunakan penelitian yuridis empiris, kajian ini menunjukkan bahwa implementasi dari perintah Qanun Nomor 31 Tahun 2012 belum terealisasi dengan baik, karena pembangunan Taman Pendidikan Al-Quran hanya sebagian kecil desa saja. Perintah pembuatan peraturan bupati juga belum terlaksana. Terdapat beberapa kendala tidak jalannya perintah dari qanun tersebut, antara lain peraturan bupati belum dibuat karena ketidaksiapan peraturan yang menjadi acuan dalam menjalankan qanun itu. Tidak adanya kepastian honorarium para tenaga pengajar, menjadi satu kendala tersendiri, sehingga menjadi penyebab tidak jalannya Taman Pendidikan Al-Quran yang sudah ada sebelumnya. The Implementation of Qanun Regarding Taman Pendidikan Al-Qur’an In Simeulue District  This study aims to determine the implementation of the Qanun on Al-Quran Education Park in Simeulu District. Will the existence of the qanun create juridical and sociological obstacles in its implementation? This Qanun ordered the district government to build Al-Quran Education Parks in each village and build representative facilities and infrastructure. This research uses empirical juridical methods. The results showed that the implementation of the Qanun No. 31/2012 had not been realized properly, because the construction of the Al-Quran Education Park was only in some villages. The order to make regents' regulations also has not been implemented. There are several obstacles in the non-functioning of the qanun, including the absence of a regent regulation which will become a reference in implementing the qanun. The lack of certainty in funding for teaching staff is also an obstacle in running the Al-Quran Education Park.

Abstract

ABSTRAK. Tulisan ini dimaksudkan untuk mengidentifikasi, menjelaskan dan menganalisis ketentuan perundang-undangan yang mengatur kewenangan pemerintah daerah dalam penyelesaian sengketa tanah. Untuk mendapatkan data bagi kepentingan penulisan ini dilakukan penelitian kepustakaan, dengan cara menelaah ketentuan perundang-undangan dan literatur yang relevan. Hasil penelitian menunjukkan bahwa ketentuan yang secara khusus menentukan kewenangan pemerintah daerah dalam bidang penyelesaian sengketa tanah  terdapat dalam Keppres Nomor 34 Tahun 2003 tentang Kebijakan Nasional Dibidang Pertanahan dan dalam Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Berdasarkan ketentuan tersebut pemerintah daerah berwenang; (a) penyelesaian sengketa tanah garapan; (b) penyelesaian masalah ganti kerugian dan santunan tanah untuk pembangunan; (c) penyelesaian masalah tanah ulayat; dan (d)  penyelesaian masalah tanah kosong. The Authority of Legal Government in Solving Land Dispute  ABSTRACT. This research aims to identify, explain and analyse the rules regulating the authority of local government in settling land dispute. In order obtain data library research is conducted by exploring relevant rules and literatures. The research shows that the special rule regulating the authority of local government in settling land dispute ruled in the Presidential Decree Number 34, 2003 on National Policy on Land and the Act Number 23, 2014 on Local Government. Based on these, the local government is eligible to: (a) settling the cultivating land, (b) reparation and remedy for land used for the development, (c) customary land dispute, and (d) unoccupted land.

Abstract

ABSTRAK: Artikel ini ingin menjawab hal yang menjadi pertimbangan yang diberikan Badan Pertimbangan Jabatan dan Kepangkatan kepada Bupati bagi Aparatur Sipil Negara yang akan diangkat dalam jabatan struktural. Selain itu, hal lain adalah keterlibatan badan ini dalam melakukan seleksi Aparatur Sipil Negara yang akan diangkat dalam jabatan struktural. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis-normatif. Hasil penelitian menunjukkan bahwa peran dari Badan Pertimbangan Jabatan dan Kepangkatan dalam mengangkat atau memilih pegawai negeri yang akan diangkat dalam jabatan struktural adalah hanya sebatas wewenang urusan menyeleksi administrasi. Badan ini tidak terlibat dalam pengambil keputusan akhir, akan tetapi hanya melakukan tugas administrasi untuk diajukan kepada kepala daerah terkait pegawai negeri yang akan menduduki jabatan struktural. Artikel ini menyarankan agar kepala daerah mengikutsertakan Badan Pertimbangan Jabatan dan Kepangkatan dalam urusan pengambilan keputusan. Official Consideration Body Authority and Official Ranking in Fulfilling Structural Position ABSTRACT: This article is going to answer the consideration given by the Office of Official Rank Consideration and Duty to the Head of District for civil servants who will be appointed in the official ranks. In addition, it also explores the involvement of this body in the selection of the State Civil Apparatus to be appointed in structural positions. This is juridical-normative research. The findings show that   the role of the Office of Official Position Consideration and Duty in appointing or choosing a civil servant who will be appointed in a structural position is only limited to the authority of administrative process. This body doe not involve as the final decision-maker, it only performs the administrative duty to be submitted to the head of the region related to the civil servant who will occupy the structural positions. It is recommended that the head of the region should include the Office the decision making process.

Abstract

The purpose of this study was to find out the application of the reasons for the elimination of criminals in cases of corruption. The results of this study are case number: 87/Pid.Sus/2010/PN.Mrb, which was strengthened in the Supreme Court's Cassation decision number: 321 K/Pid.Sus/2011, was wrong in applying the excuse of forgiveness as the reason for eliminating the crime in its legal considerations, where the element of forgiving reason applied by the Panel of Judges was not fulfilled, but the justifying reason should be applied because one of the elements of Article 3 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning the eradication of criminal acts of corruption was not fulfilled because it relied on legal facts and expert testimony without mentioning in detail and with certainty who was benefited from the act, so the implication in this case is that the defendant should be acquitted (vrisjpraak).

Abstract

Artikel ini ingin menjawab bentuk perlindungan hukum bagi pasien selaku konsumen pemanfaat pelayanan medis dan tanggung jawab rumah sakit dan dokter selaku pihak pelayanan medis. Dalam pelayanan kesehatan, tidak jarang mengakibatkan malpraktik akibat kelalaian yang dilakukan oleh tenaga kesehatan yang tidak sesuai dengan standar profesi. Metode yang digunakan adalah penelitian hukum yuridis normatif, pendekatan yang digunakan adalah pendekatan undang-undang dan pendekatan kasus. Dalam Putusan No.287/PDT.G/BTH/2011/PN.JKT.PST terdapat 5 (lima) hak konsumen yang diabaikan oleh pelaku usaha menurut Undang-Undang Perlindungan Konsumen, khususnya Pasal 4 butir (a), (c), (d), (e), (g), dan (h). Mengenai tanggung jawab yang diberikan pelaku usaha terhadap konsumen sebesar Rp 1.776.010.000,00 dan dalam Pasal 19 ayat (2) Undang-Undang Konsumen hanya mengenal ganti kerugian materiil saja. Consumer Protection for Patients as the Utilization of Medical Services In health services, it often results in malpractice due to negligence by health workers who work not in accordance with professional standards. So that raises the question of how the form of legal protection for patients as consumers of medical services and the responsibilities of hospitals and doctors as medical services. The method used is normative juridical legal research, the approach used is a legal  (statute approach) and a case study approach.  In Decision No.287 / PDT.G / BTH / 2011 / PN.JKT.PST, there are 5 (five) consumer rights which are ignored by business actors according to Law Number 8 of 1999 concerning Consumer Protection, namely Article 4 point (a), (c), (d), (e), (g), and (h). Regarding the responsibility given by business actors to consumers in the amount of Rp. 1,776,010,000.00 and in Article 19 paragraph (2) of the Consumer Protection law only recognizes material compensation.

Abstract

ABSTRAK. Status Aceh sebagai daerah istimewa dan daerah khusus yang diatur dalam undang-undang tersendiri memiliki implikasi pada kewenangan yang dimilikinya. Aceh memiliki kewenangan yang melebihi dan berbeda dengan kewenangan yang dimiliki provinsi lain di Indonesia. Artikel ini ingin membahas dinamika pembentukan regulasi turunan Undang-Undang Pemerintahan Aceh yang memberi kewenangan besar terhadap Aceh. Dari pembahasan dapat diketahui sejumlah hambatan, yakni undang-undang yang tidak diterapkan, ada pembatalan sejumlah pasal oleh Mahkamah Konstitusi, dan ketentuan sektoral yang mengenyampingkan Undang-Undang Pemerintahan Aceh. Dynamics of Formation of Derivatives Regulation the Law on Government of Aceh ABSTRACT. Aceh status as a special area and special areas set out in separate legislation has implications on its authority. Aceh has authority over and the authority is different from other provinces in Indonesia. This article wants to discuss the dynamics of the formation of derivatives regulation Law on Governing Aceh which gives great authority to Aceh. From the discussion can be seen a number of obstacles, the laws are not implemented, there is a cancellation of a number of articles by the Constitutional Court, and the provision of sectoral disregard the Law on Government of Aceh.

Abstract

ABSTRACT: This research to present whether economic democration as Stated in the 1945 Constotution, Article 33, has been able to be operationalized in to the Qanuns of Aceh for developing production athmosphir. This research refers secondary data, such as primary, secondary, tertiary resources. However emperical data was also used for quiding analysis of the research. Research finding shows that the effort of developing production athmosphir in case of the special authonomy in Aceh through regional and procedures regulation was not effectively achieved. This was indicated by unability of Aceh Government in constructing legislations product either for implementing obligation affairs or section of choices as there were mentioned in law Number 11, 2006 on Government of Aceh. Abstract

ABSTRACT: Aceh Taxation is one of the regional revenues in terms of financing Aceh’s Autonomy. A way that can be achieved in increasing the revenue is by intensifying object and subject of regional taxes. Theoretically and based on the experience in collecting it, the imposition of higher tax, is not always resulting in maximal revenue. It is better by the model of Leviathan that becomes a consideration of Aceh Governance in collecting it. The model tells that the improvement of the tax should not be obtained by burdening higher tax but by the lower one and it is combined with the intensification of subject and object of the tax in order to get maxmimal revenue. The tax is based on Qanun (Aceh’s Local Law) Number 2, 2012 that has imposed progressive rate, especially for vehicles. Meanwhile, other taxes apply proportional rate. The number of rate applied is lower that the highest rate allowed by the Act Number 28, 2009. Abstract

This paper presents a comprehensive analysis of the legal principles that govern the process of worker layoffs and the corresponding legal framework required to regulate such actions during economic crises. The study adopts a normative juridical approach, and the findings highlight the key legal principles that underpin employee terminations and form the basis of legal dogmatics. These principles include clarity, fairness, balance, empowerment, nationality, utility, non-discrimination law, and family principles. Furthermore, the regulatory framework governing employment termination should encompass a minimum set of legally mandated components. These components include clearly defined grounds for termination, prerequisites for initiating the process, procedural steps to be followed, a prescribed time limit for completion, normative entitlements of affected workers, and the implementation of online-based oversight mechanisms. Establishing regulations on employee termination in response to the global economic crisis is of utmost importance. These regulations should incorporate a baseline of legal principles and minimum legal requirements. It is recommended that governmental and legislative entities include provisions for employee terminations within the framework of the Labour Law.
