Abstract

Agrarian reform is a strategic policy to create equitable distribution of land tenure and people's welfare. Land Redistribution Object Agrarian Reform (TORA) is the main instrument to overcome inequality in land tenure. This policy aims to provide legal certainty for land recipient communities and encourage productive and sustainable land use. However, in its implementation, there are still various obstacles, such as land disputes, uncertainty about the status of land laws, and a lack of policy synergy between the central and regional governments. Based on this description, the purpose of this study is to examine the implementation of asset structuring through TORA redistribution in providing legal certainty for Agrarian Reform subjects and to find out the legal protection of ownership for Agrarian Reform subjects whose land objects are problematic as reviewed from Presidential Regulation Number 86 of 2018 or Presidential Regulation Number 62 of 2023. The research method used is normative juridical with a legal approach and case studies located in Ngargosari village, Kendal Regency and Pagerwangi Punclut village, West Bandung Regency. The data collection technique was carried out through literature studies and interviews with the local Land Office. The data analysis method uses qualitative normative analysis. The results of the study show that legal certainty on TORA redistribution in Indonesia already exists. However, in its implementation, there are still several obstacles, especially in the lack of transparency in the redistribution process and the lack of supervision over the implementation of the TORA redistribution policy. In addition, legal protection for the subject of Agrarian Reform is still not optimal. Therefore, concrete steps are needed to ensure that the land objects distributed are free from disputes, the priority resolution of land conflicts, and the improvement of legal assistance and inter-institutional coordination to ensure legal certainty and protection for the subject of Agrarian Reform.

Abstract

Class 2 obesity is a condition characterized by a body mass index (BMI) ≥ 30 and is associated with a high risk of non-communicable diseases such as diabetes mellitus, hypertension, and cardiovascular disease. This study aims to explore the factors influencing weight loss Intention among individuals with type 2 obesity, using the framework of the Theory of Planned Behavior (TPB). A qualitative case study approach was employed, focusing on subject “D,” a 30-year-old adult male weighing 150 kg. Data were collected through in-depth interviews and analyzed based on the TPB components: Attitude toward the Behavior, Subjective Norms, and  Perceived Behavioral Control. The findings reveal that although D possesses knowledge regarding the benefits of weight loss and receives support from his family, economic pressures and job instability serve as major barriers to forming a clear Intention to lose weight. Subjective Norms paradoxically contribute to psychological stress, while D’s  Perceived Behavioral Control is undermined by the necessity to prioritize job-seeking efforts. These results indicate that Intention is influenced not only by internal motivation but also by the individual’s broader social and economic context.

Abstract

This study discusses the blocking of a foreign e-commerce platform called the 'X' application from China by the Indonesian Government in October 2024. The blocking was carried out as a form of protection for Micro, Small, and Medium Enterprises (MSMEs) affected by the predatory pricing practices of the application. The problems discussed are whether this policy really protects MSMEs and how this policy is reviewed from the principle of National Treatment in international trade law. The method used is normative juridical with a regulatory analysis approach. The results of the study show that the blocking policy has a legal basis through PP No. 71 of 2019 concerning PSTE and PP No. 80 of 2019 concerning PMSE. The government does not discriminate against the 'X' application because the rules apply equally to all business actors. A similar case occurred with TikTok Shop which was blocked for making indirect sales without representatives in Indonesia. TikTok was only allowed to operate again after complying with regulations, including acquiring most of Tokopedia's shares and moving transactions to official e-commerce.

Abstract

The School Literacy Movement (GLS) program is a government initiative aimed at developing character and shaping students' characters through cultivating a literate ecosystem. This program is implemented in a participatory manner at all levels of primary and secondary education, and is based on Permendikbud Number 23 of 2015 to increase interest and awareness of literacy among students. This study aims to describe the implementation of GLS in Padang Panjang City with a focus on four schools: SDN 03 Padang Panjang Timur, SMPN 1 Padang Panjang, SMAN 1 Sumatera Barat, and SMKN 1 Padang Panjang. This study uses a descriptive qualitative approach with informants selected purposively. Data were collected through in-depth interviews, observations, and document studies. The analysis uses Pierre Bourdieu's theory of habitus, capital, and arena. Habitus refers to the literacy habits of teachers and students that influence program acceptance, while various forms of capital economic (BOS and DAK funds), symbolic (achievements, facilities), social (external cooperation), and cultural are supporting factors for GLS implementation. The results of the study showed differences in approaches between levels of education. At the elementary school level, literacy is implemented through the learning while playing method. Meanwhile, junior high schools and senior high schools/vocational schools are more varied in activities, such as strengthening the role of libraries, reading corners, wall magazines, literacy competitions, the formation of literacy teams, and the use of digital technology. The success of the program is highly dependent on the commitment and collaboration of all elements of the school. Keywords: Program Implementation, Literacy, School Literacy Movement (GLS)

Abstract

This study aims to analyze the civil legal liability of hospitals in delivering healthcare services to patients, especially in cases of negligence or violations of medical service standards. A normative juridical approach is employed, utilizing statutory regulations, legal doctrines, and court decisions as primary data sources. The results show that hospitals may be held civilly liable on the grounds of breach of contract or tort, either directly or vicariously for the actions of medical personnel. Provisions in the Indonesian Civil Code, Law No. 36 of 2009 on Health, and Law No. 44 of 2009 on Hospitals serve as the main legal basis in assessing hospital obligations. Legal protection for patients must be strengthened through regulatory oversight and increased legal awareness within healthcare institutions.

Abstract

This research aims to analyze the concept of justice in healthcare services from a legal perspective, both normatively and practically, with a focus on the implementation of the National Health Insurance (JKN) program and the involvement of private hospitals as partners of BPJS Kesehatan. The study uses a normative approach with a case study. The findings show that although existing regulations contain the principles of justice and the right to health services, in practice there are still disparities in treatment between JKN and non-JKN patients, as well as weak legal protection for partner hospitals. This indicates a legal imbalance among the state, healthcare providers, and insurance participants. Therefore, policy reform is needed to affirm justice not only for patients but also for healthcare providers.

Abstract

This article aims to examine the legal and ethical dilemmas in managing psychotic patients who are at risk of committing violence. The research approach used is normative juridical with literature analysis and comparative study. The findings indicate a tension between the protection of patients' human rights and the need for public safety. This study recommends the importance of revising legal policies and strengthening coordination between the health and legal sectors in handling high-risk psychiatric patients.

Abstract

Mental health services in hospitals pose complex legal and ethical challenges, particularly in safeguarding the rights and safety of patients with psychiatric disorders. Incidents involving self-harm or harm to others during hospitalization raise critical questions about institutional accountability. This study adopts a normative and juridical approach to examine the legal responsibilities of hospitals—civil, administrative, and criminal—under Indonesian legal frameworks, notably Law No. 18 of 2014 on Mental Health and Ministry of Health Regulation No. 54 of 2017. Through the analysis of legal doctrines and selected case studies, the findings reveal structural weaknesses in the implementation of psychiatric care, including limited human resources, inadequate medical documentation, and insufficient adherence to standard operating procedures. These issues significantly hinder the effectiveness of legal protection for psychiatric patients. This paper underscores the urgent need for regulatory harmonization, improved oversight mechanisms, and capacity building among healthcare providers to ensure the delivery of humane, accountable, and legally compliant mental health services.

Anxiety is often experienced by most people, especially in adolescence, when individuals are in a new social environment or are in a social environment that is different from the social environment in which the individual is usually located. above opinion, the formulation of the problem in this study is how is the Relationship Between Self-Esteem and Anxiety in Adolescents of SMP AL - WASHLIYAH. So the objective obtained in this study is how is the Relationship Between Self-Esteem and Anxiety in Adolescents of SMP AL - WASHLIYAH Medan. The approach used in this study is a qualitative approach. A qualitative approach is a research procedure that produces descriptive data in the form of written or spoken words of people and observable behavior. A qualitative approach has natural characteristics (Natural serfing) as a direct source of data, descriptive, the process is more important than the results. So it can be concluded that the two variables are correlated or there is a relationship. Furthermore, from the results of the correlation test, it is known that in this study the correlation between self-concept and social anxiety has a Pearson correlation value of -0.534. This shows that there is a negative relationship between the self-concept variable and social anxiety, which means that the higher the self-concept of the subject, the lower the social anxiety he has, and vice versa.

Abstract

Interpretation of the Regulation of the Minister of Health concerning the Prevention of Fraud in National Health Insurance, known by the abbreviation JKN, is a government program that aims to provide access to health services to all levels of society. replacing Permenkes 36/2015 which requires additional evaluation and research. during implementation. there is a risk of fraud In the implementation of JKN which has not yet achieved the expected results, it has also been proven that it has not been monitored by the Fraud Monitoring Group as mandated by Regulation of the Minister of Health No. 16 of 2019. Regarding this, the article further examines Government Regulation No. 16, 2019 and the search for alternative regulatory options To ensure that its implementation can run smoothly. Analyze how to utilize legal provisions, especially statutory provisions.
