Abstract

The establishment of a civil partnership among notaries, governed by Article 20 of Law No. 2 of 2014 amending Law No. 30 of 2004 on Notary Position, introduces new dynamics to notarial principles, particularly the principles of independence and confidentiality outlined in Article 16 of the same law. This development raises concerns about potential disharmony, as forming a Notary Association could compromise notarial independence. When multiple notaries operate within one association, they may find it challenging to maintain the requisite impartiality and confidentiality specified by law. Upon analyzing these issues, several conclusions emerge. Firstly, the regulations governing notary civil partnerships appear sufficient and compatible with the core principles of notarial practice. Notaries are obligated to conduct themselves professionally, adhering strictly to legal statutes and the ethical code of notaries, which stress independence and confidentiality. Hence, while engaging in civil partnerships as permitted by Article 20, notaries must uphold these moral and legal standards, ensuring their activities remain in alignment with the law and ethical guidelines. Secondly, the formation of notary civil partnerships has implications for maintaining the principles of independence and confidentiality. The essence of a notary's independence as a public officer is critical, encompassing structural, functional, and financial independence. Any association among notaries could potentially undermine these fundamental principles, as notaries may face challenges in preserving their autonomy and impartiality when operating within a partnership structure. The legal framework stipulating notarial responsibilities emphasizes the necessity for notaries to operate independently, free from external influences. In summary, while Article 20 allows for notarial civil partnerships aimed at enhancing service delivery to the public, it necessitates careful adherence to the principles of independence and confidentiality integral to notarial duties. The challenge lies in balancing the benefits of collaboration with the imperative of maintaining the integrity and autonomy of the notarial function as prescribed by law.

Abstract

To achieve nationwide land registration in Indonesia, despite regulatory support, systematic challenges persist in expediting the process known as Complete Systematic Land Registration (PTSL). These hurdles may impede the fulfillment of the mandate outlined in Article 19(1) of Law No. 5 of 1960. The research conducted is of a normative legal nature, focusing on legal norms, aligning with Peter Mahmud Marzuki's definition of legal research as inherently normative. The findings on Complete Systematic Land Registration in the Tapin Regency Land Office Area indicate that unregistered land owners face uncertainty and lack legal protection until their land is officially registered. Although Indonesia's land registration publication system allows for objections or lawsuits, legal certainty and protection are only guaranteed post-registration. The government aims to enhance certainty and protection through the PTSL program, emphasizing the importance of land certificates. However, despite serving as legal evidence of ownership, these certificates are not absolute in legal proceedings and can be subject to civil, criminal, or administrative challenges due to Indonesia's adversarial land registration system.

Abstract

One of the authorities given to a notary as a public official is to create authentic deeds, in addition to other powers determined by law. According to Article 1868 of the Civil Code, an authentic deed is one made by an authorized official in a form specified by law. Both notaries and PPAT (Land Deed Officials) have the authority to create land deeds in accordance with applicable regulations. They play crucial roles and bear significant responsibilities in property transactions, ensuring the validity and legal force of these documents. This research employs a normative legal research method, which examines legal norms. The author aligns with Peter Mahmud Marzuki's view that legal research, or Dutch *rechtsonderzoek*, is inherently normative. Legal research involves searching for and uncovering hidden truths. Based on the discussion, and referring to the source of authority for Notaries through Article 15 paragraph (2) of UUJN, a Notary's authority in creating land deeds should be considered attribution or genuine authority. However, in practice, Notaries cannot make land deeds in the same manner as PPAT because PPAT is a partner of BPN (National Land Agency), posing the biggest limitation for Notaries in creating land deeds. For a Notary to create a land deed, they must hold the same position as a PPAT and obtain permission as a PPAT. Among the eight types of land deeds mentioned in Article 2 paragraph (2) of Government Regulation Number 37 of 1998 concerning PPAT Position Regulations, deeds that can be made by a Notary include, among others, the Deed of Sale and Purchase Agreement and the Deed of Power of Attorney to Sell, with the object being land, and the Power of Attorney to Encumber Mortgage Rights (SKMHT). These deeds may be made by a Notary, but their creation must adhere to the laws and regulations governing each position.

Abstract

The aim of the research is to determine the role of panels and the Appellate Body in resolving disputes at the WTO. The research method used in this paper is a research method with a normative juridical approach with descriptive-analytical research specifications. The dispute resolution mechanism in the WTO involves five main stages. The first stage is consultation, where the disputing countries try to resolve the problem directly. The second stage includes settlement efforts through good services, conciliation and mediation. The third stage is the establishment of a panel, where independent experts examine the dispute and prepare a report. The fourth stage is the appeals process, where the appeals body reviews the panel's decision if there is an appeal. The final stage is the implementation of the decisions and recommendations issued. The panel is formed within approximately 90 days of the application, consisting of independent experts selected by the DSB. The panel works based on the Terms of Reference (ToR) which regulate the procedures for resolving disputes and is tasked with carrying out an objective assessment of the problems faced, assisting the DSB in making recommendations. If consultations fail, the aggrieved country can request the formation of a panel from the Dispute Settlement Body (DSB). If the panel fails to reach a solution, they must submit a written report to the DSB. This process ensures dispute resolution within a certain time period to ensure legal certainty. In addition, there is an appeal mechanism through the Appellate Body which consists of seven international trade law experts. The appeal process must be completed within 90 days, and the Appellate Body report is final and must be adopted by the DSB.

Abstract

Bullying has become a phenomenon that has garnered global attention due to its negative impact on individual well-being. Particularly, the development of technology and the penetration of social media have expanded the scope of bullying, including at Gereja Bethel Indonesia (GBI) in Cambodia. This research aims to understand the role of teenagers in preventing bullying on social media, focusing on their contributions in finding solutions quietly. The study uses a qualitative approach with in-depth interviews with several active teenagers on social media platform X from the GBI Cambodia community. The research employs the concept of the Spiral of Silence. The findings indicate that GBI Cambodia teenagers play a crucial role in identifying, understanding, and responding to bullying on social media platforms. The study shows that church teenagers initially tend to feel afraid or hesitant to express opinions on bullying prevention due to their perception as a minority group. However, through interactions on social media platform X, some members of this minority group have managed to break the spiral of silence by courageously voicing their opinions. The results of this research provide valuable insights into the role of teenagers in combating bullying on social media. Practical implications include the need for a collaborative approach between teenagers, families, churches, and other relevant parties to develop effective solutions. Additionally, this study contributes theoretically to the understanding of how teenagers can become agents of change in fighting bullying in a digital context.
