Abstract

The application of the concept of convenience triggers risks in Sharia KPR financing, such as problems with financing, cancellation of financing, delays in payment of material debts, delays in handing over buildings, and the risk of differences in land size. This qualitative field research aims to identify risks analyze the risk assessment of Sharia home ownership financing, the factors causing risk, and the risk management process in Sharia home ownership financing at Griya As-Sakinah PT Housing. Sabab Podho Moro Madiun. The data collection techniques used are observation, interviews, and documentation techniques. Researchers interviewed the developer (Director, Marketing Manager, Development Manager, Marketing Staff, Financial Administration Staff, Warehouse Administration Staff, and Engineering Team) and 3 (three) Griya As-Sakinah PT Housing users. Sabab Podho Moro Madiun. This research uses data analysis with an inductive method. The research results show Sharia house ownership financing at Griya As-Sakinah PT Housing. Sabab Podho Moro Madiun experiences several risks, namely financing risk, liquidity risk, operational risk, and compliance risk. Risk assessment of Sharia home ownership financing at Griya As-Sakinah PT Housing. Sabab Podho Moro Madiun is ranked 4th, namely high-fair—factors causing financing risks at Griya As-Sakinah Housing PT. Sabab Podho Moro Madiun comes from the developer (internal management processes, HR, and cash flow), and factors from the user (profitability, prospects, character, capacity, and user condition). The process of implementing risk management in PT. Sharia homeownership financing. Sabab Podho Moro has not fully implemented the risk management stages. The developer prioritizes the concept of flexibility and the principle of kinship towards users.

Abstract

The understanding of waqf is not evenly distributed among the people, especially regardingwaqf and types of waqf, productive management of waqf land assets is not yet optimal, naziris not professional. Waqf management is closely related to Nadzir's ability to manage. Inorder to expedite the management of cash waqf which is still quite unfamiliar to thecommunity, it is necessary to increase both knowledge and management. The research in thispaper aims to determine the cash waqf management organization in Islamic Boarding SchoolTazakka, to find out cash waqf management products in Islamic Boarding School Tazakka andto find out the impact of cash waqf management on Islamic Boarding School Tazakka. Thisresearch is a type of field research using a qualitative approach. Data obtained with primaryand secondary data. The results of this study. First, there is the management of cash waqf atthe Tazakka Modern Islamic Boarding School, Batang City. The management model atPondok Modern Tazakka is generally the same as other institutions, namely the wakif handsover his assets to the nadzir to be managed and then the wakif receives a cash waqf certificate.The management is seen from six aspects, namely the use of cash waqf, cash waqfmanagement team, waqf instruments, cash waqf limits, Islamic financial institutions andcash waqf certificates. The two types of waqf that are applied in Islamic Boarding SchoolTazakka is easily accepted in society. The three have an impact on the development of Islamicboarding schools and community acceptance

Abstract

Based on the Magetan Religious Court Decision Number 716/Pdt.G/2021/PA. Mgt, whohanded down the verdict, said one of the reasons was to impose a living on the husband. Thedecision is contrary to Article 149 of KHI, which states that the wife who filed for divorcedoes not get a living because the wife is considered nusuz. This research was conducted witha qualitative approach where the data source was taken from direct interviews with theMagetan Religious Court Judge and the Magetan Religious Court decision. The researchresults were described descriptively using words. The results of this study are the basis forconsideration in deciding case Number 716/Pdt.G/2021/PA. Mgt based on the SupremeCourt Circular Number 3 of 2018, the wife in a divorce case can be given mut'ah and iddahas long as it is not proven nusuz and in its proof that it is not proven that the Plaintiff hascommitted nusuz to the Defendant so that the Panel of Judges grants the Plaintiff's claimand in determining the amount of income that the amount of mut'ah is adjusted to theetiquette and ability of the husband so that it does not occur the judgment not executed wasdue to the incompetence of the Defendant. The panel of judges adheres to the progressive legalparadigm and has the courage not to want to mouthpiece the law. This reflects thecharacteristics of progressive law, namely the Judge's decision to follow the situation andcondition of thePlaintiff.

Abstract

This research is motivated by the Decree of the Minister of Religion of the Republic ofIndonesia Number 892 of 2019, concerning Web-Based Simkah in the Digital MarriageCard service system following the PMA Circular Letter of the Director General ofIslamic Community Guidance Number B-2361/Dt.III/PW.01/07/2021 concerningCards Digital Marriage. This research aims to describe the application of the Web-BasedMarriage Management Information System orSimkah Web in the Digital MarriageCard service system in KUA Pitu District, Ngawi Regency, and its effectiveness. Themethod used in this research is a descriptive method with a qualitative approach, namelyresearch that seeks to reveal and interpret a developing phenomenon. The researchresults show thatSimkah Web in KUA Pitu District, Ngawi Regency, has beenimplemented but is still hampered, especially regarding the readiness of KUA humanresources. In several cases, people found difficulties using this application, including thecomplexity of inputting marriage data in printing Digital Marriage Cards. Thus, it canbe concluded that the implementation ofSimkah Web has helped make it easier for theKUA to collect marriage data throughout Indonesia. However, it is still not fullyimplemented effectively by the community as a basis for printing Digital MarriageCards in the KUA of Pitu District

Abstract

This research was motivated by the increasing number of requests for marriage dispensation atthe Ponorogo Religious Court after the enactment of Law no. 16 of 2019. This law is expectedto provide a major transformation in efforts to prevent early marriage with all its derivativesocial problems. This field research using a qualitative approach produced two conclusions,namely: (1) in terms of the factors causing the increase, Law Number 16 of 2019 has not beeneffective. The data that has been analyzed shows that apart from the same causal factors as thecausal factors before the existence of Law Number 16 of 2019, such as being pregnant out ofwedlock, having given birth to a child, parents are worried that their children will fall intothings that are prohibited by religion, low economic conditions, poor education. low, there is anew causal factor, namely public ignorance about the increase in the marriage age limit. If werefer to the definition made by Soejono Soekanto, the law is said to be effective if it is able toachieve its objectives and (2) Judges as law enforcers in handling marriage dispensation casesare guided by existing regulations and are deemed to have been effective in implementing LawNumber 16 of 2019 in the Religious Courts. The judge has taken action in the form of giving adecision based on the law and actual factual circumstances. Considerations in the determinationrefer to existing regulations, especially Law no. 16 of 2019.

Abstract

Tokopedia is an e-commerce that has a gold investment feature, namely Tokopedia Gold,which collaborates with Pegadaian. Tokopedia is the most popular e-commerce in Indonesiawith the number of monthly web visitors reaching 147.8 million in the second quarter of 2021beating other e-commerce. Tokopedia Gold Pegadaian uses a cash & wadi'ah sale andpurchase contract. Since the Tokopedia Emas feature was launched in 2018, the trend ofbuying gold transactions at Tokopedia has increased by almost 30 times, even though thespread of Tokopedia Gold, which works with Pegadaian, is 4.5% higher than direct goldinvestment at Pegadaian Digital, which is around 3%. It is necessary to know what are thefactors that influence consumer behavior in deciding to choose digital gold at Tokopedia. Thisresearch is a qualitativeresearch. Data collection techniques through interviews, observation,and documentation. Analysis with the theory of consumer behavior. The purpose of this studyis to analyze the mechanism of digital gold investment, to analyze the factors that influenceconsumer behavior in investing in digital gold, and to analyze the impact of digital goldinvestment in Tokopedia on consumer behavior. The results of the study show that the digitalgold investment mechanism influences consumer behavior because it is quite easy andpractical from the choice of product, brand, dealer, time of purchase, purchase amount, andpayment method. Factors that influence consumer behavior, namely consumer psychologicalfactors, are the most influential in investing in digital gold at Tokopedia. Then culturalfactors have a fairly good influence, but social and personal factors have little influence. Aswell as investing in gold has both positive and negative impacts, the many conveniencesoffered, especially attractive promos, make consumers satisfied making purchases, therebyinfluencing consumer behavior to invest in digital gold on Tokopedia continuously.

Abstract

This descriptive qualitative study with a literature study approach aims to explore the "marriage age limit" in perspective and categorization in the typology of responsive law. The main material object is "limiting the age of marriage" as a legal norm following legislation (Law 1 of 1974 Ps. 7 Paragraphs 1 and 2). The formal object is ideas, ideas, and arguments that support or reject the idea of the article a quo. The analysis uses a responsive legal theory approach, an epistemological and axiological study of the review of the limitation of the age of marriage as a statutory norm applicable in Indonesia. The results show that: 1) The situation of child marriage because it is allowed to marry at the age of 16 (Article 7 paragraph (1) of Law 1 of 1974) results in the guarantee of women's constitutional rights being violated. These violations include the right to education, health, and growth and development, guaranteed protection by the 1945 Constitution. Applying legal norms needs to balance the protection of children and human rights. 2) The scope of the case includes the right to make life choices and the right to the growth and development of children—the synergy of all parties to educate the community about the adverse effects of early marriage. Provide access to quality health and education services for children so that they can grow and develop properly and ensure the law can effectively increase the prevention of child marriage cases.

Abstract

Online games that carry the theme of the play-to-earn movement have become a new phenomenon in the game industry because they can be used for a business. One of the games that developed into a business is the Axie Infinity game. The research method is a qualitative descriptive, field research approach with data obtained from interview data collection and documentation. The results of this study are 1) The practice of Axie Infinity game business transactions is carried out in two ways, namely through the Axie Infinity marketplace and through the intermediary of the Axie Family community leader. Both ways of business transactions are contrary to the principles or axioms of Islamic business ethics, which are not in accordance with the principles of tawhid, balance or justice, free will, and responsibility. 2) Factors that affect the business transactions of the Axie Infinity game include interpretation factors of the law, organizational factors, and individual factors or certain condition situations. 3) The play of Axie Infinity game done by players has an impact on the game players. Impact can be in the form of impacts on economic, social, impact on physical health, psychological aspects, time aspects, and financial aspects. In general, the business does have an impact on increasing player income, but the income obtained is erratic and risks player losses.

Abstract

The tourist attraction in Mejono Village is the Gronjong Wariti Tourism, founded by the community in 2017. The existence of this tourist attraction cannot be separated from the role of residents who care about their environment, as well as being committed to inviting residents to make it happen. This research aims to determine the Gronjong Wariti tourist attraction in Mejono Village, Plemahan Subdistrict, Kediri Regency, and the role of the Gronjong Wariti tourist attraction in empowering the people of Mejono Village, Plemahan Subdistrict, Kediri Regency. This research uses a qualitative approach with a descriptive research type. The data collection procedures used were interviews, observation, and documentation. Data analysis is done by reducing data, presenting data, drawing conclusions, and verifying. Checking the validity of the data is carried out by extending observations, persistence of observations, and triangulation. The results of this research are as follows: (1) Gronjong Wariti is a water tourist attraction that utilizes river water flow. Based on the classification of tourist attractions, Gronjong Wariti Tourism is a tourist attraction and special interest attraction because it opens visits to the public who want to visit this tourist attraction. This place has a lot of entertainment, from amusement rides to stalls selling traditional market snacks to a karaoke place. (2) The Gronjong Wariti tourist attraction empowers the community because it involves all the people of Mejono Village, namely at least 75 families in the community around the river. The involvement of all the people of Mejono Village has an impact on realizing the goals of community empowerment, namely institutional improvement, business improvement, income improvement, environmental improvement, life improvement, and community improvement.

Abstract

Weweh is a hereditary tradition that is still practiced by the community, especially in Java, by delivering food to relatives ahead of Eid al-Fitr. Qualitative research with an ethnographic approach aims to describe how the weweh tradition contributes to maintaining and encouraging social solidarity among the community and how this role is related to Islamic values in Sawahan Village, Sawahan Sub-district, Madiun Regency. The results show that weweh is usually performed after the night of 21 Ramadan until the day before Eid. There has been a modification of the food (wewehan) given for weweh from processed food consisting of rice, various vegetables, and side dishes such as opor and roast chicken arranged in rantang susun to gifts or parcels consisting of raw food ingredients such as cooking oil, sugar, coffee, tea, candy, biscuits, pastries, and instant noodles. Children of younger relatives are usually the ones who deliver the gifts to the homes of the older relatives who are given wewehan. The relatives who receive the wewehan usually give the money and or food back in the giving container. The weweh tradition teaches generosity through food alms, friendship, maintaining cultural heritage, strengthening a sense of kinship and social solidarity, and is able to provide a sense of happiness for the giver and recipient of wewehan, especially if the wewehan recipient is a poor person who will be helped by the presence of food or food ingredients to welcome the Eid celebration. It is proven that this weweh tradition impacts the internalization of social solidarity with the content of Islamic values in the community.
