Abstract

Akad Murabahah is a contract that finances an item by describing its purchase price to the buyer and asking the buyer to pay a higher price according to the agreed profit. The purpose of this research is to know and analyze the role of Notary in making a deed of financing subsidized home ownership and to know and analyze the murabaha contract in the deed of financing subsidized home ownership by notaries in Bogor Regency. This research uses normative legal research methods with the approach of legislation, norms, and doctrine as the main study, but is also supported by empirical approaches such as interviews to complement existing juridical data. The results of the study found that the role of notaries in making deeds of financing subsidized houses with murabaha contracts has not been widely carried out by Islamic banks, notaries in this case public officials who make deeds play more of a role in making ordinary commercial house financing. whereas when houses are subsidized, not many Islamic bank partners use notaries. Currently, the murabahah contract is still the choice of customers in buying houses at Islamic banks, because the margins offered by banks are not large and certain. However, there is a need for a kaffah concept of Islamic law in making deeds, for this reason this research is expected to conceptualize the anatomy of a murabahah contract based on applicable legal principles and Islamic legal values.

Abstract

Family business is a business that is run jointly by family members. The purpose of this study is to determine the succession process and the relationship between parents and children in the family business precisely in the Trusmi Cirebon batik center. The method used is qualitative with data collection techniques through interviews, documentation and observation of four informants or sources namely Batik Ninik Ichsan, Batik EB, Batik Katura, and Batik Trusmi. The results of the research on Batik Ninik Ichsan, Batik Trusmi, Batik Katura, and Traditional Batik EB found that the succession process carried out was unplanned, but the parents provided mentoring to make batik at school age, except for Batik Trusmi who only learned it after marriage. In the aspect of parent-child relationship, it is known that Batik Ninik Ichsan, Batik Trusmi, and Batik Katura are in a good relationship because there is no pressure on their children to participate in continuing their parents' business, but business continuity is carried out naturally and there is support from the environment. This is different from Batik EB, where there was a conflict within the family due to Hisham's parents' decision to hand over EB's batik business to Hisham. However, a solution was immediately found so that it was back in good condition.

Abstract

This research aims to analyze the implementation of legality regulations for Traditional Complementary Healers (TCH) based on Health Law No. 36 of 2009. The study focuses on Denpasar, with an emphasis on acupuncture and muscle massage practices. Using a qualitative approach, this study identifies that a majority of TCHs in Denpasar (around 90%) have not yet complied with the legality requirements set by Health Law No. 36 of 2009. Factors influencing the fulfillment of legality encompass legislative aspects that lack specificity in regulating traditional healing, limited attention from law enforcement, as well as challenges in infrastructure and insufficient support from professional organizations and local authorities. Society tends to deprioritize legality when choosing TCHs due to the deep-rooted cultural belief in traditional healing methods. This research underscores the need for stronger guidance and supervision from Local Governments to assist TCHs in meeting legality prerequisites. In conclusion, the implementation of legality regulations for TCHs based on Health Law No. 36 of 2009 in Denpasar still encounters significant challenges involving various factors, including culture and inadequate regulations.

Abstract

Student learning outcomes can be influenced by several factors. Some of them are teacher leadership and school climate factors. This study aims to determine the significance of teacher leadership and school climate on student learning outcomes. The method used in this research is a survey research method. The population from this research includes all class X students at Cendrawasih Catholic High School.There are 106 students in class X and consisting of 46 female students and 60 male students. Sampling in this study was carried out by means of simple random sampling. The sample size was determined using Issac & Michael’s table. Sampling of this study were 84 and consisting of 38 female students and 46 male students. Data collection techniques in this study were questionnaires and documentation. The data obtained were then analyzed using the Multiple Linear Regression analysis technique. The results of this study indicate that teacher leadership and school climate simultaneously have a positive and significant influence on the learning achievement of Class X Cenderawasih Catholic High School students in the subject of Catholic Religious Education as indicated by the values of the regression coefficients and correlation coefficients which are positive. The implication of this research is to provide enlightenment to all teachers and everyone involved in the world of education that creating a positive school climate and good teacher leadership will have a very good impact on student learning outcomes.

Abstract

Masalah hukum mungkin timbul ketika prosedur pengalihan kepemilikan tanah atau rumah berlangsung kadang-kadang tanpa konfirmasi bank. Tanpa persetujuan bank, pengalihan hak tidak memberikan perlindungan hukum kepada pihak-pihak yang tidak termasuk dalam perjanjian bank. Notaris yang mempunyai kuasa untuk membuat akta-akta yang sah diperlukan bagi pihak-pihak yang melakukan pemindahan hak di luar bank. Tujuan penelitian ini untuk mengetahui tanggung jawab notaris dalam pembuatan akta take over rumah dalam menjamin kepastian hukum. Metodologi penelitian yang digunakan adalah Penelitian normatif hukum. Menggunakan pendekatan undang-undang, yang memerlukan melihat undang-undang, peraturan, dan literatur terkait yang ada. Hasil penelitian menunjukkan bahwa jika akta otentik yang dibuat oleh Notaris menyebabkan kerugian bagi pihak lain, maka Notaris bisa dimintakan pertanggungjawaban sesuai Pasal 85 Undang-Undang tersebut. Sanksi administratif, termasuk teguran lisan, tertulis, pemberhentian sementara, hormat, atau tidak hormat, bisa dikenakan. Penelitian ini penting karena menyoroti peran notaris dalam memastikan kepastian hukum dalam proses pengambilalihan rumah (take over).

Abstract

As an education system that becomes a new choice, the implementation of inclusive education still faces many challenges. This research was conducted due to the limited research on school climate with parents' perspective about inclusion at the micro level in Kota Depok. The purpose of this study is to examine the effect of parents' perception about school climate toward school sastisfaction in Kota Depok. This quantitative correlational study involve 72 parents who had special needs children who attend inclusive public and private school. Parents completed two self-report questionnaires: Parental Perception of Inclusion Climate Scale and Satisfaction of School Inclusion Survey. The results show there are significant differences regarding satisfaction, with parents from private school tend to more satisfied about inclusive that parents from public school. A regression analysis was performed and confirmed that parents perception about school climate were predictors of parents satisfaction about inclusive school. These finding provide insight that the main consideration for satisfaction according to parents is the support provided by all school staff and teachers. Stakeholders can consider providing understanding to all school stakeholders about the importance of support, both instrumental and emotional.

Abstract

The rise of child promiscuity has resulted in children becoming pregnant out of wedlock and then giving birth. This act is a criminal offense of child neglect. The perpetrator of child neglect who is under 18 years of age is of course handled differently from adults. This research aims to find out how the reasons for dumping babies and what sanctions will be given and the form of diversion carried out by the police. This research method uses empirical juridical, where the actions committed by the perpetrators (parents) of baby dumping under the age of 18, are not included in the Child Protection Law, so they must be held accountable and the settlement must use diversion as a form of protection for living babies. The results of this study indicate that child offenders who dump their babies have violated Article 78 B of Law Number 35 of 2014 concerning Amendments to Law Number 11 of 2012 concerning Child Protection, and can be subject to sanctions for babies dumped as babies. The perpetrator is married and is obliged to take care of the discarded baby until adulthood. The perpetrator is still a child and the child born also needs protection and care, so the settlement of the case is through diversion by bringing together the perpetrator's parents, community, and religious leaders. and mediated by the police.

Abstract

Trust is an essential element in the realm of investment. This study examines two legal issues in Bancassurance's PAYDI marketing. This study employs normative legal research, a systematic scientific approach used to address legal concerns that result from regulation. The utilized data consists of secondary sources, including statutes, judicial rulings, legal doctrines, and scholarly viewpoints. This study suggests that it is important to examine the teleological contractual relationship between the parties involved, particularly those that place importance on the social and moral components of the contract's goal. The collaboration between PAYDI and life insurance firms in implementing bancassurance marketing strategies with distribution business models is essential.

Abstract

The objective of this study is to gather empirical data regarding the impact of management ownership and capital structure on stock returns, with dividend policy acting as an intervening factor. This study employs quantitative methodologies. The study focuses on the consumer products industrial sector listed on the Indonesia Stock Exchange for the period of 2020-2021. A subset of 25 organizations was chosen using the Purposive sampling approach, which adheres to specific criteria. This study demonstrates that the ownership of insiders has an impact on the structure of capital and, consequently, on the policy regarding the distribution of dividends. Stock returns are influenced by managerial ownership and dividend policy, but capital structure does not have an impact on stock returns. Furthermore, the outcome of the Sobel test demonstrates that dividend policy does not have the capability to moderate the impact of managerial ownership and capital structure on stock returns.

Abstract

Leaders have an important role in an organization. Various tasks are the responsibility of the leader in an organization, including increasing the organizational commitment of civil servants at the Andi Jemma Airport Operator Unit Office. This can also be influenced by the leadership style used by a leader, one of the leadership styles that can affect the organizational commitment of civil servants is transformational leadership. The purpose of this study is to explore the implementation of transformational leadership in improving the organizational commitment of civil servants at the Andi Jemma Airport Operator Unit Office. This research uses exploratory research with a qualitative approach. Primary data sources in this study are the results of questionnaires and secondary data sources from the exploration of various journals.  Activities in data analysis are data reduction, data presentation, and conclusion drawing or verification. The research results show that to achieve optimal results and maintain organizational sustainability, the role of human resource (HR) quality is key, which affects organizational performance and success. Transformational leadership style, with aspects of employee empowerment, effective communication, and individual development, emerges as an approach that has the potential to increase employee organizational commitment. The implementation of transformational leadership can form an environment that motivates and inspires employees to be dedicated to the organization, positively impacting the performance and existence of the organization, as in the case of Andi Jemma Airport.
