Abstract

This study analyzes the legal and ethical legitimacy of mandatory vaccination policies in schools from a public health law perspective. It focuses on the relationship between the state’s responsibility to protect public health, children’s right to health, and the boundaries of parental autonomy in making medical decisions for children. The study applies public health theory and legal certainty theory to examine the normative and ethical foundations underlying mandatory vaccination. A mixed-methods approach with a sequential explanatory design is employed, combining normative legal analysis with an empirical review of secondary data. The legal analysis examines national regulations concerning health, immunization, and child protection, while the empirical component reviews scholarly literature addressing public acceptance, implementation challenges, and ethical concerns surrounding school-based vaccination programs. The findings indicate that mandatory vaccination policies have strong legal justification as preventive measures aimed at controlling infectious diseases and protecting children’s health. From an ethical perspective, such policies may be justified when implemented proportionally, transparently, and on the basis of scientific evidence, while providing appropriate parental consent procedures and medically justified exemptions. The study further demonstrates that policy effectiveness depends not only on legal authority but also on regulatory clarity, effective risk communication, institutional accountability, and public trust. One important limitation is the restricted availability of primary empirical data concerning the experiences of parents, teachers, healthcare workers, and policymakers involved in school-level implementation. Therefore, future policy development should strengthen legal regulations, improve public health education, and establish transparent communication mechanisms. This study contributes to health law literature by integrating legal and ethical perspectives to develop a balanced framework for protecting collective health, children’s rights, parental autonomy, and legal certainty.

Abstract

This study analyzes the gap between regulation and implementation regarding occupational health and safety (OHS) protections for non-medical workers (e.g., cleaning staff, security personnel, and administrative staff) in healthcare facilities, grounded in universal labor protection principles. Employing a normative-juridical approach and a systematic literature review, the study examines the legal framework, empirical studies, and academic discourse concerning OHS in the healthcare sector. The findings indicate that despite the existence of comprehensive and universal OHS regulations, implementation remains uneven and tends to marginalize non-medical personnel—particularly outsourced workers—who often lack access to safety training, personal protective equipment, and incident reporting mechanisms. Outsourcing practices emerge as a primary structural factor causing a fragmentation of responsibility between hospitals and service providers, thereby undermining accountability. Challenges identified include weak managerial commitment, a safety culture focused predominantly on clinical aspects, and limited oversight of outsourced personnel. The study recommends strengthening OHS provisions in outsourcing contracts, enhancing labor inspections, and integrating all workers into hospital safety management systems. Furthermore, it introduces the concept of "silent vulnerability" to characterize the marginalization of non-medical workers within healthcare safety systems, thereby enriching academic scholarship in the fields of occupational health and labor law.

Abstract

Corruption is a systemic problem rooted in weak character and moral integrity, requiring preventive measures through education starting from elementary school. The implementation of anti-corruption education in elementary schools is still partial and has not been systematically managed through educational management functions or strongly integrated with local wisdom. This article aims to describe and formulate a school management strategy in integrating the local wisdom of Pancawaluya (cageur, bageur, bener, pinter, singer) based on the Six Value Systems into an anti-corruption education program to strengthen students' character. The program management strategy refers to the management functions of Planning, Organizing, Actuating, Controlling (POAC). The study used a qualitative approach with descriptive methods at SDN 1 Linggarsari and SDN 3 Plered, Purwakarta Regency. Data were collected through in-depth interviews, observations, and documentation studies, then analyzed through data reduction, data presentation, and drawing conclusions using triangulation techniques to ensure validity. The results of the study indicate that the management strategy is implemented through planning based on the school's vision and mission, emphasizing theological and ethical values ​​as the foundation for strengthening anti-corruption character. This integration is aimed at developing the Pancawaluya character, particularly bageur (good behavior and integrity), bener (honesty and adherence to rules), and pinter (critical thinking). In terms of organization, team building and role allocation reflect ethical values ​​through shared commitment and responsibility. In terms of implementation, the integration of values ​​into learning, school culture, and habituation strengthens the internalization of theological and ethical values ​​in students' daily behavior. In terms of control, character monitoring and evaluation are conducted periodically to maintain consistent honesty and discipline. The main obstacles include limited teacher understanding and suboptimal family support. The study concluded that the management of anti-corruption education based on school management functions integrated with Pancawaluya and the Six Value Systems can strengthen students' anti-corruption character if implemented systematically and sustainably.

Abstract

This study aims to analyze the implementation of restorative justice for juvenile offenders from the perspective of progressive law within the Indonesian juvenile criminal justice system. Restorative justice is conceptualized as a conflict-resolution approach that prioritizes the restoration of relationships between offenders, victims, and the community through participatory dialogue and consensus-based mechanisms. This research employs a qualitative descriptive approach using a literature review method combined with a juridical–empirical perspective by examining legal regulations, policy documents, and scholarly works related to juvenile justice. The scope of the study focuses on the regulatory framework and practical implementation of diversion as stipulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and Supreme Court Regulation Number 4 of 2014. The findings indicate that Indonesia’s legal framework has formally incorporated restorative justice through diversion mechanisms that involve offenders, victims, families, and community representatives in resolving juvenile criminal cases. Nevertheless, the practical implementation of this approach still encounters several challenges, including institutional limitations, insufficient capacity among law enforcement officials, and societal legal culture that remains predominantly punitive. As a result, the restorative justice mechanism has not yet fully realized its intended goal of restoring social harmony and ensuring the best interests of the child. This study recommends strengthening institutional capacity within the juvenile justice system, enhancing the competence of law enforcement officials in facilitating diversion processes, and promoting public legal awareness regarding restorative justice values. This research contributes theoretically by reinforcing the relevance of progressive legal thought in the juvenile justice system while offering a critical analysis of the gap between the normative design of restorative justice and its practical implementation in Indonesia.

Abstract

This research is motivated by the importance of the Intra-School Student Organization (OSIS) as a strategic forum for developing the potential of student leadership character, but in practice there are still many unplanned and unsystematic program management. The general objective of this research is to describe and analyze the OSIS management in fostering student leadership character at SMP Negeri 2 Cipeundeuy and SMP Negeri 4 Cipeundeuy, West Bandung Regency while the specific objective is to analyze the process of planning, organizing, implementing, and evaluating, as well as the impact of coaching on student leadership character. The theoretical basis used refers to the POAC (Planning, Organizing, Actuating, Controlling) management function of George R. Terry and the student leadership theory of Kouzes and Posner. This research uses a qualitative approach with a case study method through data collection techniques in the form of observation, documentation studies and in-depth interviews with the principal, vice principal for student affairs, mentors and OSIS administrators. The results of the study indicate that planning is carried out collaboratively with a strong legal basis; organizing is implemented through a clear division of tasks to foster responsibility; The program's implementation prioritizes independence and disciplined coordination; and evaluation is conducted regularly through accountability reports to provide constructive feedback. Through this management, students' leadership character, encompassing integrity, responsibility, empathy, courage, communication, and collaboration, has been comprehensively developed. The study's conclusions confirm that effective OSIS management serves as a "character laboratory" capable of fostering student leadership.

Abstract

The management of religious extracurricular activities is a crucial strategy for achieving character education goals, particularly in shaping and enhancing the *al-akhlāq al-karīmah* (noble character) of students in elementary schools. This study aims to analyze the management of religious extracurricular activities in fostering the noble character of students at SD Negeri Gadung and SD Negeri Kopo in Karangtengah District, Cianjur Regency. The research focuses on the planning, organizing, implementation, and evaluation of these activities, as well as the supporting and inhibiting factors involved. A qualitative approach utilizing a case study method was employed. Data collection techniques included observation, in-depth interviews with school principals and supervising teachers, and a review of school program documentation. Data analysis was conducted through the stages of data reduction, data display, and conclusion drawing. The results indicate that the management of religious extracurricular activities at both schools was carried out in a planned and systematic manner, characterized by program formulation aligned with the school's vision and mission, clear division of duties, activity implementation based on the habituation of religious values, and periodic evaluation. These religious extracurricular activities contributed positively to enhancing students' noble character, reflected in improved discipline in worship, politeness, honesty, responsibility, and social awareness. Key supporting factors included the commitment of school leadership, the active role of supervising teachers, and parental support, while inhibiting factors included time constraints and limitations regarding facilities and infrastructure. The study concludes that effective management of religious extracurricular activities can serve as a strategic means for fostering student character in elementary schools.

Abstract

The use of Artificial Intelligence (AI) in medical diagnosis has significantly increased in Indonesian hospitals, including RSU Cahaya Medika Makassar which has integrated AI for radiology and pathology since 2024 (with a capacity of 500 beds and 20+ AI tools). Law No. 17/2023 on Health (Article 220) and Permenkes 75/2020 on AI in Health require accuracy >90%, algorithm transparency, and liability sharing between doctors-AI-vendors. However, legal risks emerge: AI diagnosis errors (15% false positive, Kemenkes 2025), malpractice claims (Article 29 Law 29/2004), and data responsibility (UU PDP 27/2022). A case at a Jakarta hospital (2024) lost a Rp2 billion lawsuit over AI breast cancer misdiagnosis; RSCM Makassar recorded 3 AI error incidents in 2025. Without risk management (policy, training, insurance), RSU Cahaya Medika is vulnerable to litigation, reputational damage, and costs. This study aims to identify main legal risks of AI diagnosis use and design an effective legal risk management framework according to ISO 31000 and Indonesian regulations. This research uses a qualitative case study with a normative-empirical juridical approach, involving in-depth interviews with 25 key informants, AI system observations, and document analysis. The results show that the main legal risks include criminal and civil malpractice due to AI errors, non-compliance with UU Health and Permenkes AI regulations, and complex liability sharing between doctors-vendor-AI-hospitals. The effective legal risk management framework must include risk identification, risk assessment, risk treatment, and continuous risk monitoring according to ISO 31000 standards.

Abstract

This study is motivated by the importance of numeracy learning as a foundation for developing elementary school students’ logical thinking skills. Numeracy is not merely related to counting skills, but also involves reasoning abilities, pattern recognition, and contextual problem-solving in daily life. However, in practice, numeracy learning in elementary schools still faces various challenges in terms of planning, implementation, and evaluation. This study aims to describe and analyze numeracy learning management in improving students’ mathematical logic. This research employed a qualitative approach using a case study method conducted at SDN Tanjungjaya, Cianjur Regency, and SDN Mandalasari, West Bandung Regency, Indonesia. Data were collected through observation, in-depth interviews, and documentation involving principals, teachers, students, parents, and school committees. Data analysis was carried out using the interactive model of Miles and Huberman, consisting of data reduction, data display, and conclusion drawing. Data validity was ensured through source, technique, and time triangulation. The findings indicate that systematically managed numeracy learning through the Plan–Do–Check–Act (PDCA) cycle effectively improves students’ mathematical logic. Learning planning is designed by considering learning objectives, student characteristics, and real-life contexts. The implementation emphasizes active student engagement through problem-solving and contextual activities. Evaluation is conducted continuously by focusing on students’ thinking processes. Follow-up actions include improving learning strategies, strengthening numeracy practices, and enhancing collaboration between schools and parents. Therefore, well-planned and sustainable numeracy learning management plays a crucial role in improving the quality of mathematics learning in elementary schools.

Abstract

Basic education plays a crucial role in improving the quality of human resources, necessitating professional and competent educators to carry out the learning process. However, in practice, teachers are still found to lack the minimum academic qualification of a bachelor's degree, and there is a mismatch between their academic background and the subjects they teach. This situation demands the role of the principal as an educational manager to implement effective management to improve teacher performance. This study aims to describe and analyze the principal's management in improving teacher performance at Cimaja Elementary School and Banyuwangi Elementary School in Pasirkuda District. The focus of the study includes aspects of planning, organizing, implementing, evaluating, obstacles encountered, and solutions implemented by the principal. This study uses a qualitative approach with descriptive methods. Data collection techniques were carried out through interviews, observations, and documentation studies. The data obtained were then analyzed using an interactive analysis model that includes data reduction, data presentation, and conclusion drawing. The results show that the principal has implemented management functions systematically through planning teacher competency improvement programs, organizing school resources, implementing academic supervision, and continuously evaluating teacher performance. However, several obstacles remain in its implementation, including limited academic qualifications for some teachers, limited learning facilities and infrastructure, and low motivation for some teachers to develop their professional competencies. To address these challenges, principals are undertaking various efforts, such as strengthening collaboration with external parties, optimizing teacher learning communities, and encouraging teachers to pursue higher education. Therefore, planned, systematic, and sustainable principal management plays a crucial role in improving teacher performance, which ultimately impacts the quality of learning in elementary schools.

Abstract

Indonesia is a pluralistic nation characterized by diversity of religions, cultures, languages, traditions, and social views. This diversity is a national strength, but it can also give rise to conflict, radicalism, and intolerance if not accompanied by the ability to understand and appreciate differences. This study aims to analyze the urgency and strategies for disseminating peace education in educational institutions as an effort to counter radicalism and intolerance among students. The study uses a qualitative approach, employing a literature review of scientific journals, books, official websites, and other relevant sources. The analysis focuses on the concept of peace education, the characteristics of radicalism and intolerance, and strategies for its implementation in educational environments. The results of the study indicate that peace education can be a strategic approach in building a culture of peace by strengthening tolerance, respect for human rights, communication, cooperation, non-violent conflict resolution, and respect for diversity. The dissemination of peace education needs to be carried out systematically through schools, madrasahs, universities, Islamic boarding schools, and community education spaces by involving interfaith dialogue, social solidarity activities, multicultural education, and the cultivation of inclusive attitudes. From an Islamic perspective, this strategy can be developed through the principles of wisdom, al-mau'izah al-hasanah, and al-mujadalah billati hiya ahsan as contained in QS. An-Nahl, verse 125. The program evaluation framework can include objectives, indicators, verification, assessment, and follow-up. Thus, the dissemination of peace education not only functions as an instrument for preventing radicalism and intolerance but also as a means of forming a young generation that is tolerant, inclusive, humanistic, and capable of becoming agents of peace in social, national, and religious life.
