Al-Qadlaya : Jurnal Hukum Keluarga Islam, diterbitkan oleh Lembaga Penelitian, Pengembangan dan Pengabdian Kepada Masyarakat (LP3M) Program Studi Hukum Keluarga Islam, Sekolah Tinggi Ilmu Syariah Miftahul Ulum Lumajang sejak tahun 2021. Pada awalnya jurnal hanya berfungsi sebagai wadah ilmiah bagi dosen, profesor, dan mahasiswa Sekolah Tinggi Ilmu Syariah Miftahul Ulum Lumajang. Namun, karena perkembangan selanjutnya, jurnal tersebut berinisiatif mengundang para sarjana dan peneliti di luar Institut untuk berkontribusi. Al-Qadlaya, terbit dua kali setahun, selalu menempatkan Hukum Keluarga Islam, Wacana Gender, dan Hukum Perdata Islam dalam fokus utama penyelidikan akademis dan mengajak setiap pengamatan komprehensif Hukum Keluarga Islam sebagai Islam normatif dan sistem masyarakat Muslim sebagai mereka yang menjalankan agama dengan banyak segi.

Abstract

This research focuses on the distribution of inheritance based on the bilateral system. Inheritance law is part of family law that plays a very important role, as it both determines and reflects the kinship system that prevails in society. In Java, this interrelation is known as “Islam Jawa” (Javanese Islam), because the syncretism between Islam and tradition (adat) gave rise to a tradition referred to as kejawen. This condition demonstrates that in Java, adat and religion are not markedly different; in fact, at times they are difficult to distinguish or separate, as they appear to have merged. Consequently, in matters of inheritance law, compromises between customary law and Islamic law inevitably emerge.The emphasis of this study lies in the concept of inheritance distribution based on the bilateral system from the perspective of customary law and the views of contemporary Islamic scholars. The main objective of this research is to analyze the concept of bilateral inheritance distribution found in customary law and in the opinions of contemporary scholars. This study employs a normative juridical approach. Most of the primary data are drawn from library research consisting of the latest scientific literature, newly developed understandings of established facts, and new ideas. The scope of the study includes the Qur’an, contemporary scholars’ opinions, and academic journals discussing bilateral inheritance. The stages of data analysis include editing, classifying, verifying, analyzing, and concluding. To ensure the credibility of the research as a scientific work, data validity was tested through credibility and dependability assessments. The findings of this research conclude that inheritance distribution based on the bilateral system emphasizes an equal division of inheritance between men and women. The bilateral approach prioritizes a 1:1 ratio, which can reduce inequality compared to the 2:1 ratio. Furthermore, according to contemporary scholars, provided that the heirs consent, the bilateral 1:1 concept may be justified as being fairer in modern contexts. This is due to the changing roles of women in contemporary times, where many women take on responsibilities as breadwinners, unlike women in the classical era.

Abstract

Walimatul „ursy is a wedding banquet. Islam requires to announce that the marriage contract has been completed, this is to distinguish it from secret marriages which are prohibited by Islam. However, currently the implementation of Walimatul „ursy has undergone changes due to the PPKM (Implementation of Community Activity Restrictions) policy after the Covid-19 pandemic, especially in Bago village itself. Therefore, the author wants to investigate further about the Public Response to Restrictions on the Implementation of Walimatul „ursy During Ppkm (Enforcement of Restrictions on Community Activities) from the Maqashid Syari'ah Perspective (Case Study in Bago Village, Pasirian District, Lumajang Regency). There are two problem formulations in this thesis, namely: (1) How is the response of the Bago village community, Kec. Pasirian Kab. Lumajang against restrictions on the implementation of walimatul „ursy during PPKM? (2) How is the application of restrictions on the implementation of walimatul „ursy during PPKM from a maqashid shari'ah perspective? The location of this research is in Bago Village, Pasirian District, Lumajang Regency, which is the reason the author chose this location, because this happened several community violations regarding the limitation of the implementation of walimatul „ursy during PPKM and can be reached by the author. This thesis uses a field research method, namely by going directly to the field/research location. Data collection techniques with interviews, and documentation. The data from this study consisted of primary data and secondary data which were then analyzed using qualitative descriptive analysis methods. From the research results obtained in the field, it can be concluded that the public response to restrictions on the implementation of walimatul „ursy during PPKM (implementation of restrictions on community activities) in Bago village is not effective, many people do not follow the protocol when attending the walimatul „ursy event, people have several reasons for The violations committed include: feeling safe because it is far from the city center, more concerned with tradition, and less firm action from the government. Maqashid Syariah‟s view of limiting the implementation of walimatul „ursy during PPKM (Enforcement of Restrictions on Community Activities) has 3 objectives, namely hifz an- nafs (guarding the soul), hifz an-nasl (guarding offspring), and hifz al-'aqli (guarding reason).

Abstract

Ketentuan hak reproduksi telah diatur oleh undang-undang No. 13 Tahun 2003 tentang ketenagakerjaan, Pasal 81 ayat (1), menyebutkan: “Pekerja atau buruh yang dalam masa haid merasakan sakit dan memberitahukan kepada pengusaha, tidak wajib bekerja pada hari pertama dan kedua pada waktu haid”. Rumusan masalah dari penelitian ini adalah Bagaimana perlindungan hukum terhadap hak reproduksi pekerja perempuan dalam Undang-undang No 13 Tahun 2003 tentang ketenagakerjaan dan Bagaimana pandangan hukum islam terhadap perlindungan hukum hak reproduksi pekerja perempuan yang terdapat dalam Undang-undang No 13 Tahun 2003 tentang ketenagakerjaan. Sedangkan tujuan dari penelitian ini adalah untuk menggambarkan dan menganalisis eksistensi perlindungan hukum terhadap hak reproduksi pekerja perempuan dalam Undang-undang No 13 Tahun 2003 tentang ketenagakerjaan dan menggambarkan juga menjelaskan pandangan hukum islam terhadap perlindungan hukum hak reproduksi pekerja perempuan yang terdapat dalam Undang-undang No 13 Tahun 2003 tentang ketenagakerjaan. Penulisan skripsi ini termasuk jenis kepustakaan (yuridis normatif), dengan pendekatan studi kasus. Sumber data yang digunakan adalah sumber primer dan sekunder. Sedangkan tahapan analisis data dilakukan dengan editing, klasifikasi, verifikasi, konklusi, dan analisis. Adapun keabsahan data yang diterapkan adalah kredibilitas, dependabilitas, dan konfirmabilitas. Berdasarkan metode penelitian tersebut maka hasil penelitian dan pembahasan dari aspek wawancara dan observasi, peneliti dapat memahami bahwa : (1). Padal Pasal 81 UndangUndang Nomor 13 tahun 2003 tentang Ketenagakerjaan diatur masalah perlindungan dalam masa haid. Perlindungan terhadap pekerja wanita yang dalam masa haid tidak wajib bekerja pada hari pertama dan kedua pada waktu haid dengan upah penuh. (2). Berdasarkan penjelasan analisis hukum islam terhadap perlindungan hukum bagi wanita yang berkerja telah sesuai dengan ketentuan hukum islam sebab peraturan Undang- Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, juga mengangkat martabat wanita sebagai makhluk yang memeiliki ciri khusus tersediri. Sebagaimana firman allah SWT dalam surat an-Nisa', ayat : 34.

Abstract

Penelitian pada jurnal ini berfokus pada bagaimana Mediasi Perkara Kekerasan Dalam Rumah Tangga Melalui Kepala Desa Perspektif Restorative Justice Di Desa Meninjo Kec. Ranuyoso Kab. Lumajang. Oleh karenanya penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis empiris, melalui wawancara, observasi, dan dokumentasi. Dengan hasil penelitian bahwa Kepala Desa Meninjo berperan penting sebagai mediator berfungsi sebagai tempat pengaduan pertama, fasilitator dialog kekeluargaan, pemberi nasihat moral, serta penyusun kesepakatan tertulis. Peran ini tidak hanya berlandaskan kewenangan hukum formal, tetapi juga pada legitimasi sosial dan kedekatan emosional dengan warga. Pendekatan yang dilakukan sejalan dengan prinsip restorative justice, yaitu memulihkan hubungan sosial dan memberikan rasa aman bagi korban, sekaligus menumbuhkan kesadaran pada pelaku. Akan tetapi kepala desa Ketika turun lapangan Terdapat faktor pendukung dan penghambat kepala desa dalam penyelesaian kekerasan dalam rumah tangga yaitu (faktor pendukung: legitimasi dan wewenang formal kepala desa, kedekatan sosial dengan masyarakat, budaya musyawarah mufakat, dukungan tokoh masyarakat dan aparat desa, adanya mekanisme mediasi dan surat pernyataan). faktor penghambat antara lain yaitu (keterbatasan pengetahuan hukum kepala desa, budaya patriarki dan tekanan sosial, keterbatasan sarana dan tenaga profesional, ketidakpatuhan pelaku terhadap kesepakatan, kurangnya koordinasi dengan aparat hukum).

Abstract

This study aims so that community marriages in Kaliboto Village do not misunderstand the prohibition of polygamy as an agreement that is often carried out. And this research was carried out from March to May 2023, taking place in Kaliboto Village, Jatiroto District, Lumajanag Regency. The problem formulation for this research is: 1. Prohibition of polygamy as a marriage agreement in Kaliboto Lor Village, Jatiroto District, Lumajang Regency? 2. Is the prohibition on polygamy as a marriage agreement viewed from a positive legal perspective? 3. The prohibition of polygamy as a marriage agreement viewed from the perspective of madzahibul arba'ah? This research includes the type of field research or qualitative and quantitative. the data in this study were 3 husbands and wives and 1 community leader in Kaliboto Lor Village. data collection techniques used interviews and documentation. data analysis techniques used the KUHAPER book, Compilation of Islamic Law (KHI), and the Book of madzahibul arba'ah with the theory of data reduction, presenting data, and concluding data. The results of this study indicate that: (1) married couples who enter into a marriage agreement in the village of Kaliboto or that solely aim to make the couple sakinah mawaddah warohmah. (2) The positive legal and madzahibul arba'ah perspectives on marriage agreements entered into by married couples in Kaliboto village or contained in Marriage Law No. 1 of 1974 article 29, Government Regulation Number 9 of 1975, compilation of Islamic law and the book of madzahibul arba'ah.

Abstract

The phenomenon of wives as breadwinners in the family remains a topic of debate among the community, including in Sukorejo Village, Kunir District, Lumajang Regency. In traditional Islamic understanding, the husband is obligated to provide for the family, as stated in QS. An-Nisā’ verse 34. However, social reality shows a shift in roles where many wives also work to earn a living, and in some cases, their income even exceeds that of their husbands. This situation creates various social and psychological dynamics within the household, affecting family harmony and public perceptions of gender roles in family economics. This study aims to analyze the phenomenon of wives as breadwinners in Sukorejo Village and examine it through the perspective of Qirā’ah Mubādalah developed by Faqihuddin Abdul Kodir. The Qirā’ah Mubādalah approach emphasizes reciprocity and partnership between men and women in interpreting religious texts, including in the distribution of economic responsibilities within the family. Thus, the participation of wives in earning a living is not considered a violation of religious roles but rather a form of mutual cooperation and shared responsibility to achieve a harmonious, loving, and merciful (sakinah, mawaddah, wa rahmah) family life. The results of this study show that about 80% of wives in Sukorejo Village actively contribute to supporting the family’s economy due to several factors, such as limited financial conditions, the husband’s illness, or unemployment. From the Qirā’ah Mubādalah perspective, such roles are permissible as long as they are based on mutual agreement, mutual consent, and do not cause imbalance within the household. The values of mubādalah—such as commitment, cooperation, deliberation, and mutual comfort—are found to sustain household harmony despite the shifting of economic roles between husband and wife.

Abstract

Wali mafqud is the guardian of the unknown bride whereabouts so do not know whether it is dead or still alive. As happened in the village of wotgalih, there are women who live wandering since childhood by his parents, until now his whereabouts are unknown his father only the latest news is in Malang. Therefore, it is very It is important to clarify because the marriage guardian can determine whether a marriage is legal or not marriage. The formulation of the problem in this study is: What are the causes the occurrence of the mafqud guardian problem and efforts to solve it at the office Religious Affairs (KUA) Yosowilangun District, Lumajang Regency? What is the positive legal perspective on solving Wali problems Mafqud at the Office of Religious Affairs (KUA) District Yosowilangun Regency Lumajang? Writing this thesis includes the type of field research (empirical juridical), with a case study approach, with interview data collection techniques, observation, and documentation. This research belongs to the type of qualitative research. The data sources used are primary sources including the head of KUA, penghulu and secondary include photos, transcripts of interview guidelines, recordings, through purposive and time sumpling techniques. While the analysis stage data is done by editing, classification, verification, conclusion, and analysis. The validity of the data applied is credibility, dependability, and reliability confirmability. The results of this study are first: the causes of mafqud guardians include: there is a divorce then there is no communication anymore, because both parents married overseas and then left again and left their children, his father migrated after several years lost communication and did not known whereabouts, and raised orphans. The solution carried out by the Office of Religious Affairs (KUA) Yosowilangun against the bride and groom whose guardian is mafqud, that is, ordering the bride and groom to face the village head to explain that his guardian's whereabouts are unknown and witnessed by two people. Then the stamped statement letter along with the other files are given to modin to register marriage to the Affairs Office Yosowilangun Religion. After that, it will be investigated first by the KUA so that there is no manipulation of data related to mafqud guardians. Second: Wali mafqud di explained in the Regulation of the Minister of Religion no. 20 of 2019 article 13 paragraph 5 that the bride and her family go to the village head to request a stamped statement and be witnessed by two witnesses, after it was given to modin to be used as a registration requirement at KUA.

Abstract

The ontalan tradition is a hereditary tradition carried out by the people of Tunjung village. In this traditional procedure, it is to collect some money by throwing which is done by family, relatives and friends of the bridegroom. Many people in Tunjung Village who carry out this ontalan tradition do not understand the meaning, benefits, and laws of implementing this ontalan tradition. The formulation of the problem in this study is first how the practice of ontalan tradition in Tunjung village, second how to review the mursalah maslahah about ontalan tradition in wedding receptions in tunjung village. This thesis writing includes the type of field research (empirical juridical), with a case study approach, with interview, observation, and documentation data collection techniques. This research is a type of qualitative research (displaying research data word for word, descriptive analysis, interpretive or more dominant in the description of words). The data sources used are primary and secondary sources including photos, transcripts of interview guidelines, recordings, through purposive sumpling and time sumpling techniques. While the stages of data analysis are carried out by editing, classification, verification, conclusion, and analysis. The validity of the data applied is credibility, dependability, and confirmability. Based on these research methods, the results of research and discussion of the aspects of interviews and observations, researchers can understand that : (1). The implementation of the ontalan tradition in Tunjung Village is carried out in 2 ways, first carried out when the marriage proposal is directly and carried out when the proposal is only by the community, especially men in Tunjung Village. In this tradition there is a collection of some money by throwing and writing done by family, relatives, local community, and friends of the bridegroom. (2). The ontalan tradition in Tunjung Village contains positive values that can strengthen relationships / harmony between neighbors and other communities. The ontalan tradition in Tunjung Village is a form of tradition / custom that has been preserved by the ancestors and there is also a symbolic meaning in it. This ontalan tradition is also a necessity for all humans, because this tradition is a good purpose and in accordance with the purpose of shara'.

Abstract

Gender issues seem to have no end. Many emerging topics revolve around gender equality between men and women, particularly in the field of education. In communities that still adhere to patriarchal culture—especially in Prajjan Village, Campolong, Sampang—it is commonly believed that no matter how high a woman’s education is, she will still end up taking care of the kitchen, children, and other domestic matters. This assumption raises an important question for the researcher: how do community leaders view the phenomenon of wives having higher educational attainment than their husbands, and what are the implications for family harmony? This study is an empirical juridical research, aiming to reveal the legal facts concerning the perspectives of community leaders who still embrace patriarchal culture regarding the phenomenon of wives being more highly educated than their husbands and its implications for family harmony. The facts surrounding this phenomenon are analyzed through a gender analysis framework in order to answer the research questions. The findings show that community leaders in Prajjan Village generally do not consider it a problem if a wife has a higher level of education than her husband. However, one informant expressed a different opinion. Furthermore, the study found that educational differences do not affect marital harmony, but issues tend to arise when the wife’s income is higher than the husband’s.
