Abstract

Permasalahan utama yang dihadapi dalam pembangunan pertanian adalah rendahnya produktivitas dalam skala mikro, produksi total secara makro, dan kesejahteraan pelaku usaha pertanian itu sendiri. Dalam jangka pendek pembangunan pertanian bertujuan untuk meningkatkan pertumbuhan, akan tetapi dalam jangka panjang tujuan pembangunan pertanian bertujuan memberikan kesetabilan harga pelaku usaha. Secara umum arah kebijakan pertanian adalah memberikan kepastian berlangsungnya usaha baik dalam jangka pendek maupun jangka panjang. Pengkajian dilakukan dengan menggunakan data sekunder yang dianalisis secara kualitatif dengan menggunakan Metoda Desk Research. Bahan literatur yang digunakan dalam penulisan penelitian ini adalah beberapa referensi yang berasal dari hasil penelitian, kajian, dan ulasan dari beberapa tulisan yang kemudian dirangkum menjadi suatu karya tulisan ilmiah. Bahwa Jenis inovasi teknologi pertanian yang berkembang atau diterapkan oleh petani bergantung pada kondisi agrosistem wilayah  setempat.  Terdapat  hubungan  antara  penerapan  atau  adopsi  inovasi  teknologi  pertanian dengan  tingkat  ketahanan  rumah  tangga  petani.  Petani  yang  lebih  intensif  menerapkan  inovasi  teknologi berbasis  sistem  usaha  pertanian  inovatif  memiliki  tingkat  ketahanan  pangan  yang  lebih  baik  dibandingkan dengan petani yang tidak menerapkan inovasi teknologi berbasis sistem usaha pertanian inovatif

Abstract

PT Perkebunan Nusantara III (Persero) merupakan induk perusahaan terhadap PT Perkebunan Nusantara I, II, IV sampai dengan XIV dalam struktur Holding BUMN Perkebunan. Dalam rangka mengakselerasikan operasional Holding BUMN Perkebunan, induk perusahaan melakukan pengendalian dengan menerbitkan seperangkat norma kebijakan untuk diberlakukan kepada anak perusahaan. Namun demikian dalam pelaksanaannya selain menerbitkan ketentuan kebijakan, induk perusahaan juga turut terlibat langsung dalam operasional anak perusahaan hingga hal yang paling teknis, sehingga anak perusahaan sebagai separate legal entities yang terpisah dengan pemiliknya (Pemegang Saham) telah kehilangan kemandiriannya terhadap pengurusan operasional anak perusahaan yang seharusnya dilaksanakan oleh Direksi Anak Perusahaan. Adapun permasalahan yang muncul dalam penelitian ini yang palig krusial adalah apakah akibat hukumnya terhadap pengendalian induk perusahaan yang menyebabkan anak perusahaan kehilangan kemandiriannya. Teori yang digunakan dalam penelitian ini adalah teori Badan Hukum Perusahaan dan Piercing the Corporate Veil.  Hasil dari penelitian ini menyimpulkan bahwa secara yuridis kedudukan badan hukum induk perusahaan dan anak perusahaan adalah merupakan badan hukum yang mandiri dan masing-masing berhak untuk melakukan perbuatan hukum sendiri. Namun demikian, dalam realitas bisnis tidak dapat disangkal bahwa operasional anak perusahaan sepenuhnya telah tunduk di bawah kendali induk perusahaan holding. Dalam hal ini anak perusahaan telah menjadi alter ego bagi Pemegang Saham (PTPN III). Sehingga menunjuk doktrin piercing the corporate veil, terhadap Pemegang Saham (PTPN III) berpotensi untuk bertanggungjawab hingga harta pribadi (PTPN III) apabila terjadi kerugian pada perseroan dan pihak ketiga

Abstract

Tindak Pidana Pencucian Uang dilakukan oleh berbagai Perusahaan Jasa Keuangan. Pasal 17 Undang-Undang Nomor 8 Tahun 2010 Tentang Penjegahan dan Pemberantasan Tindak Pidana Pencucian Uang menyebutkan perusahaan- perusahaan yang terlibat melakukan TPPU, salah satu yang menjadi perusahaan penyedia jasa di pasal 17 tersebut ialah koperasi yang melakukan kegiatan simpan pinjam. Permasalahan dalam penelitian ini yaitu bagaimanakah pengaturan pencegahan tindak pidana pencucian uang melalui koperasi simpan pinjam, bagaimanakah pertanggungjawaban koperasi simpan pinjam yang terlibat dalam tindak pidana pencucian uang, kemudian bagaimanakah implementasi prinsip customer due diligence dan enhanced due diligence dalam pencegahan dan pemberantasan tindak pidana pencucian uang di koperasi simpan pinjam. Penelitian ini menggunakan metode penelitian hukum normatif dan empiris. Pendekatan penelitian dengan pendekatan perundang-undangan (statute approach) atau pendekatan yuridis, materi pada tesis ini diambil dari data sekunder, Adapun teknik pengumpulan data yang peneliti laksanakan dengan wawancara, dan studi kepustakaan. Hasil analisis dan penelitian dalam tesis ini adalah ntuk menganalisis dan mengetahui segala pengaturan pencegahan tindak pidana pencucian uang melalui koperasi simpan pinjam, menganilisis pertanggungjawaban koperasi simpan pinjam yang terlibat dalam tindak pidana pencucian uang, agar diketahui serta menganalisis mengenai implementasi prinsip customer due diligence dan enhanced due diligence di koperasi simpan pinjam. Pengaturan Pencegahan TPPU Melalui KSP melalui Pasal 18 UU PPTPPU, Pasal 13 POJK No 12/POJK.01/2017, peraturan Menteri Koperasi dan Usaha Kecil Menengah sesuai diatur dalam Pasal 8 PerMenKop dan UKM, Pertanggungjawaban KSP yang terlibat dalam TPPU akan diberikan sanksi administratif, pemidanaan yang dapat digunakan kepada korperasi yaitu dengan pidana pokok dan pidana tambahan, mmplementasi prinsip customer due diligence dan enhanced due diligence di KSP sudah diterapkan dalam Koperasi Simpan Pinjam dengan mengedepankan penilaian-penilaian terhadap nasabah yang hendak melakukan pengajuan pinjamam maupun penyimpanan uang

Abstract

Banks operating in Indonesia according to the Banking Law are Commercial Banks and Rural Banks. One of the business similarities between commercial banks and people's credit banks is providing credit. Something related to granting credit is the existence of collateral from the debtor's assets. If the debtor fails to carry out his obligations, the way to handle this problem is that commercial banks can purchase part or all of the debtor's collateral, while Rural Banks cannot. The different treatment or inequality before the law experienced by Rural Banks and Commercial Banks based on the provisions of Article 12 A of Law Number 10 of 1998 concerning Banking makes Rural Banks submit a Judicial Review to the Constitutional Court through constitutional case No: 102/PUU-XVIII/2020. Until the Constitutional Court granted the request for a judicial review of Article 12 A of Law No. 10 of 1998. After the Constitutional Court's decision, Rural Banks have an equal position with Commercial Banks in terms of being able to purchase part or all of debtors' collateral. The AYDA mechanism can be fully followed by BPRs as a solution to dealing with the problem of bad credit risk from debtor customers. In other words, the Constitutional Court's decision has benefits for the banking business sector in terms of handling the risk of debtors' bad credit which is a problem in banking businesses which often closes businesses

Abstract

Ganja yang termasuk dalam kategori Narkotika golongan I  mempunyai permasalahan tentang legalitas penggunaan dalam bidang medis. Narkotika ini sering mendapat hambatan oleh regulasi, kebijakan negara, dan lembaga yang berwenang dalam melakukan pengawasan dan peredaran. Penelitian ini ditujukan untuk menganalisis kebijakan hukum nasional dan internasional dalam penggunaan  ganja medis untuk pelayanan kesehatan.  Tujuan kebijakan hukum narkotika dalam tindak pidana penyalahgunaan narkotika golongan I terhadap orang lain untuk kesehatan dan analisa hukum terhadap seorang pegawai negeri dalam Putusan Nomor: 111/Pid.Sus/2017/PN. Sanggau.Penelitian ini menggunakan metode penelitian yuridis normatif yang bersifat deskriptif analitis dengan menggunakan bahan hukum primer, sekunder dan tertier yang dikumpulkan dengan teknik studi pustaka dan dianalisis dengan metode analisis data kualitatif.Hasil penelitian menunjukkan bahwa legalitas penggunaan ganja di bidang medis tidak memiliki persamaan yang pasti akibat Undang-undang Nomor 35 Tahun 2009 tentang narkotika melarang penggunaan ganja di bidang kesehatan akan tetapi Undang-undang Nomor 36 Tahun 2009 tentang kesehatan memberi ruang dengan rekomendasi dan pengawasan dan mengakibatkan tidak diberikan nya izin penggunaan ganja dalam putusan Nomor 111/Pid.sus/2017/PN. Sanggau. Kebijakan hukum internasional dalam Single Convention on Narcotic Drugs tahun 1961memberi peluang bagi terciptanya penggunaan ganja dibidang medis dengan penelitian yang jelas

Abstract

The use of portraits in trademarks creates polemics because copyright and trademarks are part of the IPR regime which have different protection concepts and objectives. This research aims to determine, examine and analyze the legal arrangements regarding the transfer of rights to the trademark "Jamu Cap Portrait Nyonya Meneer"; to find out, study and analyze the legal protection for the use of the portrait of Nyonya Meneer in the trademark “Jamu Cap Portrait Nyonya Meneer”; and to find out, study and analyze the judge's considerations in decision no. 2/Pdt.Sus-HKI/Cipta/2020/PN Niaga Smg regarding the portrait used in the trademark. The method used in this research is a normative legal research method with the approach used being a statutory approach and a case approach. The research results show that trademark rights can be transferred based on the provisions of Article 41 paragraph (1) letter f of Law no. 20 of 2016 and the transfer is permanent. Provisions regarding the use of portraits in trademarks are not clearly regulated in the 2014 UUHC and Law no. 20 of 2016. However, it can be implicitly found in Article 9 paragraph (1) and Article 12 paragraph (1) of the 2014 UUHC and in Article 21 paragraph (2) letter a of Law no. 20 of 2016. Protection of the economic rights of the portrait of Nyonya Meneer has ended, while the protection of moral rights is still valid because they are eternally attached to their creator. Protection for the portrait of Madame Meneer was given to the photographer. The Panel of Judges decided that the Plaintiff's claim was error in persona, but what was meant was the photographer who was the creator or copyright holder of the portrait which was never mentioned in this case

Abstract

PT Perkebunan Nusantara III (Persero) is the holding company for PT Perkebunan Nusantara I, II, IV to XIV in the Perkebunan BUMN Holding structure. In order to accelerate the operations of the Plantation BUMN Holding, the parent company exercises control by issuing a set of policy norms to be applied to subsidiaries. However, in practice, apart from issuing policy provisions, the parent company is also directly involved in the operations of the subsidiary down to the most technical matters, so that the subsidiary as a separate legal entity that is separate from its owner (Shareholders) has lost its independence in managing the operations of the subsidiary as it should be. implemented by the Subsidiary's Directors. The most crucial problem that arises in this research is whether the legal consequences for the parent company's control cause the subsidiary to lose its independence. The theories used in this research are the theory of Corporate Legal Entity and Piercing the Corporate Veil. The results of this research conclude that juridically, the legal status of the parent company and subsidiary companies is that they are independent legal entities and each has the right to carry out its own legal actions. However, in business reality it cannot be denied that subsidiary operations are completely under the control of the parent holding company. In this case the subsidiary has become the alter ego for the Shareholders (PTPN III). Thus referring to the doctrine of piercing the corporate veil, Shareholders (PTPN III) have the potential to be held responsible for personal assets (PTPN III) if losses occur to the company and third parties

Abstract

The purpose of this research is to determine the roles and responsibilities of company management regarding financial crimes committed by their subordinates. To find out the challenges faced in enforcing corporate criminal liability in financial crime cases. To find out cooperation between law enforcement officials in handling financial crime cases. The nature of the research used is descriptive analysis leading to normative juridical legal research. The data sources obtained in this research come from secondary data, secondary data in the research comes from revelation data, primary legal materials, secondary legal materials, tertiary legal materials. Data collection tools in legal research usually use document studies. Based on research results, forms of financial crimes committed by corporations are Defrauding the Public (deceiving the public), Conspiracy in fixing prices, advertising products in a misleading way (misrepresentation of products), Defrauding the Government (deceiving the government), Transfer Pricing, Under Invoicing, Over Invoicing. The mode of financial crimes committed by PT. Garuda Indonesia Tbk, manipulated financial reports by recording sales transaction reports as compensation income for the rights to install connectivity and entertainment service equipment on board aircraft. In the end, Garuda Indonesia's financial report recorded a net profit. Criminal liability for financial crimes committed by PT. Garuda Indonesia Tbk was In the end, the Indonesian Stock Exchange (BEI) gave a written warning III and imposed a fine of IDR 250 million on Garuda Indonesia, as well as demanding the company to correct and present financial reports. Not only that, the Financial Services Authority (OJK) imposed a fine of IDR 100 million each on Garuda Indonesia and all members of the board of directors. Abstract

Money Laundering Crimes are carried out by various Financial Services Companies. Article 17 of Law Number 8 of 2010 concerning the Prevention and Eradication of the Crime of Money Laundering states that the companies involved in TPPU, one of the service provider companies in Article 17 is a cooperative that carries out savings and loan activities. The problems in this research are how to regulate the prevention of money laundering crimes through savings and loan cooperatives, what is the accountability of savings and loan cooperatives involved in money laundering crimes, then how is the implementation of the principles of customer due diligence and enhanced due diligence in preventing and eradicating money laundering crimes in saving and loan cooperative. This research uses normative and empirical legal research methods. The research approach is a statutory approach or a juridical approach, the material in this thesis is taken from secondary data. The data collection techniques that the researcher carried out were interviews and literature studies. The results of the analysis and research in this thesis are to analyze and find out all the arrangements for preventing money laundering crimes through savings and loan cooperatives, to analyze the accountability of savings and loan cooperatives involved in money laundering crimes, so that they know and analyze the implementation of the principles of customer due diligence and enhanced due diligence. diligence in savings and loan cooperatives. Abstract

In the last few years, many customers have been harmed by the actions of irresponsible people. People often take advantage of technological developments to take advantage of technology itself as a weapon (cybercrime). This type of crime then developed and became generally known as "skimming", "cracking", "carding", and "malware". The aim of this research is: To find out about criminal acts of misuse of electronic money. To Find Out Criminal Liability for Misuse of Electronic Money. To Know and Analyze Legal Protection for Bank Customers who lose deposit funds at Automated Teller Machines (ATMs). This research was conducted using normative juridical legal research (normative legal research method). The normative juridical research method is library legal research which is carried out by examining library materials or secondary data alone. Based on the research results, it is understood that the regulation of criminal sanctions for criminal acts of account burglary via ATM in the Criminal Code for theft is contained in Articles 362-365, in Law Number. 11 of 2008 concerning Information and Electronic Transactions (ITE). The criminal liability of perpetrators of misuse of electronic money can be explained as follows. First, the criminal liability of perpetrators of misuse of electronic money in Law Number 19 of 2016 concerning Electronic Information and Transactions includes illegal access, forgery, falsification of identity, alteration or destruction of electronic data related to electronic money. In an effort to protect customer funds, the government through the Consumer Protection Law, as well as through the Banking Law, established the Deposit Insurance Corporation (LPS) and required each bank to guarantee public funds deposited in the bank concerned. Through Bank Indonesia Regulations, it has also been regulated to protect customer funds, so these regulations are used to carry out mediation in resolving banking disputes
