Abstract

The juvenile criminal justice system in Indonesia has been reformed through the enactment of Law No. 11/2012 on Juvenile Criminal Justice Sistem (UU SPPA), but its implementation is still ineffective. This study aims to examine the ineffectiveness of the implementation of diversion and the imbalance between restorative aspects and the protection of children's rights in a repressive justice system. This type of research is normative, with statutory, conceptual and comparative approaches. The results of the study showed that limited understanding of the apparatus, lack of institutional support, and the still strong paradigm of punishment were the main obstacles. In conclusion, the reform has not fully reflected the principles of restorative justice and child protection. The author recommends strengthening the capacity of officials, cross-sector collaboration, and revitalizing the role of the community in supporting the implementation of diversion and the protection of children's rights as a whole.

Abstract

This study aims to examine the role of law in poverty eradication in Indonesia through the analysis of regulations and implementation of government programs. With a descriptive qualitative approach based on literature studies, this study explores the effectiveness of books as an instrument of public policy. The findings show that the law has not functioned optimally as a tool for social transformation, tends to be administrative and not yet adaptive to the dynamics of poverty. Case studies in several regions such as Malang, Trenggalek, and Aceh Tamiang highlight weak coordination, data validation, and community participation. The main obstacles include limited local regulations, inaccurate targeting of assistance, and minimal legal-based supervision. Therefore, proactive, participatory, and contextual legal reform is needed so that poverty alleviation policies truly side with vulnerable groups. The law must be present not only as a norm, but as a structural force that guarantees distributive justice and social empowerment.

Abstract

As countries located in the Asian region, Malaysia and Indonesia each have their own investment appeal. Over time, many investors have shown a stronger preference for investing in Malaysia rather than Indonesia. This phenomenon is influenced by various factors, making it a compelling subject of study. This research aims to examine the distinguishing factors in the investment appeal of Malaysia and Indonesia, particularly from the perspective of the positive legal systems in both countries. The objective of this study is to understand the legal regulations governing investment in Indonesia and Malaysia and to determine which regulatory framework is more attractive to investors. The research employs a normative juridical method using a comparative law approach. Data were collected from primary legal materials such as legislation and secondary sources such as books, journals, and previous studies through a literature review. The data were then analyzed descriptively and comparatively. The research findings indicate that Malaysia's investment regulatory framework is more attractive to investors compared to that of Indonesia. This is primarily due to the greater stability of Malaysia’s investment regulations and their relatively infrequent sudden changes. Furthermore, Malaysia’s legal system, which is based on common law, offers greater flexibility to foreign investors. The ease and stability of regulations in Malaysia make it a more preferred investment destination. These findings offer valuable input for the Indonesian government to improve its investment regulatory framework.

Abstract

This study analyzes the dialectic of political interests in the recovery of assets from corruption through the Non-Conviction Based Asset Forfeiture (NCB) mechanism. Using a normative legal approach, the study reveals that NCB is a strategic solution to overcome the limitations of the conventional system, especially in cases where perpetrators flee or have immunity, with the potential to increase asset recovery by up to 40%. Findings indicate that political interests are hindering the enactment of the Asset Forfeiture Bill, despite NCB being mandated by the UNCAC 2003 and proven effective internationally. This study recommends accelerating the legislative process for the enactment of the Asset Forfeiture Bill, which could revolutionize the enforcement of criminal law against corruption in Indonesia

Abstract

Police patrols at the Polsek level have a strategic role in maintaining public security and order through the implementation of preventive and repressive functions. The preventive function aims to prevent crime, while the repressive function focuses on law enforcement against violations. This research aims to analyze the implementation of the repressive function in Polsek patrol activities as a response to the dynamics of law violations in its jurisdiction. The type of research used is normative legal research with statutory and conceptual approaches. The results show that the effectiveness of repressive patrols is highly dependent on officer professionalism, technological support, and community synergy. In conclusion, the repressive function must be carried out proportionally, accountably, and humanistically. It is recommended that the police strengthen personnel capacity, evaluation systems, and data-based strategies to improve the effectiveness of law enforcement while building public trust in a sustainable manner.

Abstract

This study aims to analyze the policy regarding the utilization of conservation forest areas in the Grand Forest Park (Tahura) K.G.P.A.A. Mangkunagoro I Karanganyar, particularly in the context of developing nature-based tourism grounded in the principles of benefit and sustainability. The background of this research lies in the urgency of managing conservation areas not only to preserve the environment but also to contribute to the sustainable social and economic development of surrounding communities. This research employs normative legal research methods with statutory and conceptual approaches. Data were obtained through literature study, document analysis, and direct field observation. The data analysis was conducted deductively by linking normative legal provisions with the principles of benefit and sustainability. The results indicate that the management policy of Tahura K.G.P.A.A. Mangkunagoro I has accommodated the fundamental principles of conservation as stipulated in the applicable legislation, particularly Regional Regulation of Central Java Province Number 3 of 2011. However, in practice, several potential inconsistencies remain. Therefore, it is necessary to improve the implementing regulations, technical governance, and supervision systems to ensure that the policy implementation genuinely reflects the substantive and equitable application of the principles of benefit and sustainability

Abstract

Political reform in Indonesia has brought fundamental changes to the structure of state governance and the decision-making process within the executive branch. One of the instruments still frequently utilized by the President to formulate and direct national policy is the Presidential Instruction (Instruksi Presiden/Inpres). Although it is not classified as a formal regulation within the legal hierarchy, Inpres often has wide-reaching implications for the implementation of public policy. This study aims to critically analyze the legal status, function, and limitations of Inpres in the context of Indonesia’s post-reform government system. Using a normative-juridical approach and literature study of statutory regulations and policy documents, the research finds that the use of Inpres in several instances has extended beyond its administrative function and entered the domain of strategic policymaking, which ideally requires formal legislative processes. This raises concerns regarding accountability, transparency, and the limitation of executive power in a democratic rule-of-law state. The study recommends clearer regulation of the scope and function of Inpres to ensure alignment with political reform principles and good governance standards.

Abstract

Traditional Cultural Expressions (TREs) are an important part of national identity and intangible cultural heritage that live in indigenous communities in Indonesia. In the midst of globalization and increasing cultural claims by other countries, the urgency of legal protection for TREs is becoming increasingly relevant and strategic. This article aims to examine the effectiveness of legal protection for TREs in Indonesia and to formulate strategies for strengthening protection at the national and international levels. This study uses a juridical-normative approach with literature study techniques and qualitative analysis of laws and regulations, international conventions, and case studies such as Reog Ponorogo and batik. The results of the study indicate that existing legal protection is still limited and has not been able to answer the complexity of cultural claim problems. Harmonization of national law with international standards and collaboration between parties are needed to strengthen Indonesia's legal position in protecting TREs. This study contributes to the development of more responsive and sustainable cultural policies.

Abstract

Indonesia and Malaysia, as neighboring countries, share deep historical, economic, and social ties, leading to significant migration flows between them. However, alongside legal migration, a considerable number of undocumented Indonesian migrants reside in Malaysia, often accompanied by their children, who are born without proper documentation. These undocumented children face severe barriers to education, as Malaysia’s legal framework, influenced by its reservation to Article 28 of the CRC, restricts access based on nationality and legal status. Despite both states being parties to the CRC, which mandates equal educational rights for all children without discrimination, Malaysia’s policies continue to exclude undocumented children from formal education. This study examines Malaysia’s legal stance, its contradiction with CRC obligations, and the impact on Indonesian children. Malaysia, as the host state, must take greater responsibility by ensuring non-discriminatory access to education and aligning its legal framework with its international commitments. The withdrawal of Malaysia’s reservation to Article 28 CRC and potential constitutional amendments are necessary steps toward fulfilling the right to education for all children within its territory.

Abstract

A constitutional offense constitutes a violation of the fundamental norms enshrined in the constitution, committed by public officials or state institutions. Such violations are not only political in nature but also carry juridical dimensions closely related to criminal law. This article aims to examine the existence and urgency of regulating constitutional offenses from two main perspectives: constitutional law and criminal law. The research employs a normative juridical approach, emphasizing conceptual analysis and relevant legal regulations. This study also highlights the necessity of integrating constitutional mechanisms with criminal law enforcement to establish a system of accountability that is fair, proportional, and upholds the rule of law. Harmonizing these two areas of law is crucial to preserving the supremacy of the constitution in the practice of state governance.
