Abstract

This journal defines public policy as actions taken by governmental authorities to address specific social issues and emphasizes citizen participation as a key element in the democratic process. It outlines the importance of community involvement in policymaking to enhance legitimacy, governmental accountability, and the quality of policies. Factors influencing citizen participation include education, socioeconomic status, and access to information. The theoretical framework underscores the significance of active participation for successful community development, particularly highlighting the role of Generation Z in political engagement through digital platforms.Various methods for involving citizens in decision-making—such as public forums, surveys, and online platforms—are discussed, alongside the benefits of integrating technology to promote transparency and inclusivity. To explore this phenomenon in depth, a qualitative research method with an exploratory case study approach is employed. The study involves in-depth interviews with key informants such as public officials, representatives of civil society organizations, and Generation Z citizens who are actively engaged in digital participation. Additionally, participatory observation of public policy forums and documentation of various technology-based participatory initiatives are conducted. Thematic analysis is used to identify patterns, themes, and factors that influence the effectiveness of citizen participation in policymaking. Data validity is ensured through source and method triangulation, as well as member checking with selected respondents.This paper also presents case studies of successful participatory initiatives while addressing challenges such as unequal power dynamics and limited access to information. The recommendations focus on strategies to raise awareness, enhance transparency, encourage inclusivity, and foster a culture of active participation to ensure that policies reflect the diverse needs of society. Overall, meaningful citizen engagement is deemed essential for effective governance and policymaking.

Abstract

The principle of due process of law is a fundamental pillar in every modern legal system, including in the context of procedural law for judicial review of laws at the Constitutional Court of the Republic of Indonesia. This principle demands a fair, open, and balanced procedure for all parties to the case. However, in practice, the application of this principle often faces various problems, such as limited access to trial information, limited opportunities to submit evidence, and allegations of impartiality by the constitutional panel of judges. This study aims to critically examine the problems of applying the principle of due process of law in procedural law for judicial review of laws at the Constitutional Court. The research method used is normative juridical with a statutory approach and case studies of several Constitutional Court decisions. The results of the study indicate that there is a discrepancy between the normative provisions governing the principle of a fair trial and the factual implementation in court. This condition has the potential to weaken the legitimacy of the Constitutional Court as the guardian of the constitution and the protection of citizens' constitutional rights. Therefore, efforts are needed to reform procedural law at the Constitutional Court to strengthen the application of the principle of due process of law consistently, transparently, and accountably.

Abstract

The rapid development of information technology has presented new legal challenges, particularly regarding the protection of personal data and information security. This research aims to examine the urgency of establishing legal regulations that are adaptive to the dynamics of information technology in Indonesia, and to examine the extent to which existing regulations are able to accommodate the needs of legal protection in the digital ecosystem. The research method used is normative juridical with a statutory approach and conceptual analysis of the applicable legal framework. The findings show that existing regulations, such as the Electronic Information and Transaction Law and the Personal Data Protection Law, still face obstacles in implementation, including overlapping rules, weaknesses in law enforcement, and low public digital literacy. The implications of this research emphasize the importance of continuous legal reform, synergy between law enforcement agencies, and increased public awareness to create a safe and equitable digital ecosystem.

Abstract

Fraud in cosmetic buying and selling transactions through e-commerce in Indonesia is increasing along with the growth in the use of digital technology. As a mitigation measure, the Online Dispute Resolution (ODR) system, which is one of the Alternative Dispute Resolution (ADR) dispute resolution techniques, has begun to develop into an efficient alternative solution. This article discusses efforts to apply ODR in dispute resolution of cosmetics sales fraud cases through e-commerce platforms in Indonesia. Apart from Indonesia, the application of ODR is also carried out in the United States. By utilizing ODR mechanisms, consumers can file claims, resolve conflicts, and obtain fair solutions quickly and easily without having to go through conventional court processes. In addition, this article also explores the challenges of ODR implementation in Indonesia, including regulatory constraints and the level of consumer confidence. This research is conducted using a normative juridical approach, which is expected to provide strategic recommendations in strengthening ODR regulations and infrastructure in Indonesia.

Abstract

In the ever-evolving digital age, the dissemination of personal information through social media has become an important issue, especially for journalists. One form of crime that has emerged is doxing, which is the collection and publication of a person's personal data for the purpose of intimidation. The doxing case against Ni Luh Anggela, a journalist in Indonesia, by the Instagram account @greschinov, is in the spotlight because it shows the vulnerability of journalists to cyber attacks. This study aims to analyze the criminal law protection available to Ni Luh Anggela and the legal steps she can take. The method used is normative juridical with a statutory approach and literature study. The results showed that the act of doxing by @greschinov fulfilled the elements of a criminal offense according to the Electronic Information and Transaction Law and the Personal Data Protection Law.

Abstract

The development of technology communication and information has produce the phenomenon of digital legacy, which is a person's digital footprint that remains stored and persists after they pass away.This digital legacy not only reflects a person's identity and personal life but also stores sensitive and private data.In the perspective of human rights, the right to privacy is a base right that must be protected, including personal data post-mortem. However, the legal system in Indonesia has not explicitly regulated the protection of digital legacy, resulting in a legal vacuum that potentially violates the right to privacy.This research uses a normative method with a legislative approach and a case approach.The study results show that the absence of national legal norms specifically regulating digital legacy causes society to depend on the internal policies of foreign digital platforms, which do not guarantee justice and human rights protection. National regulations are needed that specifically govern the protection of personal data post-mortem as a form of respect for human privacy and dignity, as well as a tangible manifestation of the state's responsibility to guarantee the human rights of its citizens in the digital era.

Abstract

The increasingly advanced era is certainly followed by various developments in the fields of economy, social, culture and even technology. Technological progress in various countries can be seen from the existence of a technology called AI. Artificial Intelligence or AI is an artificial intelligence technology that has the ability to solve problems like humans. In practice, AI will simulate human intelligence with the ability to recognize images, write and even make predictions based on data. Lately, AI has begun to be misused by individuals who feel they are benefiting. In Indonesia, the misuse of AI technology has been rampant where perpetrators use AI for fraud. An act that uses technology as the main weapon of crime is included in the category of cyber crime. The rampant case of cyber crime in Indonesia is the act of voice imitation or voice cloning. The perpetrators in committing their crimes usually use a technological intermediary that can change their voice so that it is similar to the voice of relatives, friends, family or important people or public figures recognized by the victim. Voice imitation or known as voice cloning is the ability to imitate a voice that is similar to the original voice. Voice cloning using AI technology is an imitation of the human voice with an extraordinary level of accuracy of similarity, both in intonation, tone, and also voice patterns. The law on information and electronic transactions contains various regulations regarding information and electronic transactions, but the law does not explain in detail the misuse of AI in voice cloning because there are still limitations in the ITE law regarding criminal acts of voice cloning fraud and until now criminal acts of voice cloning are still rampant.

Abstract

This study aims to evaluate the effectiveness of subsidized fertilizer distribution to farmers in Gorontalo Regency. The allocation system follows a regulatory procedure starting from the Minister of Agriculture Regulation, followed by the Governor’s Decree, and finally by the Regent/Mayor’s Decree, which determines fertilizer allocation down to farmer groups. However, the implementation in the field faces several issues, including fertilizer shortages, prices exceeding the government-set retail price (HET), and misuse of distribution mechanisms. Using a normative-empirical legal research method, the study finds that the ineffectiveness of the subsidized fertilizer program is mainly due to inaccurate data collection and distribution, as well as the suboptimal use of the Farmer Card (Kartu Tani), often hampered by technical problems such as inactive cards. An evaluation based on the "six accuracy principles" (right quantity, timing, price, location, quality, and type) shows that the current distribution is not functioning effectively. The main inefficiencies are rooted in administrative shortcomings, delayed distribution, and inconsistencies between regulatory provisions and field implementation

Abstract

The transfer of land ownership rights through a grant (hibah) is a form of voluntary and non-compensatory property transfer. Notaries play a crucial role in drafting grant deeds to ensure legal certainty and protect the rights of the parties involved. This study aims to analyze the legal aspects of land ownership transfer through a grant deed before a notary, as well as the legal strength of the grant deed in providing legal certainty. The research employs a normative juridical method with a statutory and conceptual approach. The findings indicate that a grant deed executed before a notary holds perfect evidentiary power and serves as a crucial requirement in the process of transferring land ownership titles at the land office.

Abstract

The implementation of police discretion in the process of investigating criminal defamation cases shows that discretion is an important instrument for police officers in assessing, determining, and following up on a criminal report based on urgency, public interest, and the principles of proportionality and professionalism. In cases of defamation, which are often subjective and private, discretion allows investigators to consider various factors such as motive, impact, and the possibility of resolution outside the criminal path. Factors Affecting the Implementation of Police Discretion in the Process of Investigating Criminal Defamation Cases show that discretion is not carried out absolutely, but is influenced by various internal and external factors, namely: Legal and Regulatory Aspects, Case Characteristics, Professionalism and Ethics of Investigators, Social and Environmental Pressure, Facilities and Resources. Police Discretion should be regulated more clearly in positive law other than Law Number 2 of 2002 and the Criminal Procedure Code so that the principles of Legal Certainty and Respect for Human Rights are more apparent. Police offices need to provide special facilities such as mediation rooms that are neutral, comfortable, and support the creation of a dialogical atmosphere between the disputing parties. Increasing the number of investigators and managing a more balanced workload will provide space for investigators to consider the discretionary path more seriously without sacrificing work efficiency. The Standard Operating Procedure (SOP) for discretion at the Polres level needs to be adjusted to local socio-cultural characteristics. In Gorontalo, for example, a legal approach that is sensitive to family values and customs must be officially accommodated in work procedures.
